Indiana Boating Safety

AGE RESTRICTIONS:All Motorboat operators in Indiana must have a valid driver’s license to

operate on all public waters. Operators who are at least 15 years of age anddon’t have a driver’s license may operate a motor vessel if they take a NASBLapproved boater education course and have an I.D. Card issued by the Bu-reau of Motor Vehicles (BMV).PERSONAL FLOTATION DEVICES (PFD):

Boats less than 16 feet long, and a canoe or kayak of any length, musthave onboard a U.S.C.G. approved PFD for everyone onboard.

Boats 16 feet and longer must have wearable PFDs for everyone onboardPLUS at least one throwable (Type IV) PFD.

Personal Watercraft operators and passengers must wear an approvedType I, II, III, or V PFD.

Required PFDs must be readily accessible.RECKLESS OPERATION:

Reckless operation of a boat, when a boat is operated carelessly in willfuldisregard of the rights, safety, or property of others, is a crime in Indiana.Examples of reckless operation include:

• Excessive speed in regulated or congested areas or during times of re-stricted visibility

• Operating in a manner that may cause an accident• Operating under the influence of alcohol or drugs• Operating in a swimming area with bathers present• Towing water skiers where obstructions exist or a fall might cause them

to be injured• Bow riding or riding on the gunwale or transom where no seating is

provided• Operation of a personal watercraft which endangers life or property.

EXHAUST MUFFLER REQUIRED:No person shall operate any powercraft without a muffler, underwater ex-

haust, or other device that muffles or suppresses the sound of the exhaust atall speeds.WATER SKIING/TUBING:No person shall tow a person on water skis, tube, or similar device withoutan observer (in addition to the boat operator) aboard to observe the skierand the towline.

Water skiing/tubing is not permitted between after sunset and beforesunrise.PERSONAL WATERCRAFT (PWC):

Persons less than 15 years of age shall not operate a Personal Watercraft.Each person on a Personal Watercraft (PWC) must wear a Coast Guard ap-proved PFD. Additionally, the operator must wear a lanyard type cut off

switch provided by the manufacturer which will shut off the PWC should theoperator fall off.

A PWC is a boat and operators of PWCs must obey all boating regula-tions and requirements. The operator of a Personal Watercraft should oper-ate in a reasonable and prudent manner. When operating a PWC, DO NOT:

• weave through congested traffic• follow a watercraft that is towing other individuals• jump the wake of another watercraft• cut between a boat and an individual being towed• cross paths with another watercraft when vision is obstructed• steer toward an object or person in the water and turn sharply at close

range.Do not operate a Personal Watercraft at night.PWCs may be used to tow skiers/tubes if the PWC is designed to seat at

least three people and is at least 10 feet long. Also, a person other than theoperator must be onboard as an observer.BOAT LIGHT REQUIREMENTS:

Boats under way between sunset and sunrise must display a green bowlight on the starboard (right) and red bow light on the port (left), as well asan “all around” (visible from 360 degrees) white light on the stern. Boats atanchor must display one all around white light visible to any approachingcrafts. Rowboats or paddleboats must have an all around white light ready todisplay in time to prevent collision.ENVIRONMENTAL AWARENESS:

It is unlawful to litter in Indiana state waters. You should properly dis-pose of your litter on shore.

In Indiana, the discharge of sewage from marine toilets is prohibited onall public waters. A boat equipped with a toilet must have a holding tank tostore the waste that can later be disposed of at a shore-side facility. A freeshore-side facility is available at the DNR boat ramp on Wawasee Lake. Theboat may use a treatment system as long as it is approved by the Departmentof Environmental Management.

