Purpose 1. Annex 1 and Appendix 1 of this circular provide a revised consolidated list of medical practitioners approved under section 20 of the Mental Health (Scotland) Act 1984 as having special experience in the diagnosis or treatment of mental disorder. 2. Annex 2 of the circular reminds NHS Boards and Trusts of the requirement for Boards to satisfy themselves that practitioners being approved under section 20 of the 1984 Act have been appropriately trained in the diagnosis and treatment of mental disorder. ANNEX 1 MENTAL HEALTH (SCOTLAND) ACT 1984 LIST OF APPROVED MEDICAL PRACTITIONERS UNDER SECTION 20 1. I enclose a copy of the revised consolidated list of medical practitioners approved under section 20 of the Mental Health (Scotland) Act 1984 as having special experience in the diagnosis or treatment of mental disorder. 2. The list can be accessed on the Scottish Executive website at www.show.scot.nhs.uk/sehd/publications/dtmd/dtmd-00.htm It is our intention to update the list periodically. Therefore, I should be grateful if NHS Boards could provide details of any changes on a regular basis to the Public Health Division of the Scottish Executive Health Department, Room 3E.04, St Andrew's House, Edinburgh, EH1 3DG. 3. From 1 April 2002 the guardianship provisions in the 1984 Act will be repealed (including section 39). Those medical practitioners approved under section 20 of the 1984 Act will wish to note, therefore, that from 1 April 2002 they will have responsibilities for providing recommendations for Intervention and Guardianship Orders under Part 6 of the Adults with Incapacity (Scotland) Act 2000 where the adult has incapacity by reason of mental disorder. 4. Scottish Executive Health Department Circular NHS HDL (2001) 31 dated 5 April 2001 gives full details on the implementation of the 2000 Act and its effect on the Mental Health (Scotland) Act 1984 and on the Criminal Procedure (Scotland) Act 1995 (Health Department web-site www.show.scot.nhs.uk )

ANNEX 2 MENTAL HEALTH (SCOTLAND) ACT 1984 APPROVED MEDICAL PRACTITIONERS UNDER SECTION 20 – TRAINING COURSES RUN BY ROYAL COLLEGE OF PSYCHIATRISTS, SCOTTISH DIVISION Background 1. The guidance in this Annex follows on from Scottish Executive Health Department Circular NHS HDL (2001) 40 dated 30 April 2001 (www.show.scot.nhs.uk) which gave guidance on the Mental Health (Scotland) Act 1984 in relation to approved medical practitioners under section 20 and training courses run by the Royal College of Psychiatrists, Scottish Division. Action 2. NHS Boards are asked to ensure that those approved medical practitioners under section 20 of the 1984 Act undertake regular refresher courses in the provisions of the Mental Health legislation at intervals of not more than 5 years. The workload of section 20 approved medical practitioners should not preclude them from attending refresher courses. 3. NHS Boards will also wish to note that the legal liability for section 20 approval remains with them and they are required to fund practitioners' attendance on the training courses. Post-Graduate Deans are required to pay for the attendance of Specialist Registrars. NHS Boards and Post-Graduate Deans are asked to settle payment for training courses promptly. 4. A Steering Group has been set up in order to maintain an overview of the training required for relevant practitioners under the 1984 Act and any subsequent legislation which replaces it. The Steering Group has representatives from the Primary Care Trust Medical Directors, the NHS Board General Managers Group, the Royal College of Psychiatrists and the Scottish Executive Health Department. The first meeting of the Steering Group is to take place shortly.

APPENDIX 1 LIST OF MEDICAL PRACTITIONERS APPROVED BY NHS BOARDS UNDER SECTION 20 OF THE MENTAL HEALTH (SCOTLAND) ACT 1984 AS HAVING SPECIAL EXPERIENCE IN THE DIAGNOSIS OR TREATMENT OF MENTAL DISORDER NOTES 1. Mental and Mental Handicap Hospitals are shown with catchment areas. 2. Against the name of each doctor on the list details are given, where appropriate, of the type of psychiatry in which he/she specialises or has special experience, in accordance with the code shown below:- GEN - work principally in general psychiatry MHcp - special experience in mental handicap CH - special experience in child and adolescent psychiatry 3.
