So this sale, highly curated as it is, kicks off “spirits season” here at Zachys. In June, we have another roughly $1m in spirits selling from our Hong Kong sale room, and some exciting offerings on tap for London this fall.

Karuizawa Geisha

Although Karuizawa distillery officially closed its doors in 2011, it hadn't been officially been producing whisky since 2000. In 2018 the Pearl Geishas were released separately as 37 and 38 year expressions. Pulled from Sherry cask #4348, the 38 year was the oldest expression in the Geisha series upon release, packed with classic Sherry oak notes and richness.

The Macallan

Irish monk St. Fillan was a Christian missionary who lived in the eighth century. During his travels through what is modern day Speyside in Craigellachie, Moray, he noted how fertile the land was. The Macallan, derived from Gaelic, is associated with prestige and quality and the reputation has lived on for well over 1000 years.

Exclusively using sherry casks in their older bottlings, their maturation and their style are known to be some of the most dense and rich whisky in Speyside and beyond.

The famed distillery has changed hands a few times over the centuries but the ultra-soft water source from deep underground remains constant. The demand for The Macallan malts far overshadows the supply and, as a result, any limited release by this distillery becomes an instant treasure.

Many purists of The Macallan maintain that the vintage bottles with distillation dating back from the 1970s contain some of the famous distilleries greatest drams. Today, Zachys has on offer some of these difficult to find bottles.

After a long heritage of making sake, in 1941, Isouji Akuto founded Hanyu distillery in the mountainous region of Saitama, not too far from Tokyo. Akuto took advantage of Japan’s whisky Boom of the late 70’s and began distilling Single Malt Whisky in 1980. Production ceased just 20 years later, but thankfully for everyone, in the 2000s, a young former employee of Suntory purchased the forgotten casks that were never bottled before they were destroyed by the distillery’s new owner. This employee’s name was Ichiro Akuto, the grandson of Hanyu founder Isouji Akuto. In 2008, all remaining casks were transferred from the town of Hanyu, where the old distillery lay, to Ichiro’s new distillery in a nearby town called Chichibu.

It is here that forgotten casks were transformed by Ichiro. His mission was to put a character to every cask, a face to each barrel. Not just a cask number. Ichiro’s creative guise gave birth to the extremely sought after Card Series bottlings. The final bottle of Ichiro’s Card Series was released in 2014 and the legend of the bottles lives on as one of the major building blocks of Japan’s current whisky renaissance. Each treasure is fine and rare and diminishing rapidly. There aren't many more drams to taste from Hanyu’s past and it will be exciting to watch future bottles evolve from Chichibu’s present distilling rebirth.

Karuizawa

Karuizawa has changed hands many times in its short history, but it all began in 1955 at a vineyard near Mount Asama in Nagano, Japan. The distillery closed in 2000 along with the Hanyu distillery and Mr. Ichiro Akuto assumed custody of the remaining casks before the distillery was completely dismantled in the mid-2000s. The releases from Karuizawa are few and far between; they are becoming increasingly scarce as there are fewer and fewer casks left to bottle. The Noh release, with each label portraying a character from the Noh Japanese theatre is now a cult collectible. In the 2000s Number One Drinks purchased the remaining casks from the closed distillery and they began to release the casks under a carefully curated set of different themes. One of these themes is the aforementioned Noh series. Other collectibles include the very rare Samurai series and the Sumo series. Library bottles are carefully selected from casks that are indicative of Karuizawa’s Sherry-- style with single cask releases from the 60s, 70s and 80s. Verticals are extremely hard to come by, but they are a treat to savour as they are indicative of the distillery’s evolution.

Special mention must be made to the incredibly rare Pre-Number One Drinks bottlings. These old releases were bottled in the 90s or earlier, making them distilled in one of the finest decades in Japanese Whisky history.

Launched by Suntory in 1989 in celebration of their 90th Anniversary, Hibiki is a masterfully blended whisky selected from malt and grain barrels distilled throughout the Suntory portfolio. Designed to represent the harmony of the broad range of Suntory and also to honor Japanese heritage more broadly, the signature 24-faceted bottle represents both the 24 hours of the day and the 24 seasons of the traditional Japanese calendar, an embedded meditation on effects of time on the whiskey within.

