NATIVE PLANTATIONS, Nos. 1 AND 2-0RDER IN COUNCIL.

His Excellency the Administrator in Council directs that the land described in the Schedules numbered 1 and 2 hereto, acquired under the provisions of the Land Ordinance, 1911-1919, for the purpose of Native Reserves shall be Native Reserves for plantation purposes.

The notice appearing in Gazette No. 6 of· the 4th May, 1921, is hereby cancelled.

Dated at Port Moresby, this twenty-seventh day of February, One thousand nine hundred and twenty-two.

All that pieee of land on the North Coast of the Island of Misima, South· Eastern Division, eontaining 100 aeres, eommeneing at a point 150 links from sea beaeh and about one mile in a South· Westerly direetion from Gulia and Siagara Villages; thenee bearing 142 degrees, 30 minutes for fifty ehains; thenee 232 degrees, 30 minutes for twenty chains ; thence 322 degrees, 30 minutes for fifty chains to a Datum Peg; thence 52 degrees, 30 minutes for twenty chains to the point of commencement.

NATIVE PLANTATION No. 18.-IsIVITA, KOKODA DISTRICT. Commencing at a peg marked (1) at the Eastern end of the Isivita Village;

thence 10 chains bearing(3) degrees to a peg marked (2); thence 360 degrees for 10 chains to a peg mark2d (3); thence 10 ch3.ins bearing 70 degrees(4) to a peg marked (4); thence 180 degrees for 10 chains back to point of commencement. Land known as Isivita. Area about 10 acres.

NATIVE PLANTATION No. 19.-WASIDA, KOKODA DISTRICT. Commencing at a peg marked (1) 10 chains bearing 45 degrees from the

junction of the Buna and Ioma roads; thence for 10 chains bearing 45 degrees to a peg marked (2); thence for 10 chains bearing 135 degrees to a peg marked (3); thence for 10 chains bearing 225 degrees to a peg marked (4); thence 10 chains bearing 315 degrees back to point of commencement. Land known as Onobuturu. Area about 10 acres.

NATIVE PLANTATION No. 20.-HuvrVI, UPPER DOBODURA DrsTRICT.(5) Commencing at a marked corner peg three chains off the Huvivi·Mongi road in

a Westerly direction and about 15 chains from Huvivi Village, and bounded thence by a line bearing 100 degrees for 10 chains; thence by a line bearing 10 degrees for 16 chains; thence by a line bearing 280 degrees for 10 chains; thence by a line bearing 190 degrees for 16 chains to point of commencement. Land known as Huvivi. Area about 16 acres.

and the Mongi-Sesengapokarita road, and bounded thence by a line bearing 225 degrees for 20 chains; thence by a line bearing 135 degrees for 10 chains; thence by a line bearing 45 degrees for 20 chains; thence by a line bearing 315 degrees for 10 chains to point of commencement. Easterly of the four peaks of Mt. Lamington bearing 163 degrees, and bounded thence by a line bearing 330 degrees for 15 chains; thence by a line bearing 60 degrees for 20 chains; thence by a line bearing 150 degrees for 15 .chains; thence by a line bearing 240 degrees for 20 chains to point of commencement. Land known as Imaniturn. Area about 30 acres.

Land known as Kanari. Area about 12 acres.

ORDER IN COUNCIL MADE PURSUANT TO SECTION 8 OF THE NATiVE PLANTATIONS ORD IN ANCE. 1925-1934.

ORDER IN COUNCIL. (1)

Present: The Lieutenant-Governor in Council. Native Plantations Ordinance, 1925.

ORDERED as follows:-"1. That each one-half or other proportion of each years produce which is

the property of native villagers in the produce of any native plantation shall be divided among the statutory workers and voluntary workers in the proportion that the number of days which each of them respectively has worked during the year bears to the aggregate number of days which all of them have worked on the native plantation in the cultivation thereof (including in the term" cultivation" the preparation for market of the annual produce) :

Provided that where any statutory worker (who has by death or age ceased to be such) or where any voluntary worker (who has ceased to be such or has died) has previously worked on a native plantation for any time during any year during which the prescribed plant cultivated thereon has not come into bearing or is unproductive then he (or, in case of his death, his widow, or in case of her death, his child or children whilst under the age or apparent age of sixteen years) shall be entitled to receive during the first productive year of the native plantation such part of the produce thereof as is the property of the villagers as -the proportion which the number of hours he worked (in his first year of work) whilst the native plantation was unproductive bears towards the total number of hours which all statutory workers and voluntary workers worked in that year and so on yearly mutatis mutandis until he (or his widow or children as the case may be) has received such part of the produce in respect of each unproductive year he worked on such native plantation.

2. That instead of allotting the proportion of the annual produce of a native plantation in the manner set out in the proviso to Paragraph 1 hereof th.e nearest Resident Magistrate or Assistant Resident Magistrate to the native plantation (which is in his Division or District) may be required by the Director of Native Taxation to confer with the villagers in their village and ascertain what other scheme of allotment of such annual produce they themselves consider to be preferable in

'. respect of such annual produce: The Magistrate shall report the result of such conference to the Director who shall forward it with any observations he desires to make to' the Lieutenant-Governor(2) whc may approve the scheme preferred by the villagers with or without modification whereupon that scheme of allotment as approved shall, b( followed in relation to such annual produce instead of the schem( ordered in the said proviso.

Officers to be instructed to adopt 2 when practicable."
