CLARIFICATION The Hon’ble Supreme Court (Bench of Hon. 7 judges) has delivered a judgment on 12/8/2005 in Civil Appeal No.5041/2005 in SLP (C) No.9932/2004 in respect of ‘rights and entitlement’ of Government as against Private Professional Educational Institutions (including Private Medical Colleges conducting graduate & postgraduate medical and dental courses). This judgment expects enactment of legislation by Central Government and in its absence, by State Government in this regard. This process has been initiated. However it is not certain, as of this date, as to when such legislation will come into force, as also its provisions. In the meanwhile, in terms of the observations of the Hon’ble Supreme Court from the aforesaid judgment, at least at this stage, it appears that State Government cannot claim any quota/seats in these colleges/institutions and consequently cannot effect admissions in these Private Medical Colleges/institutions, except to the extent agreed to with certain institutions.

It is therefore made clear that on the aforesaid interpretation and advice given to the State Government, this Brochure will not apply to the admissions to be effected in the academic year 2007-2008 at the Private Medical Colleges/Institutions, in so far as postgraduate courses are concerned, with the above exception. However, it is made expressly clear that if, after issuance of this Brochure, either on account of any legislation or on account of any different interpretation/opinion/advice or due to any judgment/order passed by any court of law or even otherwise, the State Government is found entitled to any seat(s) in the Private Medical/Dental Colleges/Institutions and consequently entitled to effect the admission(s) to such seat(s), the rules and regulations set out in this Brochure will be made applicable to such seat(s) and admission(s). In such event, a separate intimation will be issued with appropriate details. It is also made hereby clear in no uncertain terms that the same ‘Common Entrance Test’ that is proposed to be conducted in terms of this Brochure will govern such admission(s), if any.

POST-GRADUATE COURSES (MD/MS/DIPLOMA)

1. INTRODUCTION: The selection for the post graduate courses is being carried out in accordance with the rules and orders issued by Government from time to time and on the basis of directions / decisions given by Hon’ble Court in various court cases. 1.1 This procedure will be called as “Procedure for selection and admission to

medical postgraduate courses at the State Government Medical Colleges / Brihanmumbai Municipal Corporation Medical Colleges / Tata Memorial Hospital and all other Private Medical Colleges / Institutions who opt for admission to PG courses through PGM-CET 2007 (Annexure H).

1.2 This procedure is applicable for PGM-CET for admissions for the year 2007-2008. No promise is implied therein for subsequent years and no expectations should be based on this procedure for future.

2. DEFINITIONS of important terms are given in Annexure “A”. 3. COMPETENT AUTHORITY: The Government of Maharashtra vide Government Resolution No.PGM-

1006/2742/CR-301/06/Edu-2, dated 20th September 2006 has appointed Director, Medical Education and Research (DMER), Mumbai as the Competent Authority for conduct of PGM-CET-2007, selection and admission to Medical Postgraduate Courses. The Competent Authority will supervise and control the selection process by implementing these procedures through the PGM-CET Cell /Designated Authorities.

The Competent Authority will issue necessary executive instructions for implementation of these procedures and provide relevant information to be published or communicated. The Competent Authority will declare time-table, details of the dates of various processes relating to selection procedure. e.g. sale /receipt of forms, date of entrance exam, date of counselling, etc.

4. DESIGNATED AUTHORITY: For the purpose of implementation of these procedures following authorities

will act as Designated Authorities.

The Designated Authority will be responsible to carry out the instructions given by the Competent Authority in respect of selection and admission process for postgraduate medical courses. The Designated Authorities may associate other officials to assist them in the selection and admission process.

5. APPELLATE COMMITTEE: Appellate committee will consist of following members:

i) Competent Authority & Director, Medical Education & Research (DMER), Mumbai - Chairperson

ii) Joint Director (Medical), DMER Office, Mumbai iii) Dean, Grant Medical College, Mumbai

The appeal in ordinary course shall lie against allegedly arbitrary decision or violation of prescribed rules by PGM-CET cell, Designated Authority or their representatives.

The appeal/representation should be submitted through Designated Authority with one advance copy to Competent Authority, within 48 hours of cause of action, by aggrieved party.

6. LIST OF MEDICAL POSTGRADUATE COURSES:

6.1 The list of medical postgraduate Degree/Diploma courses is given in Annexure-“B”.

6.2 The seats available for admission to medical postgraduate courses through PGM-CET will be from State Government, Brihanmumbai Municipal Corporation (BMC) Medical Colleges, Tata Memorial Hospital and all other Private Medical Colleges / Institutions who opt for admission to PG courses through PGM-CET 2007.

6.3 The seats available for admission to medical postgraduate courses through PGM-CET-2007 are exclusive of All India Entrance Examination quota and in-service quota, as decided by concerned Authorities.

6.4 The institute wise availability of the seats will be decided as per Postgraduate Regulation of Medical Council of India (MCI) and MUHS, Nashik.

6.5 The seat position will be given in the preference form filling information brochure and will be displayed on the website of DMER (www.dmer.org).

