III. INSTRUCTIONS: Attach and submit the following documentsto the Office of theAttorney General with your completednotary application. Your signature on thedeclarationof application mustbe notarized. This appliesto bothnew and renewalapplicants:

A. ORIGINAL POLICE CLEARANCE: Thepolice clearancemust be issuedbythe GuamPolice Departmentwithin the last thirty (30) daysof the date yousubmityourNotaryApplicationto our office.

B. PRIVATE NOTARIES: APPLICATION FEE of $50. This fee is non

-

refundable and non-transferableand applies to both new and renewalapplicants. The fee mustbe paidto the Treasurerof Guamprior to submittingyour notary application. Proofof paymentin the form of the original receiptissuedby the Treasurerof Guammust be attachedto andsubmittedwith yournotary application. The Office of the Attorney General accepts notaryapplicationsonly between8 a.m.and 12 p.m. MondaythroughFriday.

C. GOVERNMENT NOTARIES: WRITTEN DECLARATION. A writtendeclarationaddressedto the Attorney General and signedby the applicant’sdepartment or agencyheadshallbesubmittedalongwith thenotaryapplication.The declarationmust statethat the commission applied for is in the public’sinterest. Thedeclarationmustbe submittedfor bothnewandrenewalapplicants.

D. EVIDENCEOF NOTARIAL BOND or ORIGINAL NOTARIAL BOND

:

1. NEW APPLICANTS: All newapplicantsmustprovideour office with anoriginal form of EvidenceofNotarialBond issuedandsignedby both theapplicantandauthorized(nameprintedbelowsignature)representativeoftheSurety(insurance)company.

2. RENEWALS: Renewalapplicantsmustsubmit an original notarialbondform issuedandsignedby boththeapplicantandauthorizedrepresentativeoftheSurety(insurance)company.

IV. PROCESSING: All completedapplicationsreceivedby the Office of the AttorneyGeneralonorbeforetheendofthemonthwill beprocessedandscheduledfor thewrittennotaryexaminationfor the following month. Without exception,an application whichdoes not meet all the requirements stated in these instructions is consideredincompleteand will be returned without processing

V. RENEWALS:

A. WHEN TO SUBMIT: All renewal applicants must submit their notaryapplication no earlier than thirty (30) days prior to the expiration of theircommission. If anapplicationis submittedafterthe commissionhas alreadyexpired, theapplicant must then re-take thewritten notary examination

.

B. JOURNAL INSPECTION: The journals of all notaries who are renewingapplicants will be inspected for compliance in the notary’s presenceas

provided for by 5 G.C.A. ~334O4.Pleasebring yourjournalwith you whenyouare submittingyour renewalapplication. If for any reason our office cannotinspectyourjournal at thattime, wewill giveyouan appointmentfor alaterdate.

NOTE: In accordancewith 5 GCA §33404(e)and §33554(2),notariesare requiredto surrendertheirjournal or journalsto theOffice of the Attorney General within thirty (30) days of theexpirationofa commission.

VI. WRITTEN NOTARY EXAMINATION: Exam scheduleis attached,pleasereviewschedulefor examdatesand ensureyour presenceon the examdate.

A. Applicants are given two (2) consecutivechancesto pass the written notaryexamination. Without exception,if you fail the examination two (2) consecutivetimes, your file will be closedand you will have to submit a new applicationalongwith thenecessaryattachments,including a receipt from the TreasurerofGuamprovingpaymentofanotherapplicationfee.

B. If you do not show up for a scheduledexamination, you will be given anautomaticfailure. If you cannotappearfor theexamandfor anyreasonwhichweconsidervalid, youmustcall usprior to thescheduledexamination,andyoumuststill later provethevalidity of your absence.(For example,if you areill, pleaseprovideuswith a doctor’sexcuse.) If you do not call us prior to the scheduledexamination,you will be given an automaticfailure regardlessof the reasonforyour absence.

C. You will be given forty-five (45) minutes to completethe examinationwhichconsistsoftwenty-five(25)multiple choicequestions.To pass,you musthaveapassingscoreof4 errorsor less.

