"shopping trolley" means a vehicle used or designed for use bycustomersof shopsfor thepurposeof transportinggoodsandmerchandise;"

after By-law 3-"3A An animal that is securedin any portion of a public placewhereinanimalsmay lawfully besecuredis not obstructingfor the purposesof theseBy-laws unless it is so securedfor any period exceedingeight 8 hours.3B A vehicle other than a shopping trolley, that is parked in any portionof a public placewhereinvehiclesmay lawfully beparkedis not obstructing,for the purposesof these By-laws, unless it is so parked for any periodexceedingtwenty four 24 hours, without the consent in writing of theClerk of the Council.3C A shopping trolley left in a public place is not obstructing, for thepurposesof theseBy-laws, unless it is so left for any periodexceedingthree3 hourswithout the consentin writing of the Clerk of the Council.

3. By-law 11 is amendedin paragraphb by deleting the words "the sum of$5.00 per day for eachday or part of a day that the vehicle hasremainedin theappointedplace;and uponpaymentof that costandcharge,theClerkif satisfiedthat thepersonis the owner of thevehicle or is a personentitledto possessionof thevehicle, shall permithim to removeit." andsubstitutingtherefor-"in the caseof a shopping trolley a chargeof $2.00 per day or in the caseof any other vehicle a chargeof $5.00 per day, for eachday or part of a daythat the vehicle has remainedin the appointedplace."

4. The By-laws are amendedby addingthe By-law immediately after By-law11-"hA Upon paymentof the cost and chargereferred to in By-law 11, theClerk, if satisfiedthat the personis the owner of the vehicle or is a personentitled to possessionof the vehicle, shall permit him to removeit."

5. By-law 15 is deletedand substituting the following-"15. A personcommitting any breachof this By-law or failing to complywith any requirementsof the By-law commits an offence shall be liable toa penalty not exceeding$50 for every day during which the breach iscontinued.

By-law Relating to Trading in Public Places

In pursuanceof the powersconferred upon it by the abovementionedAct andof all other powersenablingit, the Council of the abovementionedMunicipalityrecords having resolved on the 23 August 1989, to make and submit forconfirmation by the Lieutenant-Governorand Administrator the followingBy-law.

In this By-law, unlessthe context otherwiserequires-

"Community Association" meansan institution, association,club, society,or body, whether incorporated or not, the objects of which are of acharitable, benevolent, religious, cultural, educational, recreational,sportingor other like natureandthe membersof which arenot entitledor permitted to receive any pecuniary profit from the transactionsthereof;

"Council" meansthe Municipality of the City of Wanneroo;

"Public Place" includesastreet,way and placewhich thepublic areallowedto use, whether thestreet,way or placeis or is not on privateproperty;

"Trading" meansselling or hiring of goods,wares,merchandiseor services,or offering goods,wares,merchandiseor servicesfor saleor hire, in astreet or other public place and includes displaying goods, wares ormerchandisefor the purposeof offering them for saleor hire, invitingoffers for sale or hire, soliciting orders or carrying out any othertransactionstherein, but doesnot include the setting up of a stall, orthe conductingof businessat a stall, under the authority of a licenceissuedunderBy-laws madeunder section 242.

2. This By-law shall not apply to the selling or offering for sale of newspapersor magazinesunlessthey are sold or offered for sale from a stall.

3. No personsshall carry on trading in any public place unlessthat personsis actingin accordancewith the specificationsof a current licenceincludingthe conditionsthereofissuedunder this By-law andfor which all fees andchargeshavebeen paid.

4. An application for a licence or renewal of a licence shall be in writing inthe form set out in the First Schedulehereto and be accompaniedby theapplication fee.

5. In consideringan application for a licence or renewal of a licence, theCouncil shall have regardto-a any relevantpolicy statements;

b the desirability of the proposedactivity;

c the location of the proposedactivity; and

d the circumstaocevof the case.

6. The Council may grart the licerce or renewal,or may refuseto grant thelicence or renewal and it may so refuseon any of the following grounds-

a that the applicant has committed a breach of any provision of thisBy-law;

b the applicant is not a desirable or suitablepersonto hold a licence;

c theneedsof the Municipal District of the Council or theportion thereoffor which the licence is soughtareadequatelycateredfor by establishedshopsor be personsto whom licenceshavebeenissued; or

d such other groundsas may be relevant in the circumstances.

