1 PROCEEDINGS OF ORDINARY BOARD MEETING HELD ON 06 th OCTOBER 2018 AT 1100 HOURS IN THE OFFICE OF CANTONMENT BOARD DEHRADUN ----------------------------------------------------------------------------------------------------------------- On the request of Shri Hitesh Gupta, Shri Kamal Raj, Shri Vinod Panwar and Shri Jitendra Taneja, all Elected Members, the matter was considered under Building & Health Committee meeting held on 03-10.2018 regarding repair of buildings which were demolished during demolition drive for encroachment as per orders of Hon’ble High Court of Uttarakhand at Nainital. Matter was discussed deliberately; Hon’ble Members of the Legislative Assembly of Uttarakhand viz., Shri Harbans Kapoor and Shri Ganesh Joshi also deliberated on the matter. CEO apprised the Board that as per provisions of Section 235, for erection/re- erection the proper applications/Notice along with connected documents is mandatory requirement for sanction of the Board. The PCB permitted two persons Aakash Yadav and Rajeev Punj, public persons from Premnagar area, in the meeting. After much deliberation Board unanimously resolved that: 1 Persons having documents e.g. sanctioned Building Plan, Water Charges paid bills, Electric Charges bills etc. they may granted NOC for repair/re-erection of building and Building & Health Committee is authorized to approve such applications by holding its meeting within three days from the date of this meeting. 2 Board further resolved that the individual not having any document - land, sanctioned building plan, tax paid documents etc. but having the possession of land/property from decades in those cases solution may be worked out in consultation with State Govt. Authorities- Land and Revenue Department. Elected Board Members still insisted on permission being given, the PCB reminded them of the oath they had taken on becoming members to follow the rules of the Cantt Board.     On the request of Shri Hitesh Gupta, Shri Kamal Raj, Shri Vinod Panwar and Shri Jitendra Taneja, all Elected Members, the matter was considered under Building & Health Committee meeting held on 03-10.2018 regarding repair of buildings which were demolished during demolition drive for encroachment as per orders of Hon’ble High Court of Uttarakhand at Nainital.

    Matter was discussed deliberately; Hon’ble Members of the Legislative Assembly of Uttarakhand viz., Shri Harbans Kapoor and Shri Ganesh Joshi also deliberated on the matter. CEO apprised the Board that as per provisions of Section 235, for erection/re-erection the proper applications/Notice along with connected documents is mandatory requirement for sanction of the Board. PCB informed them that even he and CEO have taken the oath and Board will function within regulation of the Cantt Board Act, 2006.

    281-2 PURCHASE OF SUBMERSIBLE PUMPING SETS FOR CANTONMENT BOARD TUBE WELLS

    To consider the tenders received for the purchase of Submersible Pumping Sets for Cantonment Board tube wells. The tenders were invited vide Tender Notice No. XIV/12/Misc.Tender/310 dated 12 July 2018 duly published in daily newspaper i.e.,. Amar Ujala and Garhwal Post (English edition) dated 13 July 2018. In this connection 03 tenders received on due date were opened in the presence of the Shri Jakir Hussain, CEO Dehradun Cantt, Office Supdt, JE (E&M), Sanitary Supdt and Storekeeper. As per the comparative statement prepared by the office M/s Janak Engineering Company, Chauhan Market, Haridwar Road, Dehradun has quoted the lowest rates as follows -

    281-2 RESOLUTION: Considered by the Board. Board resolved that rates

    along with specifications be got vetted by the GE (MES), Dehradun and

    CEO is authorized to place supply orders in requisite quantity of and as

    per requisite technical specification for each tube well of the Board and to

    make payment as per rates shown on agenda side.

