OsmoseAustraliaPtyLtd(ABN75088260575)(Osmose)guaranteestothepersonwhoownsthebuildingorotherstructure(Owner)intowhichtreatedtimber,manufacturedbyanindependentlyownedandoperatedwoodpreservingfacilityauthorisedbyOsmose(Manufacturer)andtreatedbytheManufactureronlywithTimberPreservativesuppliedbyOsmose(Treated Product)isfirstincorporated(Property),that:

FortherelevantGuaranteePeriod,theTreatedProductwillresistinsectactivityand/orfungaldecay(inaccordance withtheResistanceLevelcorrespondingwiththerelevantTimberPreservativewithwhichtheTreatedProductwas manufacturedandtheHazardClassforwhichtheTreatedProductwasmanufactured)causingdamagethatwould maketheTreatedProductStructurallyUnfitforthepurposeforwhichitwasfirstacquiredandused,providedthe TreatedProductiscorrectlytreated,handledandusedinaccordancewithandsubjecttothefollowingtermsand conditions.

1.Thefollowingwordshavethefollowingmeaningsinthisguarantee,unlessthecontextrequiresotherwise: (a)Appropriate Applications meansapplicationsinaccordancewiththeexposure,specificserviceconditions andenduseapplicationscorrespondingwiththerelevantHazardClassforwhichtheTreatedProductwas manufacturedandtheBuildingCodeofAustraliaandrelevantbuildingapprovalsandbuildingstandards.

(b)Guarantee PeriodmeansinrespectofeachTreatedProduct,assetoutintheGuaranteeTable,therelevantperiod ofyears,fromthedateofmanufacturebytheManufacturerofthatTreatedProduct,whichcorrespondswiththeapplicable TimberPreservativeusedinthatTreatedProduct.

(c)Guarantee Tablemeansthefollowingtable:

(d)Hazard ClassmeanseachofthefollowingHazardClasses,describedinAS1604issuedbyStandards AustraliaLtd:

*NotetheHazardClassesH2FandH2SmustonlybeusedsouthoftheTropicofCapricorn.

(e)Resistance LevelmeansthecorrespondingresistancelevelforaparticularTimberPreservativewithwhich theTreatedProductwasmanufacturedinaccordancewiththerelevantHazardClassforwhichtheTreatedProduct wasmanufactured,assetoutintheGuaranteeTable.

(f)Structurally UnfitmeanstheinabilityoftheTreatedProducttoperformitsintendedfunctionforwhichit wasfirstacquiredandusedtotheextentcausedbyinsectactivityand/orfungaldecay(inaccordancewith theResistanceLevelcorrespondingwiththerelevantTimberPreservativewithwhichtheTreatedProductwas manufactured),wheretheTreatedProducthasbeenusedinanAppropriateApplication,inaccordancewiththe termsandconditionsofthisguaranteeandnotexceedingtheTreatedProduct’sreasonablelimitations.

(g)Timber PreservativemeansthefollowingtimberpreservativessuppliedbyOsmose: (i) Osmose Lifewood® CCA–Chromatedcopperarsenate(CCA); (ii) OsmoseNatureWood®ACQ®–Alkalinecopperquat(ACQ®); (iii) OsmoseMicroPro®MicronisedCopperquaternarycompounds(MicroPro®); (iv) Osmose Protim®LOSPLightorganicsolventpreservatives(LOSP); (v) OsmoseDeterMite®–Bifenthrin(DeterMite®);or (vi) OsmosePermethrin(Permethrin).

2.TheTreatedProductistreatedwithaTimberPreservativeinaccordancewith: a.thespecificationssetoutinAS1604asatthedateofmanufactureoftheTreatedProductbytheManufacturer; and b.theTimberMarketingAct1977(NSW)(ifapplicable).

3.ThisguaranteedoesnotapplyunlesstheTreatedProductistreatedwithaTimberPreservativeinAustraliabytheManufacturerand: a.inthecaseofTreatedProducttreatedbytheManufacturerwithCCA,ACQ®,MicroPro®,LOSPorPermethrin usedonlywithinAustralia;and b.inthecaseofTreatedProducttreatedbytheManufacturerwithDeterMite®,usedonlywithinAustraliaandsouth oftheTropicofCapricorn.

4.Thisguaranteedoesnotapplyunless: a.theManufacturertreatedandmanufacturedtheTreatedProductthathasbecomeStructurallyUnfitwithaTimber PreservativeinaccordancewithOsmose’sreasonablerecommendations(asnotifiedbyOsmosetothe Manufacturerinwritingpriortothedateoftreatment)andtheappropriatestandardsasatthedateofmanufacture ofthatTreatedProduct;and

b.theManufactureronlyusedaTimberPreservativesuppliedbyOsmosetotreatandmanufacturetheTreated ProductthathasbecomeStructurallyUnfit.

