Confirmation Hearing on Mr. Mark Mendiola

Greetings Mr. Chairman and members of the 34th Guam Legislature

My name is Peter Alecxis Ada, current chairman of the 8th Guam Education Board along with a few other members present here to testify in favor of the reappointment for the continuation of Mr. Mark Mendiola to the Guam Education Board.

In the short few weeks, shortly after Mr. Mendiola's appointment, I had asked Mr. Mendiola to chair the Budget and Finance committee which is a very difficult task, more so that he was not involved in the development of the 2018 budget, but he took the challenge and carried it through.

Just a few days ago, we came before the Committee on Education to justify our budget. I felt that the comments made that morning we extremely helpful to guide us on what

the committee was specifically looking for and to ensure that we are all on the same page. I am happy to say, that with Mr. Mark Mendiola's budget leadership, senators we will meet those goals and objectives the 14 points of the Adequate Education mandate. Thank you for that.

Mr. Mendiola engages all board members and also seeks information from all division heads which is vital to meeting these objectives. Additionally, Facilities and Maintenance is the key element here to meeting your goals and objective but again your going to hear what you hope won't be discussed and that is FUNDING. That is Mr. Mendiola's concern and we join him and we are right behind him.

Senators, I ask you on behalf of the board and parents to whom Mr. Mendiola was appointed to represent, to present Mr. Mendiola's appointment before the august body for confirmation so he may continue.

Chairman San Agustin: Good morning ladies and gentlemen, it is now 9 o'clock. The Committee on Education, Finance & Taxation now convenes this public hearing. (Presentation of Bill No. 24-34 was first presented by Senator Mike San Nicolas before confirmation hearing for Jerold W. Filush, for Member University of Guam, Board of Regents.).

Continuation proceedings by Chairman San Agustin: Now we will move to the Nominees. And looking at the nominees. Ladies and Gentlemen, the nominees are, you notice, it's like the pageant, right. And we'll start in the order as they have arrived.

Chairman San Agustin: Now to ask Mr. Mendiola, to please step up. To be a member, to be re-appointed and put back on to the Board of Education, thank you sir, and please state your name and we can move from there.

Mark Mendiola: Thank you sir. ( Speaks in Chamorro-Buenas yan Hafa Adai, Honorable Senadot. English-Rafa Adai and good morning Honorable Senators, My name is Mark Benny Cruz Mendiola, familian, "left" familian "Tanda' and am proud to be here. I've come from a long line of folks that have been in public service and who have gone through the education system and am pleased that I'm here before you this morning to offer my candidacy for your consideration support to the Board of Education. I am being appointed as the GDOE Parent Representative. I currently have four children within the public school system, one child with Special Needs. And when I was asked to serve on the board a couple months ago, I really had to put some serious thought into it, because I have a lot of activities I am involved in, but I thought it was important and I felt that I had a certain set of skills I could bring to the board, to address some of the challenges that they were facing at the time, and since that short time, I've learned a lot. I think there's still a lot more to be done, to accomplish a lot more things within the department, and I present to you my candidacy and hope that on your next vote, I get your support to continue serving on the board for a full term of three years-Si Yu'us Ma-ase.

Chairman San Agustin: Thank you Mr. Mendiola for accepting the nomination again and you know that the Guam Education Board is on a hot plate, being the oversight chair-but you know what, we're gonna work together. It's about the children-it's not about me, it's not about you, it's about taking care of our students to make sure that they're educated, correct?

Mark Mendiola: Yes sir and I appreciate in the short time that I've been on the Board, I know, you were serving on the Board as well, there's a tremendous amount of information that passes back and forth, and of course, you want to get involved in it and you gotta understand it, because, at the end of the day, it's what type of environment we're providing for our students in the classroom. From the time they wake up in the morning, to go their busses, to the time they get in to schools, to the time they get re-united with their parents at home, doing homework and all these things. So you and I had numerous conversations about the importance of education and how to make the department stronger and better, and I just gotta say-working with my colleagues on the Board, I've been very fortunate enough to have to be surrounded with individuals that have that same spirit and have that same motivation to look out for the interest of the children so, yes, sir, indeed it's for the children.

Chairman San Agustin: Thank you sir. I have the members of the panel. Would any of you want any questions/ Senator Castro?

