With the Holiday Season now here—we will soon see the start of the 2013 SD Legislative Session early in Janu-ary. In particular, I’m thinking about the Resolutions that were considered and approved at the SDACC Conven-tion in September. These Resolutions will be discussed at your District meet-ings. Copies of the Resolutions may be obtained from Kris or Bob in Pierre or via e-mail from them. I would urge each of you to become familiar with the four approved Resolutions and then discuss them with your local legislatures.

Resolution #2012-01 deals with tax increment financing (TIF). The change in law would allow only the govern-ing body that creates a TIF to use their own tax levy to support the TIF, unless other entities agree to cooperate in the TIF District.

Resolution #2012-02 addresses the sale by a County of tax deeded proper-ty. This Resolution provides that coun-ties can refuse to accept any bids, on tax deeded property, from individuals or companies that are not fully current on all property taxes in that county.

Resolution #2012-03 gives a County the power to regulate or prohibit the use of fireworks outside the bounda-ries of any municipality in the County.

Resolution #2012-05 requires the State of SD to be responsible for all expenses associated with the cost of prosecution and the defense of inmates charged with crimes stemming from their incarceration in state correctional facilities.

The above information is quite brief. Bob and Kris, and members of the SDACC Resolutions Committee will be able to better explain the history

and reasoning behind each of these Resolu-tions. We do expect these Resolutions to encounter opposition lob-bying during the legislative process. Our SDACC lobbyists will be working hard before and during the Session to promote these Resolutions. As members of the Association, we need to step up and lobby our local legislatures concerning these Resolu-tions and other issues as they arise---we can and do make a difference!!!

Greetings! I hope everyone is staying healthy & well. Mr. Flu Bug has made his presence known!

It is hard to believe another year is coming to an end. The courthouse has been busy with the Treasurer’s office collecting taxes, Auditor’s office with election and Register of Deeds’s office with land transfers. Now we are gear-ing up to finish the end of the year .

The Continuing Education Committee will be making plans for workshops in 2013. Please give the committee input on what topics you would like to see on the agenda. So put on your thinking caps and see what you can come up with.

I would encourage the newly elected official to call other county officials if they have questions about their office. I know when I took office I made a lot of phone calls! Everyone I called was always so helpful.

I would like to say THANK YOU to all the County Officials that are retir-

ing and ones that are going on to new ventures. Thank you all for the great job done and the service to County Govern-ment. I wish you well and enjoy!

The executive board will be meeting in December. If anyone has an itemof business to bring before the board, please contact me or Kris.

I hope everyone will get a chance to see the SD Counties Christmas Trees at the Capital and the SD Counties office. It will be fun to see all the different ornaments provided by the Counties.

I hope everyone is starting to get into the holiday spirit! Rememberingeverything we are thankful for and those who are less fortunate. I wish you all a Happy Thanksgiving & Merry Christmas!

Why Understand Poverty?

My friend and author, Leslie Mont-gomery, shared this with me:“Have you ever been faced with a problem that you attempt to solve in a way that you’ve always done and it didn’t work? So then you try the same solu-tion only to do it harder or more delib-erately. When that doesn’t work you become even more aggressive. In the process we get frustrated, try harder, get angry, try harder, and continue to exert so much energy and anxiety that we finally throw up our arms and say “Forget it!’ If we don’t change our method we will start to feel crazy. “

Working with the poor or indigent can be frustrating if our belief is that money is the only aspect of poverty. The way we understand and define poverty determines the steps or solu-tions we take to alleviate poverty. • Poverty caused by laziness- then one must work• Caused by choice- one must make different choices.• Caused by lack on money- one must receive more money.• Caused by a lack of Knowledge-one must educate• Caused by a lack of material re-sources- one must receive material resources.

Poverty has many root causes. It can be a lack of financial, physical, emo-tional, mental, or spiritual resources. The most unique thing with poverty is that each situation is as unique and in-dividual as the person. Unfortunately, the symptoms of poverty can look the same even when the causes differ, thus making it difficult to identify and treat. Like all of us, poor people are not fully aware of all the factors affecting their lives. Just like us, sometimes they are not completely honest with themselves or with others. Without

the proper diagnosis it is impossible to apply the proper treatment. Ste-ven Corbett and Brian Fikkert state in their book When Helping Hurts “When a sick person goes to the doc-tor, the doctor could make two crucial mistakes: (1) Treating symptoms instead of the underlying illness; (2) Misdiagnosing the underlying illness and prescribing the wrong medicine. Either one of these mistakes will result in the patient not getting better and possibly getting worse. The same is true when we work with poor peo-ple. If we treat only the symptoms or if we misdiagnose the underlying problem, we will not improve their situation, and we might actually make their lives worse.”