Yamazaki may not have been the first distillery with a license to distill in Japan, but they were indeed the first to produce whisky as we know it today. Founded in 1923 by Shinjiro Torii, whose shortened name became the flagship moniker for the Suntory brand, Yamazaki distillery was built in its location in the Kyoto prefecture because of its famously pure water dating back to Samurai times. Enthusiasts and novices alike attest to the distinctive softness and approachability of whisky produced in this area and it is this character that has become a trademark of the Suntory name. All of their whiskies are as sought after because of their taste as much as they are due to their scarcity. Suntory special releases are only released at maximum a few thousand bottles at a time and only to specific markets making them some of the most elusive bottles on the market. The unique Owner’s Cask bottles, initially difficult to find, are now essentially impossible to find since the Suntory distilleries have discontinued the program indefinitely.

Another of Scotland’s revered closed distilleries, Brora (originally named Clynelish) silenced their stills in 1983 after 164 years of operation and while the newer Clynelish Distillery exists just across the road, nothing compares to the decades leading up to the closure of Brora. Diageo has bottled some ultra rare age statements from those last years and this lot of 30-37 Year Old Brora includes a release from 2015 which is a 37 year old-the oldest release to date from the distillery. The Brora (translating loosely into ‘The Bridge’s River’ from Norse) has always yielded distinctive notes of leathery coffee and candied capsicum.

PorT ellen

Among the shuttered distilleries, Port Ellen stands as a beacon in the fog of a blustery Scottish day. Developed in the early 19th century, the distillery was originally a malt mill, and then underwent several changes in ownership until it closed for good in 1983. Diageo owns the distillery now and has announced they will be reopening soon. Scotch being Scotch, we won’t see a release from the new Port Ellen until the early 2030s, which means the bottles in this auction, the historic bottles, will always be a collector’s item, a snapshot into Scotch-making history.

In 1974, Adolph Hirsch ordered 400 barrels of bourbon from a small, struggling distillery known as Pennco, which were left to rest in barrel at the Schaefferstown, PA distillery. By 1989, the distillery had been purchased and renamed Michter’s and the new owners told Hirsch to collect his barrels or face losing the aged whiskey. The whiskey was sold privately in barrel to Gordon Hue and shortly after was bottled by Julian Van Winkle III. Initially, Hue sold two small runs - a 15 year and 16 year – to the Japanese market, and then most of the whiskey was transferred out of barrel and into stainless steel tanks to arrest the ageing. From these tanks came the majority of the A.H. Hirsch 16 year bottlings, known colloquially by their capsules: first with blue wax, then with gold wax, then the gold foil and finally in a hand-blown bottle packaged in a humidor. A handful of barrels were left to age further, resulting in tiny allocations of 18 and 19 year bourbon and finally the oldest of the original lot, just 500 cases of the 20 year with a red wax capsule were bottled in 1994. This legendary whiskey marks the beginning of the current American bourbon renaissance, rich with history, serendipity and often regarded as one of the best American whiskies ever produced.

Colonel Edmund Haynes Taylor, Jr. began distilling at the close of the Civil War when he purchased the Old Fire Copper Distillery (O.F.C.), which would later become Buffalo Trace. Made by hand, this Small Batch Bourbon is aged inside the century old warehouses constructed by E.H. Taylor, Jr. after his acquisition of the distillery in 1881. The barrels are evaluated and selected to create a perfect blend of distinctive character. This is especially true with E.H. Taylor’s special editions, like the Four Grain and Warehouse C Tornado Surviving Bourbon. Respectively, the Four Grain is made from a distinct combination of corn, rye, wheat, and malted barley and aged for twelve years to perfection; while the Warehouse C Tornado Surviving Bourbon, as the names suggests, came from the distillery’s Warehouse C that was struck by a tornado; while the warehouse was damaged, the barrels survived albeit exposed the elements. The barrels’ unique exposure to the central Kentucky climate yielded a whiskey that was so flavorful and unique, that it just had to be bottled as a special edition. Overall, E.H. Taylor, Jr.’s whiskies are unlike any sipping bourbon on the market today.