6.6 Postgraduate seats left unfilled in an academic year, shall not be carried forward to the next or subsequent academic year. The last date of joining MD/MS/Diploma courses is 31st May 2007 as per the guidelines of MCI, New Delhi issued pursuant to the orders of the Hon’ble Supreme Court of India in W.P. No.5166/2001, MCI V/s Madhu Singh & Others, followed by W.P. (C) No.306/2004, Mridul Dhar V/s UOI and Others. The academic year will start from 2nd May 2007 as per MCI guidelines.

6.7 The seats available will be filled in on the basis of State Level Merit in PGM-CET. There will be no regional reservation. There will be reservation in these seats as per Government orders issued from time to time (Annexure "C & D").

7. ELIGIBILITY CRITERIA FOR PGM-CET-2007 FOR MEDICAL POST-GRADUATE

COURSES: 7.1 Candidate must be an Indian National. Nationality Certificate issued by

District Magistrate or Additional District Magistrate or Chief Metropolitan Magistrate or valid passport shall constitute the proof of nationality.

7.2 Following candidates, who have passed final M.B.B.S. examination and completed one year internship training from a recognized medical college (Annexure F) included in the Schedule of the Indian Medical Council Act, 1956 and situated in Maharashtra, affiliated to Non-Agricultural Universities established under Maharashtra Universities Act, 1994 or the Maharashtra University of Health Sciences Act, 1998 and who have obtained permanent registration either from the Medical Council of India or

Maharashtra Medical Council (MMC) will be eligible to appear for PGM-CET for Postgraduate degree or Diploma courses subject to fulfillment of following conditions.

7.2.1 For candidates who have passed final MBBS from Government/Corporation Medical Colleges:- a) Candidates who have passed final MBBS before November/December

2004 and completed internship are eligible. b) As per Government Resolution No.MED-1006/CR-5/06/Edu-2 dated

31/7/2006, the candidates who have passed final MBBS exam in November/December 2004 from Government / Municipal Corporation Medical Colleges and completed internship and (i) will be completing 4 months of Government Service before PGM-CET 2007 Entrance Examination OR (ii) have paid stipulated bond amount to Government.

c) Candidates who have passed final MBBS after November/December 2004 and completed internship by end of September/October, 2006 will have to serve the Government/Corporation for one year OR pay the stipulated bond amount to the Government.

d) The candidates who have passed final MBBS examination after November/December 2004 and have not completed their internship by end of September/October 2006 (i.e. those candidate who are not covered by clause (c) above) and are likely to complete the same by 31st March 2007 are eligible to apply for appearing at PGM-CET 2007 subject to the condition that candidate will have to pay the stipulated bond amount to the Govt. before submission of application form for PGM-CET 2007. It is clarified that if such student is not inclined to pay the stipulated bond amount to the Govt. but is inclined to undertake one year Govt. service as contemplated by the aforesaid Govt. Resolution dated 31st July 2006, then in that event, such candidate will have to FIRST complete 1 year Govt. service and then appear at the next PGM-CET 2008.

7.2.2 The candidates who have passed final MBBS examination from Private Medical Colleges and completed/completing internship by 31st March 2007 are eligible.

7.2.3. To be eligible for In-service PGM-CET and admission, the candidates must fulfill the criteria laid down by the Public Health Department for M.M.&H.S. Medical Officer candidates and E.S.I.S. candidates; and Brihanmumbai Municipal Corporation for BMC candidates.

7.3 Application forms of the In-service candidates shall be received by the following Authorities of the respective circles. The applications will be scrutinized by them and shall be submitted with remarks to the office of Directorate of Health Services, Mumbai. The forms of eligible candidates should then be submitted to the Competent Authority. For BMC candidates, the forms of eligible candidates should be submitted to the Competent Authority by the concerned office of BMC; and for ESIS candidates by the office of the Commissioner, ESIS, and Mumbai.

7.4 The MCI / MMC registration is mandatory for appearing at PGM-CET, of

which proof should be enclosed. 7.5 Candidates, who were admitted to the colleges / institutions which are now

affiliated to the Maharashtra University of Health Sciences, Nashik (MUHS) will be eligible till such time as they are awarded the degree by the University established under Maharashtra Universities Act, 1994.

7.6 Those candidates who have passed the Final MBBS Examination from conventional non Agricultural Universities of Maharashtra /MUHS, Nashik will be eligible to appear for PGM-CET-2007.

The candidate who has obtained MBBS degree from Deemed University is not eligible to appear for PGM-CET-2007.

7.7 The candidates who are domiciled in Maharashtra and who have obtained admission under 15% quota for All India Entrance Examination (AIEE) for MBBS course and who have obtained the degree from a University situated outside the State of Maharashtra will also be eligible for PGM-CET-2007. Such candidates should submit (i) certificate from the Dean of respective college stating that the candidate was admitted under 15% AIEE quota for MBBS course, and (ii) certificate of Domicile of Maharashtra.

7.8 The candidate belonging to Backward Class must have claimed so in his application form, failing which such a claim will not be entertained subsequently. The candidate belonging to Backward Class Category should submit the certified copies of Caste Certificate, Caste Validity Certificate and Non-Creamy Layer Certificate (wherever applicable) along with the application form.

