1. Purpose

To set out the minimum requirements to ensure compliance with Health and Safety legislation, Eskom standards and procedures and to assist the contract manager and the contractor to develop, implement and maintain an organised Safety, Health and Environmental management system. The procedure is supplementary to the requirements of relevant legislation and the conditions of the contract.

2. Scope

This procedure contains the statutory requirements as well as the minimum SHE requirements to which contractors must comply whilst performing work on the premises of Matimba Power station. Conformance with the Occupational Health and Safety Act, 85 of 1993 and other related legislation is mandatory.

4.1 In these regulations any word or expression to which a meaning has been assigned in the Act shall have the meaning so assigned and, unless the context otherwise indicates-

4.2 "agent" means any person who acts as a representative for a client;

4.3 "angle of repose" means the steepest angle of a surface at which a mass of loose or fragmented material will remain stationary in a pile on the surface, rather than sliding or crumbling away;

4.4 "batch plant" means machinery, appliances or other similar devices that are assembled in such a manner so as to be able to mix materials in bulk for the purposes of using the mixed product for construction work;

4.5 "client" means any person for whom construction work is performed;

4.6 "competent person" means any person having the knowledge, training, experience and qualifications specific to the work or task being performed: Provided that where appropriate qualifications and training are registered in terms of the provisions of the South African Qualifications Authority Act, 1995 (Act No. 58 of 1995), these qualifications and training shall be deemed to be the required qualifications and training;

4.7 "construction work" means any work in connection with-

a) the erection, maintenance, alteration, renovation, repair, demolition or dismantling of or addition to a building or any similar structure;

b) the installation, erection, dismantling or maintenance of a fixed plant where such work includes the risk of a person falling;

c) the construction, maintenance, demolition or dismantling of any bridge, dam, canal, road, railway, runway, sewer or water reticulation system or any similar civil engineering structure; or

d) the moving of earth, clearing of land, the making of an excavation, piling, or any similar type of work;

4.8 "construction vehicle" means a vehicle used for means of conveyance for transporting persons or material or both such persons and material, as the case may be, both on and off the construction site for the purposes of performing construction work;

4.9 contractor" means an employer, as defined in section 1 of the Act, who performs construction work and includes principal contractors;

4.10 "design" in relation to any structure includes drawings, calculations, design details and specifications;

4.11 "designer" means any of the following persons-

a) A person who prepares a design;

b) a person who checks and approves a design;

c) a person who arranges for any person at work under his control (including an employee of his, where he is the employer) to prepare a design, as well as;

d) an architect or engineer contributing to, or having overall responsibility for the design;

e) building services engineer designing details for fixed plant;

f)surveyor specifying articles or drawing up specifications;

g) contractor carrying out design work as part of a design and build project;

h) temporary works engineer designing formwork and false work; and

i) Interior designer, shop-fitter and landscape architect.

4.12 "ergonomics" means the application of scientific information concerning humans to the design of objects, systems and the environment for human use in order to optimize human well-being and overall system performance;

4.13 "excavation work" means the making of any man-made cavity, trench, pit or depression formed by cutting, digging or scooping;

4.14 "explosive powered tool" means a tool that is activated by an explosive charge and that is used for driving bolts, nails and similar objects for the purpose of providing fixing;

4.15 "fall prevention equipment" means equipment used to prevent persons from falling from an elevated position, including personal equipment, body harness, body belts, lanyards, lifelines or physical equipment, guardrails, screens, barricades, anchorages or similar equipment;

4.16 "fall arrest equipment" means equipment used to arrest the person in a fall from an elevated position, including personal equipment, body harness, lanyards, deceleration devices, lifelines or similar equipment, but excludes body belts;

4.17 "fall protection plan" means a documented plan, of all risks relating to working from an elevated position, considering the nature of work undertaken, and setting out the procedures and methods to be applied in order to eliminate the risk;

4.18 "hazard identification" means the identification and documenting of existing or expected hazards to the health and safety of persons, which are normally associated with the type of construction work being executed or to be executed;

4.19 "health and safety file" means a file, or other record in permanent form, containing the information required as contemplated in these regulations;

4.20 "health and safety plan " means a documented plan which addresses hazards identified and includes safe work procedures to mitigate, reduce or control the hazards identified;

4.21 "health and safety specification" means a documented specification of all health and safety requirements pertaining to the associated works on a construction site, so as to ensure the health and safety of persons;

4.22 "material hoist" means a hoist used to lower or raise material and equipment, and includes cantilevered platform hoists, mobile hoists, friction drive hoists, scaffold hoists, rack and pinion hoists and combination hoists;

4.23 "medical certificate of fitness" means a certificate valid for one year issued by an occupational health practitioner, issued in terms of these regulations, whom shall be registered with the Health Professions Council of South Africa;

4.24 "method statement" means a document detailing the key activities to be performed in order to reduce as reasonably as practicable the hazards identified in any risk assessment;

4.25 "mobile plant" means machinery, appliances or other similar devices that is able to move independently, for the purpose of performing construction work on the construction site;

4.26 "National Building Regulations" means the National Building Regulations made under section 17(1) of the National Building Regulations and Building Standards Act, 1977 (Act No.103 of 1977), and published under Government Notice No. R.1081 of 10 June 1988, as amended;

4.27 "person day" means one day for carrying out construction work by a person on a construction site for one normal working shift;

4.28 "principal contractor" means an employer, as defined in section 1 of the Act who performs construction work and is appointed by the client to be in overall control and management of a part of or the whole of a construction site;

4.29 "professional engineer or professional certificated engineer" means any person holding registration as either a Professional Engineer or Professional Certificated Engineer under the Engineering Profession Act, 2000 (Act No. 46 of 2000);

4.30 "professional technologist" means any person holding registration as a Professional Technologist under the Engineering Profession Act, 2000;

4.31 "provincial director" means the provincial director as defined in regulation 1 of the General Administrative Regulations under the Act;

4.32 "risk assessment" means a program to determine any risk associated with any hazard at a construction site, in order to identify the steps needed to be taken to remove, reduce or control such hazard;