SDCL 28-13 states: “Every county shall relieve and sup-port all poor and indigent persons who have estab-lished residency”. This process can be one of trial and error. If you are experiencing frus-tration and want-ing to “give up” when working with an individual who is a “chronic consumer” be-cause the financial aid that is given

SDDOT State Planning & Research Program for Local Governments

The Safe, Accountable, Flexible, Ef-ficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) requires that the SD Department of Transportation (SDDOT) sets aside 2% of the apportionments received from several agencies for transporta-tion planning and research activities through the State Planning and Re-search (SPR) Program. The SDDOT has developed this program to admin-ister transportation planning studies at the local level with the use of a portion of these SPR funds on an application and award basis.

Eligibility: All counties and class 1 cities (>5000 population) not included with a MPO (Metropolitan Planning Organization) area will be eligible to apply to have a study conducted under this program.

Funding: The SPR program works on a federal funding matching formula. The local entity will provide reim-bursement to the SDDOT to provide the matching funds to the federal SPR funding for these studies. The lo-cal entity will reimburse the state a minimum of 20% of the study’s total cost upon completion of the study.

Application and Award: The SDDOT will solicit applica-tions each January for inclusion in the fiscal year’s work program (July 1 - June 30). Application solicita-tion letters are sent to the city engineer and

planner of all eligible class 1 cities and all county highway superintendents. Applications will be due at 5:00 pm, March 1st.Study Development: Upon approval of the application, the SDDOT will work with the local entity to establish a study advisory team to develop the study’s scope of work for inclusion into a Request for Proposal (RFP).

Types of Studies Eligible for SPR: Major Street/Roadway Plan Devel-opment; Corridor Studies; Bicycle Plans; Pedestrian Plans; Intermodel Plans; Access Management Standards Development; Long-Range Construc-tion Program; Area Master Trans-portation Plans; Economic Impact Studies; Funding/Revenue Studies; Management System Development & Implementation (Asset, Pavement, Roadway, Structures, etc.).

Some of the most expensive claims that a county may incur include Employment Related claims. These types of claims can include wrongful termination, discrimination, and fail-ure to hire, in addition to many other allegations.

Several years ago, the South Dakota Public Assurance Al-liance instituted an Employment Practices Hotline to help our members control these types of claims and reduce the frequency and/or severity of these claims. For members of the SDPAA, the Pool provides up to one free hour of expert advice from one of two law firms that are experts in this volatile area. While this hotline has been successful in helping many members, there are still some members who do not take advantage of the Hotline.

For the past four years, the South Dakota Public Assur-ance Alliance has incurred a loss ratio greater than 170% for Officials Liability which includes Employment Related claims. This includes the amounts for damages and the cost to defend these types of claims. This means that for every dollar the SDPAA collects for this coverage, more than $1.70 has been paid for damages or defense of these types

of claims.

The SDPAA wants to reward those members who use the Hotline and comply with the advice provided by the ex-perts. In order to both encourage the use of the Hotline and reward the members who call and follow the advice, effec-tive in 2013, the SDPAA will be amending the deductible on Employment Related Claims only. For these types of claims, there will be a minimum deductible of $5,000. The deductible for other Officials claims will not change. The deductible for Employment Related Claims will be fully waived; however, if the member has contacted the Hotline and follows the advice provided by the expert attorneys who provide this advice.

To completely avoid incurring a deductible for Employ-ment Related Claims and possibly avoid this type of claim entirely, we encourage members to contact the Employment Practices Hotline at 1-888-313-0839.

is not alleviating the problem, it may require a different solution. This approach benefits both the county and the individual to begin looking further into identifying possible causes. By identifying the cause, you can then connect the individual to appropriate resources that can help alleviate the poverty issue. The greatest thing about the process is that it is a win/win for the county and the individual.

Sometimes when we work with someone who is a “chronic consumer” it can begin to influence us on how we view every individual in poverty. As I close I would like to share one of my favorite poems. As you work with the poor how has it influ-enced you? Are you a carrot, egg, or coffee?