PaPPy Van winKle

Forget apple pie. Few things can be described as distinctly American as Pappy Van Winkle. With immigrant roots in Holland by way of New York, Julian “Pappy” Van Winkle was a travelling salesman that eschewed his family’s law business and would rise to own the wholesaler he began working for at age 18. Following Prohibition, which the distillery survived by producing medicinal Whiskey through a special Federal license, Pappy re-opened the Stitzel-Weller distillery and began producing premium Bourbon brands, such as Old Fitzgerald, Rebel Yell and Old Rip Van Winkle. Eventually Pappy’s son Julian Van Winkle, Jr. took over the family business, working closely with his father until his death in 1965. Seven years later, shareholders coaxed Julian Jr. into selling off their stake in the distillery operations, yielding control of all brands except the one that bore the family name: Old Rip Van Winkle. Between 1972 and 1981, Old Rip Van Winkle was released, mostly in decorative decanters, using stock from the Stitzel-Weller distillery. In 1983, Julian Van Winkle III began bottling the brand at the Hoffman distillery in Lawrenceburg, purchasing the Whiskey from Stitzel- Weller until its closure in 1991. Today the Whiskey is made to the family’s specifications through a special arrangement with the Buffalo Trace distillery under the direction of Julian Van Winkle III and his son, Preston. Bottled at various ages and proofs, the Van Winkle lineup has expanded to include the 10-year Old Rip Van Winkle, 12-year Van Winkle Family Reserve “Lot B,” 15-, 20- and 23-year Pappy Van Winkle Family Reserve Bourbons and a 13-year Van Winkle Family Reserve Rye. The Bourbons are known as “wheated” Bourbons due to the inclusion of a healthy dose of wheat in the mashbill, adding a distinctive sweetness and smoothness which has helped the line garner accolades and the miniscule releases have led to an almost mythic status among Bourbon drinkers.

The history of the Van Winkle brands is inexorably linked to the legendary Stitzel-Weller distillery, with Julian “Pappy” Van Winkle, Sr. helping to build the facility which opened in 1935, fittingly on Derby Day. Pappy continued to oversee operations at the distillery until his death in 1965. Julian Van Winkle, Jr. then took the reins, but with bourbon sales in steady decline, the facility was sold in 1972, though the sale held one condition: the younger Van Winkle would maintain rights to the Van Winkle brand name. In 1981, Julian Van Winkle, Jr. died and his son Julian III took over, continuing to purchase whiskey in bulk from the Stitzel-Weller facility until its eventual cessation of operations in 1992. At that point, Van Winkle began to purchase distillate made to spec from Bernheim and ultimately entering a joint venture with Buffalo Trace in 2002.

Over the years, the prestige lineup of Pappy Van Winkle 15, 20 and 23 year bottlings drew from the ever-dwindling stock of Stitzel-Weller stocks. In 2015, 23 years after the end of distilling at Stitzel-Weller, it was widely assumed we’d seen the end of pure Stitzel-Weller Van Winkle whiskey. But in 2017 came a dark horse riding in – 710 bottle from eleven barrels distilled in 1989 – vatted to stainless steel in 2014 to arrest the ageing and to marry the character of the different barrels. Bottled at 100 proof, this is the oldest Van Winkle bottling ever released and a worthy testament to the heritage of the Van Winkle family and the Stitzel-Weller distillery.

In 1888, Paul Jones Jr. trademarked the name that appears on every bottle of his bourbon: Four Roses. A legacy bourbon, Four Roses was made in the Lawrenceburg, Kentucky distillery that was built in 1910 and was later sold to Frankfort Distilling Company in 1922, which was one of just six distilleries in the United States allowed to produce "medicinal" whiskey during Prohibition. Once prohibition ended, Four Roses’ bourbon distilling resumed and the brand quickly became the most recognized, and even the top selling, bourbon in the U.S. during the 1930’s, 40’s, and 50’s. However, under the ownership of Seagram, the brand was discontinued in the United States in favor of sole distribution in the burgeoning European and Asian markets. The label wasn’t available in the U.S. as a straight bourbon until 2002 when master distiller Jim Ruthledge returned the brand to its ancestral home, where it has since reclaimed its seat at the table of fine bourbons.

