Welcome to our second Lime, which is also marking Amicus’ 15-year anniversary.As many of you know, Amicus was founded in 1992 – then known as The AndrewLee Jones Fund – in memory of Andrew, who was executed in Louisiana in 1991.

Thank you so much for being here tonight to support the vital work that we do.Lime 2004 enabled us to extend greatly the reach of our activities. We have increased thenumber of interns we place in the US and widened the number of states covered by ourintern programme. We have introduced regional training days and increased the totalnumber of places available on our training programmes. Our UK-based case workershave provided more assistance by preparing amicus curiae briefs and drafting motionsand applications. And, we have built on our events programme. None of this would havebeen possible without the funding from our first Lime, which enabled us to employ apart-time Executive Officer to manage all the volunteers’ activities and extend ourrelationships with US capital defense attorneys’ offices.

We are enormously grateful for the support we have received. Baker &McKenzie’sprovision of a free office (and office services) underpins all our activities, and, for Lime,the sponsorship from Cardew Group and Radley Yeldar has gone a long way to ensuringthe success of the evening.

Dear Friends,

I’m delighted to be a part of Amicus’ secondLime – building on the success of Lime(2004) andmarking the 15-year anniversaryof the founding of the charity.

There’s nothing I like better thanparticipating in events that foster andstrengthen the partnership between folksin theUK and theUS to save human beingsfrom execution. That’s what Amicus is about,training young law students and sendingthem to help overwhelmed capital defenseattorneys in theUS, andUK-based lawyersassisting their US counterparts throughdraftingmotions and helping where theycan. I’m happy to do whatever I can togenerate resources for such a worthy project.

It’s interesting to note that theUK playeda significant role in the First AbolitionistMovement to abolish slavery. Passionateanti-slavery leaders such as Harriet BeecherStowe (Uncle Tom’s Cabin) and FrederickDouglas were brought to theUK to speaklong before their voices were heard intheUS.

Now, in the Second Abolitionist Movementto end the death penalty (rightly called bysome “legal lynching”),projects such asAmicus continue the noble UK –USrelationship.

My second book, “The Death of Innocents:An Eyewitness Account of Wrongful Executions”,which was published shortly after Lime(2004),tells the story of twomen – innocent,I believe – who I accompanied to execution.The stories dramatically illustrate howdefense counsel for capital defendantsmakes all the difference. Sadly, these twocases are not rare exceptions. I am suremost of you are aware of themany caseswhere innocence has been establishedpost-conviction – some, unforgivably, toolate to save the defendant from death.

That’s why Amicus is so important, and whyI’m travelling to London to be with you forLime (2007).I hope everyone reading thiswill be over-the-top generous in supportingthis wonderful effort.

For those who were at Lime (2004),andwho I havemet at other events, I lookforward to seeing you again. And, forthose who are attending their first Amicusevent – I look forward tomeeting you.I can already anticipate the warm glow ofenergy that will fill the room of us gatheredtogether to promote the noblest of causes– human rights.

On 10thOctober the European Parliament,the Commission and Council of Europesupported a EuropeanDay against the deathpenalty, which coincided with theWorld Dayagainst the death penalty. The EuropeanUnion considers that the abolition ofthe death penalty contributes to theenhancement of human dignity and theprogressive development of human rights.

The EUhas taken a lead role in promotingand protecting human rights across theglobe and has intervened in a number ofcases by applyingminimum standards incountries retaining the death penalty.This sort of political andmoral pressurecan lead to action and is always welcome.It is no coincidence that Turkey hasabolished the death penalty while inthe process of applying to join the EU.However, it is organisations such as Amicuswhich improve the situation formanydefendants on a day-to-day basis.

Today Amicus’ work in theUS is morenecessary than ever. TheUS speakseloquently on civil liberties, democracy andthe rule of law, but on a practical basis thecountry fails ordinary people in judicialtrouble. They have withdrawn nationalfunding from organisations which help toprotect the rights of those facing the deathpenalty, and have failed to address theinherent racism of its legal system.