4.33 "roof apex height" means the dimensional height in meters measured from the lowest ground level abutting any part of a building to the highest point of the roof;

4.34 "SABS 085" means the South African Bureau of Standards' Code of Practice entitled "The Design, Erection, Use and Inspection of Access Scaffolding";

4.35 "SABS 0400" means the South African Bureau of Standards, Code of Practice for the application of the National Building Regulations;

4.36 "SABS EN 1808" means the South African Bureau of Standards' Standard Specification entitled: "Safety requirements on suspended access equipment - Design calculations, stability criteria, construction-tests";

4.37 "SABS 1903" means the South African Bureau of Standards' Standard Front-end Specification entitled: "Safety requirements on suspended access equipment - Design calculations, stability criteria, construction-tests";

4.38 "scaffold" means any temporary elevated platform and supporting structure used for providing access to and supporting workmen or materials or both;

4.39 "shoring" means a structure such as a hydraulic, mechanical or timber/steel shoring system that supports the sides of an excavation and which is intended to prevent the cave-in or the collapse of the sides of an excavation, and "shoring system" has a corresponding meaning;

4.40 "structure" means-

any building, steel or reinforced concrete structure (not being a building), railway line or siding, bridge, waterworks, reservoir, pipe or pipeline, cable, sewer, sewage works, fixed vessels, road, drainage works, earthworks, dam, wall, mast, tower, tower crane, batching plants, pylon, surface and underground tanks, earth retaining structure or any structure designed to preserve or alter any natural feature, and any other similar structure;

any formwork, false work, scaffold or other structure designed or used to provide support or means of access during construction work; or

any fixed plant in respect of work which includes the installation, commissioning, decommissioning or dismantling and where any such work involves a risk of a person falling two meters or more;

4.41 "suspended scaffold" means a working platform suspended from supports by means of one or more separate ropes from each support;

4.42 "The Act" means the Occupational Health and Safety Act, 1993 (Act No.85 of 1993);

4.43 "tunneling" means the construction of any tunnel beneath the natural surface of the earth for a purpose other than the searching for or winning of a mineral;

4.44 "safety" Includes the activities related to injury prevention, fire prevention, damage control and occupational hygiene.

4.45 "incident" An undesired event that could or does downgrade the efficiency of the business operation.

4.46 "accident" An unplanned and uncontrolled event caused by substandard conditions or acts, which could result in personal injury, damage to property, machinery, equipment or materials and delay in production or pollution.

4.47 "environment" Any activities or result of activities that can have a negative on the environment.

4.48 "health" Any activities or results of activities that can impact negatively on the health of persons.

4.49 "SHE" The combination of Safety, Health and Environment.

5. INSTRUCTIONS

5.1Client

A client shall be responsible for the following in order to ensure compliance with the provisions of the Act:

a) To prepare health and safety specifications for the construction work, and provide any principal contractor who is making a bid or appointed to perform construction work for the client with the same;

b) To promptly provide the principal contractor and his or her agent with any information which might affect the health and safety of any person at work carrying out construction work;

c) To appoint the principal contractor in writing for the project;

d) Ensure that the principal contractor has a documented health and safety plan and that it is implemented, maintained and available on request.

e) This will include audits by the client at intervals as agreed upon between the client and the principal contractor, which shall not be greater than one month. The contractor shall discuss or negotiate the content of the health and safety plan with the client before approval;

f) Stop the contractor if they do not work according to their health and safety plan. When the client makes changes to the health and safety plan, he shall inform or involve the principal contractor;

g) To ensure that where changes are brought about to the design or construction, sufficient health and safety information and appropriate resources are made available to the principal contractor to execute the work safely;

h) To ensure that every principal contractor is registered and in good standing with the compensation fund or with a licensed compensation insurer, prior to work commencing on site;

i) To ensure that potential principal contractors submitting tenders, have made provision for the cost of health and safety measures during the construction process;

j) The client shall discuss and negotiate with the principal contractor the contents of the health and safety plan before finally approving the health and safety plan for implementation;

k) The client shall ensure that a copy of the principal contractor’s health and safety plan is available;

l) Client shall not appoint a principal contractor unless the client is reasonably satisfied that the principal contractor has the necessary competencies and resources to carry out the work safely.

5.2 MATIMBA POWER STATION LINE MANAGEMENT

The Line Managers and project leaders of Matimba Power station shall, for the contractors with whom a contract was agreed, ensure that:

a) A copy of this procedure is issued to the responsible person of the contracting company. (Refer to Construction regulations)

b) The OHS Act, Section 37(2) agreement be signed (Annexure 1) before the contractor starts with his activities

c) All statutory appointments are verified to be in order and available on site before starting with work

d) A hazard identification and risk assessment has been completed before commencing with work

e) Requirements of this procedure are complied with.

5.3 SHE RISK MANAGEMENT PERSONNEL

SHE Risk Management personnel will assist the Outage Manager, the Line Managers, project leaders and the contractors responsible / competent persons in the implementation and maintenance of this procedure through advice, evaluations, auditing, rendering assistance during meetings and investigations. They will also assist the relevant project and line managers in assessing the Principal Contractor’s Health and Safety plans.

5.4PROCUREMENT

No client shall appoint any person as an agent, unless the client is satisfied that the person he or she intends to appoint has the necessary competencies and resources to perform the duties imposed on a client by these regulations. Procurement agent shall consult with the potential contractors before and during the execution of contracts in order to establish the competency of the contractor, his resources and if he has made provision for the cost of health and safety.

