Hillsborough Township Committee Regular Meeting May 14, 2002 - 1 - The Township Committee of the Township of Hillsborough met in a Regular Meeting on the above date at 8:00 p.m. Those in attendance were as follows: Mayor Joseph Tricarico, Deputy Mayor John Gelardi, Second Deputy Mayor Sonya Martin, Committeeman Anthony Gwiazdowski, Karl R. Kemm for Township Attorney Emil Philibosian, Administrator Judith C. Haas and Township Clerk Ann Marie McCarthy. Following roll call and the Salute to the Flag, Mayor Tricarico advised that notice of this Regular Meeting was given by the Township Clerk, posted on the bulletin board at the Municipal Complex, and written notices were sent to the Messenger Gazette, Hillsborough Beacon, Courier News and the Star Ledger. All notices were given at least 48 hours in advance, and to the extent known, the items on the agenda. PROCLAMATION Mayor Tricarico presented former Committeewoman Christine Jensen a proclamation in recognition for her years of service on the Township Committee. Ms. Jensen thanked the Committee and stated that she enjoyed working with the Committee as well as the Township staff. APPOINTMENTS Township Committee Vacancy Attorney Karl Kemm reviewed the Municipal Vacancy Law procedures. Mayor Tricarico announced that the following candidates were nominated by the Democratic party: Valerie Chaucer-Levine, Arthur Zander and William B. Gold. Second Deputy Mayor Martin nominated William B. Gold to fill the unexpired three-year Township Committee term, ending December 31, 2002, left vacant by former Committeewoman Christine Jensen. Said nomination was seconded by Deputy Mayor Gelardi. Committeeman Gwiazdowski nominated Arthur Zander to fill the unexpired three-year Township Committee term left vacant by former Committeewoman Christine Jensen. Said nomination was not seconded. The appointment of William B. Gold to fill the unexpired three-year Township Committee term, ending December 31, 2002, left vacant by former Committeewoman Christine Jensen was approved as follows upon call of the roll: Roll Call – Ayes – Gwiazdowski, Martin, Gelardi, Tricarico Nays - None The Township Clerk administered the oath of office to Committeeman William B. Gold. Committeeman Gold immediately resigned as President of Hillsborough’s Little League. He thanked everyone for their support and promised to do his best for Hillsborough and its residents. Agricultural Advisory Committee A motion was made by Second Deputy Mayor Martin to re-appoint Ken Osterman to the Agricultural Advisory Committee for a three-year term ending December 31, 2004. The Township Committee of the Township of Hillsborough met in a Regular Meeting on the above date at 8:00 p.m. Those in attendance were as follows: Mayor Joseph Tricarico, Deputy Mayor John Gelardi, Second Deputy Mayor Sonya Martin, Committeeman Anthony Gwiazdowski, Karl R. PROCLAMATION

Mayor Tricarico presented former Committeewoman Christine Jensen a proclamation in recognition for her years of service on the Township Committee. Ms. Jensen thanked the Committee and stated that she enjoyed working with the Committee as well as the Township staff.

APPOINTMENTS

Township Committee Vacancy Attorney Karl Kemm reviewed the Municipal Vacancy Law procedures. Mayor Tricarico announced that the following candidates were nominated by the Democratic party: Valerie Chaucer-Levine, Arthur Zander and William B. Gold. Second Deputy Mayor Martin nominated William B. Gold to fill the unexpired three-year Township Committee term, ending December 31, 2002, left vacant by former Committeewoman Christine Jensen. Said nomination was seconded by Deputy Mayor Gelardi. Committeeman Gwiazdowski nominated Arthur Zander to fill the unexpired three-year Township Committee term left vacant by former Committeewoman Christine Jensen. Said nomination was not seconded. The appointment of William B. Gold to fill the unexpired three-year Township Committee term, ending December 31, 2002, left vacant by former Committeewoman Christine Jensen was approved as follows upon call of the roll:

PRESENTATION OF THE CREDIT CARD ADVISORY COMMITTEE

Lou Possemato gave a presentation regarding the recommendations for expenditures of the Credit Card Advisory Committee. Mr. Possemato recognized the members of the Credit Card Advisory Committee for their hard work.