7.9 The candidates belonging to DT(VJ) (A), NT-1(B), NT-2(C), NT-3(D), OBC and SBC categories should have Non-Creamy layer certificate issued by appropriate authority on or after 1/4/2006 (as per Government Resolution No.lhchlh 10$2006$iz-dz-15$ekod] fnukad 30$6$2006)-

7.10 The candidate admitted for MBBS course in reserve category on the basis of Court order for Caste claim is required to submit Caste Validity Certificate given by the Caste Scrutiny Committee. If the matter is still pending with Hon'ble Court, candidate should submit a fresh Court order for PGM-CET 2007, failing which the claim will not be granted and the candidate will be considered as Open category candidate.

7.11 Candidates who have completed terms for postgraduate diploma course or would be completing terms by 31/3/2007 will be eligible for PGM-CET for admission to postgraduate degree registration in the same subject only. Candidates completing term of PG Diploma course after 31/3/2007 will not be eligible for PGM-CET-2007.

7.12 Non-eligibility of Candidate The following candidates are not eligible for applying / appearing at PGM-

CET 2007 as the case may be: 7.12.1 Candidates who have passed Final MBBS exam from institute located

outside Maharashtra, except candidates who are Domicile of Maharashtra and selected under 15% AIEE quota (Ref. Rule 7.7).

7.12.2 Candidates who are not completing internship on or before 31st March 2007.

7.12.3 Candidates who have not obtained permanent MMC /MCI registration. 7.12.4 Candidates who have obtained MBBS degree from Deemed University. 7.12.5 Candidates who had been admitted to PG course under previous PGM-

CET and resigned / left /not joined which resulted in lapse of a seat. 7.12.6 Candidates who are previously registered and are pursuing / have

completed the PG degree course or have obtained PG degree. 7.12.7 Candidates who are registered for PG diploma and have not completed

the terms. 7.12.8 Non-Compliance of BOND as per GR. No. Med-1006/CR-5/06/edu-2

dated 31/07/2006. 8. APPLICATION FORM AND FEES FOR EXAMINATION:

8.1 An applicant seeking admission to the PGM-CET will be required to submit single prescribed application form (which includes submission of manual form with attested copies of certificates and the computerised form). The Competent Authority shall issue prescribed application form alongwith information Brochure containing procedures for admission to postgraduate courses.

8.2 The information Brochure and Computerised Application Form will be available for sale at all Notified centres (Annexure E) from 01/12/2006 to 14/12/2006 and should be submitted in person at any notified center from 01/12/2006 to 15/12/2006, excluding Sundays and State Government Holidays.

8.3 The cost of the Information Brochure along with Computerised Application Form of PGM-CET 2007 and the examination fee is Rs.1800/- to be paid by a Demand Draft / Pay Order drawn on any scheduled commercial bank in favour of the “Director, Medical Education & Research, Mumbai” payable at Mumbai. This amount is not refundable.

8.4 PGM-CET-2007 will be conducted at Mumbai, Pune, Aurangabad and Nagpur centres. Candidate can choose the centre for examination as per his choice and indicate the same in application form. Such choice once exercised will be final and binding.

8.5 Original documents / certificates should not be attached with the application form.

8.6 Candidates should submit (i) Computerised Application form (separate) & (ii) Manual Application form along with attested photocopies of certificates.

8.7 The manual application form should be accompanied by attested photocopies of following certificates.

(i) Nationality Certificate / Valid Passport (ii) Certificate of Age (SSC passing Certificate / Valid Passport) (iii) First M.B.B.S, Statement of Marks. (iv) Second M.B.B.S. Statement of Marks. (v) Final M.B.B.S. Statement of Marks (Part- I & Part - II). (vi) M.B.B.S. Degree / Passing Certificate (vii) Attempt Certificates of University Examinations (First, Second, Third [

Part-I, Part-II ] MBBS) (viii) Internship Completion Certificate / Certificate indicating likely date of

completion of Internship from the Dean. (ix) Registration Certificate (MMC/ MCI) (x) Bonafide Certificate from the Dean/Principal

(xi) Certificate stating that the candidate is serving for 4 months issued by DDHS or bond release certificate issued by DMER (as per rule 7.2.1).

If applicable (xii) Caste Certificate (xiii) Caste Validity Certificate. (xiv) Non-Creamy Layer Certificate (for DT (VJ)-[A], NT-1[B], NT2[C], NT3[D],

OBC & SBC Candidates) issued by appropriate authority on or after 1/4/2006 in the name of the parent as specified in the Government Resolution No.CBC-1094/CR-86/MVK-5, dated 5th June, 1997 and No.CBC-1094/CR-86/OBC-5, dated 6th June, 2000 and CBC-10/2006/CR-15MVK-5, dated 30th June, 2006. Candidate must submit non-creamy layer certificate along with manual application form, failing which the claim of reservation will not be granted and the candidate will be considered as OPEN merit candidate.

(xv) (a) Domicile Certificate of Maharashtra State in case of Candidates who were Domicile of Maharashtra State at the time of MBBS admission and were admitted under 15% AIEE quota outside Maharashtra State and who have obtained their degree from a University situated outside the State of Maharashtra.

(b) AIEE selection letter / letter from Dean/Principal stating that the candidate was admitted for MBBS under 15% quota for All India Entrance Examination.