Carrot, Egg, or Coffee? Author UnknownA young woman went to her mother and told her about her life and how things were so hard for her. She did not know how she was going to make it and wanted to give up. She was tired of fighting and struggling. It seemed as one problem was solved a new one arose.

Her mother took her to the kitchen. She filled three pots with water. In the first, she placed carrots, in the second she placed eggs, and the last she placed ground coffee beans. She let them sit and boil with-out say a word. In about twenty minutes she turned off the burners. She fished the carrot out and placed them in a bowl. She pulled the eggs out and placed them in a bowl. Then she ladled the coffee out and placed it in a bowl. Turning to her daughter, she asked, “Tell me what do you see?”

“Carrots, eggs, and coffee,” she replied.

She brought her closer and asked her to feel the car-rots. She did and noted that they got soft. She then asked her to take an egg and break it. After pulling of the shell, she observed the hard-boiled egg. Fi-nally, she asked her to sip the coffee. The daughter smiled, as she tasted its rich aroma. The daughter then asked. “What’s the point, mother?”

Her mother explained that each of these objects had faced the same adversity—boiling water—but each reacted differently. The carrot went in strong, hard and unrelenting. However after being subjected to the boiling water, it softened and became weak.

The egg had been fragile. Its thin outer shell had protected its liquid interior. But, after sitting through the boiling water, its inside became hardened.The ground coffee beans were unique, however. After they were in the boiling water they had changed the water.

“Which are you?” she asked her daughter. “When adver-sity knocks on your door, how do you respond? Are you a carrot, an egg, or a coffee bean?”

Stanley County was created in 1873 and organized in 1889. The county is named for Brig. General David Stanley who was commander at Fort Sully for many years.

The first to visit the area are believed to be the Verendrye brothers. In 1743, they buried a lead plate on a hill over-looking Fort Pierre and claimed the land for France. The plate was found by school children in 1913. It is now on display in the Memorial Museum in Pierre.

In the spring of 1817, Joseph LaFramboise built a trading post near the mouth of the Teton (Bad River). The main function of this post was to provide shelter and protection for the fur traders. This trading post became known as Fort Pierre. In 1831, the first steamboat, the Yellowstone, navigated the Missouri and docked at Fort Pierre. This new transportation was a great stimulus to the fur trade and within a short time Fort Pierre was the leading trading post in the northwest.

At the time Stanley County was organized, it was much smaller than today. The Legislature of 1897 passed a bill to annex the unorganized counties of Sterling, Jackson, Now-lin and Armstrong. Stanley County today is what remains after Haakon and Jackson counties were separated in 1914.

Incorporated in 1890, Fort Pierre is said to be the oldest continuous settlement in South Dakota. It derives its name from a pioneer fort. The town was selected as the county seat after a spirited contest with the old town of Stanley.

Hayes is named for two early settlers in the vicinity, Wil-liam and John Hayes. The name was selected from a list of patrons of the post office when it was established in 1892.

Mission Ridge was named by Mrs. W.W. Bear, first post-master, because of its position on an unnamed ridge at the head of Mission Creek.

Wendte was named for H.S. Wendte, a German settler from Nebraska. It was first called Lance Creek for a nearby stream.

Every year when the weather turns colder, South Dakotans get excited for the annual events that are hallmarks of our American heritage such as Hallow-een, Thanksgiving and Christmas. Another less prominent but very im-portant annual event is the Medicare Open Enrollment Period. Running from October 15 through December 7, the open enrollment period is an op-portunity for those on Medicare to de-cide whether they need to change their plan or prescription drug coverage. My grandmother is on Medicare, so I have firsthand knowledge of the ques-tions that often arise about Medicare and the open enrollment process. It is important that seniors know there are places they can go to get help. Here in South Dakota, there is a pro-gram called Senior Health Information and Insurance Education, or SHIINE. Its purpose is to help seniors with their Medicare benefits, particularly

during the open enrollment period. In fact, SHIINE has over 300 volunteers and partners standing ready to answer questions during the open enrollment period. To get in touch with a SHIINE representative, South Dakotans can call 1-800-536-8197. Additionally, I have four offices lo-cated across South Dakota that stand ready to help you, and the numbers and contact information for those of-fices can be found on my website at Noem.house.gov. My staff can help answer questions on Medicare and the open enrollment process, as well as provide assistance regarding Social Security, veterans benefits or other issues South Dakotans may be having with the federal government. I encourage all South Dakotans on Medicare to take a look at their plan, compare their options and make choices that best fit their needs.
