I am directed to inform your honorable body that the House ofRepresentatives has finally concurred in the following SenateConcurrent Resolutions:

SENATE CONCURRENT RESOLUTION NO. 21—BY SENATOR HINES AND REPRESENTATIVE R. ALEXANDER

A CONCURRENT RESOLUTIONTo direct the attorney general to challenge the legality and

constitutionality of the final rule governing the operation of theOrgan Procurement and Transplantation Network which waspromulgated by the United States Department of Health andHuman Services, Health Resources and Services Administrationon April 2, 1998, and to direct the secretary of the Department ofHealth and Hospitals to issue a formal comment letter to thesecretary of the Department of Health and Human Servicesobjecting to the enactment of such rule and to the authority of thesecretary to promulgate the rule and preempt Louisiana's laws andregulations on organ donation and allocation.

SENATE RESOLUTION NO. 23—BY SENATOR C. FIELDS

A RESOLUTIONTo urge and request the Senate Committee on Education to study the

various aspects of the criterion-referenced tests administered inpublic high schools as part of the Louisiana EducationalAssessment Program [LEAP], passage of all parts of which are

required for graduation from a public high school, and the effecton those students who are unable to receive a diploma who havecompleted the required minimum units of credit for graduation andall other graduation requirements as mandated by the State Boardof Elementary and Secondary Education but have failed to pass allparts of such examinations.

On motion of Senator C. Fields, the resolution was read by title andadopted.

SENATE RESOLUTION NO. 24—BY SENATOR GREENE

A RESOLUTIONTo urge and request the state Department of Education to collect, study

and analyze data from the local school systems on Gayle pay andsabbatical leave and to report the findings to the Senate Committeeon Education by March 1, 1999.

SENATE RESOLUTION NO. 25—BY SENATOR BARHAM

A RESOLUTIONTo commend Billy Joe Watkins upon his retirement and acknowledge

his numerous contributions to cattle research and the cattleindustry.

(1) Notwithstanding the provisions of this Section or any other just reported by Committees.provision of law to the contrary, an official or entity, or officials orentities, designated by the governor may, with the approval of thegovernor, negotiate and sign a compact with any tribe on any Indianreservation after the date this Section which shall govern matters relativeto the taxation of activities on such Indian reservation and/or gaming onsuch Indian reservation and which shall contain such terms andconditions as are in the best interests of the state and the tribe.

(2) Prior to signing any such compact, any such official or entityshall provide written notification and a copy of the proposed compact tothe House committees on Ways and Means and on Appropriations, andto the Senate Committees on Revenue and Fiscal Affairs and onFinance. Such committees may conduct oversight hearings within ninetydays of receipt of such notification and may recommend to the governorthat the governor approve or disapprove the proposed compact. Thecompact shall be approved or disapproved by the governor after ninetydays have elapsed from the receipt of written notification by thecommittees.

(3) If such compact grants an exclusion or exemption from taxesnot otherwise provided by law, it shall be approved before its signatureby the enactment of a law.

to any other tax now or hereafter levied and collected, the governingauthority of any municipality having a population of less than tenthousand persons as of the most recent federal decennial census and inwhich a riverboat is authorized to conduct gaming activities pursuant toR.S. 27:41 et seq. may, in accordance with Subsection B of this Section,levy and collect a tax upon the paid occupancy of hotel rooms locatedwithin the municipality. B. The governing authority of any such municipality shall imposethe hotel occupancy tax by ordinance. The governing authority mayadopt such ordinance only after a proposition authorizing the levy of thetax has been approved by a majority of the electors of the municipalityvoting at an election held for that purpose in accordance with theapplicable provisions of the Louisiana Election Code. The governingauthority may provide in the ordinance necessary and appropriate rulesand regulations for the imposition, collection, and enforcement of thehotel occupancy tax.

C. The governing authority may enter into a contract under suchterms and conditions as it may deem appropriate, including payment ofa reasonable collection fee, with any public entity authorized to collectsales or use taxes for the collection of the hotel occupancy taxauthorized hereby. The hotel occupancy tax shall be in addition to all

taxes presently being levied upon the occupancy of hotel rooms locatedwithin the municipality."