The work that Amicus does in training legalstaff, publicising the state of the Americanjudicial system and providing internationalsupport to those working in theUS isindispensable. I congratulate the charity onits 15-year anniversary. Its continued workcontributes to the global efforts to tacklehuman rights abuses and injustice andshould be applauded.

“When I went in I was amother of two youngchildren, and a daughter and a wife. When Icame out I was a widow, and an orphan and agrandmother.”

In 1976, Sonia “Sunny” Jacobs and herpartner Jessie Tafero were wrongfullyconvicted and sentenced to death for theshooting of two police officers in Florida.

In spite of the jury’s recommendation thatJacobs receive a life sentence, the judge inher case, M. Daniel Futch – also known as“MaximumDan” who kept aminiatureelectric chair on his desk – imposed a deathsentence. Jacobs spent five years on deathrow before the judge’s decision wasoverturned, and her sentence changed tolife. It would take a further 12 years for herto be released from prison.

The actual killerWalter Rhodes was a friendof Tafero’s and an ex-con. He receivedthree life sentences in exchange for falsetestimony against Tafero and Jacobs.Evidence that Rhodes failed a polygraphtest, as well as a statement from a prison

Jacobs’ trial rested on the testimony ofRhodes and a jailhouse informant,Brenda Isham, who claimed that Jacobshad confessed to the crime. Ishamwas ayoung college student charged withpossession of pills without a prescription.She was threatened with jail time by thedistrict attorney if she did not testify.Many years later Ishamwould again takethe stand, this time for Jacobs, and retracther former statement. Ishamwas still soterrified of the district attorney that shehad a heart attack on the witness stand.

Following Jacobs and Tafero’s convictions,Walter Rhodes confessed several times tothe shootings, admitting that he was solelyresponsible. However, on 4May 1990, inspite of the evidence of his innocence,Tafero was put to death in Florida. It wasone of America’s most notorious botchedexecutions. The electric chair malfunctionedsending flames through Tafero’s head andsmoke out of his ears. It took three attemptsat pulling the switch and 131⁄2 minutes forTafero to die.

It took 17 years for Sunny Jacobs to bereleased from prison. She now lives inIreland with her partner Peter Pringle.Pringle was also wrongly convicted of killinga police officer. He was exonerated in 1995.Their stories are featured in the awardwinning play “The Exonerated”.

Alistair Carmichael MPKenny Richey: the cost of poorlegal representation

“Even though this new evidencemayestablishMr Richey’s innocence,theOhio andUnited States constitutionsnonetheless allow him to be executedbecause the prosecution did not know thatthe scientific testimony offered at trial wasfalse and unreliable.” Prosecutor Dan Gershutz

Anyone who thinks that good quality legalrepresentation is expensive should have alook at the case of Kenny Richey.They would pretty soon realise that the costof poor representation can be even higher.It could still cost Kenny his life.

Kenny is a Scot who has lived in Americasince hemoved there in 1981 aged 18.In 1987 he was convicted in PutnamCountyCourt of themurder of a two year old childand sentenced to death. He was on deathrow from then until earlier this year whenhis conviction was overturned (for thesecond time) by the Sixth Circuit Courtof Appeal. He is now remanded in custodyawaiting a retrial. Amnesty Internationalhas described his case as one of themostcompelling cases of apparent innocencethat they have ever encountered.

Of all themany ironies in Kenny’s case,perhaps themost acute is that he is nowbeing retried by the same prosecutors whoin 1987 offered him a plea bargain of serving11 years in prison if he would plead guilty tomanslaughter. He refused. He was not guiltyof anything so why would he plead guilty?

Kenny did not have themeans to fund hisown defence and was represented at trial bya court-appointed lawyer – then a youngmanwith little experience. The case against him isriddled with inconsistencies and was notproperly tested at first instance. It has taken20 years since then to get theOhio criminaljustice system to concede the possibility of amiscarriage of justice. At one stage he wasonly hours from execution and was shaved inpreparation for being strapped into theelectric chair, thenOhio’s chosenmethod ofkilling people.