D. Noticeswill be sentoutnotifying applicantson theresultsoftheexam. If you donot receivea noticeafter7 daysfrom dateofexam,pleasecontactouroffice.

E. After you havepassedthewritten notaryexamination,theAttorney Generalwillcompletethe bottomportion of the form of Evidenceof Notarial Bond. TheEvidenceof Notarial Bond will then be returnedto you for submittal to theSurety(insurance)companyfor processingof theOriginal Bond. Pleasecontactour office once you haveobtainedthe original Notarial Bond so that we mayschedulea datefor yourcommission.

VII. MISCELLANEOUS: Pleasereviewyour application before submitting it to our office.You have the responsibility of ensuring that your application is complete,not us. Anincompleteapplicationreceivedby ouroffice will be returnedto you withoutprocessing

Implementation

§33101.ShortTitle. This Chaptershallbe knownandmaybecitedasthe ModelNotary Law.

SOURCE:ThisentireChapterwas enactedby P.L.21-106:2.

COMMENT: This Chapteris basically the Model Notary Law’ aspromulgated by the National Notaries Association. The GuamLegislature has made various amendmentsto conform to localadministrativeneedsandorganization.

§33102.Purposes.ThisChaptershallbeconstruedandappliedto advanceits underlyingpurposes,whichare:

1.To promote, serve, and protect the publicinterest;

2.To clarify and modernizethe law governingnotaries;and

3.To make uniform notarial laws among thejurisdictionsenactingit.

§33103. Prospective effect. The existing bond, seal,lengthof commissionterm,andliability of currentnotariescommissionedbeforethis Chapter’seffectivedatemaynotbe invalidated,modified, or terminatedby this Chapter,but those notaries shall comply with this Chapter inperforming notarizations and in applying for newcommissions.

§33104.Definitions.As usedin thisChapter:

(1) Acknowledgmentmeansa notarialactin whicha notary certifies that a signer, whose identity isproYen on the basis of satisfactory evidence,hasadmitted, in the notary’s presence,having signedadocumentvoluntarily for its statedpurpose.

(2) Commissionmeansto empower to performnotarial acts and the written authority to performthoseacts.

(3) Copycertificationmeansanotarialactin whicha notary certifies having made a photocopy of adocumentthatis neithera public recordnor publiclyrecordable.

(4) A crime involving moral turpitude includesanyfelony committed in Guam or any crime committedoutsideGuamthat would be a felony under Guamlaw, any crime involving personalinjury, and anycrime involving a breachof official duty if donewillfully.

(5) FundmeanstheNotaryPublic RevolvingFundassetforth in thisChapter.

(6) Jurat meansa notarial act in which a notarycertifiesthatasigner,whoseidentity is provenon thebasis of satisfactory evidence, has made, in thenotary’spresence,avoluntary signatureandtakenanoath or affirmation vouchingfor the truthfulnessofthesigneddocument

(7) Notarial act andnotarizationmeananyactthata notary is empoweredto perform under Section33301of thisChapter.

(8) Notarial certificateandcertificatemeanthatpartof or attachment to a notarized document forcompletion by the notary and bearingthe notary’ssignatureandseal.

(9) Notary Public and notary meanany personcommissionedto perform notarial acts under thisChapter.

(10) Oath and affirmation meana notarial act orpart thereofin which a notary certifies thata personmadeavow in thepresenceof the notary on penaltyof perjury,with referencemadeto aSupremeBeingfor anoath.

(11) Official misconductmeans: (i) a notary’sperformance of or failure to perform any actprohibitedor mandated,respectively,by this Chapteror by anyotherlaw in connectionwith anotarization;or (ii) a notary’s performanceof a notarial act in amannerfoundby theAttorney Generalto benegligentIor againstthepublic interest.

(12) Personal knowledge of identity meansfamiliarity with an individual resulting from contactwith thatindividual over aperiod of timesufficienttoeliminateevery reasonabledoubt that the individualhastheidentity claimed.