5.5 General

The risks and hazards that can affect the safety and health of persons are the same as normally associated with your type of construction work. Special attention will be given to the following: -

a) Working from elevated positions

b) Falling objects.

c) Work in confined spaces.

d) The use of personal protective equipment.

e) Lifting machines and lifting tackle.

f) Barricading.

g) A planned maintenance system for equipment and tools.

h) The building and use of scaffolds will be in accordance with SABS 085, SABS 1808 and SABS 1093.

i) All Isotopes on the unit will be made safe during the isolation procedure. Take note that all the areas zoned, and identified, as noise areas will be treated as such, including the unit on the outage.

j) Adhere to all notices, symbolic safety signs and road signs displayed on the station.

k) Please take note of the legal requirements of the construction regulations as per checklist attached.

l) The required documentation is required before commencement of work.

m) The Matimba health and safety requirements for contractors are supplementary to the Occupational Health and Safety act and regulations. The requirements form part of the contract. Refer to procedure PA/270/003 latest revision.

n) In terms of Section 37 of the OHS Act and the contract, every contractor will be responsible and accountable for his own employees and will comply with the requirements of the Occupational Health and Safety act, the relevant regulations and the contract at all times.

o) All contractors are advised to ensure that they comply with the requirements of ConstructionRegulations 5 (1) and provide the client with a suitable, practical well-documented and workable health and safety plan for approval. No contractor will be allowed to enter Matimba Power Station before the health and safety plan is approved. (Refer to the attached H&S plan checklist).

p) The client will execute all his responsibilities in terms of the act and regulations, and will ensure that all contractors comply with the requirements of the act as well as the conditions of the contract.

5.6 Cardinal Rules

Cardinal Rules are non-negotiable health and safety rules which must not be broken under any circumstances. It must be highlighted that Eskom takes a ZERO TOLERANCE stance to violation of these rules. These rules are applicable to any person entering Eskom sites

a) Rule 1: Open, isolate, test, earth, bond, and or insulate before touch.

b) Rule 2: Hook up at height.

c) Rule 3: Buckle up.

d) Rule 4: Be sober.

e) Rule 5: Ensure you have a permit to work.

5.7 Principal Contractor

a) A principal contractor who intends to carry out any construction work shall notify the provincial director in writing of the construction work;

b) A principal contractor shall provide and demonstrate to the client a suitable and sufficiently documented health and safety plan, based on the client’s documented health and safety specifications;

c) A principal contractor shall take reasonable steps to ensure co-operation between all contractors;

d) A principal contractor shall provide any contractor who is making a bid or appointed to perform construction work for the principal contractor with the relevant sections of the health and safety specifications;

e) Appoint each contractor in writing for the part of the project;

f) To take reasonable steps to ensure that each contractor’s health and safety plan is implemented and maintained on the construction site. It shall include periodic audits at intervals mutually agreed upon but at least once every month;

g) To stop any contractor from executing any construction work, which is not in accordance with the principal contractor’s and/or contractor’s health and safety plan or which poses a threat to the health and safety of persons;

h) To ensure that where changes are brought about to the design and construction, sufficient health and safety information and appropriate resources are made available to the contractor;

i) To ensure that every contractor is registered and in good standing with the compensation fund or with a licensed compensation insurer, prior to work commencing on site;

j) To ensure that potential contractors submitting tenders have made provision for the cost of health and safety measures during the construction process;

k) The principal contractor shall discuss and negotiate with the contractor the contents of the contractor’s health and safety plan before final approval of the plan for implementation;

l) The principal contractor shall ensure that a copy of his Health and Safety plan as well as a copy of the contractor’s Health and Safety plan is available;

m) The principal contractor shall hand over a consolidated Health and Safety report to the client upon completion of the construction work;

n) The principal contractor shall compile a comprehensive and updated list of all the contractors on site, the agreements between them and the type of work being done;

o) A principal contractor shall not appoint a contractor, unless he is reasonable satisfied that the contractor which he intends to appoint, has the required competencies and resources to perform the work safely;

5.8 Contractors

a) A contractor shall provide and demonstrate to the principal contractor a suitable and sufficiently documented health and safety plan, based on the relevant /applicable sections of the principal contractor’s health and safety plan;

b) A contractor shall open a Health and Safety file, keep it on site and make it available upon request;

c) Where a contractor appoints another contractor (sub-contractor) to perform work the responsibilities that apply to the principal contractor shall apply to the contactor as if he were the principal contractor;

d) A contractor shall not appoint another contractor unless he is reasonably satisfied that the (sub) contractor he intends to appoint, has the necessary competencies and resources to perform the work safely;

e) Contractors shall co-operate with the principal contractor to enable each of them to comply with the provisions of the act;

f) Every contractor shall provide to the principal contractor any information which might effect the health and safety of any person carrying out work, or any person who might be effected by the work of such a person, or which might effect the Health and Safety plan;

5.9 Health and Safety Plan

a) A health and safety plan is a documented plan which addresses hazards identified and includes safe work procedures to mitigate reduce or control the hazards identified.

b) It will show and describe the assignment of responsibilities, procedures and actions to be taken in the process of implementing and maintaining the health and safety plan.

c) All principal contractors are advised to ensure that they comply with the requirements of CR. 5 (1) and provide the client with a suitable, practical, well-documented and workable health and safety plan for approval. No contractor will be allowed to enter Matimba Power Station before the health and safety plan as well as all requirements and documentation are approved.

d) The client will do regular audits, at least once per month on the principal contractor’s health and safety plan to ensure that each principal contractor’s health and safety plan is implemented and maintained on the construction site.

e) All principal contractors/contractors will ensure compliance with all legal requirements and complete the

checklist (Safety Plan Approval) with all their contractors and present a copy thereof to the risk management department before any commencement of work or access to the site will be allowed. See appendix 1

f) The risk management department will assist the relevant project manager in assessing the Health and Safety plan. The relevant project manager will do the final approval by signing the assessment checklist

g) All principal contractors/contractors may be co-responsible for any non-compliance by any of their contractors.

h) It is of the utmost importance that all principal contractors ensure that the approval of their health and safety plan and health and safety specification requirements are obtained from the client at least two weeks before the commencement date of the contract to avoid any delays due to non compliance. Costs due to delays will be for the account of the principal contractor.

i) The principal contractor will ensure that he approves the health and safety plan and health and safety specifications requirements of all his contractors at least two weeks before the commencement date of his / their contract to avoid any delays due to non compliance.

j) All the required documentation of both the principal contractors and the contractors will be kept in a safety file on site, and will be available for inspection at all times.

k) In terms of the construction regulations the client, principal contractor or contractor will stop the construction work of any principal contractor or contractor who is not working according to the legal requirements or the conditions of the health and safety plan.

l) All principal contractors will be responsible and accountable for their contractors as per the requirements of the Construction Regulations. (CR 5)

m) The health and safety plan shall be based on the requirements of the OHS act as well as information provided by the client.

n) The checklist contained herein as an annexure can be used as a guide to determine the contents of the health and safety plan.