7. The Council may issue a licence specifying such requirements,terms andconditions as in the opinion of the Council are appropriateincluding-

a the place to which the licence applies; which in the event of mobiletradersmay include a pre-determinedapprovedroute or area;

b the days and hours when trading may be carried on;

c the number, type, form and construction,as the case may be, of anystand, table, structure or vehicle which may be usedfor trading;

d the particulars of the goods or servicesor transactionsin respect ofwhich trading may be carried on;

e the number of personsand thenamesof personspermittedto carry ontrading, and any requirementsconcerningpersonal attendanceat theplace of trading and the nomination of assistants, nominees orsubstitutes;

g any prohibitions or restrictionsconcerningthe causeof any nuisance,the useof signs, the making of noise andthe useof amplifiers, soundequipment,sound instruments and lighting apparatus;

h any requirementsconcerningthe display of the licence holder’s nameand other details of the licence;

i the care, maintenanceand cleansingof the place of trading;

j the vacating of the place of trading when trading is not taking place;

k any requirementsregarding the acquisition by the licence holder ofpublic risk insurance;

1 the period not exceeding12 months during which the licence is valid;m designationof any place or places wherein trading is totally or from

time to time prohibited by Council.

8. A licence shall be in or substantially in the form set out in the SecondSchedule.

9. Chargesand fees shall be calculatedand payablein accordancewith theThird andFourth SchedulesheretoandnotwithstandingCouncil’s approvalof the issueof a licencesuch licenceshall not be valid until the appropriatefees havebeenpaid.

10. The Council may revoke a licence in the event that the licence holderbreachesany provision of this By-law or fail to comply with any requirement term or condition of a licence.

11. Wherea licenceis revokedthe Councilshall if requestedprovide the licenceholder with reasonsin writing and shall refund the chargehaving firstdeductedthechargeapplicableto the period from the issuingof the licenceto its revocation.

12. Any personwho contravenesor fails to comply with any provision of thisBy-law commits an offenceandis liable on conviction to a penalty for eachoffence of not more than $1 000 or imprisonment for six months.

13. Notwithstandingthe provisionsof Clauses3 and7 a licencemaybe validlyissuedto a community associationnotwithstanding that it is exempt fromthe paymentof appropriatefees and chargesand a community associationmay validly carry on trading under avalid licence issuedunderthis By-lawwithout having paid all fees and chargesfor that licenceprovidedthat thetrading carried on by the community associationis for the purposesof thatCommunity associationand for no other purposeandin the eventthat thetrading is not for thosepurposesthen the community associationshall beliable to pay all chargesandfeeswhich it would haveotherwisebeenliableto pay under this By-law.

Objects from Land.In pursuanceof the powersconferredupon it by the abovementionedAct, andof all other powers enabling it, the Council of the Shire of Tammin herebyrecordshaving resolvedon the 21st day of April 1989, to make and submit forconfirmation by the Lieutenant-Governorand Administrator the followingBy-laws-1. In theseBy-laws-

"Council" meansthe Tammin Shire Council."District" meansthe District of the Shire of Tammin.

2. If there is-a On any vacant land within the district any trees,scrub, undergrowth

or rubbish; or

b on any land within the district any refuse, rubbish, disusedmaterialsor unsightly items/objectswhetherof the samekind or a different kindfrom that here specified;

which in the opinion of the Council is likely to affect adverselythe valueof adjoining property, or the health, comfort or convenienceof the inhabitants thereof, the Council may causea Noticeunder the hand of the ShireClerk to be served on the owner or occupier of such land requiring him,within the time specified in such Notice, to clear the land of such trees,scrub,undergrowth, or removesuch refuse, rubbish, disusedmaterials orunsightly items/objectsfrom such land;

3. If thereis on any land whethervacant or occupiedwithin the district anyderelict motor vehicle, or vehicle body or old machinery which, in theopinion of the Council, is likely to adversely affect the value of adjoiningproperty or the health, comfort and convenienceof the inhabitants thereof,the Council may causea Notice under the hand of the Shire Clerk to beservedon theowner or occupierof suchland requiring him, within the timespecified in such notice, to remove such vehicles, vehicle bodies ormachineryfrom suchland.

4. Where the owner or occupierdoes not clear the land of such trees, scrub,undergrowth,or removesuch refuse, rubbish, disusedmaterials,unsightlyitems/objects,derelict motor vehicles,vehicle bodies or old machinery, theCouncil may,without paymentof any compensationin respectthereof,clearand remove it and disposeof it at the expenseof, and recoverin a courtof competentjurisdiction the amount of the expensesfrom, the owner oroccupier to whom the Notice was given.

5. Every owner or occupierof landupon whom a Notice hasbeenservedunderBy-laws 2 or 3 of theseBy-laws shall comply with such Notice within thetime specified therein or in that time give satisfactory reasonwhy thematerialsshould be retainedor be given extra time in which to comply. Anypersonwho fails to comply with the terms of any noticeservedundertheseBy-laws commits an offence, and on conviction shall be liable to a penaltynot exceeding five hundred dollars $500.00 and a daily penalty notexceedingfifty dollars $50.00 for eachday on which the offence occursafter the expiry of the Notice.