What can I do to help prevent the spread of Zebra Mussels?• Inspect boat and trailer for weeds and remove. Zebra mussels are often

found on aquatic plants.• Flush the cooling system, bilge areas, and live wells with tap water and

discard all bait that may have contacted infested waters.• Let your boat dry out of the water for 10-14 days. If visibly fouled by

algae wash the hull with hot water (140 degrees F), which kills zebra mus-sels. High-pressure spray will also help remove them.ACCIDENT REPORTING:

Any accident involving death, disappearance or personal injury, or dam-

Indiana Boating Safetyage greater than $200 must be reported within 48 hours to the Departmentof Natural Resources.BOATING WHILE INTOXICATED:

Operating a boat under the influence of intoxicants is against the law.Refusal to submit to a test may result in loss of operating privileges for oneyear.SPEED LIMITS AFTER “OFFICIAL SUNSET”:

No skiing, or any other activity requiring speeds in excess of 10 MPHmay be engaged in between the official time of sunset and sunrise. Syracusehas a flashing beacon light on the NW corner of the lake (at the public pier)that starts flashing at sunset.DAMAGE TO MARKER BUOYS:

The Lake Association has been charged by the Indiana Department ofNatural Resources with the responsibility of placing and maintaining State-Owned Marker Buoys. These are placed less than 200 feet from shore in lo-cations considered particularly critical as warning to boaters to keep theirdistance from shore (such as off point of land) or to reduce their speed (suchas entries to channels). Intentional damage or other interference with thesebuoys is a crime against the State and carries a severe fine, a jail sentence, orboth. These buoys are anchored with a chain and will probably damage aboat if hit.LEGAL DISTANCE FROM SHORE:

It is unlawful to operate a motorized boat closer than 200 feet from theshoreline, unless coming or going from the shore; also to operate at greaterthan idle speed closer than 200 feet from shore.REGISTRATION/TITLING:

All motorboats operated on the waters of Indiana must be registered andnumbered. Motorboats legally registered in another state can be used in In-diana for 60 consecutive days before an Indiana registration is required.

The Bureau of Motor Vehicles handles the application for registrationand fees are based upon the length of the boat. The BMV issues a certificateof registration and 2 decals indicating the class of your boat and the monthand year of expiration. You must carry the registration certificate onboardwhen underway.

A watercraft that is required to be registered in Indiana must have a cer-tificate of title, except for the following:

• A watercraft acquired by its owner before 1/1/86• A watercraft that is less than $3,000 in value when new• A home-built watercraftAlthough these are excepted, you may want to title your watercraft as it

verifies ownership, in case the boat was stolen.The number on your registration certificate must be attached or painted

on each side of the forward half of the vessel where it can be easily read. Thenumbers and letters must be 3” in height, vertical, plain block characters incontrast to the hull color. The decals are placed to the right of, and within 3”of the registration numbers. Only the current decals shall be displayed.

Indiana and federal boating laws are presented in a summarized form.The laws in their entirety can be found by consulting Indiana State Law.These laws are subject to change. It is the responsibility of the operator to beaware of the most current laws when using a boat.

Certain bodies of water in Indiana have local restrictions as to type andsize of watercraft or motor horsepower, restricted use areas, boat speed, andtimes for use. Check with the local authorities for these additional restric-tions.

INSTRUCTIONS: Applicants who received a reserved date must complete license application within thirty (30) days of notification and at leastsixty (60) days before the scheduled event, whichever is earlier. Failure to submit a timely completed application releases the reservation.

All other applications for a license to conduct a fishing tournament must be completed at least sixty (60) days before the scheduled event.

The applicant shall attach, to this application, the proposed standards and regulations governing the tournament.