    282-3 CULTURAL MEET ‘TARANG – 2018’

    Reference PDDE, CC, Lucknow Cantt letter No. 56531/Cultural Meet/Cantt/11/15 dated 21 Aug 2018 and CEO, Cantonment Board Lukcnow Cantt letter No. LCB/6/Cultural Meet/2018 dated 24 Sep 2018. To consider the office report thereby stating to release a sum of Rs. 2 lacs towards the contribution in respect of Cantonment Board Dehradun to CEO Lucknow Cantt for the Cultural Meet ‘Tarang-2018’ which shall be held at Lucknow Cantt w.e.f. 15th-17th Nov 2018.

    In this connection the office report further states that a sum of Rs. 6 lacs approx shall also be required to sanction for the railway fare for to and fro of 60 staff (48 participants, 08 school teachers, 03 musicians and 01 helper) departure on 14th Nov and arrival on 18th Nov 2018, hiring of 03 music teachers including musicians and dance master to train the school children to perform a quality cultural programme during the forthcoming TARANG 2018; procurement of dresses for participants, refreshment and other contingencies. In this connection the PDDE, CC/CEO Lucknow Cantt letters are placed opposite along with all relevant papers. 283-4 MUTATION OF PROPERTY UNDER SECTION 81 OF CANTONMENTS ACT, 2006 BY INSTRUMENT OF SALE DEED, GIFT DEED, WILL, INHERITANCE ETC.:

    To consider the applications received from the individuals for mutation of properties under the provisions of section 81 of Cantonments Act 2006. These applications were scrutinised by the Revenue Superintendent, who is official In charge of Tax Branch. The objections from the general public were invited vide this office notice No. VI/56/Tax dated 31 July 2018, which was published in daily newspapers “Hindustan” (Hindi) and “Dainik Jagran” on 01 August 2018. The Revenue Supdt. has further reported that in the list of the applicants appended below from Sl. No. 1 to 64 all applications are in order and supported by relevant documents.

    282-3 RESOLUTION: Board considered the matter in the light of PD DE, CC,

    Lucknow Cantt letter dated 21 Aug, 2018 and CEO, Cantonment Board, Lucknow

    letter dated 24 Sept., 2018. CEO apprised the Board that Cantonment Board,

    Lucknow is organizing the Cultural Meet at Central Command Level for the

    Cantonment Boards in Central Command for which each Cantt Board has to

    contribute Rs. 2,00,000/- (Rs. Two Lakh) to CEO, Lucknow and further approx.

    Rs, 6,00,000/- (Rs. Six Lakh) for Travel Arrangement, Dresses, Sports

    Equipment, Musical Instruments, refreshment/meals etc which is approved by

    the Board with authorization to meet the expenditure involved.

    In this context the relevant documents/files and notices as published in

    newspaper for inviting objections and suggestions are placed on the table.

    284-5 MILITARY CONSERVANCY AGREEMENT FOR THE FY 2018-19 As per the guidelines from SHQ, Dehradun to restrict the budget of Military Conservancy for the FY 2018-19 till 4.40 crores, the same was prepared accordingly and has been submitted to SHQ, Dehradun vide this office letter No. VIII/3/MCA/2018-19/112 dated 22 Sep 2018.

    In this connection the office report dated 01 Oct 2018 states that due to the curtailment in budget of MCA FY 2018-19 the SHQ, Dehradun has also withdrawn 32 safakaramcharis out of 110 from F(9). Now this office proposes to shift these 32 safaikaramcharis in Head F4, the civil conservancy (Garhi Dakra and Premnagar area). The report further states that there is a need to hire a tractor/trolley for the collection of garbage from civil area of Garhi/Dakra and Premnagar area.

    In this connection the concerned documents are placed on the table. The Board may decide.

    283-4 RESOLUTION: Board considered the matter and resolved to

    approve mutation of properties as shown from Sl No. 1 to 64 of the

    agenda side. Board further resolved that the properties at Sl No. 1 to 4 on

    the agenda side in the second table are not approved in the light of

    objections received from general public.