8.8 Candidates should submit (i) Computerised Application form (separate) and manual application form with required certificates (ii) In-service candidates should submit Manual Application form with relevant certificates as prescribed by the concerned Authorities (DHS, ESIS & BMC) in addition to Computerised application form.

8.9 Candidate should keep one photocopy of his/her duly filled in Computerised Application form with him/her for future reference and should bring the same at the time of filling the Preference form.

8.10 Candidate should preserve the (i) Receipt of purchase of application form, (ii) receipt-cum-identity card, (iii) Information Brochure for subsequent use.

8.11 Application forms of the candidates (other than In-service candidates) shall be received by the Notified Centres. The applications will be scrutinized by them and shall be submitted with remarks to the Designated Authority of their respective region. The for ms of eligible and ineligible candidates should be submitted in two separate bundles to the Competent Authority. The notified centers (Annexure-E) will be responsible for sale, receipt of application form, scrutiny and determining the eligibility.

8.12 The Notified Centres (Annexure-E) will submit the application forms to the Competent Authority.

Admit Card: 8.13 The Admit Cards will be issued at the Notified Centers where the candidate

has submitted his/her application form, from 10/1/2007 to 20/1/2007. 8.14 Issue of Admit Card is merely an enabling document for appearing at the

PGM-CET and does not imply that the candidate satisfies all the requirements of eligibility conditions of admission.

8.15 In case of loss of Admit Card, it shall be obligatory on the part of candidate to procure duplicate Admit Card by paying fees of Rs. 500/- from the office of the concerned center in charge not later than 1 hour before the commencement of examination, on production of Receipt-cum-Identity Card/sufficient evidence to prove that he/she is the genuine/bonafide examinee.

9. CONDUCT OF PGM-CET:

9.1 All eligible candidates are required to take the PGM-CET at their own cost. 9.2 The PGM-CET-2007 will be conducted on Sunday, 21st January 2007, Time:

10.00 a.m. to 1.30 p.m. No entry will be permitted to the candidate in the examination hall after 10.00 a.m. for any reasons whatsoever.

9.3 The PGM-CET will be conducted at Mumbai, Pune, Aurangabad and Nagpur Centers.

9.4 The examination will be conducted in English Medium. 9.5 PGM-CET paper will be of 3 1/2 hours duration containing 300 multiple choice

questions (MCQs). Questions will be of single best response objective type with four answer options. Each correct response shall be awarded one mark. There shall be no negative marking for wrong answers. Scratching, overwriting, tick mark, and multiple answers will be considered as wrong answers and no marks will be awarded to them.

10. DECLARATION OF RESULT AND PREPARATION OF STATE MERIT LIST: 10.1 The Competent Authority shall conduct PGM-CET, evaluate the answer-

sheets and prepare the State Merit List (SML). 10.2 The Competent Authority will prepare a State Merit List (separate merit list

for In-service candidates) indicating number, name, category, category merit number, marks scored by the candidate. The same will be made available at the Designated Authorities and merit list of In-service candidates will be made available at the office of the Directorate of Health Services, Office of the Employees State Insurance Scheme and Brihanmumbai Municipal Corporation and also available on the Website of DMER “www.dmer.org”.

10.3 The statement of marks of the candidate will be dispatched by post/courier on 9/2/2007.

10.4 In case of any typographical error in Marksheet, regarding name, age, gender, category etc., representation for correction should be submitted to the Competent Authority within five days from the date of declaration of result.

10.5 The candidate who wants duplicate Mark-sheet will have to apply to the Competent Authority with fees of Rs.200/- (Rupees Two Hundred only) which shall be paid by Demand Draft in favour of “Director, Medical Education & Research, Mumbai” payable at Mumbai drawn on any Scheduled Commercial bank.

10.6 There will be no rechecking / revaluation of the answer sheets. However the candidate can apply for verification of marks to the Competent Authority by 19/2/2007 in prescribed form (Annexure ‘G’) along with fees of Rs.1,000/- (Rupees One Thousand only) to be paid by Demand Draft in favour of “Director, Medical Education & Research, Mumbai” payable at Mumbai and drawn on any scheduled commercial bank. The candidate will be given photocopy of the answer sheet and model answer key after verification by Speed Post.

10.7 Final Merit List will be declared on 28/2/2007 on the website of DMER. 11. STATE MERIT LIST:

11.1 The Competent Authority will prepare a State Merit List of eligible candidates on the basis of the marks obtained by the candidate at the PGM-CET-2007.

11.2 To be eligible for selection to medical Postgraduate courses a candidate belonging to open category must secure not less than 50% Marks and candidate belonging to backward class category must secure not less than 40% Marks at PGM-CET-2007.

11.3 TIE-BREAKER: Determination of the Inter-se-merit of candidates obtaining

equal PGM-CET marks. In case of two or more candidates obtaining equal marks in the PGM-CET-

2007, the inter-se-merit of such candidates will be determined in the order of preference as under:

11.3.1 The candidate with higher aggregate marks (converted into percentage) at First, Second and Third M.B.B.S. Examination (Part-I & II) taken together shall be preferred. If the tie still persists,

11.3.2 The candidate with higher aggregate marks (converted into percentage) at Third M.B.B.S. Examination (Part-I & II) will be preferred. If the tie still persists,

11.3.3 The candidate with higher aggregate marks (converted into percentage) at Second M.B.B.S. Examination will be preferred. If the tie still persists,

11.3.4 An older candidate will be preferred over a younger candidate. 11.3.5 While considering I, II, III MBBS marks and aggregate for above

purpose, grace marks and / or NSS marks will not be taken into account.

