Construction of the Mayor Vera Calvin Plaza remains on schedule and within budget.

Construction activity for next week, October 28 – November 1, will include:

C. City of Burleson wins statewide excellence awardThe Burleson Drowning Prevention Coalition named best in public safety for cities over25,000 in population

During the 2019 Texas Municipal League(TML) Annual Conference and Exhibitionin San Antonio, the City of Burlesonreceived a 2019 Municipal ExcellenceAward in public safety for cities over25,000 in population. The awardrecognized the City for the BurlesonDrowning Prevention Coalition.

Inspired to prevent childhood drownings, the City of Burleson Fire Department andmarketing team created a public service video to raise awareness and encourageparents to safeguard their children. Wanting to do more, the Drowning PreventionCoalition, which consists of multiple community partners, formed and begancollaborating on ways to end childhood drowning deaths. The result was a successfuleffort to provide swimming lessons, free of charge, to Burleson youth. To date, theCoalition is responsible for providing 1,500 children with swim lessons.

On hand at the Conference to accept the award were councilmembers Ronnie Johnson,Katherine Reading, Stuart Gillaspie and Rick Green.

"We are extremely proud that our grass-roots efforts to stop childhood drownings in ourcommunity has been recognized statewide,” stated Burleson Fire Chief K.T. Freeman.“We look forward to growing this project with the continued support of city council,local businesses, our community and the school district.”

TML’s Municipal Excellence Awards recognize and encourage the achievements of Texascities in meeting the challenge of municipal governance. Innovative problem-solving,

excellence in management, increasing citizen participation, and reaching toward higher service levels are all daily occurrences in Texas cities, and they deserve recognition. This awards program seeks out the best of these programs to honor. Awards are given in two population categories (under 25,000 and over 25,000) and five areas (management innovations, communication programs, city spirit, public safety, and public works).

D. Walking Connect with Council scheduled for Nov. 2Mayor Shetter and council member Stuart Gillaspie will be hosting a ‘walking’ Connectwith Council from 9 to 10:30 a.m. on Saturday, November 2. Residents can speak withtheir elected officials during a relaxed stroll around Bailey Lake. There will also beMaster Naturalists who will discuss flora and fauna native to the area.

E. BISD Collegiate High School VolunteersStudents in the Pathway to College and Career Readiness class came to the rescuerecently to assist with two big projects in the Department of Recreation and LifelongLearning.

Volunteerism is an important part of their curriculum, and these 11th and 12th-gradestudents are required to find opportunities to serve the community as a group. Their callto the city seeking opportunities to serve came at the perfect time. Department staffrecently visited several BISD schools asking students to complete surveys as part of theYouth Parks Master Plan Outreach program. Staff received over 1,000 writtenresponses, which required computer data entry. Since all of the BISD students havedistrict assigned tablets, their teacher agreed that the class could accomplish the dataentry in very little time. City staff delivered the surveys late on a Thursday afternoon,and the students had the task completed by noon the next day. This saved atremendous amount of staff time and was much appreciated.

Subsequently, the BISD students agreed to volunteer at the library on Friday, October18, to assist with important but time-consuming tasks. The students were separatedinto groups of 5 and performed the following tasks:

• Pulling books forward on the shelves aligning spines neatly• Dusting all shelving• Cleaning all hard surfaces with disinfecting wipes• Cleaning and disinfecting all of the children’s toys

The students did an exceptional job and were courteous, polite, and efficient. Staff even received feedback from library patrons about the wonderful work the students were doing and how wonderful it is for the city and BISD to partner together to give our youth this experience. In appreciation, department staff hosted a pizza lunch for the students at Warren Park.

Staff followed up with their teacher to inquire about their experience. She responded that it was a “very successful field trip,” and they would love to come back again. Some of the students have taken the initiative to sign up individually to help with Boo Bash, and some have expressed an interest in helping to decorate for Santa’s Breakfast in December.

Their teacher asked if we could work with them to extend the volunteer experience to her 9th and 10th-grade students. They are very interested in being involved in events supporting our veterans. Staff is considering a thank you card writing campaign for veterans and will continue to seek out volunteer opportunities for these students.