Senator Castro: Actually, I just want to again highlight the experience and education of this particular nominee. Mr. Chairman. If you read his experience, you'll find that he has K through twelve experience, actually, a K through Sixteen experience, both in public and private settings. He also has a unique skill set that he brings to the table, in so far as his accomplishments at the Northern Marianas College, I know we

served together, so his dynamic and very unique experience in systems change and turn around strategies are Mr. Chairman, may assist the Department of Education in addressing a lot of those issues, those perennial issues, not just that our physical in nature, but are problematic. I have the utmost confidence that Mr. Mendiola here will address those and apply himself fully. I also just want to highlight, for the record, that, Mr. Mendiola, probably more important than his skill set is a, an active and contributing member of this community-I don't know a month that could go by, where he's not on his riding mower volunteering to clean up a park, or help a family, or do something for his children's school. So, it's that selfless contribution to society that makes him such a valuable candidate. I will also say, I 'm not sure what convinced him to serve. I'm delighted that he's there to assist the Superintendent and other members of the governing board. I will end with this Mr. Chair, that absent any other document that could convince me otherwise, and being a fellow educator, I want to remind you and the Board members that are here, which I believe to be true, also, for you, that you're role as a governing entity for education extends beyond just the public school setting, that, in fact, your decisions should also be mindful of those in the private and home school settings, that in fact, you're the keepers of the public trust for all things education and so I'm sure with your particular lens and experiences, you'll be mindful of that Mr. Mendiola.

Mark Mendiola: Thank you sir.

Chairman San Agustin: Do we have, Senator Espaldon?

Senator Espaldon: Thank you Mr. Chairman. Mr. Mendiola, good morning. Again, I definitely, first of all the statement is-this is one of the most difficult boards to serve on, so we definitely have to thank you for even stepping up to the plate on this one-I don't think you'll see too many people stepping up to serve on this particular board, but, I do have a couple questions. One is, in public, you do have four children in public schools you say?

Mark Mendiola: Yes sir, one in Middle School and three in Elementary School.

Senator Espaldon: Three in Elementary and one in Middle school? That in itself is a tough job, but the real pertinent question is, under your financial interests, you have listed as one of them, it's called an organization or a company called Guardian of Micronesian, Micronesia on Education consulting firm? Could you kind of elaborate on that? I guess the question will be, will there be a conflict of interest?

Mark Mendiola: Yeah, yeah. I understand Sir. I appreciate that question. I worked in the private sector for about ten years and I've built a set of skills around fund raising and so that organization that my partner and I are involved in, is basically trying to assist non-profit organizations in building foundations so that they can generate revenue to be self sustaining, sustainable, and so I've done consulting work down in the Republic of Palau for the conservation society. The Palau Community College, College of Micronesia in the Northern Mariana Islands. On Guam, I've done work with the Father Duenas Memorial Foundation. I've served there to give some guidance on how to set their foundation and it's very successful through those endeavors, these foundations were able to build financial portfolios that allows them to be more self sustaining and so that's pretty much the extent of my work. In terms of my education and consulting license, I still keep it active. I do know, that the Department of Education has a foundation and I have not done any work with the Department of Education with respect to receiving services, or funds, or from the department.

Senator Espaldon: I appreciate that. The description of your efforts, obviously, you're involved in some very noble activities, in trying to help education along, at least from the fund raising side for education, so, I appreciate that explanation. Otherwise, I followed you ever since you've come on in to the public scene just try to work on the various positions that you have and you've actually contributed much in your short time, I won't say short, because I guess we're now in to, it seems that time has gone so fast, but, here we are, what, twelve, fifteen years later, something to that degree and you definitely made a significant contribution and I look forward to your service on the Board of Education. You have my support Mr. Mendiola.

Chairman San Agustin: Senator Muna?

Senator Mufia: Good morning Mark. I just wanted to say that you came in to the Board of Education, at a time when they, it was in the lime light and I commend you for stepping up to the plate in continuing this relationship with the other Board Members. And I know, I'm not sure how you balance your personal life and your professional life and then to be a board, I'm not sure how you do it, but, maybe you need to share some of these secrets with me. Just a little bit of advice, I know that you and your wife have a great partnership with raising your kids, I guess , if you continue that relationship with the other Board Members then definitely, the thousands of public school children here will reap the benefits of your relationship with the rest of the Board members. So, Thank you again, for stepping up to the plate. I know it's not an easy job to do and there is a lot work ahead and I look forward to seeing you in the Board.

Mark Mendiola: Thank you Senator. I appreciate those comments because without my wife, I think I'd be in serious trouble with my time management and we work really well together. My wife is an Educator, she's a Math teacher at Tiyan High School, and so, I really value her input when it comes to dealing with certain things that I deal with on the board. When it comes to be in the classroom and it gives me a greater sense of understanding of what's going on within the school system, but, more than that, it's I realize being on the board, it's not just about, like I said, my family. Really, I'm looking at the big picture, the totality of education and those are great points Mr. Castro, about those who are on home school and those who are in the private school, I mean they're all our children, we all, they all attend our educational system, and so, I just want to impart that. I pray a lot, I get information that is pertinent to the discussion, I read it, try to understand it, provide input where I feel it will make change, or it will improve, or strengthen whatever decisions gonna be. And then, that's how I usually guide my decision making process, I've always prided myself in developing problem solving skills and that's what I feel I bring to the table when we meet at the department. I feel I'm always looking for ways to try and solve some of the problems and challenges that we're forced with in the department. So, thank you for those comments. Si Yu'us Ma'ase.