11.4 TIE-BREAKER (for In-service candidates): Determination of the Inter-se-merit of candidates obtaining equal marks.

In case of two or more candidates obtaining equal marks in PGM-CET, the inter-se-merit of such candidates will be determined in the order of preference as under :

11.4.3 An older candidate will be preferred over a younger candidate. 12. SELECTION PROCESS:

12.1 The selection to a course / college will be made considering his/her State Merit List Number and preferences given by the candidate. Candidates as per State Merit List (SML) Number will be called for counselling and asked to fill the preference form. Counselling will be carried out at Govt. Medical Colleges of Mumbai, Pune, Aurangabad & Nagpur. Counselling sessions are not meant for instant seat allocation at these offices. During these sessions, candidates are assisted in exercising their preferences for various courses and the institutions. Seat allocation shall be made centrally at a later date on the basis of PGM-CET-2007 State Merit List (SML) and preferences exercised by the candidates.

12.2 Selection Process shall be as follows: 12.2.1 The candidate should submit only one preference form. Submission of

more than one form may lead to disqualification. The preference form shall be available at the office of the Designated

Authority, i.e. Grant Medical College Mumbai, B.J.Medical College Pune, Govt. Medical College Aurangabad & Govt. Medical College, Nagpur. The duly filled preference form should be submitted at the office of the Designated Authority where candidate has appeared for PGM-CET 2007 as per the schedule, which will be notified.

12.2.2 The availability of postgraduate seats as per course, college and category will be provided in the information brochure for filling of Preference form and on website ‘www.dmer.org’. The selection will be on the basis of merit and the preferences submitted by the candidates in their preference form. For filling of vacant seats after first round, same preference form will be considered and no separate preference form will be required to be filled by the candidate.

12.2.3 The candidates who have filled the preference form, but are not selected in the first round, are eligible for vacant seats in the subsequent rounds.

12.2.4 For reserved category candidates: Ear-Marking - Reserved category candidate entitled to admission on the basis of merit in an open category seat will have the option of taking admission either against his / her respective category seat or on an open `category seat. If he / she opts for the reserved category he / she will be deemed to have been admitted as an open category candidate and not as reserved category candidate. One seat in the college where he / she was eligible for admission against open seat shall be earmarked for a candidate belonging to the respective reserved category. Such earmarked seat will be made available immediately to the successive reserved category candidate from the same category merit.

12.2.5 Based on preferences given, the seats will be allotted on merit and the allotment will be displayed on website of DMER i.e. ‘www.dmer.org’ and at the office of Designated Authorities.

12.3 Documents: The candidates must produce original certificates at the time of filling the

Preference form / Counselling and a set of attested photocopy of each of the documents, as per the list given (Rule 8.7).

NOTE: In case of dispute during counselling, the Competent Authority may verify following documents, therefore candidates should also bring these documents at the time of counselling:

12.4 At the time of filling the Preference form the candidate should bring all original documents and a set of attested copies of the same in support of claim made in application form i.e. Caste Certificate, Caste Validity Certificate issued by Caste Scrutiny Committee. If the matter is still pending with Hon'ble Court, candidate should submit a fresh Court order for PGM-CET 2007, failing which claim will not be granted and the candidate will be considered as Open Category candidate.

12.5 Canvassing directly or indirectly for the allotment of seat would disqualify the candidate for admission. Influencing the staff by unfair means, will lead to cancellation of allotted seat and such candidate will also face disqualification for appearance in the subsequent PGM-CET.

12.6 The registration once granted is valid only if the teacher and the Dean are satisfied about regularity, diligent pursuance of studies by the student as well as good conduct.

12.7 Candidate selected for admission shall be subject to disciplinary rules of Institution, MUHS Nashik, and State Government.

12.8 A candidate selected for postgraduate course will not be allowed to change subject / college / institute on mutual basis as per the MCI rules / MUHS regulations as may be applicable.

12.9 In case of dispute in the matter of allotment of seat / course / institution or any other matter pertaining to the provisional selection or cancellation of admission, the decision of the Competent Authority shall be final and binding.

12.10 Status Retention of Admission: After selection in first/subsequent rounds, if the candidate desires to retain the same selection (subject & college) and does not want to take any further betterment, then he can do so by filling ‘Status Retention Form’ (Annexure-I) in the prescribed Proforma within specified period after selection, which will be notified along with selection list. ‘Status Retention Form’ is to be submitted to the Competent Authority through the college where he is admitted. However candidate should note that his name will be deleted from the further selection process for the academic year 2007-2008 (Please refer rule 13.3 before filling status retention form).

12.11 Legal Jurisdiction: All disputes pertaining to the conduct of examination and selection process shall fall within the jurisdiction of courts in Mumbai only.

13. PROCESS FOR FILLING VACANT SEATS

13.1 The Competent Authority will issue notification of round(s) in the news papers, which will also be displayed on notice boards of all Notified Centers and on DMER website indicating the dates of subsequent selection process.