First things first: Black Maple Hill is not a distillery. It is a portfolio of brands, owned by California Vineyards Inc. Initially, Black Maple Hill worked with Julian Van Winkle III in Lawrenceburg to bottle single barrel, well-aged whiskies. While it is not definitive, many believe that these early bottlings are drawn from the same Stitzel-Weller stocks used for his Van Winkle bottlings. In 2002, when the Pappy Van Winkle brands were brought under the Buffalo Trace umbrella, the Black Maple Hill bottling partner shifted to the Bardstown-based Kentucky Bourbon Distillers (producer of Willett), bottling single-barrel bourbons and ryes, a release of well-aged, vatted bourbon labeled as “Small Batch 16 Year,” as well as the under-the-radar “red ink” no-age-statement bourbon until 2011. In 2014, Black Maple Hill appeared again on the market with bourbon and rye produced in Oregon at the Stein Distillery.

KenTucKy owl

Kentucky Owl is a bourbon resurrected. C.M. Dedman founded Kentucky Owl back in 1879 but was forced to shutter his distillery at the advent of prohibition and never reopened it though retained the land. Generations later Dixon Dedman, the great-great grandson of Kentucky Owl’s founder has worked over the years to make a whisky worthy of the family’s distiller legacy. Made from some of the best barrels of bourbon in the state of Kentucky, the acquired barrels are combined in different ways until the perfect blend is achieved. As Dixon says, "I'm not some chemical engineer in a lab coat, looking for a perfect 'congener profile.' I didn't even start out with a taste in mind; I just went where the bourbon took me." And then, there’s Michter’s. Established in 1753, allegedly America’s first official distilling company, they have been a true Whiskey family producing brown spirits from Rye to Bourbon.

The result of centuries of dedication, experienced master distillers and an unwavering commitment to quality have allowed them to produce some of the greatest contributions to American Whiskey. A crown jewel and one of their finest, most rare bottles is the Michter’s 25- Year Old Single Barrel Bourbon

From a single-cask release of only 134 bottles distilled in 1983, this is among the ancient distillery’s most prized bottles. Where the Angel’s Share is roughly 2% in most climates, Kentucky has no dry season so that 2% is more like a 10% evaporation rate for the first year and roughly 5% for all the following years. After a quarter century of ageing in a single cask, the quantity of the cask’s contents has decreased dramatically but the concentration of flavors, aromas and palate are among the world’s most luxurious and unmatched.

The Birthday Bourbon line releases all hail from one day’s production from its particular year of release, and as such, they’re different from year to year. With history dating back to 1935, the Willett family has done a bit of everything in the Kentucky distilling world. Naturally, they’ve produced plenty of bourbon, but in the 1970s with bourbon consumption reaching its nadir, shifted production to ethanol for fuel before ceasing operations as a distillery altogether in the early 1980s. The name was resurrected in 1984 when Martha Willett and her husband bought the company, renaming it Kentucky Bourbon Distillers, despite not distilling a drop themselves! The company focused on buying stocks from other companies, ageing, blending and bottling the distillate with great success. KBD released blended and no-age-statement whiskies under a number of different brands, as well as hundreds of single-barrel Willett Family Estate releases of bourbon and rye, either through their gift shop or special bottlings for retailers (who could choose the color of wax the tops were dipped in). The earliest bottles of single-barrel whiskey were in Cognac-style bottles, with a later shift to the tall, slender bottles now seen. In 2012, they returned to distilling and started releasing their own stocks of various mashbills of rye, bourbon and wheated bourbon in 2014.

If the option is not exercised on all lots in the same parcel, the auctioneer will open bidding on the next unsold lot and offer the Buyer of that lot the option to take any or all of the remaining lots in the parcel sequence. Bidding shall continue in the same manner until all lots in the parcel have been offered and declared sold or unsold by the auctioneer. The Conditions of Sale and all other contents of this catalog may be amended by posted notices or oral announcements made during the sale. The property will be offered by Zachys as agent for the Consignor, unless the catalog indicates otherwise. By participating in an auction, you agree to be bound by these terms and conditions.

2 The purchase price payable by the Buyer (“Purchase Price”) will be the sum of the final bid price (the “Hammer Price”), the Buyer's Premium and the Protection Fee, when applicable, together with any applicable sales tax. The Buyer's Premium is 24.5% of the Hammer Price. The Protection Fee is 1% of the Hammer Price plus the Buyer's Premium.

3 Zachys reserves the right to withdraw any property or cancel any sale before or at the sale and shall have no liability whatsoever for such withdrawal or cancellation.

