THE COMMISSION ON RESTITUTION OF LAND RIGHTS (CRLR) 2012/13(CLAIMS IN FREE STATE, KWAZULU NATAL, MPUMALANGA AND LIMPOPO)

•As requested by the Select Committee on Land and Environmental Affairs (National Council of Provinces) the presentation will indicate progress on outstanding claims in Free State, KwaZulu Natal, Limpopo and Mpumalanga.

•The presentation will also indicate the budget projections for the respective offices for the 2013/14 financial year.

THE COMMISSION ON RESTITUTION OF LAND RIGHTS (CRLR) 2012/13(CLAIMS IN FREE STATE, KWAZULU NATAL, MPUMALANGA AND LIMPOPO)

• The Commission on Restitution of Land Rights received approximately 25 965 land claims in respect of Free State, KwaZulu Natal, Limpopo and Mpumalanga.

• Since inception the Commission has settled 24 332 claims and finalized 10 444 claims.

• In the 2012/13 financial year a total of 218 claims were settled (i.e. Ministerial approvals in terms of Section 42D) and 170 claims were finalized (i.e. this is where awards were fully paid up and properties transferred).

• It should also be noted that the number of outstanding claims is not the variance between 25 965 (approximate lodged) minus 24 332 (settled) which equates to 1 633 claims, as the settled claims is a combination of claim forms and rights.

• From the counting process that was undertaken last year, the provisional total for outstanding claim forms is 5 623. The respective offices are currently unpacking in terms of rights claimed on the claim forms.

Note the following•As indicated in the settled claims (24 332) as well as the finalised claims (10 444) consist of a combination of claim forms and rights restored.• The discrepancies in terms of the variance with lodged, settled and finalised claims would only be resolved once the unpacking process of claim forms lodged and rights on claim forms has been finalised. However , this process will need dedicated full-time capacity to deal with it both regionally and nationally.

• The total outstanding claims in respect of the abovementioned provinces is 5 623 as at 31 March 2013.•In the 2012/13 financial year 218 claims were settled and 20 claims were dismissed. •The total outstanding as at 31/03/2012 minus settled claims as at 31/03/2013, minus dismissed claims as at 31/03/2013 gives a total outstanding of 5 623 claims as at 31 March 2013 for the respective provinces.