Both the department and BISD view opportunities such as these to be critical in developing a love of lifelong learning and service. These students went above and beyond to make a difference in their community, and their actions represent what makes Burleson such a great place to live.

F. Hidden Creek Golf Course’s Greg Gregory captures back to back victories at theYamaha Golf-Car Company & Srixon/Cleveland Golf/XXIO Match PlayChampionshipThe Championship Match of the Yamaha Golf-Car Company & Srixon / Cleveland Golf / XXIOMatch Play Championship featured the #5 seedGreg Gregory, PGA head professional at HiddenCreek Golf Course, and the #6 seed BrianNorman, PGA teaching professional atGleneagles Country Club. Greg Gregory wasvictorious after 21 holes.

Gregory took an early lead in the match going1UP after the first hole, and played with a lead for eleven of the next twelve holes.However, with a birdie on #14, Norman was able to square up the match, and then takethe lead 1UP after winning hole #16 with a birdie. On hole #17, Gregory chipped in fromthe front of the green for birdie, forcing the match back to all square. After making parson #18, Gregory and Norman were onto extra holes. On their 21st hole of the match,Gregory made a 30-foot putt for birdie to claim the victory.

This marks Gregory’s second consecutive, and third overall, Match Play Championshipvictory and eighth NTPGA individual major championship. Gregory took home $7,000 ofthe $42,000 Open Division purse.

The Yamaha Golf-Car Company & Srixon / Cleveland Golf / XXIO Match Play Championship was contested October 14-16 at River Crest Country Club in Fort Worth, Texas, a 6,512-yard, par 70 layout. The Championship was presented by Adventures In Golf, AT&T Byron Nelson, Green Garden Gold and PGA TOUR. The top 32 players on the final 2019 Yamaha Golf-Car Company & Srixon / Cleveland Golf / XXIO Player of the Year Points Challenge were invited to compete in the season-ending major championship.

G. BRiCk MaintenanceA couple of maintenance items were brought up by council during the October 21, regular meeting. The faucets in the locker rooms are set to run for a period of time and then automatically shut off. But it was reported that there were faucets stuck in the on position. Staff recently serviced the faucets and are doing regular walkthroughs. However, staff will also hang a clipboard in the locker room to show when the last walkthrough occurred and extend into the locker room the recently enacted texting feature for guests to report fitness equipment concerns.

A treadmill was reported to be squeaking while another guest was using the treadmill, and multiple staff were unable to replicate any squeaking from a mechanical issue. However, they were able to create a squeak by wearing tennis shoes and not adequately picking up their feet as they walked. It is unknown if that was the cause, but staff will continue to monitor to ensure the equipment is functioning properly.

It was also reported that there were parking lot lights out on the south end of Bartlett Soccer Complex. Staff recently ordered the necessary parts to do the repair, and the lighting was replaced on Wednesday morning of this week.

H. Director of Finance Recruitment UpdateThe Director of Finance position recruitment was officially opened on Tuesday, October22. Ralph Andersen & Associates will engage in an active nation-wide search to attract well-qualified candidates for consideration. The recruitment period will close on November 25. The city will review the top list of candidates the week of December 16, with interviews being held the week of January 6, 2020. The recruitment brochure is attached on page 18.

I. Old Town Quiet Zone UpdateThis project required the shifting of the railroad crossing arms further from the street to accommodate the proposed wider sidewalk widths. Because of this shift, UPRR requires that two mature Oak trees at the north end of the Main Street parking lot will need to be trimmed so that sight distance to the flashing beacons is maintained. These trees are mature and provide an important aesthetic to Old Town. However, UPRR will require this sight distance for safety and ultimately acceptance of the Quiet Zone. As a result, staff is procuring trimming quotes by a local tree service to raise the canopy to satisfy

the sight distance requirements with attention to preserving the integrity of the trees and appearance of the corridor.

J. Interim Assistant Fire Chief NamedBattalion Chief Casey Davis has been named as the interim Assistant Fire Chief as aresult of Brent Batla’s recent resignation to accept a promotional job opportunity as FireChief at Horseshoe Bay. Casey will continue his Battalion Chief duties overseeing theCity’s Emergency Medical Services (EMS) Program, as well as assuming additionalresponsibilities as Assistant Fire Chief until a permanent replacement is decided. We arecurrently working through the details and timeline to begin the replacement process.We want to extend our thanks to Casey for his willingness to serve in this acting role.