4 Zachys reserves the right to reject any bid. The highest bidder acknowledged by the auctioneer will be the Buyer. In the event of any dispute between bidders, or any other issue with respect to the bidder, the auctioneer will have absolute discretion to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the property in dispute. If any dispute arises after the sale, Zachys' sale record is conclusive.

5 In its sole discretion, Zachys may accept and execute absentee bids (written bids submitted to Zachys prior to the sale), telephone bids and inter-net bids as a convenience to clients who are not present at auction.

6 Unless otherwise indicated, all lots in this catalog are offered subject to a reserve, which is the mini-mum price the Consignor is willing to accept. This amount is confidential and will not exceed the low presale estimate. Lots not subject to a reserve are identified with the symbol (d) next to the lot number. Zachys shall act to protect the reserve by bidding through the auctioneer. The auctioneer may open bidding on any lot below the reserve by placing a bid on behalf of the Consignor. The auctioneer may continue to bid on behalf of the Consignor up to the amount of the reserve, either by placing successive bids or by placing bids in response to other bidders.

7 Title to the offered lot passes to the Buyer upon the fall of the auctioneer's hammer and the announcement by the auctioneer that the lot has been sold, subject to compliance by the Buyer with all other Conditions of Sale and the Buying & Bidding Information.

8 The Protection Fee is 1% of the hammer price plus the Buyer's Premium for all arranged deliver-ies of purchased property. In return for payment of the Protection Fee, purchased property will be protected against breakage, loss, theft or fire and other losses as covered by Zachys' insurance

while in transit to the Buyer's declared point of destination. If Buyer elects to decline the protec-tion afforded by the Protection Fee, Buyer there-upon assumes full risk and responsibility for the lot while in transit.

9 No property may be removed from Zachys' prem-ises until Buyer has paid the Purchase Price in full plus all other fees and taxes (inclusive of any taxes due in the location of the auction on Buyers who are not residents of such location) and has satis-fied such terms as Zachys, in its sole discretion, shall require. Zachys reserves the right to withhold all property until such time as all outstanding amounts are paid in full from purchases from any prior auction(s). Upon receipt of full payment, Zachys will issue a Release Order, which must be presented in order for Zachys to release purchases made at auction. Subject to the foregoing, all lots are to be paid for no later than 4:30 PM (local time at the place of the auction) on the fourteenth calendar day following the live sale, and removed from Zachys' premises at Buyer's expense no later than 30 calendar days after the date of sale. If payment is not made within 14 calendar days of purchase for live sales and 7 calendar days of purchase for net sales, Zachys reserves the right to impose a late charge of up to 2% per month of the Purchase Price, in addition to any other rights and remedies available by law to Zachys. Any payments in default after 21 calendar days of purchase will incur a penalty equal to 3% of the Purchase Price. Additional late fees equal to 3% of the Purchase Price may be charged for every 14 calendar days past the initial 21-calendar-day period. If Buyer fails either to timely remove the purchased lots from Zachys' premises or make timely arrangements with New York Fine Wine Storage or Newcorp Logistics to store the pur-chased lots, Zachys may transfer such property to a public warehouse for the account, and at the risk and expense, of Buyer. If a lot has not been collected within 30 calendar days of the date of sale and Zachys does not transfer the uncollected property to a public warehouse, Buyer will be liable to Zachys for interest, storage fees, and handling charges.

10 Zachys is not responsible for acts or omissions by itself or others in packing or shipping, whether or not the carrier or packer is recommended by Zachys. Packing and handling of purchased lots are entirely at the risk of Buyer. Zachys may, at the request and direction of Buyer and for an administrative fee, make arrangements for the consolidated shipment by common carrier of the purchased lots, provided that Zachys is not liable in any way therefore.

11 If Buyer fails to comply with any of these Conditions of Sale, Buyer will be in default and Zachys may avail itself of all remedies avail-able by law, including, without limitation, the right to (i) hold such defaulting Buyer liable for the Purchase Price including all fees, charges and expenses, (ii) cancel the sale of that lot and

