Part A: Conditions of Tendering

1. Introduction 1.1 Invitation to Tender

Yarriambiack Shire Council invites tenders from qualified companies and personnel for the construction of E-Waste Disposal Sheds at the Hopetoun, Murtoa and Warracknabeal Transfer Stations as per Council’s specifications.

1.2 Definitions In these Tender Conditions, the following terms have the meanings indicated, unless inconsistent with the context:

"Best Value Principles" means the Best Value Principles described in section 208B of the Local Government Act 1989;

“Council” means Yarriambiack Shire Council “Tenderer” means the person/company submitting an offer

2. Nature of Contract

2.1 Services to be Performed

The Services are described in Part E: Specification. Tenderer’s should, however, ensure that they read the Contract Documents fully to ascertain the Services to be performed and the terms on which the Services are to be performed, as the Contract will be evidenced solely by the Contract Documents.

2.2 Contact Staff

2.3 No Canvassing Any tenderer who canvasses a Councillor or a Council staff member will be disqualified.

2.4 Type of Contract

The Contract, for which a Tender in accordance with these Standard Conditions of Tendering and the Specific Conditions of Tendering (if any) (herein called the "Conditions of Tendering") is made, is a Lump Sum Contract and all work performed under it shall be in accordance with the Contract Documents as defined hereunder.

3. Tenders

3.1 Tender Documents

The tender document consists of the following components issued by Council to tenderers for the purpose of tendering and are identified as follows,

3.2 Lodgement of Tenders

Tenders are to be in writing and placed in a sealed envelope and addressed to:

Tenders can be lodged in the Tender Box located at the Municipal Offices of the Yarriambiack Shire Council, 34 Lyle Street, Warracknabeal, or be posted to and received at the above address prior to the closing time and date.

The closing time and date for this tender is 2 pm on Monday 4th February, 2019

Tenders received after the closing time and date stated above, will not be considered. The lowest or any tenders will not necessarily be accepted. Emailed or faxed tenders will not be accepted.

Tenderers must ensure that they have provided two (2) signed copies of their tender (one to be marked “ORIGINAL” and bound, the other to be marked “COPY”). Any brochures or pamphlets must be attached to both the original and the copy.

A tender shall be rejected without consideration of its merits in the event that it is not submitted before the deadline and at the place specified. The tender may be rejected if it fails to comply with any other requirements of the specification.

All documents, materials, articles and information submitted by the Contractor as part of, or in support of a tender, shall become upon submission, the absolute property of Council and will not be returned to the Contractor at the conclusion of this tender process PROVIDED that the Contractor shall be entitled to retain copyright and other intellectual property rights therein, unless otherwise provided by the Contract.

3.3 Disclosure of Information

Documents and other information relevant to the tender may be disclosed when required by law under the Freedom of Information Act 1992 or under a Court order. All contractors will be given particulars of the nominated contractor or advised that no tender was accepted.

3.4 Validity Period

All tenders shall remain valid and open for acceptance for a minimum period of 60 days from 30th November, 2018, or forty-five (45) days from Council’s resolution for determining the award of the tender, whichever is the later, unless extended by mutual agreement between Council and the relevant tenderer in writing.

3.5 Notice to Tenderers

· Tenders received on other than the approved Tender Form cannot be considered. · The lowest or any tender need not necessarily be accepted. · Tenderers are required to attach OH&S Declaration, Questionnaire and their company

profile and details of previous experience on similar projects together with the tender document.

· Council is not liable to the Tenderer for any cost, losses and expenses incurred by the

Tenderer in preparing the tender documents.

3.6 Privacy Statement Personal information requested in this form will only be used by Council for contract administration purposes and will not be disclosed without your consent except where authorised by law. You have the right to seek access and correction of your personal information.

3.7 Information to be submitted with Tender

The following forms and information should be submitted with the tenders. Tenders without any of the required information and signed by the Tenderer shall not be considered.

4. Evaluation of Tenders

4.1 Best Value Principles Council has adopted a best value for money approach to this Contract. The Contract will be awarded to the contractor who best demonstrates the ability to provide quality services at a competitive price.

The tender will be assessed with the following evaluation criteria to determine the most advantageous outcome for Council. This means that, although price is considered, the Contractor containing the lowest price will not necessarily be accepted, nor will the Contractor ranked the highest on the qualitative criteria.

4.2 Evaluation Criteria

The tender evaluation panel will evaluate tenders in accordance with the evaluation criteria listed below (in order of importance):-

· Tender Price · Demonstrated Experience on Similar Projects · OH & S Management

· Local Benefit

4.3 Post – Tender Submissions

Council may require a Tenderer to submit additional information concerning its tender or to personally discuss its tender before any tender is accepted.