I met Kenny Richey on death row in 2004.It was a profoundlymoving experiencewhich turnedme from someone who hadalways been opposed to capital punishmentto being a committed advocate for itsabolition world-wide.

On one view Kenny is fortunate (hemayhave some difficulty seeing it like this).He now has the support of organisationslike Amicus and others and at long lastthere is a prospect that hemay be treatedjustly. After 20 years, however, it truly is thecase that justice delayed is justice denied.

Amicus’ main activities are:

01. InternshipsThe charity arranges volunteer placementswith US capital defense attorneys’ offices.Funding fromLime 2004 enabled Amicus toextend the reach of its intern programme,increasing the number of interns placed intheUS and widening the number of statescovered by the programme. In the periodOctober 2004 toOctober 2007, Amicusplaced 64 interns across theUS forinternships of between three and 18months.Outside of the ongoing intern programme,several Amicusmembers travelled out towork in NewOrleans in the aftermath ofHurricane Katrina, providing vital assistanceto Amicus’ contacts there at a time whenmany of their own staff were unable to returnto work.

02.TrainingAmicus runs a comprehensive trainingprogramme inUS criminal law andprocedure, legal research, evidence andprofessional conduct, equipping internsto be ofmost use to an office on arrival.The training is available for any internintending to go to theUS (including thosenot being placed by Amicus) and for UK-based volunteer case workers drafting amicuscuriae briefs, motions and internationalapplications and conducting generalresearch on behalf of capital defenseattorneys’ offices. The charity is registeredas a CPD (continuing professionaldevelopment) training provider by theBar Council and the Law Society. After Lime2004, Amicus was able to introduce regionalintroductory training days to complement itsLondon- and Birmingham-based trainingcourses, increasing greatly the total numberof trainee places. SinceOctober 2004 (toOctober 2007),Amicus has trained over 560people in preparation for internships andUK-based case work.

Amicus collaborated with theMiddle TempleLibrary to ensure that all the key US capitalpunishment criminal and constitutionaltexts are available in theUK, as part of theMiddle Temple’s American Collection (thelargest collection of US law in London) andCapital Punishment Collection (whichincludes key texts andmaterials forjurisdictions around the world, includingtheUS).Both collections are housed on thethird floor of theMiddle Temple Library,with access for all barristers and entryarrangements for non-barristers arrangedby Amicus.

03. Case workAmicus curiae briefs: Literally meaning“a friend of the court”, amicus curiae briefsare a way in which professional groups,organisations and charities are able to assista court in coming to a decision by describingcomparative standards, international law andthe practices of other nations. At the requestof capital defense attorneys, Amicus haspresented briefs on a number of topics (suchas the execution of juveniles and thementally retarded, the treatment of juriesand rules of evidence) at various stages ofcases’ proceedings, including to theUS SupremeCourt.

Drafting motions:UK-based case workers havepreparedmotions for use by capital defenseattorneys across theUS both before andduring trials and appeals, such asmotionsagainst the use of gruesome photographsand on the use of the lethal injection asameans of execution. Amicus has alsoprovided assistance with the drafting ofclemency statements and petitions in anumber of states. This voluntary practicalassistance fromUK-based lawyers is oftenvital to capital defense attorneys who arefacing very tight timescales, with limitedresources, prior to and during trialand appeal.

International applications:UK lawyers are veryexperienced in arguing before internationaltribunals on points of international law.The jurisdiction of the Privy Council inLondon, which is still the final court ofappeal formany Caribbean countries, meansthat they have arguedmany of the issueswhich pertain to the death penalty in theUSbefore an extremely sophisticated tribunal.In addition, UK-based lawyers have arguedCaribbean cases before theUnitedNationsHuman Rights Commission. Amicuslawyers have drafted applications to theInter-American Commission of HumanRights, inWashington, on behalf ofcapital defense attorneys in capital cases.Applications have covered such issues as theVienna Convention on Consular Relations(where appellants were not given properaccess to consular officials), the admissionof unadjudicated previous convictions in thesentencing phase and the appropriatenessof executing juveniles and thementally ill.

