POLICY NO. 3.x STRUCTURE PLANS
PURPOSE To provide guidance on the assessment and determination of applications for subdivision and development within areas requiring a Structure Plan.
POLICY
1. APPLICATION OF POLICY
This Policy applies to the land within the precincts identified in Clause 3.1 and identified on the plans contained in Appendix 1.
2. OBJECTIVE
The challenges of planning efficient road access, open space provision and servicing for large parcels of land creates the need for structure plans to be prepared to guide the subdivision and development of land. Council has identified that these precincts require a Structure Plan before subdivision and development is allowed to occur. The objective of this Policy is to ensure that any subdivision and/or development within areas requiring a Structure Plan does not compromise the longer-term planning for those areas.
3. POLICY
3.1 A Structure Plan is required for each of the following precinct areas (as depicted on the plans contained in Appendix 1).
• Belmont Road• Dudley Road North• Gibbs Park• Lissiman Street• Martin• Kenwick East• Kenwick Library• Kenwick North
• Kenwick Primary School• Kenwick West• North Gosnells• Rimmer Lane• South Maddington• Stafford• Wanaping Road• Yule Brook 3
3.2 Council will not support a Structure Plan for any area geographically smaller than the precincts depicted on the plans contained in Appendix 1, unless it is satisfied that a Structure Plan for a smaller area would represent a self-contained development cell, and progression of the Structure Plan will not prejudice the orderly and proper planning of any other lot(s) within the relevant precinct.
3.3 Clause 27(2) of Schedule 2 of the Planning and Development (Local Planning Schemes) Regulations 2015 states that a decision maker for an application for development approval or subdivision approval may approve an application in the absence of a Structure Plan if it is satisfied that the proposal does not conflict the principles or orderly and proper planning and would not prejudice the overall development potential of the area. In considering such an application, Council will have regard to the whether the proposal:

(i) Impedes the eventual achievement of a comprehensive and permeable road network between lots, incorporating consolidated access points to the existing road system and, if applicable, suitable public access to any conservation and/or recreation reservation.
(ii) Impedes the provision of essential services to the site or surrounding area. (iii) Impedes the eventual achievement of consolidated areas of POS. (iv) Compromises the value or wellbeing of any environmental feature, including
(but not limited to) Bush Forever sites, wetlands, the Canning and Southern Rivers and areas of remnant vegetation.
(v) Presents a long-term constraint to the ultimate urbanisation of the area. (vi) Prejudices the operation of a future City-administered contribution
arrangement to equalise the cost of providing new or upgraded infrastructure and POS needed to service development.
(vii) Further fragments landholdings within the precinct.
3.4 If an application for development approval satisfies the above provisions and is
therefore capable of implementation without prejudicing the future planning and development of the surrounding area, the application is to be assessed against Council’s Local Planning Policy relating to infill development.