13.2 After concluding the first round for the further round(s) candidates who

have been allotted seat(s) in the earlier round(s) as also the candidate(s) who have not been allotted any seat, will be eligible. In the subsequent round(s), betterment chance(s) will be given to the candidate(s) who have already been allotted seat(s).

It is hereby made abundantly clear that shifting on account of a better choice given by a candidate in any round, will be effected only and only if such a candidate in the subsequent round(s) is found entitled for 'change of course' or a 'change of college'. Mere possibility of a 'change in category' on account of availability of seat in the same college and/or same course in the further round(s) will not amount to "betterment" as such and therefore, no shifting will be effected in such an eventuality. Such a 'change in category' will include inter-alia change from reserved category to open category or vice-versa. The shift in such betterment shall be compulsory and mandatory, except as provided in Rule No.12.10.

13.3 Final round (By Personal Counseling): There shall be a final round for allotment of seats remaining vacant

after completion of the earlier rounds of allotment of seats by way of preference forms. This final round of allotment of seats shall be conducted by way of personal counseling instead of allotment on the basis of preference forms.

On account of allotment of seats in this final round of admission, no fresh vacancies consequent upon allotments made in this round will be created. This is principally because this final round of allotment is meant to fill in (as far as possible all) available vacant seats without creating a new or fresh vacant seat on account of such allotment.

At this round, eligible candidates will appear personally, seeking allotment of seats of their choice. The personal counseling for such allotment will be held strictly in the order of merit. Each candidate will be offered all seats that have remain vacant and are available for allotment, only at the time of his/her turn of counselling i.e. State Merit List position.

The following candidates will not be eligible for being considered for allotment of seat in this round:-

a) The candidate(s) who have joined the postgraduate course in terms of allotment made to such candidate(s) in the earlier round of this admission process and have also submitted ‘Status Retention Form’ in terms of aforesaid Rule 12.10.

b) The candidate(s) who have joined the postgraduate course in terms of allotment made to such candidate(s) in the earlier round of this admission process but have not submitted ‘Status Retention Form’ in terms of aforesaid Rule 12.10, provided that such candidate relinquishes the seat so allotted and accepted by the candidate by resigning strictly on or before 13/05/2007. It is hereby made expressly clear that if such candidate(s) who have joined, do not relinquish the seat by resigning under any circumstances on or before 13/05/2007, such a candidate will be held ineligible.

c) The candidate(s) who have been allotted seat(s) in the earlier rounds of this admission process but who have not reported to the college and / or not paid the entire requisite amount of fees strictly within the time stipulated for such payment and / or have not fully complied with the entire process of taking admission within the time stipulated for the same.

d) The candidate(s) whose admission(s) have been cancelled by the concerned Dean/Principal of the College at which such admission has been granted on account of disciplinary action.

It is hereby clarified that all such candidates to whom no allotment of any seat was made in the previous rounds of this admission process, shall be expressly eligible for being considered for an allotment of a seat in this round.

The preferences given by all the candidates who are eligible for being considered for allotment of seats in this round by way of preference forms submitted in this admission process will stand cancelled and the allotment shall be made in this round without reference to such preferences on the basis of choice made on the spot by the candidate at the time of personal appearance counseling.

All the candidates to whom the seats will be allotted in accordance with the choice and available seats at his/her merit position at the time of personal counseling, during the course of this round will be required to join the concerned college and complete all necessary formalities requisite for taking admission accordingly within the prescribed time.

It is made hereby clear that in case such a candidate does not join the concerned College and / or fails to comply with the necessary formalities of the admission within the prescribed time, such a candidate shall not be eligible for appearing at immediately next PGM-CET conducted for grant of admissions to post-graduate courses in the state of Maharashtra i.e. PGM-CET 2008.

13.4 Candidates may resign on or before 13/05/2007 to be eligible for next PGM-CET.

14. THE CONDITIONS TO BE SATISFIED BY CANDIDATE AFTER SELECTION:

14.1 A candidate will have to pay the prescribed fees (i.e. tuition + deposit + others). He/she should deposit all relevant original certificates / documents in the concerned institution.

14.2 The candidate will have to work as a Resident, under the Residency scheme, prescribed vide GR No.MED-1059/2116/CR-10/96/EDU, dated 31st Jan. 1996 as amended from time to time.

14.3 All selected candidates will have to submit DD/Pay order of Rs.650/- drawn on any scheduled commercial bank in favour of “Competent Authority, MH-CET” payable at Mumbai for Amartya Shiksha Yojana as per GR.MED /100/880 /CR-129/Edu-1, dated 13/10/2003.

15. CANCELLATION AND REFUND:

15.1 Candidate who has confirmed his/her admission may cancel it by submitting an application to the concerned Dean.

15.2 Candidate cancelling his/her admission on or before 13/5/2007 will be eligible for subsequent PGM-CET.

15.3 Refund of fees by the college after change of college, course or cancellation of admission: a) On or before 13/5/2007 Rs. 1000/- (Rs. One Thousand only) to be

deducted and rest of the fees to be refunded. b) After 13/5/2007 - No refund.

15.4 If a candidate expires or becomes an invalid within 3 months from the date of admission, full refund shall be made.

15.5 The refund will only be made after 3 months from the date of application for refund. No correspondence shall be entertained by Competent Authority in this matter.