04. EventsAmicus holds events to raise awareness of theissues surrounding the application of thedeath penalty in theUS. Since Lime 2004,the charity has built on its existing eventsprogramme in London and Birmingham,holding a variety of regional events andactivities inManchester, Oxford, Newcastleand Leeds. One successful series of eventswas a tour by JuanMelendez who wasexonerated from Florida’s death row afteralmost 18 years behind bars. Initially, Juanvisited theUK briefly in spring 2005,speaking to over 170 people. He returnedfor a longer trip in February 2006, speakingto over 350 people in London,ManchesterandOxford.

05. Legal educationThree recipients of some Amicus fundinghave completedUS legal education and arepractising full-time as capital defenseattorneys. Amicus’ long-term objective isto reinstate US legal education grants toindividuals who commit to practising ascapital defense attorneys post-qualification.Currently, however, the charity’s fundingpositionmeans that the short-term focus ison extending further the intern programmetomeet the immediate demands in theUS.

Andrew was born in rural Louisiana, the fifthson of a black share-cropping family. His lifechanged on the death of his father, when thefamily was evicted from their home andAndrew, devastated by the death of amuch-loved father, took off to Baton Rouge. He fellinto a life of petty crime.

In 1984, Andrew was charged with themurder of the daughter of his estrangedgirlfriend. The only evidence offered at histrial – which lasted less than a day – was thathe knew the victim. No scientific evidencewas produced by the prosecution. There wasno evidence of a break-in at the girl’s housein spite of the prosecution’s allegations ofthe use of force. Andrew himself had norecollection of that fateful night, exceptthat he had been drunk. Prior to the trial, adefence witness was beaten by the policeand withdrew his alibi statement.

Andrew was found guilty and sentenced todeath by an all-white jury in a courtroomwhere the only black faces were those of thefamily members, in spite of 30% of the localpopulation being black. Black jurymembersare traditionally excluded from serving inEast Baton Rouge parish.

On 19th July 1991, the Board of Pardonsmetto hear the final pleas for clemency fromwitnesses and appeals from the defencelawyers. Discussion of guilt or innocence isnot part of this procedure. Andrew’s mother,brothers and sister begged for his life,and a psychiatrist and a psychologist gaveinformation relating to the family situation,and Andrew’s state ofmind.

Finally, the defence lawyer at the trial gaveevidence. He offered his apologies for notgiving Andrew a fair defence. As a court-appointed lawyer he had received the papersonly a short time prior to the trial. He wasnot qualified to conduct capital trials, beingless than five years out of law school, and thiswas his first capital case. He saw his clientonly occasionally prior to the trial, and hehad only recently beenmade aware that hisclient wasmedicated with Thorazine, apsychotropic drug, before and during thetrial. The amount ofmedication givenduring his trial exceeded the amountneeded for tranquilising purposes.

However, Andrew was refused clemency andhewas duly executedby the State of Louisiana.

The girl’s mother – who had continuallyvisited Andrew on death row, until shebecame a heroin addict – phoned him lessthan 10 hours before he was electrocuted, tosay that she was really sorry, she had nevermeant for this to happen…

In his memory, and in recognition of theneed for people like Andrew to receiveproper legal representation when facing theultimate penalty, Amicus was formed in 1992.

Annabel TimanI’ll admit it, as soon as I knew I was going toMississippi I went straight out and hiredA Time to Kill, Mississippi Burning and, foramusement value,My Cousin Vinnie.Armed with this wealth of culturalknowledge I boarded the plane full ofconfidence and headed for theOffice ofCapital Defense Counsel in Jackson for whatI thought would be threemonths ofadministrative assistance with the occasionalglimpse into capital litigation, the odd bit offried chicken and perhaps a visit to deathrow at some point.