K. Shannon Creek AdditionStaff received some concerns that water was not draining properly from the intersectionof Stillwater Drive and Laramie Lane and inquired if there should be storm inletsconstructed.

Roadways are designed in a manner to carry stormwater in heavy rain events within theright-of-way. In the event, the right-of-way will not hold all of the storm water storminlets are constructed to carry the excess water underground. The right-of-way forStillwater Drive and Laramie Lane is capable of carrying all of the stormwater out to thefloodplain. This is why residents do not see the storm inlets in this area. Rainwater isexpected to flow along the gutters of the roadway and the area is to dry up within 24hours of a rain event.

Staff visited the area after receiving the concern and observed on two different occasions, sprinkler systems on at several residential lots near this intersection. There was excess water observed running over the sidewalk and into the roadway which was then conveyed to the intersection. This water eventually ran across the parking lot and out to the parkland/floodplain as designed. From staff’s visual assessment, there was plenty of fall, and no ponding was observed while the sprinklers remained on. Staff did observe some stains within the intersection where water may pond. The site visits occurred in the early morning on two different days of the week. Water runoff from sprinklers were observed each visit. It appears that if sprinklers are active almost every day, there may not be enough time in between where the water may evaporate and dry up. Staff has initiated a public education campaign to educate homeowners about the overuse of sprinkler systems in the area.

While the roadway appeared to have adequate fall, survey shots were taken at the intersection and a couple of hundred feet outside of the intersection. The data indicates that the roadway was constructed in conformance with the design plans and there is adequate fall to convey the water through the intersection.

L. Health Insurance Benefits Committee Update The Wellness Committee was recently combined into the Health Insurance Benefits Committee. The Health Insurance Benefits Committee met on Tuesday, October 22.

The committee reviewed the health plan, and it is performing well and no stop loss reimbursements thus far in the plan year. Open Enrollment is in progress through October 25. The feedback indicates employees are satisfied with the plan designs for 2020. The committee asked about part-time benefits. The city does not offer part-time group health, but given committee comments, we will explore trends and benchmarking for follow up.

In the area of Wellness, the lunch and learn topics are being received positively, and we solicited feedback for additional topics in 2020. The Flexible Wellness Reimbursement program is also being received as a positive change in the Wellness program. Derek Rose at the BRiCk recently completed his Personal Trainer Certification and will be launching a City Commit to Fit program in January. Two wellness related businesses are coming to town, so we will reach out to inquire about partnership discounts.

United Way fundraising ideas were discussed for 2020, and those ideas will be further reviewed with Brandi Rendon, our United Way contact at the city, and city management for implementation.

Other items for discussion were various methods to improve communication with employees such as a Facebook group, consideration to bring back the prior Sick Leave payout policy, and a subsidy or discount for daycare. The noted items and ideas will be

prioritized for review of options and follow up with relevant parties, including City Management and Council.

M. LumberjAX Axe Throwing Specific Use Permit (SUP) AmendmentThe owner of LumberjAX Axe Throwing Facility located at 138 North Wilson Street hasrequested to modify the SUP associated with the site to allow sale of beer, wine andfood on site.

The current SUP reads: “Food and alcohol being brought from the outside will beallowed during the patrons’ reserved times although there will be no food or alcoholsales on site”.

The amendment request reads: “Food, beer and wine will be sold on-site. No outsidefood or drinks will be permitted.”

The Planning and Zoning Commission considered this request at their October 15meeting. The ultimate vote was to allow the amendment with the conditions as follows:

• Beer and wine sales may commence upon receipt of a permit from the TexasAlcoholic Beverage Commission (TABC);

• Patrons may continue to bring in food and drink at the applicant’s discretionuntil January 1, 2020; and

• The site will obtain and maintain all appropriate food and beverage permitsthrough the state.