16. CONDUCT AND DISCIPLINE:

16.1 Failure of the candidate in making full and correct statements in the application form and/or suppression of any information would lead to

disqualification of the candidate, even at later date. Such a candidate will be debarred from the entire selection process.

16.2 It is responsibility of every candidate to submit proper documents. Any attempt to submit documents which are not genuine will lead to cancellation of the admission of the candidate, forfeiture of the fees, deposits and expulsion of the candidate from the college by the Competent Authority or by his authorised official. The name of such candidate/s shall be deleted from the State Merit List and he/she will not be eligible for further rounds of the selection process and will be debarred from the selection process. If deemed fit even criminal proceeding may be initiated by the Competent Authority against such candidates / their parents.

16.3 If any candidate / authorised representative or person accompanying is found obstructing the counselling and / or admission process, or trying to influence in unlawful manner/ creating nuisance, the candidate shall be liable for disqualification from the process of selection. The decision taken by the Competent Authority in this respect shall be final and binding.

16.4 All candidates selected for admission shall be subject to the disciplinary rules of the Institution, MUHS, Nashik and Government.

17. BOND:

17.1 Candidate selected for postgraduate course should complete Junior residency tenure, failing which he/she will be required to pay Rs.1,00,000/- (i.e. for non completion of Junior residency tenure). However, this is not applicable to the candidates of PGM-CET-2007 resigning the PG registration before 13/5/2007.

17.2 Candidate will be required to give a bond of Rs.15 Lakhs supported by two sureties, to serve Govt. of Maharashtra/Corporation/Defence Services for a period of 3 years. If the candidate fails to render the services as stipulated above, the amount noted in the bond will be recovered.

18. Any issue not dealt here-in above will be dealt with, when arising, fully and

finally by the Competent Authority.

Annexure “A”

DEFINITIONS

Unless the context otherwise requires,

a) “Appropriate Authority” means the Government of Maharashtra. b) “Approved Institution” means the hospital, health center, affiliated college or

such other institution recognised by the MCI and MUHS, Nashik as an institution in which medical postgraduate courses are available.

c) ‘Central Government’ means the Government of India. d) ‘Competent Authority’ means the authority appointed by the Government for

the purpose of conduct of common entrance test for selection and admission to medical postgraduate courses.

e) ‘Course’ means 3-years degree course leading to MD / MS degrees and/or two years diploma course in various subjects.

f) ‘Designated Authority’ means authority responsible to carry out the instructions given by the Competent Authority in respect of selection and admission process for postgraduate medical courses.

g) ‘Government’ means the Government of Maharashtra. h) ‘Internship’ means the compulsory rotating internship to be completed as per

rules of Medical Council of India (MCI) and concerned University. i) ‘Medical Council of India (MCI)’ means the Medical Council of India

established under Indian Medical Council Act, 1956. j) ‘Notified Center’ means the center responsible for Sale of Application forms

and information brochure, receipt of application form and determining the eligibility of the candidates.

k) ‘PGM-CET Cell’ means the cell constituted for the purpose of conduct of PGM-CET and selection process for postgraduate courses.

l) ‘Postgraduate Teacher’ means a medical teacher who is recognised as a postgraduate teacher under the regulation of the Medical Council of India (MCI), by MUHS, Nashik.

m) ‘Recognised Qualification’ means the qualification recognised by the Medical Council of India (MCI) and the University in the State of Maharashtra and in case of in-service candidates, a Statutory University in India.

n) ‘Registration’ means the registration of the qualification either with the Medical Council of India (MCI), Maharashtra Medical Council (MMC) or State Medical Council after completing One Year compulsory rotating internship.

o) ‘Reservation’ means the reservation prescribed by the Government for admission to medical Postgraduate Courses which includes both Constitutional Reservation for the Backward Classes & other reservations if any.

p) ‘University’ means the non agricultural Universities constituted under the Maharashtra University Act, 1994 and/or MUHS constituted under MUHS Act, 1998.

q) 'BMC' means Brihanmumbai Municipal Corporation, Mumbai r) 'DHS' means Directorate of Health Services, Mumbai s) 'DDHS' means Deputy Director of Health Services t) 'ESIS' means Employees State Insurance Scheme

CONSTITUTIONAL RESERVATIONS 1) The candidates recognized by the State of Maharashtra as belonging to the

following Backward Classes, shall alone be eligible to claim admissions as against the seats reserved for such backward class categories. These Backward Class categories are as follows:-

4) The Caste/Tribe validity Certificate issuing Authorities are as follows:- a) For Candidates belonging to Scheduled Caste, Scheduled Caste converts to

Buddhism, Vimukta Jati, Nomadic Tribes1,2&3 and Other Backward Class, Caste Validity Certificate is issued by Divisional Caste Certificate Scrutiny Committee of respective Divisional Social Welfare Office (Konkan, Pune, Nashik, Aurangabad, Amravati and Nagpur).

b) For Candidates belonging to Scheduled Tribe the Tribe Validity Certificate is issued by Director/Deputy Director, Tribe Certificate Scrutiny Committee of respective Region (Konkan, Pune, Nashik, Aurangabad, Amravati and Nagpur).