§33105. Effective date.This Chaptershall take effectninety (90) daysfollowing its enactmentinto law. §33106. Notary Public Revolving Fund. There isestablisheda fund to be known as the “Notary PublicRevolvingFund,” (the “Fund”) which shallbemaintainedseparateandapartfrom otherfundsof the governmentofGuam. All fundsgeneratedfrom feesunderthis Chapterfor application, authentication,copying, and any othergovernment fee required by this Chapter shall bedepositedinto theFund. The Fundshallbe usedby theAttorneyGeneralfor the purposeof theadministrationofthenotaryprogram,includingpersonnelcostsfor training,notary educationalprogramsand conferences,and anyadministrativeandequipmentcosts.

§33201. Commissioning. (a) Except as provided insubsection(c), the Attorney General shall commissionasanotaryanyqualifiedpersonwho submitsanapplicationinaccordancewith thisChapter.

(2) Revocation,suspension,or restriction of anotarialcommissionor professionallicenseissuedtotheapplicantby thisterritoryoranyotherstate;or

§33202. Jurisdiction and term. A personcommissionedasa notaryby the Attorney Generalmayperformnotarialactsin Guamfor a termof four (4) years,unlessthenotary’scommissionis revokedunder§33510orthenotaryhasresignedunder§33552of thisChapter.

§33203.Bond. No notarialcommissionmaybeissuedunlessthenotaryhasproduced,aspartof theapplication,evidencethat, uponcommissioning,a bond is in force inthesumof OneThousandDollars ($1,000).Thebondmustbeexecutedby a licensedsuretyfor thewhole termof thenotary’s commission,terminating on its expirationdate,with paymentof the bond’s principal to any personconditionedupon the notary’s misconductasdefined inSection 33104 of this Chapter. The bond shall not becanceled,revokedor modifiedwithouttheexpresswrittenauthorizationof the Attorney General,which shall begivenonly in extraordinarycircumstances.

§33211. Statementof PersonalQualifications.The

(3)Thattheapplicantcanreadandwrite English;

(4) All criminal convictions of the applicant,including anypleasof guilty andnob contendereornocontest;and

(5) All issuances, denials, revocations,suspensions,restrictionsandresignationsof a notarialcommissionorotherprofessionallicenseinvolving theapplicantin Guamorin anystate.

§33213.Notarized declaration. Every applicant for anotarialcommissionshallsign thefollowing declarationinthepresenceofanotary:

“Declaration of Applicant

I, (name of applicant), solemnlyswear(or affirm) under penalty of perjury that the personalinformation in this application is true, complete, andcorrect; that I have read carefully the materialsdescribingtheduties of a notary in Guam; and that I willperform, to the best of my ability all notarial acts inaccordancewith law.

§33214. Fees. Every applicant for a notarialcommission shall pay to the Treasurer of Guam anonrefundablefee of Fifty Dollars ($50). All feesshall bedepositedinto theNotaryPublicRevolvingFund.

Part3-Governmentemployees

§33220. Governmentemployees. (a) The AttorneyGeneralmay commission any number of governmentemployeesto actasnotaries,but notariesso empoweredmay perform notarial acts only during their hours ofemploymentwith their respectivegovernmentagencies.Such acts include the notarization for membersof thepublic or for fellow employees,of anyformsor statementswhich anygovernmentagencyrequiresbeforetransmittalfrom or submissionto suchagency,or any othernotarialact; provided,however,that suchgovernmentemployeesmaycharge,no feesfor notarialservices.

(b) Notaries empoweredunder this section mayperformnotarial actsin any part of Guamfor a term offour (4) years, and shall seek recommissioningby theAttorneyGeneralfor eachsubsequentterm.

(c) Exceptasprovidedin this section,anapplicantfora notarial commissionunderthis sectionmust meettherequirementsin Sections 33210 through 33215 of this

(d) Thepremiumonthebond andcostsof all notarialsuppliesfor a notaryempoweredunderthis sectionshallbepaidfrom fundsof thenotary’sgovernmentagency.

