9.0 FINDINGS
This Phase I ESA was prepared in accordance with ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process Designation: E 1527-13, 40 CFR Part 312 Standards and Practices for All Appropriate Inquiries: Final Rule, U.S. Housing and Urban Development (HUD) Multifamily Accelerated Processing Guide, as amended, and accepted Phase I ESA industry standards. This assessment has revealed the following findings based on the subject property inspection, interviews, and review of available records:

10.0 OPINION
Based on the findings of this Phase I ESA, the following observed conditions are not considered a REC or an environmental concern to the subject property: Stored Hazardous Materials
No bulk storage of hazardous materials or petroleum products was identified at the subject property. However, paints and cleaning products are stored in the maintenance areas. None of the stored materials were observed to be leaking or to have had signs of major spillage. No floor drains or other potential receptors for the release of hazardous materials were observed within the areas of material storage. The on-site chemicals are commercially available, stored in limited quantities, and are not believed to present an environmental concern to the subject property.

PCBs One (1) hydraulic trash compactor is also located on the subject property. It is not known whether the trash compactor contains regulated levels of PCBs; however, based on the subject property structure’s date of construction (1985), the hydraulic oil is not suspected to contain regulated levels of PCBs. In addition, leakage was not observed at the time of the subject property visit. Therefore, the trash compactor is not believed to present environmental concerns to the subject property.
In addition, one (1) hydraulic elevator is located on the subject property. It is not known whether the hydraulic elevator equipment contains regulated levels of PCBs; however, based on the subject property structure’s date of construction (1985), the elevator equipment is not suspected to contain regulated levels of PCBs. In addition, leakage was not observed at the time of the site visit. Therefore, the elevator and the associated equipment are not believed to present environmental concerns to the subject property.
On-site AST
Located at the subject property is an approximately 50-gallon diesel aboveground storage tank (AST) which is utilized to fuel the fire suppression system. The AST was located over bare ground attached to the western side of the subject property structure and was observed to be in good physical condition. Based on observed subject property conditions, the diesel AST is not suspected to present an environmental concern to the subject property. In addition, according to HUD guidelines, ASTs with a capacity of less than 100 gallons are not subject to 24 CFR Part 51.
Underground Mine According to the West Virginia Geological and Economic Survey (WVGES) Interactive Mining Map accessed at http://ims.wvgs.wvnet.edu/All_Coal/viewer.htm, an underground mine named Minden No. 4 & 5 in the Sewell coal bed has been or is currently located under the subject property. D3G submitted a FOIA Request to the West Virginia Department of Environmental Protection (WV DEP) – Division of Mining and Reclamation on April 3, 2013 to obtain additional information pertaining to the mine. According to an e-mail response from Mr. Dustin C. Johnson, Environmental Resource Specialist III, the Minden No. 4 and 5 mine that underlays the subject property ceased mining sometime in the mid-1950s. It was owned by the now obsolete New River & Pocahontas Coal Company. This is a pre-Surface Mining Control and Reclamation Act (SMCRA) mine and there is little information on the actual mine available within the Division of Mining and Reclamation and Abandoned Mine Lands files. The mine itself encompassed 1,579.18 acres. The mine is below drainage and inundated as part of the local Sewell Seam Mine Pool. Mr. Johnson stated that there are no known environmental issues with the mine. Based on the fact that the mine has not been operational since approximately the mid-1950’s and the fact that there are no known environmental issues associated with the mine, the on-site former mine is not suspected to present environmental concerns to the subject property.

11.0 CONCLUSIONS
Dominion Due Diligence Group performed a Phase I Environmental Site Assessment (ESA) in conformance with the scope and limitations of ASTM Practice E 1527-13 of the Twin Oaks Plaza located at 201 Oak Hill Avenue in Oak Hill, Fayette County, West Virginia (subject property). Any exceptions to, or deletions from, this practice are described in Section 2.4 of this report. This assessment has revealed no evidence of recognized environmental conditions (RECs) in connection with the subject property.
12.0 DEVIATIONS
There are no deviations from the ASTM standard Phase I ESA except for those outlined in Section 2.4 of this report.
13.0 ADDITIONAL SERVICES
No additional services were contracted between the User and D3G.