5.10 Health and Safety File

a) The Health and Safety file will contain the documentation as required by the OHS Act as well as the Clients Specifications.

b) This file will be kept on site and will be available at all times to the Client and Department of Labour as per Construction Regulations 5(7).

c) At completion of contract, the Health and Safety file will be included in the consolidated file as per the requirements of the Construction Regulations 5(8) and will be handed over to the Client’s representative (Project leader).

5.11 Notification of Construction Work

All contractors will be responsible to do their own “notification of construction work” to the provincial director.

a) Before carrying out that work, notify the provincial director in writing of the construction work if it includes;

(i) the demolition of a structure exceeding a height of 3 meters; or(ii) the use of explosives to perform construction work; or(iii) the dismantling of fixed plant at a height greater than 3 meters.

b) before carrying out that work, notify the provincial director in writing when the construction work-

(i) exceeds 30 days or will involve more than 300 person days of construction work; and(ii) includes excavation work deeper than 1 meter; or(iii) includes working at a height greater than 3 meters above ground or a landing.

5.12 Risk Assessments (CR7)

a) A risk assessment is a document compiled to show the risks identified and the actions to be taken to eliminate / mitigate all the identified risks and all possible hazards and conditions that can pose a threat to the health and safety of any person.

b) A competent person will be appointed in writing to do all risk assessments.

c) A risk assessment will be compiled for every task to be performed as well as: -

(i) Transportation of passengers and goods.(ii) Site establishment(iii) Use of all equipment

d) No principal contractor / contractor will be allowed to do any work without a proper risk assessment.

e) Every principal contractor / contractor will have a proper risk assessment with his / her arrival at Matimba Power Station. Before commencement of any work, every principal contractor/contractor will adapt his risk assessment to the prevailing hazards and conditions.

f) In terms of the construction regulations a risk assessment will include a: -

(i) Risk identification.(ii) Risk analysis.(iii) Clear and understandable controls to prevent or mitigate risk.(iv) Matrix and rating (to show low, medium and high risk).(v) For all risk assessments reflecting a high risk, a safe work procedure will be compiled.

g) A monitoring plan to show the processes to be followed to ensure that there is compliance to the risk assessment and to determine whether the risk assessment is suitable to ensure safe working practices.

h) A review plan to show the process to be followed to determine under which circumstances a risk assessment will be reviewed to ensure safe working practices.

i) Every principal contractor / contractor will ensure that all risk assessments are training documents and it will be compiled in such a way that all risks and controls are clearly understandable.

j) All risks will be considered and addressed, therefore all risk assessments will be comprehensive (See list of suggestions attached).

k) A training attendance register reflecting the dates of training and the names and signatures of all trainees will be kept in the safety file. See annexure D, Hazard checklist or a list of possible points to consider and include in a risk assessment.

5.13 Letter of Good Standing (CR 4(1) (g))

a) A letter of good standing is the registration certificate issued by the workman’s compensation fund or any other licensed insurer when the insured has complied with all the requirements of the insurer and the requirements of the act.

b) The certificate will reflect the -

(i) Name of the insured company(ii) Expiry date (iii) The registration number.

c) The certificate will be issued without any alterations.

d) No company may do any work without a valid letter of good standing.

5.14 Fall Protection Plan (CR 8)

a) A fall protection plan will be compiled to show the responsibilities and the processes to be followed to ensure that the possibility of a person falling from an elevated position will be eliminated or mitigated.

b) A competent person will be appointed in writing to compile a fall protection plan.

c) The duties of the dedicated employer sec 16(2) (person in charge) the supervisor and the workers will be clearly recorded.

d) The fall protection plan will include: -

(i) a proper risk assessment.(ii) proper training of risk assessment and the fall protection plan by a competent person appointed in

writing.(iii) attendance register which includes the date of training and the names and signatures of all

trainees and will be kept on site and is available for inspection at all times.(iv) maintenance registers as per checklists of the fall protection equipment and fall arrestors will be

kept and inspected by a competent person appointed in writing. A rescue procedure shall be in place.

5.15 Planned Maintenance Inspection Registers and Records.

a) This section will give guidelines for the care and maintenance of equipment in accordance with the statutory regulations and safe work procedures.

b) A competent person, appointed in writing, will carry out the required maintenance inspections at least once a month to ensure that all equipment is safe and in good condition. Records will be kept of all equipment and all inspections must be dated and signed by the inspector. See Annexure C for a listing of where competent persons are required. See Annexure F for a list of equipment and appliances to include in the maintenance system.

5.16 Statutory Appointments

Refer to Annexure C checklist for a listing of required appointments.

a) These appointments are legal documents and are used to appoint competent persons to assist the Employer in executing his duties, and to ensure that all work is done safely and that proper supervision is performed at all times.

b) All required statutory appointments will be done in writing.

c) All persons appointed will be competent persons.

d) An appointment will include the following:

(i) clear reference to the act or regulation under which the person doing the appointment is authorised to do so.

(ii) the date, name and signature of the person doing the appointment.(iii) the area of responsibilities.(iv) the duties to be performed.(v) clear reference to the act or regulation under which the appointee is appointed.(vi) the name of the person appointed.(vii) the date, signature and the acceptance of the person appointed.

e) Any termination of any appointment will be done in writing and a copy placed on file.