Mayor Tricarico questioned the grant for the Somerset Valley Players. Mr. Possemato stated that the

Somerset Valley Players benefit both senior citizens and youth. Mr. Possemato expressed the Credit Card Advisory Committee’s concerns that the bank is no longer taking

new applications. He stated that the Committee is concerned with the future of this program. Second Deputy Mayor Martin gave a brief history of the program and stated that this program benefits both

the senior citizens and the youth in the Township. She stated that the program provides a fine balance between both groups.

Committeeman Gwiazdowski expressed his concern that Mr. Possemato may have a conflict of interest

being on the Credit Card Advisory Committee as well as being President of the Board of Education since two of the grants are being awarded to school groups. Committeeman Gwiazdowski also expressed his concern that the senior citizens are not receiving the same benefits as the youth groups are under this program. Mr. Possemato responded by stating that there is not a conflict with him being on both boards. He further stated that although he is not in control of what grants come in and who complies with the guidelines, the senior citizens do receive $10,000 per year under this program. A brief discussion ensued regarding how the program was developed to ensure fairness to all that apply for grants.

Upon motion by Deputy Mayor Gelardi and seconded by Second Deputy Mayor Martin, the presentation of

the Credit Card Advisory Committee was accepted by the Township Committee as follows upon call of the roll: Roll Call: Ayes – Gwiazdowski, Martin, Gelardi, Tricarico

REPORTS AND NEW BUSINESS FROM COMMITTEE LIAISONS

Mayor Tricarico Mayor Tricarico reported on the County’s proposed work to the Nevius Street Bridge informing the Township Committee that the new bridge will be repositioned west of the original bridge which will eliminate the 90° turn at the end of the road. The Township Committee concurred with the County’s proposal and will notify them of the same. Deputy Mayor Gelardi Deputy Mayor Gelardi informed the Township Committee that he will have a report from the Economic & Business Development Commission shortly on ways to attract viable ratables into the Township. Deputy Mayor Gelardi reported that he has been acting as Police Liaison in former Committeewoman Jensen’s absence. He read a letter from the Police Chief regarding grants that are available to the Police Department. He stated that these grant applications need to be submitted by the end of the week. Upon motion by Deputy Mayor Gelardi, seconded by Second Deputy Mayor Martin, the Township Committee supported the Police Department’s application for COPS grants and authorized the Mayor to execute said grant applications. Said motion carried as follows upon call of the roll:

Roll Call: Ayes – Gwiazdowski, Martin, Gelardi, Tricarico Nays – None Abstain: Gold Second Deputy Mayor Martin Second Deputy Mayor Martin reported that issues regarding the Route 206 Bypass have been resolved and should be completed by Fall 2004/Spring 2005. The bypass will be completed before the mid-section of Route 206 is completed. Second Deputy Mayor Martin urged everyone to attend the Memorial Day Parade and Picnic on May 25th. Second Deputy Mayor Martin announced that the Recreation Department will be holding a Hawaiian Luau for the senior citizens in May. The Recreation Department is making an effort to schedule more activities for senior citizens. Committeeman Gwiazdowski Committeeman Gwiazdowski asked Township Administrator Judith Haas to make certain that all township vehicles are removed from the parking lot on May 25th for the Memorial Day Parade and Picnic.

Committeeman Gwiazdowski reported that the first Deer Commission meeting was held last Thursday and all members were sworn in. Committeeman Gwiazdowski reported that the Cable Advisory Committee will be meeting tomorrow. He reported that most of the digital cable conversion is completed. He noted that negotiations continue with Beekman Gardens regarding right of entry. He reported that RCN plans to finish the conversion by the end of June.