There was a significant discussion related to TABC permitting and regulations with some uncertainty as to what the TABC specifically allows in relation to the city’s local option regulations. Given this uncertainty, a request has been made from the Planning and Zoning Commissioner for additional TABC information and to potentially reconsider the request pending the additional information.

To keep the applicant on schedule for the November 11 City Council meeting, a special P&Z meeting has been scheduled for November 5 at 6:30 p.m. The meeting will include a briefing from the City Attorney’s (TOASE) office related to TABC and city regulations with respect to sale and consumption of alcohol. Upon completion of the briefing, P&Z will vote to determine whether to reconsider the LumberjAX SUP amendment. If they choose to reconsider it, staff will provide a presentation, a public hearing will be conducted, and a vote on the amendment taken.

As mentioned above, this item is scheduled for consideration by Council on November 11. The City Attorney presentation on TABC/City regulations will occur in Work Sessionprior to consideration of the item.

N. New Cold Storage Facility chooses Highpoint Business ParkBurleson Economic Development Corporation announced today that Yukon Ventures,

LLC will be opening a new refrigerated and cold storage distribution center in Burleson, Texas. This project is a joint venture with Marty Khait, principal of Yukon Ventures and Anthony Rinaldi, managing partner of Saxum Real Estate. The entire project, which will involve new construction and state-of-the-art design and build-out is projected to exceed $50 million.

"The City of Burleson, and specifically the Economic Development team has been a pleasure to work with since the start of the RFP process. They've been responsive, fair, and eager to win our business for their community," said Marty Khait. "We're excited to break ground on our project, another much needed cold storage facility for the metroplex."

"With the success our community has had over the past few years within the food industry it is a great achievement for our team to be able to be a part of an amazing development from Yukon Ventures and Saxum Real Estate," said Alex Philips, economic development manager for the City of Burleson. "We look forward to the project progressing and welcoming them to Burleson's Highpoint Business Park. We truly are, Hometown, Done Right!"

The project is slated to start construction early 2020 with a scheduled completion in the fourth quarter of 2021. Premier Refrigerated Warehouse will be the anchor tenant leasing 200,000 square feet of the new facility upon completion. Marty Khait adds, "The incredible customer base in DFW, combined with the metroplex' world-class distribution infrastructure, creates an environment ideal for cold storage users. We are excited to offer them another option with our project."

"We are incredibly happy that Yukon Ventures, LLC, selected Burleson as the location of their new 400,000 square-foot facility," said Burleson Mayor, Ken Shetter. "Yukon Ventures will become a vital piece of Highpoint Business Park, continuing to solidify Burleson as a city of choice for thriving businesses considering growth or expansion. Finally, when it comes to economic opportunity, I would encourage businesses to join Yukon Ventures and bet big on Burleson!"

O. City Council approves funds for fire station relocationBurleson City Council approvedconstruction costs for the relocationof Fire Station No. 2 during its regularmeeting on Monday, October 21.

The new facility will be located at 250E. Hidden Creek Parkway, near theintersection of E. Hidden CreekParkway and S. Dobson St. The new

building will replace the existing Station 2, which was built in 1995 and is located at 620 Memorial Plaza.

“Station 2 will be located off of Hidden Creek Parkway with quick access to Interstate I-35W while providing strategic access to major roadways for maximum efficiency in our response,” said Fire Chief K.T. Freeman. “With the growth of the city, the current location of Station 2 is hindering response capabilities to the city’s southern border, HighPoint Business Park and Hidden Vistas subdivision, as well as future residential development that will be located on CR 714.”

Originally built for one crew and minimal vehicles, Station 2 currently has limited amenities for the firefighters it houses. The proposed station will be able to house additional fire apparatuses and crews assigned to that district with room to grow. The new station will also meet modern standards for firefighter safety for decon-ing gear. Also included in the layout is an emergency operation center which will assist in increasing the city’s ability to respond to disasters.

“We also want to make sure that the residents and business owners who currently are close to Station 2 understand that even with the move response times will remain consistent with the average response times throughout the city,” states Chief Freeman. “The city also has an automatic/mutual agreement with Fort Worth’s Station No. 42, located at Spinks Airport, which automatically will respond to any reported structure fire in this area.”