5.ThisguaranteedoesnotapplyiftheTreatedProductisusedforpublicutilities,woodfoundationsystems,woodexposedtosaltwater,anyHazardClassH6application,andinfrastructureconstruction(exceptforfreewaysoundbarrierpanelling).

6.ThisguaranteedoesnotapplyiftheTreatedProductisusedinutilityorelectricitypoles,buildingpoles,foundationpiles,

freshwaterormarinepiles,vineyard,orchardorotheragriculturalposts,wharvesorbridges.7.Tothemaximumextentpermittedbylaw(includingundertheCompetitionandConsumerAct2010(Cth)),Osmose’sonlyobligationforfailuretocomplywiththisguarantee,islimitedto: a.theextentthattheTreatedProducthasbecomeStructurallyUnfitwithintheperiodsetoutincolumn5ofthe GuaranteeTable,oneormoreofthefollowing(atOsmose’ssoleelection):

(i).thereplacementoftherelevantTreatedProductorthesupplyofequivalentgoods;

(ii).therepairoftherelevantTreatedProduct;

(iii).thepaymentofthecostofreplacingtherelevantTreatedProductorofacquiringequivalentgoods;

(iv).thepaymentofthecostofhavingtherelevantTreatedProductrepaired;and

b.inadditiontoparagraph7.a,totheextentthattheTreatedProducthasbecomeStructurallyUnfitwithinthe periodsetoutincolumn4oftheGuaranteeTable,thepaymentofthereasonabledirectlabourcostsincurredinthe replacementorrepairoftherelevantTreatedProductattheProperty,anddoesnotcover: c.anyotherlossordamageofanykindwhetherdirect,indirect,incidental,specialorconsequential; d.anyotherlossordamageduetoinsectactivityorfungaldecayincludingpestinspection,pestextermination, relocationortemporaryoralternativeaccommodation; e.anylossordamagetoothertimber,hardwareorothermaterialsintheProperty; f.incidentalorconsequentiallossordamagesclaimedtobearesultofdamagedorundamagedTreatedProduct; g.anylossordamageduetothecorrosionoffasteners,hardwareoranyothermaterialoranydamage resultingfromsuchanoccurrence; h.anylossordamageduetoweathering,mouldgrowth,mechanicalwearandtear,physicalbreakagedueto overloadorfireoftheTreatedProduct;or i.fungaldecayotherthaninaccordancewiththeResistanceLevelcorrespondingwiththerelevantTimber PreservativewithwhichtheTreatedProductwasmanufactured.

8.Tothemaximumextentpermittedbylaw(includingundertheCompetitionandConsumerAct2010(Cth)),Osmose’sonlyobligationforfailuretocomplywithanyguaranteeundertheCompetitionandConsumerAct2010(Cth),islimited(wheretheTreatedProductisnotagoodofthekindordinarilyacquiredforpersonal,domesticorhouseholduseorconsumption)tooneormoreofthefollowing(atOsmose’ssoleelection):

(a).thereplacementoftherelevantTreatedProductorthesupplyofequivalentgoods;

(b).therepairoftherelevantTreatedProduct;

(c).thepaymentofthecostofreplacingtherelevantTreatedProductorofacquiringequivalentgoods;and

(d).thepaymentofthecostofhavingtherelevantTreatedProductrepaired.

9.ThisguaranteedoesnotapplyinrelationtoTreatedProductthatishardwoodwithheartwoodinthecrosssectionofthathardwoodifthatTreatedProductbecomesStructurallyUnfitduetoinsectactivityorfungaldecaythatoccurstotheheartwoodofthathardwood.

10.ExceptwhereOsmosehasagreedinwritingtothecontrary,thisguaranteedoesnotapplyunlessallTreatedProductistreatedinitsfinalshapeandform.TreatedProductthathasbeenripsawn,re-sized,requiredadditionalmachiningorhaditsoriginaldimensionsalteredinanywaymustbere-treatedwiththeappropriateTimberPreservative.

11.ExceptwhereOsmosehasagreedinwritingtothecontrary,thisguaranteedoesnotapplyunlessallcutsincludingendcutsandcutsforspeedbracingandboreholesandserviceholesintheTreatedProduct(otherthanTreatedProducttreatedbytheManufacturerwithDeterMite®orPermethrin)aretreatedwithanappropriatepreservativeinaccordancewithOsmose’sreasonablespecifications(asnotifiedbyOsmosetotheManufacturerinwritingpriortothedateoftreatment),duringconstruction.