BUSINESS FROM THE FLOOR FOR ITEMS ON THE AGENDA

Walter Galanowsky, 2 Deer Run, asked the Township Committee not to remove the artificial athletic field from the school budget. He stated that the artificial field would be less maintenance and a investment. Peter Passe, 310 Thatcher Terrace, supported the artificial athletic field included in the school budget. He stated that the Board is getting the field at a reduced cost because it will be used as a showroom for schools in the central New Jersey area. He stated that Service Master does not do a good job in regard to field maintenance. Mr. Passe commended the Mayor and the DPW for their excellent maintenance of township fields and parks. Helene Fine, Hillsborough Education Association, supported the Board of Education. She stated that the schools have outstanding staff and programs that will be hurt by the Township Committee’s proposed reductions. She asked the Township Committee to consider not reducing the budget. She suggested that the Township Committee consider eliminating some of the courtesy busing in place of their proposed reductions. Cindy Klepich, 5 Powelson Drive, commended Second Deputy Mayor Martin’s effort and work in reducing the school budget. Ms. Klepich recommended additional reductions to the budget and cited the areas she thought could be reduced. Ms. Klepich asked the Township Committee to strongly consider reducing the school budget more than the proposed $1,234,500. Karen Galanowsky, 2 Deer Run, thanked the Township Committee for their hard work in reviewing the school budget. She supported the retaining of the athletic field in the budget. Lou Possemato, Board of Education President, thanked the Township Committee for the opportunity to speak. He clarified to the Township Committee and the public that the Board of Education continues to support the athletic field and will attempt to keep it in the budget. He reviewed the school budget process. He stated that it is a great challenge for anyone to keep the budget with no increase. Dr. Robert Gulick, Superintendent of Schools, spoke on the school budget law and how governing bodies are left to deal with defeated school budgets. He stated that he believes the township’s reassessment program is the reason why the school budget was defeated. He stated that the law requires the governing body to review the budget, but does not require them to reduce the budget. Dr. Gulick reviewed the Township Committee’s proposed reductions to the school budget line by line item. He concluded by stating that the Board of Education is willing to reduce their budget by $591,000 out of the $1,234,500 of the Township Committee’s proposed reductions. Dr. Gulick stated that the Board of Education believes that reductions in the amount of $1,234,500 will impact on the quality of education provided to Hillsborough students. Mayor Tricarico stated that the township’s reassessment program is not mandated by the municipality, it is mandated by the county and the state. Mayor Tricarico stated that the Board is not bound by the line items that the Township Committee chose to reduce, they are only bound by the amount proposed to be reduced. Mayor Tricarico stated that the Township Committee does not want to impact on the quality of education, but on the other hand, they cannot ignore the voters who voted against the school budget. Second Deputy Mayor Martin stated that it was a challenge to the Township Committee to review and understand the school budget. She stated that the Township Committee tried to do their best in not impacting the quality of education and reduced areas least likely to impact education. School Business Administrator Thomas Venanzi reported that Hillsborough ranks fourth lowest cost per pupil in schools of the same size. He stated that their surplus is under $1 million and surplus is what has been used for cash flow emergencies and items that were not budgeted. The low surplus takes away the budget’s flexibility. Committeeman Gold asked how many teachers are retiring. Dr. Gulick replied that they have received 12 retirements to date and this number may increase before the end of the school year. A brief discussion ensued between Deputy Mayor Gelardi and Mr. Venanzi regarding legal expenses and retirement breakage.

Dr. Gulick stated that it is not the Board’s position to blame the Township Committee for the reductions, but noted that if the reductions remain at $1,234,500, programs will be impacted. Dr. Gulick asked the Township Committee to reduce the municipal budget by the difference between the Board’s proposed reductions of $591,000 and the Township Committee’s proposed reductions of $1,234,500.

Committeeman Gwiazdowski stated that school board members and budget are voted on by a low

percentage of votes and he suggested that it may be a better option to have the school board and budget voted on at the general election. Committeeman Gwiazdowski stated that he supports the athletic field because of its potential

maximum use and low maintenance costs. He stated that the Board of Education should have followed the Mayor’s direction when he asked for advice from them regarding the school budget. There was no response from the Board of Education to help the Township Committee review and reduce the budget, putting the entire burden on the Township Committee. He noted that they have a responsibility to the taxpayers to reduce the school budget

Pat Donahue, 442 Township Line Road, stated that the field is overused and an artificial field is a great

need to the school system. He stated that Hillsborough’s school system is excellent. He stated that if the field is purchased next year, the school will lose the cost savings and it will cost over $1.7 million.

