ISSUES /PROBLEMS ON SHAHRAH-E-FAISAL

a) In the past , due to construction of under by pass at Dawood

pota road, the drainage/ sewerage system has deteriorated,

because the new sewerage line has been diverted from Dawood

Poota Road to Lucky Star and Raja Gazanfar Road to Avari

Tower , in this connection the flow of rain water/sewerage water

has effected.

b) Besides, other deptt /offices are also throwing the rainy water

through their heavy de-watering pumps on Shahrah-e-Faisa,

resultantly the rain water continuously overflows on

Shahrah-e-Faisal.

c) Askari III, Umer Kot lines, Flag Lane , Hocky stadium and log

area sewerage and rain water flowing towards Dr. Dawood

Poota Road through F.G.Public School and college through

drain nallas.

i) The City Govt totally covered Nalla on above places and

also reduced its width therefore the flow of drain water

/sewerage water is badly effected.

MEASURES TAKEN BY KCB DURING THE RAIN EMERGENCY

Karachi Cantonment Board took no …of steps for rain emergency as

given below:-

1. KCB has established rain emergency centre in the Office.

2. KCB has constituted committee comprising seniors officials

in shifts basis 24 hrs. The committee is responsible for :

a) Availability of all kinds of required machinery.

b) Cleaning of storm water/channels/drains etc

c) Round the clock availability of class IV staffs.

d) Food arrangement i.e lunch and dinner for all concerned

staff

e) Cancelled leave for all the concerned staff.

Resolution: The Board appreciated the efforts of the CEO and his team members i.e

Mr. Arif Danish , Asstt Cantt Engineer and Mr. Kamran Khan, PHO and other class

IV staff of Karachi Cantonment Board.

Requirement: To consider the MEO, Karachi Circle, Karachi letter

No. K-7/20/1/37, dated 11th Oct, 2018 regarding issuance NOC

from the municipal point of view for the proposed conversion of

Property No. 20 & 20/1, measuring 1198 Sq. Yards plus

common passage 109 Sq. Yards in Commissariat Lines, Karachi

Cantt from residential to commercial purpose, the subject

property is held on old grant for residential purpose of CLA

Rules, 1937 by M/s. Shoukat Ali S/o Muhammad Sadiq &

Others said lease had applied for taking regular lease in

Schedule-IX-C of CLA Rules, 1937 property for commercial

purpose.

It is pointed out that the Principle Health Officer has asked to

accorded NOC from health point of view of the proposed

commercialization in respect of above bungalow vide letter No.

KCB/INSP/CONST/2020/194, dated 25th June, 2020.

Title: PROPOSED NON UTILIZATION FEE RATES IN

RESPECT OF OPEN PLOTS.

Requirement: It is formal practice that municipal bodies in their respective

jurisdiction impose Non Utilization Fees on open plots since the

conservancy services are being provided to them unfortunately

the same was not adopted by this office. In view of the necessary

KARACHI CANTT.

Reference: Application dated 09/06/2020 submitted by Mr. Ayub Khan

Qaimkhani, Member Ward-3 of Karachi Cantt Board.

Requirement: To consider the application dated 09/06/2020 submitted by

Mr. Ayub Khan Qaim khani, Member Ward-3 of Karachi Cantt

Board stated therein that the owner of M/s. Ahsan Petroleum

constructed on plot of land bearing survey No.148/2 measuring

544.44 Sq,Yds situated at Abbyssania Lines, besides Saddar

Police Station, Karachi Cantt has illegally encroached on Govt/

KCB land and constructed a Generator Room & a Tire Puncture

shop behind the Petrol Pump and earned about Rs.60,000/- per

month as rent. The Member above named requesting KCB to take

action against the encroacher and demolish the said illegal

construction.

In this connection, the KCB staff after site/survey of site has

reported on Note sheet No.1 that “the Petrol Pump along with

office building is situated with the area of Survey No.148/2,

however, encroachment exists between border of survey No.148/2

and wall of Saddar Police station. The encroacher has

established a generator room and a tire hop illegally on Govt. /

KCB land”.

As the land in question is Govt/KCB land therefore the case is

placed before the Board for approval to vacate the site by way of

demolishing the illegal construction through KCB staff.

Gulbahar No. 1, Karachi. The applicant has submitted copies of

Indenture of Rent Agreement, CNIC of House Owner and Search

Certificate showing ownership of the applicant in respect of the

flat mentioned above. The applicant requesting to allow rental

ceiling for self hiring of his flat from 05-08-2020 as admissible

under the Govt.of Pakistan, Ministry of Housing and Works,

Title: (54) NOS DRAFT BYE – LAWS

It is apprised that the Cantt Act, 1924 is a comprehensive

code and empowers the Board to frame certain bye-laws for

its management and to regulate day to day affairs under

section 282 of the Cantt Act, 1924. The section 60 of the Act

also empowers the Board with previous sanction of the

Federal Govt., impose in any cantonment any tax which,

under in any enactment for the time being in force, may be

imposed in any municipality in the province where such

cantonment is situated. In proceeding year, HQ ML&C

Deptt felt that comprehensive bye-laws have not been

framed in the last 95 years and the bye-laws, however few

bye-laws have been framed earlier, which are needed to be

updated. In existing bye-laws, there is need of major

amendment. The Director Region was assigned this task

framing of bye-laws and updation of existing bye-laws in all

over the country, while in the first step, the needful shall be

done in Karachi Region. The RHQ scheduled a meeting on

27-9-2019, in which all officers from the Regions

participated and agreed the proposal of RHQ for

standardization of bye-laws and resolved unanimously

agreed to hire a legal consultant for the purpose of

standardization of bye-laws. After public notice,

consequently M/s. Aashir Law Associates (Ashraf Ali Butt

CLA) was assigned this task, who worked hard for

standardization of bye-laws and now submitted the following

bye-laws and notifications after certain amendments in

existing notifications.