5.17 Section 37(2) Agreements

This document is a legal agreement in terms of section 37(2) of the Occupational Health and Safety Act. The agreement is between the client (Eskom Matimba Power Station) and all principal contractors with a direct contract with the client. The agreement will confirm that the appointed person of any company will remain responsible and accountable for his own employees, including any labour hire employees. Have the agreement form completed and signed by the chief executive officer of your company as soon as possible and return it to the relevant project manager for his signature. The relevant project manager will sign the agreement on behalf of the client. The principal contractor and / or the contractor shall make the necessary appointments. The attached checklist will be used to determine the applicability of appointments.

5.18 Contractors Statutory SHE Meetings

Individual Contractors shall hold a Statutory SHE meeting at least once a month. Where a Contractor has Sub-contractors the sub-contractor shall be included in the contractor’s meetings. All appointed SHE Representatives shall be a member of at least one committee and the meeting must be held in accordance with the OHS Act.

5.19 Matimba Power Station She Meetings

During a project a SHE meeting will be held at least once a month under the leadership of the project leader. The following persons shall be members of this committee: Contractor's Competent Persons and SHE Representatives.

5.20 Outages, General Overhaul and Contract Periods.

Every Contractor's appointed SHE representative shall once a week do his inspection as required in terms of the OHS Act. The written inspection report shall be submitted to and discussed at the project leaders SHE meeting.

5.21 Good Housekeeping (CR 25)

a) A place for everything and everything in its place.

b) Contractors shall ensure that, suitable housekeeping is continuously implemented on each construction site, including provisions for the-

(i) proper storage of materials and equipment, and

(ii) removal of scrap, waste and debris at appropriate intervals.

5.22 Buildings and Floors

All buildings / cabins must be of sound construction and must be maintained in good order. Areas in which persons are permitted to be or are required to work, must be kept free of materials, goods and other articles except those necessary for the work process, materials must at all times be stacked properly in demarcated areas. All floors shall be maintained in a clean, slip-free and dry condition and free from protruding objects, nails, splinters, holes or loose boards.

All walkways and storage areas are to be clearly demarcated. Walkways are to be kept free from materials, goods, tools, scaffolding and other articles.

5.23 Walkways and Storage Demarcation

a) Storage areas for materials and equipment shall be established and maintained.

b) Provision must be made for walkways and vehicle traffic.

c) Existing walkways and storage areas must be adhered to.

d) White lines indicate walkways. Yellow lines indicate storage areas.

5.24 Stacking and Storage (CR 26)

Materials must be stored in areas specifically allocated for storage purposes. The height of stacks must not exceed three times the smaller dimension of the underlying base of the stack. Superfluous material and equipment should be stored in the yard and not on site. Scrap and waste materials shall be removed from site on a daily basis. Stacking of articles shall be done in accordance with the general Regulations. The contractor supervisor shall ensure that:

a) a competent person is appointed in writing with the duty of supervising all stacking and storage on a construction site;

b) adequate storage areas are provided;

c) there are demarcated storage areas; and

d) storage areas are kept neat and under control.

5.25 Matimba Environmental Rules

Matimba Power Station is ISO 14001 compliant and it is therefore very important that all contractors performing work at Matimba adhere to the following rules:

a) Provide sufficient storage containers, labelled and depicting general or hazardous waste which shall be stored in a designated area.

b) Hazardous waste shall not be stored for a period of more than 90 days on site.

c) Ensure that all hazardous waste is disposed of at a licensed class H disposal site; a copy of the waste disposal certificate shall be submitted to the project manager.

d) General waste shall be disposed of at the local municipal dump site..

5.26 Mechanical, Electrical and Personal Protection

All dangerous moving parts of machinery must be securely fenced or guarded so that accidental contact with these parts is not possible, i.e. open pulleys, chains, gears, etc.

5.27 Lifting Gear and Lifting Machines, Cranes. Refer OHS Act - Driven Machinery Regulation 18.

a) A competent person must be authorised in writing

b) Equipment must be inspected every three months.

c) Cranes must be inspected at least once every twelve months.

d) A competent person must carry out inspections.e) Every hook must be fitted with a device to prevent accidental unhooking of the load.

f) Slings, chains and ropes must bear a mark indicating the maximum load and serial number.

g) Lifting equipment must be stored in such a manner that damage and unnecessary exposure to the weather is prevented.

h) The latest inspection records must be available on site for verification purposes.

5.28 Cranes (CR 20)

a) Contractors shall ensure that where tower cranes are used- account is taken of the effects of wind forces on the structure;

b) Account is taken of the bearing capacity of the ground on which the tower crane is to stand;

c) The bases for the tower cranes and tracks for rail-mounted tower cranes are firm and level;

d) Tower cranes are erected at a safe distance from excavations;

e) There is sufficient clear space available for erection, operation and dismantling;

f) The tower crane operators are competent to carry out the work safely; and

g) The tower crane operators are physically and psychologically fit to work in such an environment by being in possession of a Medical certificate of fitness.

5.29 Suspended Platforms (CR 15)

A contractor shall ensure that all suspended platform work operations are carried out under the supervision of a competent person who has been appointed in writing, and that all suspended platform erectors, operators and inspectors are competent to carry out their work. The requirements of Construction Regulations 15 shall apply

5.30 Ladders

a) Ladders must be constructed of suitable material of adequate strength.

b) Home made ladders will not be allowed on Site.

c) All ladders shall be prominently identified with the contractor’s name and ladder number.

d) Ladders shall be checked on a monthly basis.

e) Records are to be kept.

f) Register must be available for audit purposes.

5.31 Scaffolding (CR 14)

Every contractor using access scaffolding shall ensure that such scaffolding, when used, complies with the safety standards incorporated for this purpose into these Regulations under section 44 of the Act i.e. SABS 085, SABS 1808 and SABS 1093. A contractor shall ensure that all scaffolding work operations are carried

out under the supervision of a competent person who has been appointed in writing and that all scaffold erectors, team leaders and inspectors are competent to carry out their work.