any other property sold to Buyer, (iii) resell the property without Reserve at public auction or privately on reasonable notice to the Buyer, (iv) pay the Consignor an amount equal to the net proceeds payable in respect of the amount bid by the defaulting Buyer and then resell the property to a third party without Reserve at public auction or privately on reasonable notice to such Buyer, and/or (v) take such other action as Zachys deems necessary or appropriate. If Zachys resells the property pursuant to clause (iii) or (iv) above, the defaulting Buyer shall be liable for the payment of any deficiency between the Purchase Price and the price obtained upon resale pursuant to clause (iii) and (iv) above and all costs and expenses, including, without limitation, warehousing, the expenses of both sales, reasonable attorneys' fees, commissions, incidental damages and all other charges due hereunder. In the event that such Buyer pays a portion of the Purchase Price for any or all lots purchased, Zachys shall apply the pay-ment received to such lot or lots that Zachys, in its sole discretion, deems appropriate. Any Buyer who fails to comply with these Conditions of Sale will be deemed to have granted Zachys a security interest in, and Zachys may retain as collateral security for such Buyer's obligation to it, any property in Zachys' possession owned by such Buyer. Zachys shall have the benefit of all rights of a secured party under the Uniform Commercial Code or applicable law adopted in the jurisdic-tion where the auction is held.

12 Payment will not be deemed to have been made in full until Zachys has collected good funds. In the event Buyer fails to pay any or all of the Purchase Price for any lot within 30 calendar days of sale and Zachys nonetheless elects to pay the Consignor any portion of the sale proceeds, Buyer acknowledges that Zachys shall have all of the rights of the Consignor to pursue the Buyer for any amounts paid to the Consignor, whether at law, in equity, or under these Conditions of Sale.

13 Notwithstanding any other terms of these Conditions of Sale, if within 3 calendar days of the date of delivery of the property, Buyer noti-fies Zachys in writing of a claim that any lot is short, ullaged, or has suffered breakage, then Zachys in its sole discretion will decide any such claim as between the Consignor and Buyer and may rescind the sale and refund all or part of the Purchase Price received. This does not affect any other rights of the Buyer at law or under these Conditions of Sale.

Notwithstanding any other terms of these Conditions of Sale, if a Buyer purchased property that is inauthentic and returns such property to Zachys within 90 calendar days of the date of delivery, then Zachys agrees to rescind the sale and refund the Purchase Price received.

The benefit of this Condition of Sale 13 is not assignable and shall be applicable only to the original Buyer of the lot and not to subsequent assigns, buyers, heirs, owners or others who have acquired or may acquire an interest therein.

At its discretion, Zachys will not always cut the bands on original packaging of younger wines. In such cases, Zachys will not accept returns for any issues the Buyer might discover after the band is cut.

14 Alcoholic beverage products sold at auction may be subject to laws governing export from the jurisdiction where the auction was held and import restrictions of foreign countries. Buyers should always check whether an export license is required before exporting alcoholic beverage products. It is the Buyer's sole responsibility to obtain any relevant export or import license. A delay in obtaining licenses shall neither justify the rescission of any sale nor excuse delay in providing full payment for the lot. Local laws may prohibit the importation of some property and/or may prohibit the resale of some property in the country of importation; no such restriction shall justify the rescission of any sale or delay in mak-ing full payment for the lot

15 Prospective Buyers are also reminded that various jurisdictions impose limitations on the quantity of alcoholic beverage products which may be purchased and brought into their jurisdiction by a purchaser from another jurisdiction, without requiring the purchaser, a consignor or shipper to possess certain licenses or permits. Zachys and Consignor shall not as a condition of sale assume any obligation or bear any responsibility what-soever for applying for or obtaining the requisite permits or licenses in the event the quantity pur-chased exceeds said limitations.

Therefore, all prospective Buyers are strongly advised to investigate the possibility of such limi-tations and to determine the manner in which alcoholic beverages shall be brought into the jurisdiction so as to comply with all local require-ments.

16a For auctions that are held not in Hong Kong, the District of Columbia or the United Kingdom, the respective rights and obligations of the parties with respect to the Conditions of Sale and the conduct of the auction shall be governed by and interpreted in accordance with the laws of the State of New York. By participating in an auc-tion, whether present in person or by agent, by absentee bid, telephone bid, internet bid or other means, Buyer shall be deemed to have consented to the exclusive jurisdiction of the State Courts of, and the Federal Courts sitting in, the State and County of New York. For such auctions, Buyer's sole and exclusive remedy against Zachys and/or the Consignor for any dispute or injury related to the auction or the property listed in the catalog shall be the rescission of the sale and the refund of the original Purchase Price paid for the lot. This remedy shall be in lieu of any other remedy which might otherwise be available to Buyer as a matter of law or at equity, and neither Zachys nor the Consignor shall be liable, in whole or in part, for any indirect, special, punitive, incidental or consequential damages, including, without limita-tion, loss of profits.

