    (2) the term senior executive means8

    (A) a member of the Senior Executive9

    Service under subchapter VIII of chapter 53 of10

    title 5, United States Code;11

    (B) a member of the FBIDEA Senior12

    Executive Service under subchapter III of chap-13

    ter 31 of title 5, United States Code;14

    (C) a member of the Senior Foreign Serv-15

    ice under chapter 4 of title I of the Foreign16

    Service Act of 1980 (22 U.S.C. 3961 and fol-17

    lowing); and18

    (D) a member of any similar senior exec-19

    utive service in an Executive agency;20

    (3) the term senior-level employee means an21

    employee who holds a position in an Executive agen-22

    cy and who is covered by section 5376 of title 5,23

    United States Code, or any similar authority; and24

    (4) the term Executive agency has the mean-1

    ing given such term by section 105 of title 5, United2

    States Code.3

    (b)(1) Notwithstanding any other provision of law,4

    except as provided in subsection (e), no statutory pay ad-5

    justment which (but for this subsection) would otherwise6

    take effect during the period beginning on January 1,7

    2011, and ending on December 31, 2012, shall be made.8

    (2) For purposes of this subsection, the term statu-9

    tory pay adjustment means10

    (A) an adjustment required under section11

    5303, 5304, 5304a, 5318, or 5343(a) of title 5,12

    United States Code; and13

    (B) any similar adjustment, required by stat-14

    ute, with respect to employees in an Executive agen-15

    cy.16

    (c) Notwithstanding any other provision of law, ex-17

    cept as provided in subsection (e), during the period begin-18

    ning on January 1, 2011, and ending on December 31,19

    2012, no senior executive or senior-level employee may re-20

    ceive an increase in his or her rate of basic pay absent21

    a change of position that results in a substantial increase22

    in responsibility, or a promotion.23

    (d) The President may issue guidance that Execu-1

    tive agencies shall apply in the implementation of this sec-2

    tion.3

    (e) The Non-Foreign Area Retirement Equity As-4

    surance Act of 2009 (5 U.S.C. 5304 note) shall be applied5

    using the appropriate locality-based comparability pay-6

    ments established by the President as the applicable com-7

    parability payments in section 1914(2) and (3) of such8

    Act.9

    SEC. 148. Notwithstanding section 101, the level for10

    Department of Commerce, National Telecommunications11

    and Information Administration, Salaries and Expenses12

    shall be $40,649,000.13

    SEC. 149. The following authorities shall continue14

    in effect through the earlier of the date specified in section15

    106(3) of this Act or the date of enactment of the Na-16

    tional Defense Authorization Act for Fiscal Year 2011:17

    (1) Section 1021 of the Ronald W. Reagan18

    National Defense Authorization Act for Fiscal Year19

    2005 (Public Law 108375; 118 Stat. 2042), as20

    amended by section 1011 of the National Defense21

    Authorization Act for Fiscal Year 2010 (Public Law22

    11184; 123 Stat. 2441);23

    (2) Section 1022 of the National Defense Au-24

    SEC. 150. Subject to the availability of appropria-20

    tions, the Secretary of the Navy may award a contract21

    or contracts for up to 20 Littoral Combat Ships (LCS).22

    SEC. 151. Section 8905a(d)(4)(B) of title 5, United23

    States Code, is amended24

    SEC. 152. Notwithstanding section 101, the level for8

    Special Inspector General for the Troubled Asset Relief9

    Program, Salaries and Expenses shall be $36,300,000.10

    SEC. 153. Public Law 111240 is amended in sec-11

    tion 1114 and section 1704 by striking December 31,12

    2010 and inserting March 4, 2011 each time it appears13

    and in section 1704 by adding at the end the following:14

    (c) For purposes of the loans made under this sec-15

    tion, the maximum guaranteed amount outstanding to the16

    borrower may not exceed $4,500,000.17

    SEC. 154. The appropriation to the Securities and18

    Exchange Commission pursuant to this Act shall be19

    deemed a regular appropriation for purposes of section20

    6(b) of the Securities Act of 1933 (15 U.S.C. 77f(b)) and21