(e) No fees may be charged for notarial servicesperformedby anotaryempoweredunderthis section.

(f) Upon leaving their employment with thegovernmentof Guam, notaries empoweredunder thissectionshall resigntheir commissionsimmediately anddisposeof theirjournalsandsealsasprovidedin Sections33553and33554of thisChapter.

(g) Unlessotherwisespecifiedin thissection,a notaryempoweredunder this section shall comply with allprovisionsofthisChapter.

§33301.Powers.A notary is empoweredto performthefollowing notarialacts:

(1) Acknowledgments;

(2) Oathsandaffirmations;

(4) Copycertifications.

§33302. Disqualifications.A notary isfrom performingnotarialactsif thenotary:

(1) is a signerof or namedin thedocumentthatis tobenotarized;

disqualified

(2) Will receivedirectlyfrom a transactionconnectedwith the notarial act any commission, fee (except forattorneys),advantage,right, title, interest,cash,property,or otherconsiderationexceedingin valuethefeesspecifiedin §33310ofthis Chapter;or

(3) Is relatedto the personwhosesignatureis to benotarized as a spouse,sibling, or lineal ascendantordescendantas definedin 15 GCA §809 of the Estates&ProbateCodeofGuam.

(b) A notary shall perform notarial acts in lawfultransactionsfor any requestingpersonwho tenderstheappropriatefeespecifiedin §33310of thisChapter.

§33304.False certificate. A notary may not executeacertificatecontaininga statementknown by the notary tobe false or perform any official action with intent todeceiveordefraud.

§33305.Testimonials.A notarymay not endorseorpromoteanyproduct,service,contest,or otheroffering ifthe notary’s title or sealis usedin the endorsementorpromotionalstatement.

§33306. Unauthorized practice of law. (a) A non-attorneynotarymaycompletebut may not selectnotarialcertificates,andmaynot assistanotherpersonin drafting,completing, selecting,or understandinga documentortransactionrequiringanotarialact.

(b) This sectiondoesnot precludea notary who isduly qualified in a particular professionfrom givingadvicerelatingtomattersin thatprofessionalfield.

(c) A notaryshall not,makerepresentationsto havepowers,qualifications,rightsor privilegesthattheofficeofnotary doesnot have, including the providing of legaladviceunlessthenotaryis alsoa licensedattorney.

(d) A non-attorneynotary who advertisesnotarialservices in any language shall include in theadvertisement,notice, or sign the following statement,prominentlydisplayedin thesamelanguage:

“I amnot anattorneyandhaveno authorityto give adviceonanylegalmatters”.

§33310.Fees.(a) Subjectto theprovisionscontainedinthissection,everyNotaryPublicmaydemandandreceivethefollowingfees:

(1)For taking acknowledgmentor proofof adeedor otherinstrument,to includethesealandwriting ofthe certificate, for the first two (2) signatures,TenDollars ($10) each;and for eachadditionalsignature,EightDollars ($8);

(2) For administeringan oathor affirmation,Ten• Dollars($10);

(3) For everycertificateof a certified true copy,andtheseal,TenDollars ($10).

Provided,however, that in no eventmay a NotaryPublic who is an employeeof the governmentof Guamdemandorreceiveanyfeeor compensationof anykind forperformingany duty of a Notary Public during normalhours of work in his or her employment by thegovernment.

(b) A notarymaychargea reasonabletravelfee whentravelingto performanotarialactif:

(1) The notaryexplainsto the personrequestingthenotarialactthatthe travel fee is separatefrom thenotarial’feein subsection(a) and is neitherspecifiednormandatedin law; and

• (2) The notary and the personrequestingthenotarialactagreeuponthetravelfeein advance.

§33401.Journal.A notaryshallkeep,maintain,protectas a public record,and provide for lawful inspectionachronological, permanently bound, official journal ofnotarialacts,containingnumberedpages.