16b For auctions that are held in Hong Kong, the respective rights and obligations of the parties with respect to the Conditions of Sale and the conduct of the auction shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. By participating in an auction, whether present in person or by agent, by absentee bid, telephone bid, internet bid or other means, Buyer shall be deemed to have consented to the exclusive jurisdiction of the Courts of Hong Kong Special Administrative Region. For such auctions, Buyer's sole and exclusive remedy against Zachys and/or the Consignor for any dispute or injury related to the auction or the property listed in the catalog shall be the rescission of the sale and the refund of the original Purchase Price paid for the lot. This remedy shall be in lieu of any other remedy which might otherwise be available to Buyer as a matter of law or at equity, and neither Zachys nor the Consignor shall be liable, in whole or in part, for any indirect, special, punitive, incidental or consequential damages, including, without limita-tion, loss of profits.

16c For auctions that are held in the District of Columbia, the respective rights and obligations of the parties with respect to the Conditions of Sale and the conduct of the auction shall be governed by and interpreted in accordance with the laws of the District of Columbia. By participating in an auction, whether present in person or by agent, by absentee bid, telephone bid, internet bid or other means, Buyer shall be deemed to have con-sented to the exclusive jurisdiction of the District of Columbia courts and the United States District Court for the District of Columbia. For such auc-tions, Buyer's sole and exclusive remedy against Zachys and/or the Consignor for any dispute or injury related to the auction or the property listed in the catalog shall be the rescission of the sale and the refund of the original Purchase Price paid for the lot. This remedy shall be in lieu of any other remedy which might otherwise be avail-able to Buyer as a matter of law or at equity, and neither Zachys nor the Consignor shall be liable, in whole or in part, for any indirect, special, puni-tive, incidental or consequential damages, includ-ing, without limitation, loss of profits.

16d For auctions that are held in the United Kingdom, the respective rights and obligations of the par-ties with respect to the Conditions of Sale and the conduct of the auction shall be governed by and construed in accordance with the laws of England and Wales. By participating in an auc-tion, whether in person or by agent, absentee bid, telephone bid, online bid or other means, the Buyer irrevocably agrees that the courts of England and Wales shall have exclusive jurisdic-tion to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Conditions of Sale, the Buyer & Bidding Information or their subject matter or formation. For such auctions, Buyer's sole and exclusive remedy against Zachys and/or the Consignor for any dispute or injury related

17 All offers and sales of alcoholic beverage products by Zachys are subject to the local laws governing the sale of alcoholic beverage products in the jurisdiction in which the auction takes place.

17a Right of Cancellation

This section only applies to Buyers based in the European Union or United Kingdom who are act-ing as consumers (i.e.for purposes unconnected with their trade or business) who have purchased in an auction held in the United Kingdom.

In the event that the Buyer purchases a product in any way other than in person at an auction (such other way being, for example, by way of absen-tee, telephone and/or online bid), the Buyer shall have a legal right to:

(i) withdraw any bid at any point prior to accep-tance by Zachys (i.e.at the fall of the hammer); and/or

(ii) cancel any purchase within 14 days, which period shall expire after 14 days from the day on which the Buyer (or any third party indicated by the Buyer to receive such delivery) acquires physical possession of the goods (or the last good, in the case of multiple deliveries as part of the same lot) or,

To exercise the right to cancel any purchase, the Buyer is required to:

(i) inform Zachys of such decision by a clear statement in writing to auction@ zachys.com by no later than the expiry of the above cancella-tion period; and

(ii) send back the goods to or hand over the goods in person at Newcorp Logistics, Sikkel 13, 3274 KK Heinenoord, The Netherlands without undue delay and in any event no later than 14 days from the day on which the Buyer sends the relevant cancellation notice.

Subject to the foregoing, in the event that the Buyer cancels any purchase, Zachys shall reim-burse the Buyer all payments received by it from the Buyer, including any costs of delivery paid to Zachys (except for delivery costs exceeding the least expensive type of standard delivery). The Buyer is required to bear the direct cost of return-ing the goods.

