84. NARRATIVE OF THE FACTUAL BASIS FOR PROBABLE CAUSE: Toe undersigned certifJes and swears that he/she has just and reasonable grounds to belieoe that the heretofore named defendant did commit the •iolations of law as stated above and the factual basis for this belief is as follows:

Your Affiant/this author, is Senior Inspector Audenia Thomas of the Office of the Inspector General, Florida Department of Corrections.

On September 23, 2019, at approximately 7:00.a.m, I was alerted via telephone by Captain Brooks Varnum, to a staff member being caught bringing contraband into the Martin Correctional Institution (MCI), for an inmate. Upon arriving at MCI I was briefed by Colonel Nathan Pollock. Pollock advised Roxana Lyn Hodges was caught brining in contraband during a pat down search conducted by Correctional Officer (CO) Louise Marshall. Roxana Lyn Hodges is a contract employee with the Department of Corrections: employed by Centurion as a medical clerk.

I interviewed CO Louise Marshall. In her sworn statement, she indicated the following:

On September 23, 2019, at approximately 6:55a.m., while she was assigned as the interdiction officer, she observed Roxana Lyn Hodges enter the security area. CO Rosario checked Ms. Hodges personal belonging in. Ms. Hodges entered the institution earring a med-size clear bag. Upon checking Ms. Hodges through the security area, CO. Marshall stated she requested Ms. Hodges step into the female staff bathroom; Ms. Hodges complied. As CO Marshall was conducting the pat down search, she indicated that she felt "something" that did not seem to be "Flesh" in Ms. Hodges trunk area (pelvic). Ms. Marshall stated that she repeated the pat down process a 2nd time and again felt "something" that did not seem to be "Flesh". CO Marshall requested Ms. Hodges hand over the contraband. Ms. Hodges then reached down into her pelvic area and retrieved cigarettes which were wrapped in a white cloth towel. The cigarettes themselves were contained in a small plastic bag, and within the plastic bag were two (2) T-Mobile Compatible SIMS Cards as well. Upon making this discovery CO Marshall stated she notified her superiors.

On September 23, 2019, at approximately 9:30.a.m, I interviewed Ms. Roxana Lyn Hodges at Martin Correctional Institution (Office of Inspector General Office). Ms. Hodges was read her Miranda Rights from a Florida Department of Corrections (Officer of Inspector General)-Waiver of Miranda Rights Fonn. Ms. Hodges signed the fonn, stating she understood her rights and wished to make a statement. (Also present during this interview was Captain Jackie Binsse)

The SIMS cards along with the cigarettes were collected and submitted to evidence.

To wit: Witness (Louise Marshall) and defendant (Roxana Lyn Hodges) testimony, including a confession established probable cause to believe that Roxana Lyn Hodges did introduce contraband into a correctional institution. Roxana Lyn Hodges committed a felony by violating Florida State Statue 944.47(1A6)-lntroduction, removal, or possession of contraband.

(1)(a) Except through regular channels as authorized by the officer in charge of the correctional institution, it is unlawful to introduce into or upon the grounds of any state correctional institution, or to take or attempt to take or send or attempt to send therefrom, any of the following articles which are hereby declared to be contraband for the purposes of this section, to wit: Any cellular telephone or other portable communication device intentionally and unlawfully introduced inside the secure perimeter of any state correctional institution without prior authorization or consent from the officer in charge of such correctional institution. As used in this subparagraph, the term "portable communication device" means any device carried, worn, or stored which is designed or intended to receive or transmit verbal or written messages, access or store data, or connect electronically to the Internet or any other electronic device and which allows communications in any fonn. Such devices include, but are not limited to, portable two-way pagers, hand-held radios, cellular telephones, Blackberry-type devices, personal digital assistants or PDA's, laptop computers, or any components of these devices which are intended to be used to assemble such devices. The term also includes any new technology that is developed for similar purposes. Excluded from this definition is any device having communication capabilities which has been approved or issued by the department for investigative or institutional security purposes or for conducting other state business.

Your Affiant respectfully submits that probable cause has been established that Rozana Lyn Hodges did commit the criminal Violation of Introduction of Contraband in a State Correctional Institution, to-wit, in violation of s. 944.47(1A1), Florida Statute; at Martin Correctional Institution, Indiantown, Florida Florida. 34956