    284-5 RESOLUTION: Considered by the Board in details it was apprised by

    the CEO to the Board as per station Headquarters authorities the allotment of

    fund’s under Military Conservancy head been curtailed substantially and due

    to that reason 32 Safai Karamchari have been transferred from Head F(9) to

    F(4) and some of the schedule under Military Conservancy have been

    excluded. GOC and PCB of the Board told the Board if more funds are allotted

    towards Military Conservancy services, additional fund may be allotted to

    Cantt Boards in due course to mitigate the shortfall.

    285-6 HIRING OF RETIRED STAFF ON CONTRACTUAL BASIS To consider the letter No. 15/ADM/CO dated 28 Sep 2018 received from DEO, Meerut Circle, Meerut Cantt thereby requesting to bear the 50% financial expenses on hiring of the services of retired staff from DEO Meerut Circle office - Shri Rajkumar Giri at Rs. 25,000/- per month on contractual basis due to shortage of manpower and the increase workload. Thus this Board shall have to bear a sum of Rs. 12,500/- p.m. on hiring his services by DEO, Meerut Circle.

    In this connection the DEO, Meerut Circle letter is placed on the table.

    286-7 HIRING OF JUNIOR ENGINEER (E&M) ON CONTRACT BASIS To consider the letter dated nil received from Smt Rajender Kaur Sondhi, Vice-President and Smt Megha Bhatt, Member, Cantonment Board Dehradun which states that the water supply services in Cantonment area is not upto the mark due to shortage of staff. They have also stated that due to work load on JE(E&M), a JE(E&M) and other skilled/technical staff for maintaining of better water supply in the Cantonment area be hired on contractual basis.

    As per the office record presently the Board is running 08 tube wells to cater water supply in Dehradun Cantt area and as per the standards, essential and skilled staff required for running of these tube wells to perform round the clock duties is as follows –

    i) For two tube wells the skilled staff required viz., Elelctricians,. MPAs (03 skilled staff for each TW and 01 reliever for weekly off For two TWs) … 07 Nos

    Therefore for 08 TWs the skilled staff required … 28 Nos.

    ii) Field staff required for Main Cantt and Premnagar area … 05 Nos.

    iii) Hiring of JE(E&M) … 01 No.

    As per the office record presently there are 04 skilled staff on duty for running of the 08 TWs. However the Board is managing the TWs by engaging unskilled staff viz., Toll Peons, Chowkidars, Labour etc. The Board may decide for hiring of the JE(E&M), skilled/non-skilled staff as mentioned above.

    285-6 RESOLUTION: The matter was considered by the Board and

    resolved to approve a payment of Rs. 12,500/- p.m (50% of the

    contractual pay) to the staff engaged by the DEO Meerut. Board further

    authorize the CEO to pay the above approved amount on monthly basis.

    287-8 IMPROVEMENT OF WATER SUPPLY PIPE LINE Reference CBR No. 136-35 dated 23.10.2017. The Board vide CBR under reference had approved the rates of M/s Meher Enterprises, 63 Mandir Lane, Ballupur Chowk, Dehradun for laying of water supply pipe lines in Dehradun Cantonment area. The estimated cost projected in the tender was Rs. 50 lakhs.

    While execution of the subject work it has been observed that the estimates of the work may exceed as the scope of work on ground is more than it was anticipated. A sum of Rs. 20 lakhs more are required for some urgent works. The Board may decide. 288-9 ESTIMATES: LAYING OF PIPE LINE DEHRA DUN CANTT

    To consider the report of the Junior Engineer (E&M), Cantonment Board Dehradun thereby submitting estimates as prepared by him for improvement of water supply by laying of pipe line, Dehradun Cantonment:

    In this connection the estimates are placed on the table.