Zachys shall make the reimbursement without undue delay, and not later than: (i) 14 days after

the day Zachys receives back from the Buyer any goods supplied; or (ii) if earlier, 14 days after the day the Buyer provides evidence that it has returned the goods. If possible, Zachys shall make the reimbursement using the same means of pay-ment as used by the Buyer for the initial transac-tion, unless expressly agreed otherwise.

Zachys may make a deduction from the reim-bursement for loss in value of any goods supplied, if the loss is the result of handling by the Buyer other than as necessary to establish the nature and characteristics of the goods. For the avoidance of doubt, this cancellation right will not apply to any bottles of wine which have been opened.

18 District of Columbia and New York State law requires that Buyers of alcoholic beverages must be at least 21 years of age. Hong Kong and English law requires that Buyers of alcoholic beverages must be at least 18 years of age. Buyers should observe and comply with the applicable laws relating to the purchase of alcoholic bever-ages in the jurisdiction where the auction is held. By participating in the auction, each Buyer represents and warrants to Zachys that he, she or it has the legal capacity to purchase, receive, and possess any lot purchased.

19 Zachys does not ship alcoholic beverage prod-ucts. As an accommodation to Buyers, Zachys may arrange to have property packed, insured and delivered at Buyer's expense and direction, but (other than as provided in Condition of Sale 8) Zachys shall have no liability or obligation for shipping alcoholic beverage products. Zachys makes no representation, and assumes no obliga-tion, with respect to the legality of shipment of alcoholic beverage products into any jurisdiction. Zachys urges all Buyers to investigate and under-stand the alcoholic beverage products shipping laws and regulations of the jurisdiction to which they intend the alcoholic beverage products to be shipped prior to the purchase of alcoholic bever-age products at auction.

20 By participating in the auction, Buyer agrees with Zachys and the Consignor that these Conditions of Sale, together with any instrument captioned (i) Buying & Bidding Information and (ii) General Catalog Notes published by Zachys and in effect from time to time and which are incorporated herein by reference as part of this Condition of Sale, shall become the legal, valid, and bind-ing obligation of the Buyer, enforce- able in accordance with their terms by Zachys and the Consignor (who is both a party hereto and, with respect to portions hereof between Buyer and Zachys, an intended third-party beneficiary).

21 In the event any one or more of the provisions, or any part or parts of a provision, of these Conditions of Sale and/or the Buying & Bidding Information is determined to be invalid or unen-forceable in any respect, the validity and enforce-ability of all remaining provisions and parts of provisions shall not in any way be affected or

Labels and capsules can become soiled, stained, or otherwise marked, especially with wines over 20 years of age. Unless oth-erwise noted, label conditions will be appropriate for age, but Buyers should note that normal staining, discoloration or other conditions may not be noted if such conditions are appropriate for the age of the label. BN Bottom Neck: Excellent for a wine of 10 years or older.

VTS Very Top Shoulder: Normal for any wine 10 years or older.

TS Top Shoulder: Normal for any wine 25 years or older.

JBTS Just Below Top Shoulder: Normal for any wine 30 years or older.

US Upper Shoulder: Slight natural reduction through easing of cork and evaporation through cork and capsule. Very good for any wine over 40 years old. Excellent for any wine over 50 years of age.

UMS Upper-Mid Shoulder: Good for any wine 50-60 years of age.

MS Mid Shoulder: Probably some weakening of the cork. Very good for wines over 50-60 years of age. Estimates usually take this into account.

LS Low Shoulder: Some weakening of cork acceptable if wine or label is exceptionally rare or interesting.

Because of the slope of shoulder, it is imprac-tical to describe levels of Burgundy-shaped bottles as into neck, etc. Wherever appropriate, the level between capsule and wine will be measured and cataloged in centimeters.

The condition and drinkability of Burgundy are less affected by ullage than its equivalent from Bordeaux. For example, a 5 to 7cm. ullage in a 50 year old Burgundy can be considered normal, indeed good for that age; and 3.5 to 4cm., excel-lent for that age.

Champagne bottle measurements are done from the bottom of the foil to the level of the wine.

Though every effort is made to describe or measure the levels of older vintages, corks over 20 years old begin to lose their elasticity and levels can change between cataloguing and sale. Old corks have also been known to fail during or after shipment. We therefore repeat that there is always a risk of cork failure with old wines, and Zachys assumes no responsibility for this.