312 IAC 2-4-9 GENERAL DUTIES OF A LICENSE HOLDER

Sec. 9. In addition to the terms of the license and the requirements otherwise set forth in this rule, a license holder must do the following:

(1) At least fourteen (14) days before the scheduled event, deliver a list of officials who will be present during the event.(2) Obtain permission from the department to use a zone or zones in the public waters for mooring, judging, weigh-in, starting or for any other activities using public facilities.(3) Upon the request of the department, meet with a designated authorized representative or representatives before a tournament orother organized activity begins.(4) Remove equipment and refuse and otherwise restore zones used in connection with a fishing tournament or other organized activity to condition that existed before the event as directed by the department.(5) Provide officials needed to supervise participants and spectators.(6) Require each participating watercraft to clearly display a logo, banner, or other visible item approved by the department to identifythe tournament or other organized activity.(7) Establish a starting location for the tournament or other organized activity within an idle speed zone.(8) Refrain from and prohibit the sale of food, beverages, or supplies within the area of the activity unless approved in writing by the department and the owner of the area.(9) Refrain from obstructing ingress, egress, or regress from private property.(10) Assure reasonable access to all persons to public use facilities, including swimming areas, mooring areas, navigational channels, and similar facilities. Limitations on the usage of facilities must include the following:

(A) Except as provided in clause (B), vehicles and trailers of contestants must use no more than seventy-five percent (75%)of the ramp and parking facilities in the staging area of the tournament.(B) The owner of the staging area may, in writing, authorize more than the maximum allowed usage under clause (A). This clause does not apply to a fishing tournament that is subject to section 12 of this rule.

(11) Sponsor no more than one (1) event licensed under this rule on the same waterway with starting dates separated by less than fourteen (14) days. A tournament scheduled for two (2) consecutive days is considered a single event. The Division of Law Enforcementmay authorize an individual to seek more than one (1) event on the same waterway, with starting dates separated by less thanfourteen (14) days if in seeking the license the individual is acting as the agent for different tournament organizations.(12) Act in good faith to fully perform the event. A person who demonstrates a pattern of violations of this subdivision may be denied another license.

Eating recreationallycaught fish from Indianawaters can be healthy andtasty when you have theproper information. Thefollowing section shouldalleviate most anglers’ con-cerns about eating wild-caught fish.

It’s all about a person’s ex-posure to contaminants

over time. The two con-taminants that drive thefish consumption advisoryare mercury and polychlo-rinated biphenyls (PCBs).Both contaminants aregenerally persistent in theenvironment at lowenough levels they do notpose a health risk from di-rect contact with the water.However, both contami-

nants accumulate in fishtissue. The contaminantsaccumulate in human tis-sue like they do in fish andcan build to levels thatcould pose a health threat.

The consumption advisoryis based on a model thatpeople are consuming 8oz. of fish on 225 dayseach year over 70 years. Adetermination can then bemade from concentrationsof contaminants in fishtested as to how frequentlythey can be safety eaten(note the fish consumptionadvisory groups).

The consumption recom-mendation groups rangefrom 1 to 5 with 1 being

unlimited consumptionand 5 being do not eat.Most anglers do not eatwild-caught fish nearly thisfrequently. As a result, ifthey are aware of the con-taminant levels that likelyare in the fish they catch,they should have little con-cern about eating them.

WHO NEEDS A FISHING LICENSE

To fish in public lakes, streams, rivers ortributaries in Indiana or its boundary wa-ters, you must have a valid fishing licensethat is signed in ink, or qualify for a li-cense exemption. You must carry your li-cense with you when fishing and present itto an Indiana Conservation Officer (orany authorized law enforcement official)upon request. There are fines and penal-ties for fishing without a license.

Indiana residents who are 64 years old andborn after March 31, 1943 are eligible tobuy a Senior Annual or Senior Fish forLife License.

A fishing license may be revoked if the li-cense holder is convicted of violating fishand wildlife regulations. Any equipment,appliances and apparatus used in the vio-lation of Indiana fish and wildlife lawsmay be seized for evidence and, upon con-viction, confiscated.

To qualify for resident fishing licenses, aperson must have established a true fixedand permanent home and primary resi-dence in Indiana for 60 consecutive daysprior to purchasing a license or permit andnot claim residency for fishing, hunting ortrapping in another state or country. Allothers are non-residents.