§33402.Entriesin journal. (a) For everynotarialact,the notaryshall record in the journal before the time ofnotarizationatleastthefollowing:

• (1) Thedateandtime of dayof thenotarialact;

(2) Thetypeof notarialact;

(3) A descriptionof thedocumentorproceeding;

(4) The signatureand printednameandaddressofeachpersonfor whoma notarialactisperformed;

(5) Theevidenceof identity of eachpersonfor whoma notarialactis performed,in theform of a descriptionoftheidentificationdocument,its issuingagency,its serialoridentification number, and the date of its issuanceifexpired,or a • statementby the notary that he or shehaspersonalknowledgeof identityof theperson;

(6) Thefee,if any,chargedfor thenotarialact;and

(7) The address where the notarization was

performedif notthenotary’sbusinessaddress.

• §33403. Signature in journal. At the time ofnotarization, the notary’s journal must be signed, asapplicable,by:

• (1) The person for whom a notarial act isperformed;and

(2) Thetwo (2) witnessesto a signatureby markofa documentthatis notarized.

§33404.Inspection,copyinganddisposalof journal.(a) Exceptasotherwiseprovidedin subsection(e) of thissection,and notwithstanding5 GCA, Chapter10 or anyother law, a journal of notarialactsis an official publicrecordthatmaybe inspectedonly in thenotary’s presenceby an individual whoseidentity is personallyknown tothenotaryorprovenon thebasisof satisfactoryevidence,who specifiesthe notarialact sought,andwho signsthenotary’sjournal.

(b) Uponrequestin compliancewith subsection(a) ofthis section,the notary shallprovide a photocopyof anentryin thejournalat a costof notmorethenFive Dollars($5) per photocopy.If a certified photocopyis requested,thecostis asspecifiedin Section33310of thisChapter.

(c) A notary shall safeguardthe journal and othernotarial recordsasvaluablepublic documentsandneverdestroy them, except at the direction of the AttorneyGeneral.

(d) Thejournalmustbekept in theexclusivecustodyof thenotary,andmaynotbeusedby anyothernotaryor

§33410. Official signature. In completing a notarialact,a notaryshall sign on the notarialcertificateexactlyandonly thenameindicatedonthenotary’scommission.

§33411. Official seal. (a) A notary shall keep anofficial notarialsealthat is the exclusivepropertyof thenotaryandthat may not be usedby any otherpersonorsurrendered to an employer upon termination ofemployment.

(b) Upon resignation,revocation,or expirationof anotarial commission,or deathof the notary, any sealhavingtheexpirationdateof thecommissionon it mustbedestroyedin accordancewith Article 7 of this Chapter.Anewsealmustbe obtained,under§33413of this Chapter,for anynew commission.Thenotaryneednot destroytheembossingseal,if any,norobtaina newembossingseal,ifthere is not time lapsebetweenthe expiration of onecommissionandthegrantingofanothercommission.

§33412. Notarial seals. (a) Near the notary’s officialsignatureon a notarialcertificate,thenotaryshall affix inblack ink a sharp, legible, and photographicallyreproducibleinked stampimpressionof the notarialsealthatmustincludethefollowingelements:

(1) The notary’s nameexactlyasis indicatedonthecommission;

(2) The words “Notary Public, in and•for theTerritory of Guam, U.S.A.” and “My commissionexpires(commissionexpirationdate)”;

(3) The addressof the notary’s business orresidence;and

(4) A rectangular border surrounding the

(c) An embossedseal impression that may bephotographicallyreproducibleandwhich shallcontainthewords “Notary Public in and for the Territory of Guam,USA,” andthe notary’s nameexactly asindicatedon thecommissionshallbe usedin additionto butnot in lieu ofthesealdescribedin subsection(a).

§33413. Obtaining a seal. Part1-Liability

§33501.Liability of notary, surety and employer. (a)A notary is liable to any person for all damagesproximately causedthat personby the notary’s officialmisconductin performinga notarization.

