BRAND COMPLIANCETHE FTC IS WATCHING

Influencer marketing is now more important than ever for brands to understand the rules, and landscape that govern. If you want to advertise in the influencer space and avoid legal head-aches, understanding the legal landscape ensures long term success and can be a critical part of your overall strategy. We make sure you’re entire campaign is compliant from beginning to end.

The FTC prohibits deceptive advertising, and requires any paid endorsements to be publicly and explicitly stated. Advertisers may face legal discipline if they fail to comply, so it is manda-tory for all RAD partnered brands and participating influencers to include compliant disclo-sures.

A major retail brand paid more than 50 social media influencers to post pictures of themselves wearing the same dress from their new collection. After failing to disclose that they had given each influencer the dress and thousands of dollars for their endorsement, the FTC investigated, issued a consent agreement, and hit the brand with fines.

One of the top entertainment brands paid high- profile influencers thousands of dollars to post positive reviews for a new game release without disclosing, which resulted in an FTC investigation, issued consent agreement, and fines.

A large scale music festival paid celebrity influencers to promote the festival without disclosing. After the festival failed to live up to audience expectations that were advertised, the festival’s organizers and 100 social media influencers were called out in the press and hit with a $100 million class action lawsuit.

WHY SHOULD I CARE?

Failing to comply with FTC disclosing guidelines may result in the FTC knocking on your door and serving you with charges. Since it’s safe to assume this would not be the most ideal way to spend a afternoon, paying attention to the rules helps avoid unneeded headache overtime.

In April 2017, the FTC sent warning letters to 90 influencers regarding failure to appropriately disclose. Non-compliant advertising is often seen as deceptive and can be damaging to brand reputation and trust.

These rules are strictly enforced.