12.Thisguaranteedoesnotcoveranylossordamageduetotheinherentphysicalpropertiesorqualitiesofwoodorengineeredwoodproducts(includinglaminatedveneerlumber(LVL),particleboard,plywoodandl-beams),includingwarping,splitting,twisting,checking,colourchange,shrinking,swelling,delaminationorotherchangesintheshapeorstrengthoftheTreatedProductordamageresultingfromanycauseotherthaninsectactivityorfungaldecay(inaccordancewiththeResistanceLevelcorrespondingwiththerelevantTimberPreservativewithwhichtheTreatedProductwasmanufactured).

13.Despiteparagraphs10and11above,trenchesinTreatedProducttreatedbytheManufacturerwithDeterMite®donotrequireresealingiftheyaretightlyjoinedtotreatedtimberwhichhasbeentreatedtothesameorahigherHazardClass

andifthereisnoexposeduntreatedtimber.14.TreatedProducttreatedbytheManufacturertoHazardClassH1orH2mustbekeptprotectedfromtheweatherandclearofgroundcontactatalltimesduringanystorage,warehousingoruse(excludingareasonableperiodduringconstructionusingthatTreatedProduct).15.TreatedProducttreatedbytheManufacturertoHazardClassH3,mustbekeptclearofgroundcontactatalltimesduringanystorageoruse.

16.Tomakeaclaimunderthisguarantee,theOwnermust,atitsowncost: a.notifytheretailoutletorsupplieroftherelevantTreatedProductthathasbecomeStructurallyUnfitinwritingof theclaim; b.delivertoOsmosewrittennoticeoftheOwner’sintentiontoclaimundertheguaranteeincludingevidenceofthe dateofpurchaseorsupplyoftheTreatedProductthathasbecomeStructurallyUnfit(Notice)(writtennoticemustbe senttotheaddressspecifiedinthecontactdetailsattheendofthisguarantee); c.within30daysafterdeliveryoftheNotice,delivertoOsmoseasufficientsampleoftheTreatedProduct,thathas becomeStructurallyUnfitthatwillallowOsmosetoconductidentificationtesting;and d.within60daysafterdeliveryoftheNotice,provideOsmosewithaccesstoviewtheTreatedProductthathas becomeStructurallyUnfitpriortotheremovalofthatTreatedProductfromservice.

17.TheManufacturerwhomanufacturedandtreatedtherelevantTreatedProductthathasbecomeStructurallyUnfitmustbeabletoprovetoOsmosethatthatTreatedProductwastreatedinaccordancewiththeappropriatestandardsandOsmose’sspecificationsandreasonablerecommendations(asnotifiedbyOsmosetotheManufacturerinwritingpriortothedateoftreatment),andthatOsmosewasthesolesuppliertotheManufactureroftherelevantTimberPreservativeatthetimethatTreatedProductwasmanufacturedandtreated.

18.OsmoseretainstherighttodealdirectlywiththeOwnerinrespectofanyclaimandtoinspecttherelevantTreatedProductthathasbecomeStructurallyUnfitpriortoitsremovalfromservice.

19.Failuretocomplywithanyoneormoreoftherequirementsorrecommendationsofthisguaranteewillvoidthisguarantee.

20.ThisguaranteeisforthebenefitofthefirstOwner,whileitistheownerofthePropertyandanysubsequentOwner,whileitistheowneroftheProperty,butisnototherwisetransferableorassignabletoanyotherperson,includinganybuilderoranyoccupieroftheProperty.

21.ThisguaranteedoesnotcovertheOwnerforanyclaimsmadeagainsttheOwnerbyanyoccupieroftheProperty.

22.ThisguaranteeisgovernedbythelawsofNewSouthWales.

23.Inthisguaranteeareferencetoincludingmeansincludingbutwithoutlimitation.

24.ThisguaranteeisinadditiontotheOwner’srightsandremediesundertheCompetitionandConsumerAct2010(Cth)andsimilarstateandterritorylawsinrelationtothesupplytoconsumersofTreatedProduct.Nothinginthisdocumentlimitstherightsorobligationsofaparty(whichcannotbelimited,modifiedorexcluded)underprovisionsoftheCompetitionandConsumerAct2010(Cth)andsimilarstateandterritorylawsinrelationtothesupplytoconsumersofTreatedProduct.OurgoodscomewithguaranteesthatcannotbeexcludedundertheAustralianConsumerLaw.Youareentitledtoareplacementorrefundforamajorfailureandcompensationforanyotherreasonablyforeseeablelossordamage.Youarealsoentitledtohavethegoodsrepairedorreplacedifthegoodsfailtobeofacceptablequalityandthefailuredoesnotamounttoamajorfailure.