Chairman San Agustin: Thank you Senator Muna. You know, Mark. I see on the roster here, you have Mr., the Chairman in support of your nomination. Thank you Mr. Chairman, Mr. Ada. We have, he's submitting a written testimony. We'll just keep him on the hot seat, for now, Mark, we got Katrina Contreras and she's in support, we have Jeff Emmanuel, that your business associate? You partner? Good man, but I do like your statement and I see the Vice Chair, Mrs. Gutierrez. I know she's in support of you. She wants to put you to work. Is really what she wants to do, but you know, Mr. Mendiola, I really appreciate when you mentioned about your wife, because that's one rule, I do apply at home. A happy wife is a happy life, I know Mrs. Filush, she's probably saying, yeah hon, remember that, but, yes, you believe in God and that's good, cause, we all have to believe in the Almighty God. But, if unless is there anybody else wants to any oral testimony on behalf of Mr. Mendiola, oh, Mrs. Gutierrez, you would like, please, let's get the Vice Chair up here on the hot table. Mrs. Gutierrez, please, just turn on the mike.

Mrs. Gutierrez: I told him I'll say nice things-Good Morning, Buenas Dias Chairman San Agustin, Senator Castro, Senator Espaldon and Senator Muna. My name is Maria Atalig Gutierrez, currently, I'm the Vice Chair for the Guam Education Board. I appear here not only as a Vice Chair of the Board, but also as a private citizen and a voter of Guam. I'm here this morning, to support the nomination and the confirmation hearing of my colleague, Mark Mendiola. In the four and half months that Mr. Mendiola came on board, he has really contributed his and take his responsibility seriously as the Parent Rep on the board, and I know how it is to be a parent, because I was sitting in Mr. Mendiola's chair at the time, when I was not even a voting member, but, to be a parent rep on the board, it takes a lot, a lot of responsibility and a lot of commitment, cause you're committed to the parents, you represent the parents and the students. So, I really enjoyed Mr. Mendiola when he first came on board in December. He's a team player, he listens, it's not his way, it's our way, it's for the students .. I think with his, in just going back when the position was vacant for the Parent Rep, and Senator Muna, thank you for that, it was a very interesting time and you know, I said we need to find a parent that will serve on that, on behalf of the parent, so, I call up Mr. Leon Guerrero, I found you a candidate, he said, who, I said, Mark Mendiola. Please get in touch with him, because he as four kids

and I know when you have four kids in the public school system, it's very important that you get involved and he's very involved over at Agueda Johnston. And I was praying hard that he would not decline the request to serve on the board, but, again, Senators, I'll tell you, Mr. Mendiola is an asset to the board. He participates hundred per cent and I really, as one Board member, I enjoy his participation. This morning, I ask all of you to please confirm his nomination as soon as possible, because he told me Tuesday night, you won't see until after April, I hope it don't happen. Thank you so much. Chairman San Agustin: Thank you Mrs. Gutierrez. I see Mr. Ada signaling me that he wants to be able to speak, also, cause he's the Chairman. We got the Vice, now we got the Chairman. Mr. Ada, please come forward and you can provide your oral testimony, or you can read your written testimony, if you choose. Are you giving his blessing Mr. Ada?

Mr. Ada: Greetings and good morning to the members of the committee. Senator San Agustin. Senator Wil Castro, Senator Muna. The three of you are products of the Guam public school system. I think, Mr. Mendiola went to San Vicente a few years. I purposely did not include Senator Espaldon, because I know Senator Espaldon's educational history. He was my student and one student, I can say, I am proud of this young man. (Mr. Ada now reads his written testimony verbatim).

Chairman San Agustin: Thank you Mr. Ada. We have any follow up questions from Senator Wil Castro.

Senator Castro: I'm not sure which member of the body here referenced Mr. Emmanuel, so, while you get to enjoy certain privileges of being associated with this gentleman. I want to encourage Mr. Mendiola's member of the board, to resurrect if you remember, Mr. Emmanuel, because I was a member about of that organization members of the board, the Guam Parent Teacher Congress and that was a really healthy forum for the PTA's, to come together and to talk about policies and other issues that were germane to their schools, but you could see it kind of percolate up, and we found that they were universal, across all schools. It wasn't much more of a booster club, than it was really an opportunity to address policy issues and safety issues for our students. So, if I can encourage you, members of the board and Mr. Emmanuel, you don't get off that easy too. So, I wanna encourage you to please reconsider resurrecting that and you have my commitment to be an active member again as public school parent.