5) The candidate should have claimed the constitutional reservation in the original application form. The candidate claiming constitutional reservation must submit original caste validity certificate at the time of counseling for filling preference form, failing which the category claim will not be granted.

6) NON-CREAMY LAYER A candidate belonging to ‘Creamy Layer’ amongst the categories (C) to (G) must

note that the provision of reservation is NOT applicable to him/her. A candidate claiming benefit of reservation under the categories (C) to (G) above will be required to produce Non-Creamy Layer Certificate in the name of parent as specified in the Government resolution No. lhchlh 10$2006$iz-dz-15$ekod] fnukad 30$6$2006). The certificate should have been issued on or after 1st April 2006. The Non-Creamy Layer Certificate is issued by Sub-Divisional Officer/Deputy Collector/Collector of the district.

However, such a Non-Creamy Layer Certificate shall be produced in any case at the time of filling up of Preference Form, failing which the category claimed will not be granted.

Applicants belonging to Special Backward Class N.B.: Hon’ble High Court Mumbai had stayed admission to SBC category as a separate quota and therefore, vide Government Circular from Social Welfare, Cultural Affairs and Sports Department No. CBC-1095/WS/264/BCD-5 dated 24th October 1995, the persons belonging to Special Backward Class (SBC) are to be considered as OBC candidates.

7) Inter-se amongst the reserved categories will be operated at the end of each admission process against the unfilled reserved categories seats as per merit and choice of the reserved categories candidates.

The seats remaining vacant from various categories will be filled in during inter-se admission process as follows:

a) From among the candidates of their respective group from the Interse State Merit List of that particular group where the vacancies exist.

The groups are as follows - GROUP - I

(i) Scheduled Castes and Schedule Caste converted to Buddhism (S.C.) 13% (ii) Scheduled Tribes including those living out-side specified area (S.T.) 7%

candidates of all the categories mentioned above from the all categories combined merit list.

(c) If the seats still remain vacant then the seats will be filled from among the candidates of the common merit list.

8) Ear-Marking : Reserved category candidate entitled to admission on the basis of merit in an open category seat will have the option of taking admission either against his / her respective category seat or on an open category seat. If he / she opts for the reserved category he / she will be deemed to have been admitted as an open category candidate and not as reserved category candidate. One seat in the college where he / she was eligible for admission against open seat shall be earmarked for a candidate belonging to the respective reserved category. Annexure "D" Physically Handicapped (PH)

1) As per Govt. letter NO. MED-1006/CR-72/06/Edu-2, dated 07/03/2006, three percent of the total available seats in Health Science courses at Government /Corporation /Govt. aided colleges are reserved for the physically handicapped candidates. As per MCI guidelines letter NO.MCI-34(I)/2003-Med/11773, dated 14/07/2003, the physically handicapped candidates should have "locomotory disability of lower limbs ranging between 50-70% only". The Candidate with a disability more than 70% will not be eligible for admission to Health Sciences (Post Graduate) Courses. No other disability shall be allowed as per the MCI guidelines. However, such a candidate will be required to undergo medical examination by a Special Medical Board constituted for this purpose by the Competent Authority. The Medical Board after ascertaining his/her disability must be satisfied that the candidate is physically fit to undergo the course despite his/her disability.

2) Candidate is required to submit the proof of his/her disability by way of a certificate in prescribed proforma from Civil Surgeon of a District Hospital/Medical Board/Medical Superintendent of a Government Medical College/Hospital in Maharashtra; or from the Director of All India Institute of Physical Medicine and Rehabilitation, Haji Ali, Mumbai; (as per Prescribed Proforma) at the time of verification of disability. Verification of the disability will be carried out by Special Medical Board constituted for this purpose by Competent Authority. The date and place of Special Medical Board shall be communicated to the concerned candidates telegraphically and by the way of notification on the website i.e. www.dmer.org

01. Candidate must preserve the Receipt-Cum-Identity Card and Admit Card and bring to the examination hall and produce the same on demand by invigilator / supervisor.

02. Candidate should occupy the seat in the examination hall at least thirty (30) minutes before the commencement of the examination.

03. Details such as seat number, question paper booklet number and version code number must be entered carefully on the answer sheet. The answer sheet no. & the seat No. must be entered carefully on the Question Booklet.

04. Under any circumstances, no candidate will be allowed to enter the examination hall after 10.00 a.m.

05. No candidate will be allowed to leave the examination hall till the end of examination.

06. In case of the loss of Admit Card, it shall be obligatory on the part of the candidate to procure duplicate Admit Card from the concerned centre in charge not later than one hour before the commencement of examination, on production of sufficient evidence to prove that he / she is the genuine / bonafide examinee (Receipt-Cum-Identity card issued by the College Authority).

07. All entries on answer sheet must be made only with Black ballpoint Pen.

08. Photograph on application form and Receipt cum-Identity card should be taken from the same negative.

09. Please note that issue of admit card is just an enabling provision for appearing PGM-CET 2007 and does not imply that the candidate satisfies all the requirements of eligibility conditions of admission.

10. Please arrange the documents as per the order mentioned on the receipt of enclosures as per 8.7 along with the manual application form.

11. Please quote your application form number in further correspondence.