25.ThisguaranteeisvalidonlyinAustralia.

It is recommended that the Owner:A. Retainsoriginalproofofpurchaseand: (i)originalend“tag”;or (ii)originalend“burn-brand”(sawnendoftimber).B. Forbestperformanceandresults,followsalloftherecommendationsofOsmoseincludingasset outinanyofOsmose’sbrochures.C. OnlyusesTreatedProductintheAppropriateApplicationsandenvironmentasper: (i)thespecificationssetoutintheAustralianStandardAS1604asatthedateof purchaseoftheTreatedProduct,includingtherespectivecategoryoftheHazardClass forwhichtheTreatedProductwasmanufactured;and (ii)theTimberMarketingAct1977(NSW)(ifapplicable).D. Obtainsandfullyreadsacopyof: (i)Osmose’sbrochurefortherelevantTimberPreservativewhichwillcontainfurther informationaboutuseofthatTimberPreservative;

(ii)Osmose’sConsumerInformationandHandlingGuide;and (ii)Osmose’sMaterialSafetyDataSheet,orequivalentManufacturer’spublications.FORMULATION:SeeMaterialSafetyDataSheetformoreinformation.

IMPORTANT INFORMATION

•USESITEPRECAUTIONSAllsawdustandconstructiondebrisshouldbecleanedupandsafelydisposedofafterconstruction.Donotusetreatedwoodundercircumstanceswherethepreservativemaybecomeacomponentoffoodoranimalfeed.Examplesofsuchsitesincludewoodmulch,cuttingboards,countertops,animalbedding,andstructuresorcontainersforstoringanimalfeedorhumanfood.Onlytreatedwoodthatisvisiblycleanandfreeofsurfaceresidueshouldbeusedforpatios,decksandwalkways.Donotusetreatedwoodforconstructionofthoseportionsofbeehiveswhichmaycomeintocontactwithhoney.Treatedwoodshouldnotbeusedwhereitmaycomeintodirectorindirectcontactwithdrinkingwater,exceptforusesinvolvingincidentalcontactsuchasdocksandbridges.Ifthetreatedwoodistobeusedinaninteriorapplicationandbecomeswetduringconstruction,itshouldbeallowedtodrybeforebeingcoveredorenclosed.Ifthetreatedwoodistohaveafinishingproductappliedtoit,suchaspaint,stain,clearwaterrepellentorotherfinish,followthemanufacturer’sinstructionsandlabelofthefinishingproduct.Toensurethefinishingproductprovidestheintendedresult,firstapplythefinishingproducttoasmallexposedtestareaofthetreatedwood.

•HANDLINGPRECAUTIONSTreatedwoodcanbedisposedofinaccordancewithapplicablelaws.Formoreinformation,contactrelevantwastemanagementauthorities.

Treatedwoodshouldnotbeburnedinopenfiresorinstoves,fireplaces,orresidentialboilersbecausetoxicchemicalsmaybeproducedaspartofthesmokeandashes.Treatedwoodfromcommercialorindustrialuse(e.g.constructionsites)maybeburnedonlyincommercialorindustrialincineratorsorboilersinaccordancewithallapplicablelaws.Avoidfrequentorprolongedinhalationofsawdustfromtreatedwood.Whensawing,sandingormachiningtreatedwood,wearadustmask.Wheneverpossible,theseoperationsshouldbeperformedoutdoorstoavoidindooraccumulationsofairbornesawdustfromtreatedwood.Whenpower-sawingormachiningtreatedwood,weargogglestoprotecteyesfromflyingparticles.

Weargloveswhenworkingwiththetreatedwood.Afterworkingwiththetreatedwood,andbeforeeating,drinking,toileting,orusingtobaccoproducts,washexposedareasthoroughly.Becausepreservativesorsawdustmayaccumulateonclothes,theyshouldbelaunderedbeforere-use.Washworkclothesseparatelyfromotherhouseholdclothing.

•WOODTREATEDWITHINORGANICARSENICWoodtreatedwithinorganicarsenic,includingCCA,shouldbeusedonlywheresuchprotectionisimportant.

Inorganicarsenicpenetratesdeeplyintoandremainsinthepressure-treatedwoodforalongtime.However,somechemicalmaymigratefromtreatedwoodintosurroundingsoilovertimeandmayalsobedislodgedfromthewoodsurfaceuponcontactwithskin.Exposuretoinorganicarsenicmaypresentcertainhazards.Therefore,theaboveprecautionsshouldbetakenbothwhenhandlingthetreatedwoodandindeterminingwheretouseordisposeofthetreatedwood.