5.32 Compressed Gas Cylinders

a) Industrial gases must be stored in an isolated and well-ventilated covered area at least 10m away from building or boundary fences.

b) Empty cylinders are to be stored away from full cylinders.c) Cylinders must be stored out of direct sunlight.

d) 2 x 9kg. Dry powder extinguishers shall be placed near the gas store.

e) Equipment must be kept in sound condition at all times.

f) Cylinders must be kept in an upright position at all times, and must be adequately chained or strapped to prevent them from falling over.

g) Valves must be closed when equipment is not in use and each set must be provided with a locking spanner.

h) Handling and storage of gases must be in accordance with the manufacturer specifications and good practices.

i) Flame cutting equipment shall be fitted with flashback arrestors.

j) Hoses are to be free of joints.

k) Clamps shall be used to fit the hoses to fittings.

l) The oxygen and the acetylene hoses shall not be tied together with electrical straps, wire, and insulation tape. Hose clips must be used.

m) Where flame-cutting work is in progress a protective blanket shall be used in such a manner as to protect persons and equipment in areas below.

5.33 Pressure Vessels and Records. OHS Act, Vessels under Pressure Regulations

The latest pressure test certificate will accompany all pressure vessels, e.g. compressors, air containers. The construction of the vessels and their associated equipment shall comply with the relevant OHS Act Regulation.

5.34 Motorised Equipment

The speed limit within the Power Station boundaries is 40 km/h.

a) A contractor shall ensure that all construction vehicles and mobile plants-

(i) are of an acceptable design and construction;(ii) are maintained in a good working order;(iii) are used in accordance with their design and the intention for which they where designed, having

due regard to safety and health;(iv) are operated by workers who- have received appropriate training and been certified competent and

been authorized to operate such machinery; and(v) are physically and psychologically fit to operate such construction vehicles and mobile plant by

being in possession of a medical certificate of fitness;(vi) have safe and suitable means of access;(vii) are properly organized and controlled in any work situation by providing adequate signaling or

other control arrangements to guard against the dangers relating to the movement of vehicles and plant, in order to ensure their continued safe operation;

(viii) where appropriate, are fitted with structures designed to protect the operator from falling material or from being crushed should the vehicle or mobile plant overturn; are on a daily basis inspected prior to use, by a competent person who has been appointed in writing and the findings of such inspection is recorded in a register.

d) A contractor shall furthermore ensure that:

(i) no person rides or be required or permitted to ride on any construction vehicle or mobile plant otherwise than in a safe place provided thereon for that purpose;

(ii) every construction site is organized in such a way that, as far as is reasonably practicable, pedestrians and vehicles can move safely and without risks to health;

(iii) all construction vehicles and mobile plant left unattended at night, adjacent to a freeway in normal use or adjacent to construction areas where work is in progress, shall have appropriate lights or reflectors, or barricades equipped with appropriate lights or reflectors, in order to identify the location of the vehicles or plant;

(iv) bulldozers, scrapers, loaders, and other similar mobile plant are, when being repaired or when not in use, fully lowered or blocked with controls in a neutral position, motors stopped and

brakes set;(v) whenever visibility conditions warrant additional lighting, all mobile plant are equipped with at least

two headlights and two taillights when in operation;(vi) tools and material are secured in order to prevent movement when transported in the

same compartment with employees;(vii) safety belts shall be worn.(viii) passengers will not be allowed to sit on the sides of Lorries or pick-ups. Persons will not be

allowed to ride in the bucket of front-end loaders, or as passengers on dumpers, tractors, cranes, forklifts, etc.

5.35 Driving Inside the Plant

a) Driving inside the Power Station plant is only allowed when equipment needs to be loaded/unloaded, vehicle lights and hazards shall be switched on during this time.

b) The speed limit of 10 km/h shall not be exceeded.

c) No parking is allowed inside the plant except when offloading equipment; vehicles shall not be left unattended.

5.36 Hand tools

All tools on site, including privately owned tools, must be kept in sound condition at all times. All tools shall be inspected on a regular basis by supervisors.

5.37 Electrical Protection

5.37.1 Definition:

All equipment fed through a flexible cable from a plug point-220, 380 or 500V, this would include welding machines, power tools, extension cables, etc. All portable electrical equipment shall be suitably numbered. A register shall be kept. All portable electrical equipment shall be inspected once a month and the results entered into the register.

a) The inspection shall include:

(i) damaged or joined cables plugs.

5.37.2 Earth leakage relays

Earth leakage relays - portable or permanently fixed - must be provided and tested on a regular basis. Records shall be kept.

5.37.3 General Electrical Installations

a) These must be inspected once a month by a competent person appointed in writing for:

(i) polarity of wall sockets(ii) earth continuity(iii) open switchboards(iv) damaged extension leads(v) broken switches etc.

b) The results of above inspections must be entered into a suitable register.

5.37.4 Electrical Installations and Machinery on Construction Sites (CR 22)

Notwithstanding the provisions contained in the Electrical Installation Regulations promulgated by Government Notice No.R.2920 of 23 October 1992 and the Electrical Machinery Regulations promulgated by Government Notice No. R.1953 of 12 August 1988, respectively, as amended, a contractor shall ensure that-

a) Before construction commences and during the progress thereof, adequate steps aretaken to ascertain the presence of and guard against danger to workers from any electrical cable or apparatus which is under, over or on the site;

b) All parts of electrical installations and machinery are of adequate strength to withstand the working conditions on construction sites;

c) In working areas where the exact location of underground electric power lines is unknown, employees using jackhammers, shovels or other hand tools which may make contact with a power line, are provided with insulated protective gloves or otherwise that the handle of the tool being used is insulated;

d) All temporary electrical installations are inspected at least once a week and electrical machinery on a daily basis before use on a construction site by competent persons and the records of these inspections are recorded in a register to be kept on site; and

e) The control of all temporary electrical installations on the construction site is designated to a competent person who has been appointed in writing.

