On January 18, 2018, the Court, after hearing the argument of the parties, found that the Defense
has demonstrated a particularized need for confidentiality with respect to the Defendant's application for
the appointment of Defense Expert #1, for the reasons stated on the record.
In consideration, pursuant to § 19.2-264.3:1.3, the Court ORDERS that the Honorable Penney S.
Azcarate be designated as ex parte judge to consider the Defendant's application for the appointment of
Defense Expert #1.