    1. Improvement of water supply for laying of GI pipe line of 50/ 40mm dia from Mohanpur near house of Bhandari-Goswami, Thapliyal-Neeraj, Joshi-Bhatia house and Balmiki Mohalla, Wing No. 4, Premnagar

    Rs. 4,14,312/-

    2. Improvement of water supply for laying of GI pipe line of 80mm dia near Thakurpur Road to near house of Tyagi, General Wing, Premnagar

    Rs. 3,09,250/-

    3. Improvement of water supply for laying of GI pipe line of 100/50mm dia near house of Bhatia to Smith Nagar Premnagar

    Rs. 12,42,500/-

    289-10 (I)REMOVAL OF ENCROACHMENT BY THE ORDER OF HON’BLE HIGH COURT

    To consider the letter No. 4002/1/SC (PCB) dated 03 Sept 2018 of Station HQ Cell Dehradun thereby desiring that the issue of encroachment in the Cantt area needs to be followed as per the direction of Hon’ble High Court. The task include the identification of all residential premises being used for commercial purpose should start immediately and notice to the defaulters to be given with proper planning of removal of encroachment to be done and implementation after necessary co-ordination with civil administration.

    In this connection, the letter is placed on the table for Board consideration.

    (II) NOC FOR DEVELOPMENT WORK THROUGH MLA FUND IN PREMNGAR

    (IX) COMPOUNDING OF UNAUTHORIZED BUILDING OF SMT. GEETA DEVI

    To consider a plan of smt. Geeta devi r/o of Aam Bagh Garhi Cantt there by requesting to compound her unauthorized constructed building at khasra No. 425(M). This office has served a notice under section 320 of Cantt Act to demolish her unauthorized part of construction against which Smt. Geeta Devi moved to the court for stay on her demolition. Further she has submitted a plan of compounding her unauthorized building but after her withdrawal of case from the court, the case has been put up for consideration.

    There was a complaint received from Shri MC Kukreti that one three storey

    building has been constructed by Smt. Geeta Devi on Khasra No. 425(M) at ONGC Golf Course road in Garhi Cantt. According to Cantt Bye Laws the applicant should have to leave 15 ft space in front of the commercial building but not even an inch has been left. The shopkeeper of the building has encroached on the road by making 10 ft shade on the road and doing business.

    In lieu of the complaint, the Building Health Committee on 06 Sept 2018 inspected

    the location in which it was observed that the commercial building plan of Smt Geeta Devi has been passed vide CBR No.59-42 dated 04 July 2011. As per the plan, the owner has to leave 10 feet open space from front side and five feet open space from the remaining sides of the building. As per the existing building constructed, the owner has left only 3 feet front which is covered with steps, 3 feet open space from east side, 2 feet 2 inch from north side and dead side from west direction. As per the plan, the road width is 100 feet while on actual measurement, the road width is 124 feet. The building is not as per the sanctioned plan.

    The applicant has submitted the plan in which she has shown her ground floor to

    be used as parking area. Further the other sides of the building has 2-3 feet set back which can be excepted in commercial building case. Also the left side of building has common stairs with neighboring building which is constructed as per their consent. As per the office report, the deviation part is difficult to demolish as hitting the unauthorized portion may affect the whole part of building which may create nuisance.

    In this connection, the case is placed before the committee. The Board may decide.

    289-10 (VIII) RESOLUTION: Considered by the Board and resolved that B

    & HC has recommended to ask to resubmit their Building plans (Residential,

    Commercial) which is correct as the sanction is more than one year old and

    therefore the recommendation of B & HC are approved.

    289-10 (IX) RESOLUTION: The Board considered the matter in detail

    and resolved that necessary proposal be initiated to GOC-in-C Central

    Command under the provisions of Cantonment Act, 2006 and who is

    competent to compound the case.