5.38 Personal Protective Equipment

a) The contractor’s employer shall issue his employees on site with approved personal protective equipment.

b) The equipment shall be worn where required and where it is indicated by symbolic safety signs.

c) Personal protective equipment shall include, but will not be restricted to, the following:

(i) head protectors(ii) eye and face protection e.g. grinding, flame cutting (iii) footwear(iv) respiratory equipment e.g. dusty areas(v) hand protection e.g. material handling(vi) hearing protection e.g. grinding, drilling(vii) safety harness .e.g. when working in elevated positions. (viii) protective clothing e.g. overalls(ix) personal protective equipment shall be maintained in a good and clean condition.

d) PPE Shall:

(i) be checked on a regular basis.(ii) be replaced when necessary.

(iii) records of issue shall be kept.

6. FIRE PREVENTION

6.1 PRECAUTIONS ON CONSTRUCTION SITES (CR 27)

a) Subject to the provisions of the Environmental Regulations for Workplaces promulgated by Government Notice No.R.2281 of 16 October 1987, as amended, every contractor shall ensure that-

(i) all appropriate measures are taken to avoid the risk of fire;(ii) sufficient and suitable storage is provided for flammable liquids, solids and gases;

(iii) smoking is prohibited and notices in this regard are prominently displayed in allplaces containing readily combustible or flammable materials;

(iv) in confined spaces and other places in which flammable gases, vapors or dust cancause danger-

(v) only suitably protected electrical installations and equipment, including portablelights, are used;

(vi) there are no flames or similar means of ignition;(vii) there are conspicuous notices prohibiting smoking;(viii) oily rags, waste and other substances liable to ignite are without delay removed to a

safe place; and(ix) adequate ventilation is provided;(x) combustible materials do not accumulate on the construction site;(xi) welding, flame cutting and other hot work are done only after the appropriate

precautions as required have been taken to reduce the risk of fire;(xii) suitable and sufficient fire-extinguishing equipment is placed at strategic locations

or as may be recommended by the Fire Chief or local authority concerned, and that such equipment is maintained in a good working order;

(xiii) the fire equipment contemplated in paragraph (g) is inspected by a competentperson, who has been appointed in writing, in the manner indicated by the manufacturer thereof;

(xiv) a sufficient number of workers are trained in the use of fire- extinguishingequipment;

(xv) where appropriate, suitable visual signs are provided to clearly indicate the escaperoutes in the case of a fire;

(xvi) the means of escape is kept clear at all times;(xvii)there is an effective evacuation plan providing for all persons to be evacuated

speedily without panic;(xviii) persons to be accounted for, and(xix) plant and processes to be shut down; and(xx) a siren is installed and sounded in the event of a fire.

b) All employees are conversant with the meaning of all alarms at Matimba Power Station.

6.2 Use and Temporary Storage of Flammable Liquids on Construction Site (CR 23)

Notwithstanding the provisions for the use and storage of flammable liquids as determined in the General Safety Regulations promulgated by Government Notice No.R1031 dated 30 May 1986, as amended, a contractor shall ensure that-

a) where flammable liquids are being used, applied or stored at the workplace concerned, this is done in such a manner that a fire or explosion hazard is not caused, and that the workplace is effectively ventilated: Provided that where the workplace cannot effectively be ventilated-

(i) every employee involved is provided with a respirator, mask or breathing apparatus of a type approved by the chief inspector, and

(ii) steps are taken to ensure that every such employee, while using or applying flammable liquids, uses the apparatus supplied to him or her;

b) no person smokes in any place in which flammable liquids are used or stored, and such contractor shall affix a suitable and conspicuous notice at all entrances to any such area prohibiting smoking;

c) flammable liquids on a construction site are stored in well-ventilated fire resistant containers, cage or room and kept locked with proper access control measures in place;

d) an adequate amount of efficient fire-fighting equipment is installed in suitable locations around the flammable liquids store with the recognized symbolic signs;

e) only the quantity of flammable liquid needed for work on one day is to be taken out of the store for use;

f) all containers holding flammable liquids are kept tightly closed when not in actual use and, after their contents have been used up, are removed from the construction site and safely disposed of;

g) where flammable liquids are decanted, the metal containers are bonded or earthed; and

h) no flammable material such as cotton waste, paper, cleaning rags or similar material are stored together with flammable liquids.

6.3 Fire Alarm (CR 27)

Contractor employees shall be made aware of the meaning of Matimba power station alarms, how to report a fire, where to report it and what to do in case of a fire.

7. Occupational Hygiene

Occupational hygiene factors and stresses are those that can affect a person after a long period of time e.g. noise, dust etc.

7.1 Noise

a) All employees who are exposed to noise must be educated and made aware of the harmful effects of long-term exposure to noise.

b) They must be provided with approved hearing protection where necessary and record must be kept of such issues.

c) Noise areas must be demarcated with the appropriate signboards. The following areas should be considered, e.g. where compressors, jackhammers, explosive tools, riveting tools, etc. are used.

7.2 Heat

a) When employees are working in hot conditions, clean cool drinking water must be accessible to them.

b) Employees must be made aware of the dangers of heat exhaustion/stroke and the signs and symptoms of impeding heat collapse.

c) Frequent and extended rest periods must be provided in accordance with the Occupational Health and Safety Act.

7.3 Illumination

a) Adequate and sufficient illumination is essential and where it is insufficient the contractor must make additions to ensure safe-working conditions at all times.

b) Ensure that all roof lights, light fittings and fanlights are kept clear and unobstructed.

c) When use is made of artificial lighting where machinery is being used all moving parts must be clearly visible.

d) Illumination provided must be so designed to avoid glare, reflections and stroboscopic effects.

7.4 Hazardous Chemical Substances

7.4.1 Refer to OHS Act, Hazardous Chemical Substances Regulations:

When any chemical substances are brought onto site, Matimba Safety Risk Management must be provided with the following information:

a) A list of all the substances

b) A material safety data sheet (MSDS) for the specific substances

c) Training records showing what training the employees have received

d) Handling and storage of chemicals must be according to the Manufacturers specifications.

e) Persons handling the substances must be trained in its uses, dangers and precautions

f) Adequate precautions must be taken when toxic substances are used, e.g. notices posted, demarcation and warning signs.

g) Personal protective clothing must be provided and employers must ensure its correct usage and compliance with recognised code.

h) Adequate measures must be taken to remove gasses generated from the working environment.