Michael Detsis, stated that the budgets, both school and municipal, should be impacted by economic

restraints. He stated that long time residents have to move out of Hillsborough because they can no longer afford to live here. He stated that some of the new positions in the school budget should be deferred to another year.

Arthur Zander, 323 South Branch Road, commended the Township Committee for their efforts with the

school budget. He asked that if an artificial field is better, why have some professional sport teams returned to natural fields.

Howard Miller, Horseshoe Drive, asked the Township Committee to reduce the school budget because he

personally cannot keep paying his taxes if they continue to increase at an alarming rate. Steve Sloan, 10 Wolfe Drive, stated that in 1999, the Township Committee did not reduced the budget. He

stated that in 1994, they reduced it by $600,000.00.. He asked the Township Committee to reconsider and to reduce its proposed reductions by half.

Frank Herbert, 17 Baird Drive, stated that other school districts are reducing their school budgets. He cited

that Bridgewater is reducing their budget by $1.2 million and Manville is proposing reductions in the amount of $900,000 out of a $12 million school budget.

Annette Sammer, 35 Partridge Road, thanked the Township Committee for their work and disagreed with

Dr. Gulick’s use of the athletic field as a hammer. She was disappointed that the Board of Education did not work with the Township Committee. She stated that the state of the economy needs to be recognized and she is in favor of keeping residents in town.

Phil Rukus, 68 East Mountain Road, gave benefits of artificial field and stated that tough decisions have to

be made by the Township Committee. He asked that they remember to keep in mind the best interests of the children for both education and athletics.

John Perrone, 415 Ernest Drive, stated that he belives Dr. Gulick is the best Superintendent of Schools in

Somerset County and Tom Venanzi is the best Chief Financial Officer of schools in Somerset County. He commended the Township Committee for balancing taxes and the quality of education.

Ed Plaskon, Board of Education member, asked the Township Committee to reconsider their proposed

reductions and reviewed the possibility of additional students coming into the township before the next school year. Mayor Tricarico recessed the meeting at 10:27 p.m. The meeting resumed at 10:35 p.m. John Klepich, 5 Powelson Drive, appreciated the Township Committee’s hard work with the school budget

and asked if they would consider additional reductions.

PUBLIC HEARINGS

Ordinance 2002-09 Mayor Tricarico offered the following ordinance for consideration:

AN ORDINANCE TO AMEND CHAPTER 77, “DEVELOPMENT REGULATIONS”, OF THE TOWNSHIP OF HILLSBOROUGH AS TO STANDARDS FOR COMMUNITY SHOPPING CENTERS IN

THE O-2 ZONE

Upon motion by Second Deputy Mayor Martin, seconded by Deputy Mayor Gelardi, the public hearing was declared open for Ordinance 2002-09. Said motion was carried as follows upon call of the roll:

Roll Call: Ayes – Gwiazdowski, Martin, Gelardi, Tricarico

Nays – None Abstain: Gold Linda Burdge, Hamilton Road and Greg Soldini, Attorney for Concerned Citizens for a Better Hillsborough reviewed the case regarding the aforesaid ordinance. Mr. Soldini reminded the Township Committee that the original ordinance may be thrown out. He stated that this ordinance will create increased traffic problems. He stated that the ordinance should not be approved and the Township Committee should allow the appeal process to run its course. Ms. Burdge stated that this ordinance does nothing good for the township and she opposes it. Both Mr. Soldini and Ms. Burdge accused the Township Committee of creating the ordinance as requested by the developer. William Krame, developer for the Hillsborough Promenade, disagreed. Mayor Tricarico stated that this