(b) A suretyfor anotary’sbondis liable to anypersonfor damagesproximately caused that person by thenotary’sofficial misconductin performinga notarization,butthis liability maynotexceedthepenaltyof thebondorof anyremainingbondfundsthathavenotbeenexpendedonotherclaimants.Regardlessof thenumberof claimants,a surety’stotal liability maynot exceedthe penaltyof thebond.

(e) If the employer is the governmentof Guam,damagesmaybe recoveredonly throughtheproceduresoftheGovernmentClaimsAct.

§33502. Proximate cause. Recovery of damagesagainstanotary,surety,oremployerdoesnotrequirethatthenotary’smisconductbe thesoleproximatecauseof thedamages.

Part2-Revocation

§33510. Revocation.(a) The Attorney Generalmayrevokeanotarialcommissionon anygroundfor which anapplication for a notarial commission may be deniedunder33201of thisChapter.

(b) Resignationor expirationof a notarialcommissiondoesnot terminate or preclude an investigationinto anotary’s conduct by the Attorney General, who maypursuethe investigationto a conclusion,whereuponitmustbemadea matterof public recordwhetherornot thefindingswouldhavebeengroundsfor revocation.

§33511. Other remedies.(a) The Attorney Generalmay deliver a written Official Warning to CeaseMisconductto anynotarywhoseactionsarejudgedto be.official misconductunder§33104of this Chapter.

(b) TheAttorneyGeneralmayseeka courtinjunctionto preventa personfrom violating any provision of thisChapter.

§33512. Criminal prosecution. A notary whoknowingly and repeatedlyperforms or fails to performany act prohibited or mandatedrespectivelyby thisChapteris guilty of a third degreefelony. A notarywhoknowingly performsanotarizationfor a personwho doesnot appearbefore the notary or at the notary’s office isguilty of a third degreefelony.

Miscellaneous

§33550. Changeof address.Within thirty (30) daysafter the changeof a notary’s businessor residenceaddress,thenotaryshalldeliver to theAttorneyGeneral,by certified mail or other meansproviding a receipt, asignednotice of the change,giving both old and newaddresses.

§33551.Changeof name.(a) A notarywith a changeof name shall deliver to the Attorney Generala signednoticeof thechange,giving bothold andnewnamesandtheeffectivedateof thenewname.

(b) Starting on the effective date of the change,anotarywith a newnameofficially shallsignthatnameonall notarialcertificates,but only afterthe following stepshavebeencompleted:

(1)Thenoticedescribedin subsection(a)of thissectionhasbeendelivered;

(2)A Confirmationof Notary’sNameChangehasbeenreceivedfromtheAttorneyGeneral;

(3)A newsealbearingthenewnameexactlyasin theConfirmationhasbeenobtained;and

(4)Thesuretyfor thenotary’sbondhasbeeninformedin writing.

§33552.Lost journal or seal.Within ten (10)days afterthe loss or theft of any official journal or seal,the notaryshalldeliver to the AttorneyGeneral,by certifiedmail orothermeansprovidingareceipt,asignednoticeof thelossor theft, and inform the appropriatelaw enforcementagencym thecaseof theft.

§33553. Resignation. (a) A notary who resigns anotarialcommissionshall deliver to theAttorneyGeneral,by certified mail or other meansproviding a receipt,anoticeindicatingtheeffectivedateof resignation.

§33554.Disposition of sealandjournal. (a) When anotarialcommissionis resigned,revoked,or expires,thenotaryshall:

(1) As soonasreasonablypractical, destroy theofficial seal;and

(2)Within thirty (30)daysof theaftertheeffectivedateof resignation,revocationor expiration,delivertotheAttorneyGeneral,by certifiedmail orothermeansprovidingareceipt,thenotarialjournalandrecords.

§33555. Death. If a notary dies during the term ofcommission,thenotary’s heirs or legal representative,assoonasreasonablypracticalafterdeath,shalldeliverto theAttorney General by certified mail or other meansprovidinga receipt(i) anoticeofthedateof death,and(ii)thenotarialjournalandrecords.