Newsome Construction Inc. was selected through a competitive bid process and will be providing the design, engineering and construction for the new fire station in an amount not to exceed $5,662,087. The funding is provided by bond sales and no increase in the property tax rate will be necessary.

Construction is expected to begin in November 2019 with completion in mid-2021. Firefighters will remain at the current station on Memorial Plaza until construction is complete.

P. TXDOT to start conversion on I-35W service roads to one wayDue to the dangerous nature of the existing two-way frontage roads along I-35W southof Ricky Lane to the city’s southern boundary, TxDOT will be converting the frontageroads to one-way. One-way frontage roads help to improve safety and mobility as wellas reduce wrong-way entrance onto highways. Typically, two-way frontage roads willbe converted to one-way as an area becomes more urbanized and development alongthe corridor increases creating additional travel demands. TxDOT has been evaluating

converting the two-way frontage roads from Ricky Lane to CR 604 for several years and conducted public meetings to discuss the concerns of the land owners.

TxDOT will begin the process of converting the two-way frontage roads to one-way frontage roads from Ricky Lane to County Road 604 the week of November 4, 2019 starting with the southbound frontage road. In order to control the traffic at the exit and entrance ramps, barrels will be set up to direct traffic in a one-way flow pattern to the south. Construction crews will also begin any utility work including storm culvert replacement / extension.

The conversion of the northbound frontage road is scheduled at this time to begin the week of February 2020. This is dependent on any weather delays or unforeseen events that arise during the southbound conversion. Barrels will be placed to control the traffic in the same manner as above and utility work will also be occurring simultaneously.

TxDOT construction crews will resurface stripe the frontage roads after all work associated with the conversion has been completed. Resurfacing is anticipated to begin in April 2020.

TxDOT also proposes to reconstruct the FM 917 bridge after the conversion of the frontage roads are completed. Schedule for the start of the reconstruction of the bridge has not been determined at this time.

QualificationsAny combination of education and experience that would provide the required knowledge, skills, and abilities is considered qualifying. The following is a typical way to qualify:

Education: A Bachelor’s degree from an accredited college or university in Accounting, Finance, or a related field. A Master’s degree in Accounting, Finance, Public Administration, or Business Administration is preferred.

Proposition 4 (HJR 38) “The constitutional amendment prohibiting the imposition of an individual income tax, including a tax on an individual’s share of partnership and unincorporated association income.”

Explanation

Proposition 4 would prohibit the Texas Legislature from establishing a personal state income tax.

Arguments For

• A 2019 poll by the University of Texas at Austin and the Texas Tribune found 71% ofrespondents oppose an individual state income tax. *

• Texas has a low-tax, pro-growth approach to economic expansion, and that is dependenton having no personal income tax.

• This amendment could support population growth in Texas, as families andbusinesses may move to Texas because there is no state income tax.

• An income tax would also increase the size of government by requiring a largebureaucracy to administer it.

Arguments Against

• This amendment is not necessary because the Texas Constitution now prohibits theLegislature from imposing an income tax without a statewide referendum (Art. 8, Sec.24, adopted in 1993). In addition, any net revenue from that tax must be used for thesupport of education.

• Revenue from an income tax could reduce the tax burden on businesses, which pay ahigher proportion of taxes in Texas than in other states.

• The current Legislature and today’s voters should not make taxation decisions for futureTexans. The needs of Texans change over time, so future Texans should make their ownchoices on taxation.

• One reason Texans pay high property and sales taxes may be because Texas has noincome tax. If Proposition 4 passed, these taxes would likely continue to increase, soProposition 4 would not necessarily decrease the size of state government.

Re: Parks Master Plan Youth Outreach Results

Parks Master Plan Youth Outreach Results On June 17, 2019, City Council received a report on the proposed Parks, Trails, and Recreation Master Plan. Council expressed a desire to provide additional opportunities for youth input on the plan. Staff developed a revised survey and began collecting surveys from the youth of Burleson on Monday, September 16, 2019 and concluded the survey on October 11, 2019. Ideas and feedback generated from the youth survey will be included in the Parks, Trails, and Recreation Master Plan.

Staff received more than 2,300 responses to the survey, and the results are included in this report.