ordinance changes all O-2 zones throughout the township, not just the O-2 zone where the Hillsborough Promenade is located. Mr. Kemm stated that this ordinance is a result of various issues that needed to be addressed. He reaffirmed that the ordinance was not dictated by Mr. Krame. He stated that the Planning Board submitted recommendations to the Township Committee and after review, the Township Committee decided to amend the ordinance. Wayne Beron, Meadowbrook Drive, suggested that the term “community” be defined in the ordinance. Committeeman Gwiazdowski restated his objections to the ordinance and the developer’s consent order. He noted that the Township was forced to let the developer build and questioned the necessity of the changes to the ordinance. Committeeman Gwiazdowski questioned the increase of traffic generated as a result of the additional retail. He also questioned the additional hours of operation due to the additional retail. Mayor Tricarico stated that the Township has had to deal with four separate lawsuits resulting from the Greenbriar case. He stated that the Krame case was very adversarial and there was a choice of a mall or 950 homes. He noted that a mall is in the best interests of the residents. He stated that the Planning Board confirmed that there would not be increased traffic because it is being built prior to the highway improvements. Committeeman Gwiazdowski asked if the Planning Board conducted an additional study. Mayor Tricarico replied that there was not an additional study done, there are only Planning Board minutes regarding this ordinance. A brief discussion ensued regarding the need for the ordinance and the lawsuit.

Nays – Gwiazdowski Abstain: Gold Ordinance 2002-15 Mayor Tricarico continued the public hearing on the following ordinance:

AN ORDINANCE TO AMEND THE WILLOW ROAD LEASE TO ALLOW AN ADDITIONAL LITTLE LEAGUE FIELD AND

AMEND THE TERMS OF THE LENGTH OF THE LEASE

Attorney Karl Kemm reported that minor changes have been made to the lease and that all parties are in agreement. He stated that the changes were to protect Township interests. The issue regarding how complaints are handled and resolved will be addressed in a resolution instead of being part of the lease.

Bob Hollingshead, 31 Winding Way, expressed his disappointment that the neighbors were not part of the

lease process. He reviewed the concerns of the neighbors. Each issue was addressed and resolved.

An amendment was made to page 6 of the lease by deletion of the word “month” in the phrase “last day of the month”. The word was replaced by the word “season”.

Tony Judas, Rivendell Road, Hillsborough Heat Baseball Club, asked how his club could reserve playing time on these fields, Mayor Tricarico suggested that Mr. Judas meet with the Recreation Director or attend a Recreation Commission meeting regarding field use in the Township.

Upon motion by Committeeman Gwiazdowski, seconded by Second Deputy Mayor Martin, the public hearing was closed for Ordinance 2002-15. Said motion was carried as follows upon call of the roll:

Abstain: Gold Resolution Establishing Procedures for Addressing Complaints Regarding the Use of the Willow Road Baseball Complex Upon motion be Second Deputy Mayor Martin, seconded by Deputy Mayor Gelardi, the following resolution was adopted as follows upon call of the roll:

WHEREAS, A lease between the Township of Hillsborough and the Hillsborough Little League, Inc. was signed on May 25, 1999 granting permission for the installation and use of a baseball complex at the Willow Road Park, and the Little League has recently requested an Amendment to said Lease for the installation of a seventh field and other amenities; and

WHEREAS, the property owners adjoining the Willow Road Baseball Complex have voiced concerns

about the past use of the Willow Road Baseball Complex and have requested a procedure for registering, documenting and resolving complaints concerning the use of the Willow Road Baseball Complex; and the Little League and the Township agree that a specified procedure should be established; and

WHEREAS, an Amendment to said Lease granting permission for the installation of a seventh field and

other amenities, as well as other changes to the Lease has been approved by the Township Committee on May 14, 2002.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey, that the following procedures are hereby adopted for addressing complaints regarding the Little League’s, and others use of the Willow Road Baseball Complex:

