Kurukshetra. The above cited case came up for hearing on 10-09-2014 and Hon'ble Court

passed the following order:-

"As per submission made by the learned counsel, the instant writ petition is

disposed of with the observation that respondent No.2 would look into the grievance of the

petitioner with regard to his transfer in the light of representation dated 14-08-2014 at

Annexure P - 6 and decide the same expeditiously.

Petition disposed of."

I have gone through the representation dated 14-08-2014. Through the

representation the petitioner has sought that his transfer order dated 12-08-2014 from

GPS Kanwar Kheri, Kurukshetra to GPS Gobind Majra, Kurukshetra may be cancelled

because he is working as Both Level Officer for village Kanwar Kheri (Booth No. 153) in

addition to teaching work. As per BEEO and DEED report no appeal/representation was

given by the petitioner at the time of implementation of transfer orders. Now election

process has been completed. Hence request of petitioner for cancellation of transfer order

dated 12 - 08 - 2014 is hereby rejected.

and District Palwal filed CWP No. 21424 of 2014 in the Hon'ble High Court for the issuance

of a writ in the nature of mandamus directing the respondent No. 2 to decide the legal

notice of the petitioner, dated 13-08-2014 (Annexure P-4) in the light of instructions dated

08 - 08 - 2011 and 12 - 12 - 2012 issued by the respondent No. 2 to accept the claim of the

petitioner for Inter District Mutual Transfer and post him in Govt. Primary School, Main

Khurd, Bhiwani, District Bhiwani. The above cited case has been disposed of by the Hon'ble

High Court on 16.10.2014 by passing following orders inter alia:-

"After hearing learned counsel for the petitioner, however,

without opining on the merits of controversy, respondent No. 2

is directed to take a final decision on the legal notice dated

13.8.2014 got served by the petitioner. The needful shall be

done within a period of four months from the date of receipt of

copy of this order. The petition stands disposed of.

I have gone through the legal notice dated 13.08.2014 (Annexure P-4).

Through this legal notice Sh. Raj Kumar, JBT teacher Government Girls Primary School,

Allika, District Palwal has sought his mutual Inter District Transfer from G.G.P.S., Allika,

Palwal to Government Primary School Mainkhurd, Bhiwani vice Kirpal Singh, JBT teacher,

on the basis of judgement passed by Hon'ble Punjab and Haryana High Court in CWP No.

6055 of 2014 titled as Jitender Singh Versus State of Haryana & Others, decided on

09.07.2014.

The petitioner had applied for Inter District Mutual Transfer vice Kirpal

Singh, JET teacher from GGPS, Allika, Palwal to Government Primary School Mainkhurd,

Bhiwani.

As per record, the petitioner Raj Kumar has to retire on 30.12.2040 and Sh.

Kirpal Singh, JBT on 01.03.2013. The department has taken a decision in file no. 13/277-

201.2 FT- I (2) at NP - 64 & 67 that teachers, who are going to retire within one year, their

cases for inter district transfer may be kept in abeyance and one year should be calculated

from 30.11.2013. The claim of the petitioner was considered along with other applicants by

the department on 21.11.2013 and list of transfer of eligible candidates was issued on

25.11.2013. As Sh. Kirpal Singh, JBT teacher against whom petitioner sought Inter District

Mutual Tran-sfer was going to retire on 01.03.2013. As per the decision of department, the

year, are to be kept in abeyance and one year should be calculated from 30.11.2013.

Accordingly, application to the petitioner for mutual inter-district tran s fer was not

accepted.

I have gone through the judgment dated 09.07.2014 of Hon'ble High Court

passed in CWP No. 6055/2014 on which petitioner has sought his claim of mutual inter-

district transfer. In this judgement, petitioner Jitender Singh, JBT Teacher, Government

Primary School, Bukharpur, District Faridabad and Sh. Satyavir, JBT teacher, Government

Primary School, Bhatera, district Jhajjar submitted their application for mutual Inter

District Transfer. As Sh. Satyaveer, JBT teacher against whom petitioner jitender was

seeking mutual Inter District Transfer was going to retire on 31.03.2014 and by the time

case of the petitioner was taken up for decision, less than one year was left in his

retirement. Accordingly, the request of the petitioner could have not accepted for mutual

inter district transfer. After detailed discussions, the Hon'ble High Court held in this case as

follows inter alias:-

All this point out towards the inaction on the part of the respondents

and that delay has now been taken as a ground for denying the

petitioner his rightful claim under the policy, which is unacceptable.

All the pleas, as have been raised by the respondents, have been

found to be without any basis and justification and, therefore, the

impugned order cannot sustain.

In view of the above, the present writ petition is allowed.

Order dated 22.03.2014 (Annexure P-12) is hereby quashed.

Direction is issued to the Director, Elementary Education Haryana-

respondent No.2 to accept the claim of the petitioner for inter-

district mutual transfer and post him in Government Primary

School, Bhatera, District Jhajjar. Needful be done within a period of

one week from the date of receipt of certified copy of this order.

In view of law laid down by the Hon'ble High Court in CWP No. 6055/2014-

the delay caused in taking the final decision on the application of petitioner could not be

taken a ground for denying his claim. In the present case, last date for filing the application

for mutual Inter District Transfer was 06.01.2013 and same may be taken as standard for

calculating one year period of retirement, keeping in view of observations made by the

Hon'ble High Court while deciding the case of Jitender Singh (supra). Sh. Satyaveer Singh,

JBT teacher in that case was to retire on 31.03.2014. Hence, as on 06.01.2013 Sh. Satyaveer

Singh, JBT teacher is to be retired after more than one year. The Hon'ble High Court has

accepted the stand of petitioner in that case while allowing his writ petition.

In the present case, the application of the petitioner was received before last

date of submission of application i.e. 06.01.2003. The date of retirement of Sh. Kirpal Singh

JBT Teacher against whom the petitioner i.e. Sh. Raj Kumar JBT Teacher had sought Inter

District Mutual Transfer was 01.03.2013 and of petitioner, Sh. Raj Kumar was 30.12.2040.

Sh. Kirpal Singh, JUT Teacher was going to retire within one year from the last date of

submission of application i.e. 06.01.2013. Hence, the case of the petitioner for mutual Inter

District Transfer is not covered under the judgment dated 09.07.2014 passed by the

Hon'ble High Court in CWP No. 6055/2014 titled as Jitender Singh Versus State of Haryana

& Others, as the delay in taking decision on the application of the petitioner for the inter

district mutual transfer has not affected the case of the petitioner at all. Therefore claim of

the petitioners for Inter District Mutual Transfer is hereby rejected.