Should a Tenderer fail to -

· submit the additional information so required by; or

· attend personally to discuss its tender at -

the date and time stipulated by Council, its tender may not be further considered.

4.4 Acceptance of Tender The successful tenderer will be notified in writing of the acceptance of its tender. The notification of the acceptance of tender will create a contract between the parties on the basis of the successful tenderer's tender and the Contract Documents. The successful tenderer must execute and return to Council a formal agreement in the form of the Contract Documents, as amended by the insertion of any details which tenderer’s are required to include in tenders within seven (7) days of its receipt.

8. Insurances

8.1 Public Liability Insurance The Contractor shall maintain an appropriate Public Liability Policy of Insurance

covering the Contractor in respect of any claim arising from or related to the provision of the Project Services. Such policy shall be for an amount not less than $20,000,000 and the insurer shall note on the relevant policy the interests of Council under this Agreement.

Part D: Occupational Health and Safety Declaration General OH&S Requirements For All Contracts Council is obligated to provide and maintain, so far as is practicable, a working environment for its employees and members of the public, that is safe and without risk to health. This requirement applies equally to contractors undertaking works and services on behalf of Council. The Contractor and any sub-contractors that may be engaged by the Contractor to perform works under this Contract Agreement shall at all times identify and exercise all necessary precautions for the health and safety of all persons. This includes the employees of the Contractor, Council employees and members of the public who may be affected by the works. The Contractor will inform itself of all Occupational Health and Safety (OH&S) policies, procedures or measures implemented or adopted by Council and/or the occupiers of any premises at or within which the Contractor will perform works under this Contract Agreement. The Contractor will comply with all such policies, procedures or measures; and in the event of any inconsistency, will comply with such procedures or measures so as they produce the highest level of health and safety. The Contractor will comply with any and all directions by Council relating to OH&S. 1.1 Legislative Compliance The Contractor must comply with and ensure that its employees, sub-contractors and agents comply with all applicable Acts, regulations, local laws and by-laws, Codes of Practice, Australian Standards and Council’s OH&S policies and procedures that are in any way applicable to this Contract Agreement or the performance of the works under this Contract Agreement.

2. Risk Assessment

A Risk Assessment shall be completed by the successful Contractor in relation to the contract works and submitted to Council for approval prior to commencement.

The primary objectives of the Risk Assessment are to:

· identify hazards associated with contract tasks and activities

· determine the level of risk

· establish appropriate risk control measures

Each major or significant task or activity associated with the contract shall be assessed in terms of the associated hazards. When all hazards have been identified the most likely outcome as a result of an incident shall be determined.

Part E: Specification

1. SCOPE OF WORK

This contract is for the construction of a Drive Through Truck Shed with End Walls at the Hopetoun Works Depot. Dimensions: Building Length – 12m (Approx) – 2 Bays Building Width – 9mm (Approx) Building Height – 5 mtrs (Clearance) Roller Doors: 5m X 5m 3m X 3m Concrete Slab: 125mm thick with 500mm x 300mm Perimeter Beams

2. LOCATION

Hopetoun - 8 Tip Rd, Hopetoun Murtoa - 1281 Wimmera Highway, Murtoa Warracknabeal - 108 Tip Road, Warracknabeal

3. ON-GOING OPERATIONS OF THE DEPOT The contractor will need to accommodate the health and safety of Council staff working within the Council Depot and to keep the disruption to the on-going operations of the Depot to a minimum – the Contractor shall liaise with Council to confirm these arrangements.

4. CONTRACT TERM

The maximum timeline for completion of the works is eight weeks after the hand-over of the site. Tenderers are requested to provide their project methodology and delivery timetable with their tender. Access to the site will be available from Monday 7th January, 2019 or earlier by mutual agreement.

5. MAKE GOOD ANY DAMAGE

Any damage to pavements, adjoining/supporting building components, services, or Council’s

workshop equipment, arising from demolition and/or construction works, shall be repaired/replaced to the satisfaction of Council and at the contractor’s cost.

6. WARRANTY

The Contractor shall supply an unconditional warranty to Council for all workmanship and materials and their compliance with this specification. A 12 month Maintenance period will apply.

7. SPECIFIC REQUIREMENTS OF THE PROJECT

(a) Shed Size 12m (Approx) Long X 9m Wide X 5m High Clearance with 2 bays at spouting and flashing to be included. (b) Wall and roof Cladding – Zincalum.

(c) Frame to be steel, primed and painted (d) To be constructed on the existing pavement (e) Drainage Stormwater to the ground.

(f) Council approval of the detailed drawings is required prior to the commencement of

on-site work Contractor will be responsible for obtaining all permits required for this project.

8. SUPPLY OF EQUIPMENT The Contractor shall provide all scaffold, safety equipment, elevated platforms, plant and

equipment and labour required to carry out the construction works.