Any complaints by any person that the Little League is not using the fields in accordance with the terms of their Lease will be submitted in writing to the Hillsborough Township Recreation Director, or to such person as may be designated by the Township Committee (hereinafter “Director”). The Director may also take complaints orally which shall be reduced to writing. Upon the making of a complaint, the Director will provide a copy to the Little League to the contact listed in Paragraph 19 “Notices” of the Lease advising them of the complaint and declaring the Little League in default of the Lease in order to advise the Little League that there may be a default and so that remediation of the default may begin in a timely manner should the Little League be at fault. The Director will undertake a sufficient investigation to determine the facts surrounding the complaint, including interviewing the Complainant and a representative of the Little League, and to determine if a default under the terms of the Lease occurred by the Little League or if someone other than the Little League is the cause of the complaint. The Director shall report his findings in writing to the Township Committee for further action if necessary, with a copy to the Little League and the Complainant. Said report shall include the specifics of the complaints, the results of the investigation, who is responsible for the complaint, any remedial action taken or proposed by the Little League, and whether the Complainant is satisfied with the remedial action taken or proposed by the Little League, recommendations to avoid similar problems in the future, if applicable, and whether this type of complaint has been made in the past and results of the same. This procedure does not subrogate either Township’s or the Little League’s rights under Paragraph 24 “Submission to Mediation Before Suit” of the Lease or as may otherwise exist under the Lease or at law. Nothing herein shall preclude the Township or other entities from making other complaints, investigations and taking enforcement actions for violations of applicable laws, rules, and regulations.

Consideration #7 -- Resolution authorizing Escrow Agreement for Development Fees with the Council on Affordable Housing (COAH)

Mayor Tricarico offered the following resolution: WHEREAS, the Council on Affordable Housing (COAH) requires a three-party escrow agreement between COAH, the Township of Hillsborough and the Township’s banking institution that maintains the interest-bearing affordable housing trust fund; WHEREAS, the Township desires to comply with COAH’s requirement and Township Attorney has reviewed and approved the form of Agreement; and

Mayor Tricarico offered the following resolution: WHEREAS, the Hillsborough Township Volunteer Fire Company No. 2 has served the residents of Hillsborough Township for many years; and WHEREAS, the Hillsborough Township Volunteer Fire Company No. 2 is holding an annual fair for the purpose of raising funds from July 22-27, 2002; and WHEREAS, the Hillsborough Township Volunteer Fire Company No. 2 has made application for a carnival license for this event; and WHEREAS, Hillsborough Township Volunteer Fire Co. Mayor Tricarico offered the following resolution:

WHEREAS, the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, desires to collect all taxes, assessments, and other municipal charges that are now delinquent; and WHEREAS, the Tax Collector is directed to sell all municipal delinquencies through December 31, 2002 in a manner prescribed by N.J.S.A. 54-5-19, and is amended by Chapter 99 Public Laws of 1997; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, New Jersey, that the Tax Collector is hereby authorized and directed to sell all municipal liens in accordance with New Jersey law, and as stated above, on June 19, 2002 at 10:00 AM.

1. Video Corporation of America $22,676.00 WHEREAS, it has been found that there is sufficient in-house expertise and manpower, with the assistance

of the Cable Advisory Committee, to install the equipment; and WHEREAS, Video Corporation of America has agreed that the Township can acquire the equipment in the

the school year 2002-2003 was submitted to the voters of the Township on April 16, 2002 in the amount of $52,732,307.00 to be raised by taxes; and WHEREAS, the General Fund budget was defeated by a vote of 1180 for and 1526 against; and WHEREAS, Hillsborough Township is a Type II school district without a board of school estimate; and WHEREAS, pursuant to N.J.S. 18A:22-37, the defeated school budget was referred to the Hillsborough Township Committee for review; and WHEREAS, the Township Committee has pursuant to N.J.S. 18A:22-37, consulted with the Board of Education on April 29, 2002 and convened in a work session on May 7, 2002; and WHEREAS, the Township Committee has determined that certain adjustments in the General Fund expenses in the proposed budget are acceptable, appropriate and will reduce the amounts to be raised by local tax levy by $1,234,500.00; and

BE IT FURTHER RESOLVED that copies of this resolution be forwarded by the Township Clerk to the persons and departments herein named for certification purposes.

Second Deputy Mayor Martin stated that the Committee feels that the 1.5% reduction of the school budget is reasonable. She restated that the Board of Education is only bound by the amount of the reduction, not the specific line items chosen by the Township Committee. She stated that the Board will do what it has to do.

Deputy Mayor Gelardi stated that all has been said by all on both sides and that he supports the reduction which will result in a minimal impact.

Committeeman Gwiazdowski commended the school system and noted that it would be sending the voters a bad message if they did not reduce the school budget. He stated that the reductions to the school budget were not easy to make and noted that the municipal budget will be reduced by 1.5% also this evening.