Mrs. Gutierrez: Senator Castro, as you bring that up, from 1991to1997, Guam Parent Teacher Organization Congress, exit, but, when I left island in 1997, it just stopped there, but, it was a body of all Guam PTO/PTA, here in the public school system, that we get together and we had really a strong voice, because the President has a loud voice, but that's why I know. I encourage Mr. Mendiola, and I still have all my documents of that Guam PTA Congress, because at the time, we were trying to be a member of the National State PTA, but, at that time, we were told, but because we're a territory, and also, at that time, we don't have a DODEA school, that we are not considered for a membership, but, now that we have a DO DEA, I think that Mr. Mendiola, as a President for one of the PTO's at one of the schools, they couldn't again apply for National PTO Association, and I know that CNMI is a member of that, so, thank you for bringing that back, it's a lot of memories for me, thank you.

Senator Castro: Well I'm encouraged, first of all. Thank you for your prior service. But I'm encouraged because, if anybody knows you well Auntie, are a very vocal and active member of the board and I accept that challenge. The challenge, to bring it back to the table, to petition the United States, the appropriate entities within the still perfecting union to reconsider it's position as it addresses our application to be recognized on the national level, so, I accept that challenge.

Mrs. Gutierrez: And I'd like to place a challenge to the committee on Education Chair, because at the time we had a very strong Chairwoman on the Education that Congresswoman Bordallo that she does hold. We have conference, and you know, it's a really big conference for the PTO. So I have all the materials, I have and I challenge the Senator on Education, the Chairman to help us have this annual conference here, because it's something I know it's deep in my heart. Although I'm just a great grandmother now in the public school

system, but I know, my colleague Mr. Mendiola, he still has a long way, so, we'll try to work with Senator San Agustin and all of the Senators, thank you

Mark Mendiola: I'm surrounded with a lot wisdom, so, yes, absolutely. I didn't know that our board, we are going to be conducting a retreat within the Superintendent and that's one of the items, I'm actually gonna be addressing with the Superintendent. How to engage more parents with the school system, and it was actually really rewarding at our last board meeting at Simon Sanchez High school, where we had the committee came out engaged. Welcome out May 2nct, I believe at 6PM to the Town Hall meeting that will be up at the Simon Sanchez High School, and one thing, Senator San Agustin, I appreciate the opportunity to have the dialogue, I mean there's ideas that are out there on the table and there's many ideas out there, but, I think when people start talking about it and start giving ideas and solutions to the problems, then that's when the community can wrap itself around what is the best thing for the community and I do believe that the Sanchez community knows what they want and I do believe that the intent of the Legislature is to provide that type of support and to hear their concerns and to also give them options as to how we can address some of the challenges faced, current challenges faced. I mean I'm not trying to solve all the problems in one setting, but, at least, it gives us an opportunity, but, Mr. Castro, you definitely do raise that very valid point, I know, Mr. Emmanuel here is gonna be hearing from me, soon, we're gonna get a group of parents together and try and get this organization back on track. Chairman San Agustin: Thank you Mr. Mendiola. And yes, The Committee on Education do wanna hear the issues and concerns of everybody, when it deals with our Education of Guam, and we'll go when we gather all the issues and their concerns. We will put out the recommendations, ask them for their comments and being you're the Parent Teacher's Rep on the board. I look forward to seeing the resurrection of the PTO and if you need help, please, feel free to call me, you know my number Mark. We talk many times, but, ..

Mrs. Gutierrez: Senator, I just wanna thank Senator Espaldon, when he said, that the Board that Guam Education, board is one of the hardest board to serve, yes, Senator, that's true, you know, but I think if we're committed to the students and to that it's what it's all about, cause if we're not committed, we could have just given up. I'm very committed, I still have a long way. I have great grands now, that's, so you know, thank you for that Senator, and so I know you since we were neighbors. going to enable, thank you.

Chairman San Agustin: I'm just so happy. I feel really young now, and we're the same age, so, ok. But, thank you Mr. Mendiola, and for the ladies and gentlemen, that are showing support of Mr. Mendiola. Everybody has, I'm only allowing less than forty, by tomorrow, and it also applies to Mr. Filush by tomorrow, all the other nominees, but by tomorrow that all the testimonies, for or against the nominees be presented, because, I do intend on submitting this to the floor next week, cause I wanna get all the nominees to work, so we can start addressing the problems that we all face.