    sections 13(e), 14(g), and 31 of the Securities Exchange22

    Act of 1934 (15 U.S.C. 78m(e), 78n(g), and 78ee).23

    SEC. 155. Section 302 of the Universal Service24

    Antideficiency Temporary Suspension Act is amended by25

    SEC. 158. Notwithstanding section 101, the final1

    proviso under the heading Science and Technology, Re-2

    search, Development, Acquisition, and Operations in Pub-3

    lic Law 11183 (related to the National Bio- and Agro-4

    defense Facility) shall have no effect with respect to all5

    amounts available under this heading.6

    SEC. 159. Notwithstanding sections 101 and 128,7

    amounts are provided for Department of the Interior8

    Minerals Management ServiceRoyalty and Offshore9

    Minerals Management in the manner authorized in Public10

    Law 11188 for fiscal year 2010, except that for fiscal11

    year 2011 the amounts specified in division A of Public12

    Law 11188 shall be modified by substituting13

    (1) $200,110,000 for $175,217,000;14

    (2) $102,231,000 for $89,374,000;15

    (3) $154,890,000 for $156,730,000 each16

    place it appears; and17

    (4) fiscal year 2011 shall be substituted for18

    fiscal year 2010 each place it appears.19

    SEC. 160. The Secretary of the Interior, in order20

    to implement a reorganization of the Bureau of Ocean En-21

    ergy Management, Regulation, and Enforcement, may es-22

    tablish accounts, transfer funds among and between the23

    offices and bureaus affected by the reorganization, and24

    take any other administrative actions necessary in con-25

    formance with the Appropriations Committee reprogram-1

    ming procedures described in the joint explanatory state-2

    ment of the managers accompanying Public Law 111883

    (House of Representatives Report 111316).4

    SEC. 161. Notwithstanding section 101, section 4235

    of Public Law 11188 (123 Stat. 2961), concerning the6

    distribution of geothermal energy receipts, shall have no7

    force or effect and the provisions of section 3003(a) of8

    Public Law 111212 (124 Stat. 2338) shall apply for fis-9

    cal year 2011.10

    SEC. 162. Notwithstanding section 109, of the funds11

    made available by section 101 for payments under sub-12

    sections (b) and (d) of section 2602 of the Low Income13

    Home Energy Assistance Act of 1981, the Department of14

    Health and Human Services shall obligate the same15

    amount during the period covered by this continuing reso-16

    lution as was obligated for such purpose during the com-17

    parable period during fiscal year 2010.18

    SEC. 163. (a) A highly qualified teacher includes19

    a teacher who meets the requirements in 34 C.F.R.20

    200.56(a)(2)(ii), as published in the Federal Register on21

    December 2, 2002.22

    (b) This provision is effective on the date of enact-23

    ment of this provision through the end of the 2012201324

    academic year.25

    SEC. 164. (a) Notwithstanding section 101, the level1

    for Department of Education, Student Financial Assist-2

    ance to carry out subpart 1 of part A of title IV of the3

    Higher Education Act of 1965 shall be $23,162,000,000.4

    (b) The maximum Pell Grant for which a student5

    shall be eligible during award year 20112012 shall be6

    $4,860.7

    SEC. 165. (a) Notwithstanding section 1018(d) of8

    the Legislative Branch Appropriations Act, 2003 (29

    U.S.C. 1907(d)), the use of any funds appropriated to the10

    United States Capitol Police during fiscal year 2003 for11

    transfer relating to the Truck Interdiction Monitoring12

    Program to the working capital fund established under13

    section 328 of title 49, United States Code, is ratified.14

    (b) Nothing in subsection (a) may be construed to15

    waive sections 1341, 1342, 1349, 1350, or 1351 of title16

    31, United States Code, or subchapter II of chapter 1517

    of such title (commonly known as the Anti-Deficiency18

    Act).19

    (c) Notwithstanding section 106 of this Act, the use20

    of the funds described under subsection (a) of this section21

    shall apply without fiscal year limitation.22

    SEC. 166. Notwithstanding section 101, amounts23

    are provided for Department of Veterans Affairs, Depart-24

    mental Administration, General Operating Expenses at a25