§33556. Copying Fees. Notwithstanding 5 GCA§10203,oranyotherlaw, theAttorneyGeneralmaychargea copyingfeenot. to exceedTwo Dollars ($2) for the firstpageof anyrequesteddocumentunderthis Chapter,suchasNotarialCommissions,Certificatesof Authority andtheModel NotaryLaw, not to exceedOneDollar ($1) for eachadditionalpage.All feesshallbedepositedinto theFund.

§33601.Evidence of authenticity of notarial act. (a)Theauthenticityof the official notarialsealandsignatureof anotaryofGuammaybeevidencedby:

(1) A Certificateof Authority from the AttorneyGeneral,authenticatedasnecessary;or

(2) An Apostille from theAttorneyGeneralin theform prescribedby the HagueConventionAbolishingthe Requirementof Legalizationfor Foreign PublicDocumentsof October5,1961.

(3) An Apostille as specified by the HagueConvention must be attached to any documentrequiringauthenticationthat is sentto a nation thathassignedandratifiedtheConvention.

(b) The Attorney Generalmay chargea Twenty-fiveDollar ($25) non-refundable fee for a Certificate ofAuthority oranApostille. SuchfeesshallbedepositedintotheFund.

Anycommissionedofficer of the Armed Forcesof the UnitedStates, while on active duty, who is authorized toadministeroathsby the Uniform Codeof Military Justice,may administeroathsand affirmations, takedepositions,affidavits and acknowledgementsof deeds, grants,transfersandotherinstrumentsof writing, andpowersofattorney,ofanypersonwhofor thetime beingis onactiveduty with the Armed Forcesof the United States,in thesamemannerasa NotaryPublic.

Any oathor affirmation administered,or depositionor affidavit taken,or acknowledgmentcertified by suchofficer hereunder,if otherwise in accordancewith law,shallbeeffectualfor all purposesasif administered,takenor certified by a Notary Public appointed andcommissionedunderthisChapter.

Section1.. A new§420is herebyaddedto Title I of theGuamCodeAnnotatedto readasfollows:

“Section420.Affirmation ofSelf-RespectandProhibitionofUseofthe Term “Territory” in All Official UsesWithin the Government ofGuam. In the interestsofpromotingself-respectandin recognitionof thenecessarilypejorative,diminishing and colonial aspectsof the term‘territory’ within thecontextofAmericanlaw,theterm‘territory ofGuam’or its derivatives,suchas‘territorial,’ shall not be usedin direct titularassociationwith theIsland,people,or governmentof Guamor for thepurposesof direct self-description,in any governmentdocumentorotherwiseas part of any governmenttitle. This Sectionis intendedtoprohibit,amongotherthings,official governmentuseoftheterm‘tenitoryofGuam’ in anystatute,resolution,official governmentactordocument.In replacement~thedesignation‘Guam’ shallbeused.Further,theterm‘territorial,’ as is used in the titles of various governmentagencies,councils,boardsandinstrumentalitiesis prohibited,to bereplacedwiththeterm‘Guam.’ ThisSectionis notintendedtobantheuseof theterms‘territory’ or ‘unincorporatedterritory’ in documentsor publicationsdescribingGuamorthepolitical statusof Guam,butrathertodiscontinuethe self-perpetuationof this unworthystatusin official titles associatedwith Guam. In such caseswhere existing statutes contain the term‘territory of Guam,’ on theeffectivedateof this Act, all suchstatutoryreferences,notwithstandinganyotherprovisionof law, areamendedtoreplacetheterm‘territory ofGuam’with theterm‘Guam,’whichshallbeunderstoodto have the same meaning and effect with respecttoconstructionandeffectof thestatutessoamended.On theeffectivedateof thisAct, all governmentinstrumentalities,agencies,councilsorboardscontaining the term ‘territorial’ in their titles shall be amendingnotwithstandinganyotherprovisionof law insuchmannerasto removethe term‘territorial’ from thetitle and replacesuchtermwith the term‘Guam.’