Well, my first week consisted of watching acapital trial, both in the courtroom and onCNN, leaving the courtroom to be greetedby crowds chanting “hang him, hang himhigh”, witnessing aman being sentenced todeath, protesting an execution and a visit toParchman’s Unit 32 tomeet those on deathrow whom the office was representing onappeal. From there on out I was given a carandmy own cases to investigate. I alsoextendedmy stay to sixmonths. Nothing canprepare you for investigating in the deep-south, least of all in the wake of a hurricane;attempting to find witnesses from towns thathave been blown away, conducting interviewsin FEMA trailers or, more often, the back of a

pick up truck. I interviewed everybody fromschool teachers, police officers and theclient’s family to the families of the victims.Many of these interviews were emotionallydraining, some hostile, some hilarious,mostly unpredictable but always rewarding.

In addition to investigation, one ofmy caseswent to trial. It was here that I witnessed firsthand what an innocentman accused ofcapital murder is really up against.Prosecutionmisconduct is commonplace,racism continues, the jury selection processthat talks about sentencing before decidingguilt or innocence, the list is endless.

All offices that Amicus work with areunderstaffed and underfunded.The contribution by interns is invaluable.Formy part the experience was incredible.I continue to be involved with Amicus herein theUK to help ensure that they remainin a position to continue the internshipprogramme and extend their work.•••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••

Courtenay BarklemI hadn’t really heardmuch about SouthCarolina before I arrived there. It was thefirst state to declare its independence fromBritain and the first to secede from theUnion, sparking the American Civil War.It seems to take pride in being rebellious.

I beganmy internship for Amicus in SouthCarolina in late 2002.Within two hours ofarrival I was in a federal district court, whereI witnessed an appeal for aman who hadbeen sentenced to death despite hisacknowledgedmental illness.

during this time I worked on several appealcases doing investigation work, draftingmotions and carrying out legal research.I got to know several inmates and developedclose relationships with them and theirlawyers with whom I worked.

Being a qualified lawyer at the time,I was able to provide the law office withadditional resource and do jobs which theAmerican lawyers would not have had thetime or capacity to do – these tasks wouldnot have been done without Amicus’internship programme.

My experience reinforcedmy commitmentto international pro bono and human rights,ultimately leadingme to changemy careerpath from that of a commercial lawyer toworking in human rights.

I continue to do voluntary work for Amicusbecause I believe that the internshipprogramme is an important resourceproviding free assistance to people facingthe death penalty and their legal advisers.Without the efforts made by its interns,and the contributions from its donors,Amicus would not be able to provide thisinvaluable service.••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••

Ramanjit KangInitially, tome capital punishment was analien concept. I did not understand theissues surrounding such a topic, especially asI was not affected by it in theUK. So throughcuriosity I attended the Amicus Lectures,where I clearly remember listening to anexoneree talk about his experiences.He spoke of how police impropriety led

him to spending 22 years incarcerated fora crime he did not commit. But it wasthrough speaking to previous interns thatI was shown that I could do something tohelp and the next thing I knew I was on aplane toMississippi.

Once inMississippi I worked on appealsagainst the death penalty. While there Idraftedmotions, conducted legal research,interviewed clients – andmuchmore.I remember the first time I went to death rowandmet a client who was up for execution inless then a week. Talking to himmade himhuman, especially after reading all the badpress splashed across front pages depictinghim as amonster. Nearer the hour of hisexecution last minutemotions were stillserved, the defence team continued toput up a fight. It was a huge legal battleover themedical evidence and just amere15minutes before the execution, it wasstayed. Unfortunately, this was a legalargument that we were able to fight onlyfor a fewmore weeks before we finally lost.

Working theremademe fully realise thehelp that was really needed and thededication needed to not only fight theprosecution, but also the public andmedia.The office I worked for was hugely underfunded and under staffed for the numberof clients they had – there was one activelawyer for 45 clients.

Gaining such experiences would not havebeen possible without Amicus. I continue towork for the charity because I realise thatAmicus needs the support of others in orderto continue its important work – especially toeducate and inspire others.