    (X) COMMERCIAL BUILDING PLAN OF SHRI NIRANJAN AGGARWAL

    To consider the building plan of Shri Niranjan Aggarwal thereby requesting to

    construct a commercial building at Khasra No. 524, 525 Garhi Cantt. As per the documents, the land was adjacent to B4 land under the management of DEO Meerut which was joint surveyed by DEO rep. The DEO Meerut vide their letter No. 1427/Misc/D.Dun/III dated 11 May 2015 has issued NOC for the land out of B4 land and is in private land. There was a complaint received by advocate Krishan Kumar Kashyap dated 13 Oct 2015 that the owner of khasra No. 523 Shri Jitender Narayan and others has given his attorney to him. He states that the his khara is adjacent to Shri Niranjan Aggarwal property and Shri Niranjan Aggarwal without any demarcation from revenue authorities want to encroach his property by showing Krishan Kumar Kashyap property in his land and for which the said building plan is proposed on his land. He has also complaint that Shri Niranjan Aggarwal has encroached the property of irrigation dept which is going from his land. In this connection, this office asked the Irrigation dept to provide the detail of the said land. The irrigation dept vide their letter dated 09 June 2016 has informed that there is no any encroachment done on khasra No. 526. This office on 17 April 2017 asked the applicant to demarcate his land from revenue authorities under section 41 of revenue authority. The revenue authority rep on 16 Nov 2017 inspected the site. On complaint receiving of Krishan Kumar Kashyp, the revenue authorities has deferred the date for proper demarcation of total land of Shri Nirajan Aggarwal which is pending till date.

    Adv Krishan Kumar has issued notice via his advocate that the building plan

    should be sanction after proper demarcation of land otherwise he will move to court against the dept. As per the CLA report, the applicant has not encroached the said property therefore the building plan could be sanctioned. In this connection, the file is placed before committee for consideration. The board may decide.

    290-11 REQUEST FOR WAIVING THE PAYMENT OF INSTALMENT UNDER CONTRACTUAL AMOUNT OF TOLL TAX To consider the application of Shri Ashok Kumar S/o Shri Dharam Singh resident of Lakhnota, Roorkee, District Haridwar thereby stating that the road (Chakrata Road) passing from Rangadwala to Premnagar has been closed since 19-09-2018 indefinitely, on which the collection of Toll Tax is being done for Cantonment Board Dehradun at 2 points 1. Rangadwala 2. Premnagar. The above contractor has requested to waive off the proportionate amount payable to Cantonment Board Dehradun in weekly installments as no collection is being done at above mention toll barriers. In above context the office report states that the highest financial bid amounting to Rs. 1,27,00,786/- payable in 50 equal weekly installments of Rs. 2,54,016/- , offered by Shri Ashok Kumar S/o Shri Dharam Singh resident of Lakhnota, Roorkee, District Haridwar was approved vide CBR No. 235-9 dated 11-May-2018. Office report further states that as per clause 9 of the Contract Agreement executed between the above contractor and the Cantonment Board Dehradun. That in the event, the collection of Toll Tax is abolished or stopped at any or all of the toll barriers in pursuance to the orders of any statutory body like Hon’ble District Court/Hon’ble High Court/Hon’ble Supreme Court/the Central Govt. etc., the rights of the Second Part will be limited to apply to the First Part to waive the payment of installment(s) of the Contractual Amount proportionate to the reduction in the collection of Toll Tax due to such order. The application of Shri Ashok Kumar S/o Shri Dharam Singh resident, the Contract Agreement and connected file is placed on the table for the consideration of the Board.

    289-10 (XI) 3 RESOLUTION: The Board considered the matter in the light of

    the recommendation of the B & HC and resolved that the construction of

    boundary wall cannot be sanctioned in the restricted area where the erection

    /re-election is probhited by orders of GOC-in-C ,EC and GOC-in-C CC of 1942

    and 1967 respectively.

    290-11 RESOLUTION: The matter of waiving off the payment of weekly

    installments of Toll Tax was considered by the Board and resolved that

    the road of Premnagar (Chakarata Road) has been closed for all vehicles

    during the demolition drive of State Govt., which should got verified from

    Police Authorities and other sources and verification report be put up in

    the next meeting of the Board for further consideration.