7.4.2 Dust / Asbestos

All employees must be made aware of the inherent dangers of dust. Employers must take such measures as may be necessary to decrease the generation of dust and post warning signs.

The use of thermal Insulation Materials containing Asbestos is not allowed at Matimba. Where any process necessitates the breaking up, grinding, pulverising, crushing or cutting of Asbestos cement products the Project Leader must be notified immediately of the quantity and location.

Where employees are exposed to dusts such as Silica, Asbestos Cement, Fibreglass etc. adequate protective clothing and appliances must be provided.

8. Injury/Accident Reports and Investigation

8.1 Incident Recording

In addition to the reporting of incidents as required in terms of the Occupational Health and Safety Act and Compensation for Occupational Injuries and Diseases Act, each disabling accident shall be reported to Matimba Outage/Project management and the Occupational Health Nurse. Reporting of disabling injuries (which includes fatal accidents) must be done immediately. First Aid and medical treatment injuries must be reported to the Occupational Health Nurse as soon as possible. Incidents such as fire and damage must also be reported to Matimba Safety Risk Management. The responsible person, or a person appointed by him, must do reporting of all incident/accidents.

Every Contractor will be in possession of an Accident Register as required by the OHS Act and must acquaint himself with the contents of Section 24 of the OHS Act (Reportable Incidents) by the investigating party involved. A copy of this form must be sent / forwarded to Matimba Outage Management or relevant project leader within 24 hours. The highest authority in the Contracting Company concerned shall sign fatal and permanent total disability investigation forms. The following incidents/accidents must be investigated. (Refer Section 24 of OHS Act)

8.3 Fatal Injuries, Disabling Injuries and Medical Treatment Injuries.

A committee appointed by the Outage Manager or project leader will, (in addition to any other investigating body) investigate the incident.

The persons to attend these investigations will be:

(i) the Eskom Risk Manager(ii) the Eskom Projects Manager(iii) the Project Manager / Leader(iv) the Project Safety Officer(v) the Contracting CEO(vi) the Contracting Designated Employer (Section 16 (2))(vii) the Contractors Supervisor(viii) the Contractors Safety Officer and Health and Safety Representative(ix) all witnesses(x) any other person who is requested by the Risk Manager / Project Manager to do so.

8.4 Occupational diseases

Incidents that may cause / caused occupational diseases must be brought to the attention of Matimba Safety Risk Management who will conduct an investigation.

NOTE: IT REMAINS THE RESPONSIBILITY OF THE CONTRACTOR TO REPORT ANY REPORTABLE INCIDENT TO THE DEPT. OF LABOUR

9. SHE Organisation

9.1 INDUCTION TRAINING (CR 7)/MATIMBA POWER STATION GENERAL INDUCTION

All contractors will undergo the Matimba safety induction before an access permit will be issued. This induction does not replace the contractors own compulsory induction training or exempt any employer from his responsibilities or accountabilities.

9.2 Contractors Specific Induction Training

a) All contractors will have a well-documented induction syllabus.

b) Induction training is given to all new employees to inform them of what the company health and safety rules are, as well as the hazards related to their work. Refer to the risk assessment.

c) A competent person will be appointed in writing to do training.

d) Induction training will be valid for one year and should be given to all employees at least once a year.

e) An attendance register will include the date of training and the names and signatures of all trainees. The training register will be kept on site and be available for inspection at all times.

f) All persons that received induction training will carry proof of such induction on his person at all times when at work.

g) The Responsible Person shall ensure that all of his employees are made aware of the contents and requirements of this procedure. Records of this induction shall be kept.

h) The Employer/Designated Employer/Construction Supervisor shall provide proof of training for his employees with respect to:

(i) Risk Assessment results(ii) Safe Work Procedure(iii) Health and Safety Plan(iv) Company internal Health and Safety Induction.

9.3 Medical Examination (CR8 (2) (b), CR 20(g) and CR 21(1) (d))

The OHS Act 16(2) Designated person / Construction Supervisor 6(1) shall ensure that all the employees under his control undergo a medical examination as contemplated in the Occupational Health and Safety Act. All employees shall have a “man-job specification” that will accompany them when they go for their medical examination; this document forms the basis for compiling a worker's occupational risk exposure profile and is to be included in the worker's personal medical record for the prescribed period. Employees who are required to carry out work on a “suspended platform”, or who have to work from an “elevated position” or employees who operate “construction vehicles” shall undergo a “physical and psychological” evaluation.

9.4 Toolbox Talks

a) Toolbox talks are to be held on a daily basis to create a better awareness of risks attached to the job, safety measures and their precautions.

9.5 First Aid Facilities

a) Every contractor shall have on site a first-aid box that is equipped as required by the OHS Act

b) Every contractor will comply with the requirements of the OHS Act, General Safety Regulations 3, regarding First Aid boxes. Matimba provides a fully equipped First Aid Station and Ambulance under the supervision of qualified Occupational Health and Nursing Assistants. In serious cases contractors can make use of this facility.

9.6 Work Permits, Lock-Out Procedures, Safe Work Procedure (CR7(4)

a) All supervisors of contracting companies who are directly involved with Eskom’ Permit to Work system shall be trained and on successful completion of Matimba’ authorisation evaluation process, be authorised as Responsible Persons.

b) The Responsible Person shall ensure that:

(i) the conditions of permits are strictly adhered to.(ii) that lock-out procedures, mechanical as well as electrical, are strictly adhered to and any

deviations are corrected immediately.(iii) that safe work procedure as laid down by Matimba Power Station and as determined by

the risk assessment shall be followed.(iv) the workers register is discussed daily with workers and that their names appear on the

register.9.7 Exemptions

a) The legal requirements as laid down in the Occupational Health and Safety Act shall be adhered to.