To legally fish for or take trout and salmonfrom public waters, you must also have avalid trout and salmon stamp privilegeand a valid fishing license (signed in ink).Trout/salmon stamps can be bought sep-arately as a commemorative issue. Com-memorative stamps do not convey fishingprivileges. Contact the DNR CustomerService Center, Indiana Government Cen-

FISHING LICENSE EXEMPTIONS

A fishing license and trout and salmonstamp are NOT required for:

• Residents born before April 1,1943. However, you should carry yourdriver’s license or other identification toverify your age and residency.

• Resident and non-resident anglersunder the age of 18.

• Residents who are legally blind. • Residents of a state-owned mental re-

habilitation facility. • Residents of any licensed health care

facility in Indiana taking part in a super-vised fishing activity sponsored by the fa-cility.

• Fishing a private pond does not re-quire a license. However, the angler musthave permission from the property ownerto fish.

• Residents of Indiana who are engagedin full-time military service may fish with-out a license while on approved militaryleave. However, the angler must carry

leave orders and a valid Indiana driver’s li-cense or voter registration card. Non-res-ident military personnel stationed withinIndiana must obtain a resident license tofish or hunt in Indiana.

• Landowners or lessees of farmland,who farm that land, their spouses andchildren living with them, while fishing inpublic waters from the farmland they ownor lease.

Migratory game bird and water-fowl hunting dates are set by theU.S. Fish and Wildlife Service in co-operation with Indiana and otherstates. State/Federal Regulation Reminders• In order to hunt ducks and geesein Indiana, all individuals must havean Indiana hunting license, an Indi-ana waterfowl stamp privilege and afree Harvest Information Program(HIP) validation number. Com-memorative (traditional) waterfowlstamps do not convey hunting privi-leges. Additionally, all persons 16years or older must have a signedFederal duck stamp to hunt water-fowl. Federal duck stamps are avail-able at most post offices and onlineat www.fws.gov/duckstamps. Statewaterfowl stamp privileges are avail-able from hunting and fishing li-cense vendors and online atIndianaOutdoor.IN.gov.• Indiana enforces all federal mi-gratory bird laws. Violating any pro-vision of a state law regardingfederally protected migratory birds isalso a violation of federal law.• Migratory game birds may behunted from a motorboat providedit is beached, resting at anchor, tiedto a stationary object, or withoutmotion other than that imparted bywind and current acting upon the

hull, or due to hand-op-erated oars or paddles.• Hunters may retrievedead or injured birds byhand or from a motor-boat under power butmay NOT shoot from aboat under power or inmotion due to motorpower.• Migratory game birdsin a hunter’s possession must haveone fully feathered wing or head at-tached to the carcass for identifica-tion when the hunter is in the fieldor traveling from the field to home.• All migratory game birds killedor crippled shall be retrieved, if pos-sible, and retained in the custody ofthe hunter in the field.• No person shall give, put or leaveany migratory game birds at anyplace or in the custody of anotherperson unless the birds are tagged bythe hunter with the following infor-mation:

• The hunter’s signature.• The hunter’s address.• The total number of birds in-volved, by species.• The dates such birds werekilled.

• No person or business shall re-ceive or have in custody any migra-tory game birds belonging toanother person unless such birds areproperly tagged.

Non-Toxic ShotHunters are required to use approvednon-toxic shot while hunting all wa-terfowl. Hunters are also required touse non-toxic shot to hunt mourn-ing doves on all DNR properties.

Coatings of copper, nickel, tin,zinc, zinc chloride, zinc chrome, and

fluoropolymers on approved non-toxic shot types are allowed. Leadshot plated with copper, nickel orother material does not qualify. The use of lead shot for hunting waterfowl was banned nationwide in 1991.

It is illegal to possess shells loadedwith anything other than approvednon-toxic shot while hunting ducks,geese and coots anywhere in thestate.

It is illegal to possess lead shotwhile hunting mourning doves onany state-managed property.

Waterfowl Hunting on State AreasHunters can apply for reserved wa-terfowl hunts by completing the re-served waterfowl hunt applicationonline at hunting.IN.gov.
