    Localgovernancedrawsstrengthandfocusfromqualitylocallegislation. More than a mere procedural act or legislativeformality,legislationisconcernedprimarilywithsubstance,whereitssupremeobjectiveisgeneralwelfareandwell-being.

    Legislationrequiresnotonlytheskillsofalegislatorbutalsosensitivityto challenges, pressures and inadequacies of governance. It cannot be overemphasized that central to the concerns of local

    legislation is development with a human face.

    1. inStaLLa LegiSLative traCkingand anaLySiS SyStem

    The LegislativeTrackingandAnalysisSystem isanessential tool inquality legislativework.Beyond theconnesofthebasiclegislativeprocess,itsprincipalaimistoassesstheeffectivenessornon-effectivenessofanenactment, with the information generated factored intothe review of the legislative measure.

    2. Create baCkStopping Committee

    BackstoppingCommitteesareparticularlyuseful inthesensethatsuchmechanismsensurefocusedanalysisof issues,with responsive legislative remedieseasilyworked out. Since it is the professional research arm ofthelegislativebody,qualityresultsfreethesanggunianmembers from lengthy, time-consumingandcostly

    debates on legislative action to take in the face of aparticular issue. Leadershipof thecommittee is issue-dependent.Ifitisanissueonhealth,necessarilytheheadshouldbetheMunicipalHealthOfcer.

    NOTE: Make sure to have a regular updating of thelegislative database, and to conduct periodiclegislative review.

    The sanggunian members are expected to befamiliarwithordinancesthatarealreadyenactedbytheprevious sanggunians. This is important as it guides them

    inidentifyingandrationalizingwhichordinancesrequirefurtheranalysis,amendmentorsupplementation,orareto be enacted as new legislation. Consultations with lawenforcementagency,barangayofcialsandthegeneralpublic could be helpful.

    R.A. 9729 (Climate Change Act of 2009)

    Sec. 14. Local Climate Change Action Plan. The LGUsshall be frontline agencies in the formulation, planning andimplementation of climate change action plans in their respectiveareas, consistent with the provisions of the Local Government Unit,the Framework and the National Climate Change Action Plan.

    Barangays shallbedirectly involvedwithmunicipalandcitygovernmentsinprioritizingclimatechangeissuesandinidentifyingand implementing best practices and other solutions. Municipalandcitygovernmentsshallconsiderclimatechangeadaptation,as one of their regular functions. Provincial governments shallprovide technical assistance, enforcement and informationmanagementinsupportofmunicipalandcityclimatechangeactionplans.Inter-localgovernmentunitcollaborationshallbemaximizedintheconductofclimate-relatedactivities.

    LGUsshallregularlyupdatetheirrespectiveactionplanstoreectchanging social, economic, and environmental conditions andemerging issues. The LGUs shall furnish the Commission withcopies of their action plans and all subsequent amendments,modicationsandrevisionsthereof,withinone(1)monthfromtheiradoption.TheLGUsshallmobilizeandallocatenecessarypersonnel,resourcesandlogisticstoeffectivelyimplementtheir

    respective action plans.

    The local chief executive shall appoint the person responsible forthe formulation and implementation of the local action plan.

    Act of 2010 This Act provides for the development of policies andplans and the implementation of actions and measures pertainingto all aspects of disaster risk reduction and management includinggoodgovernance,riskassessmentandearlywarning,knowledgebuildingandawarenessraising,reducingunderlyingriskfactorsandpreparednessforeffectiveresponseandearlyrecovery.

    How shall an OIC Municipal Mayor assume hisfunctions?

    WithregardstoOICMunicipalMayor,uponpresentationofa

    valid designation in writing, he can assume as OIC MunicipalMayor.(Section26(c),LocalGovernmentCode)

    In this case, itmaybenotedthat theMunicipalMayorcandesignateanyofcialoftheMunicipalGovernmentasOICfor three(3)consecutivedayswhileheisoutsidehis territorialjurisdictionbutwithinthecountry.Itshouldbefurthernotedthatin

    caseofdesignationofOIC,thereisreally,incontemplationoflaw,notemporaryvacancytospeakofintheOfceoftheMunicipalMayor.TheMunicipalMayormaydesignatetheMunicipalVice-Mayororanymemberof theSanggunianoranyappointiveofcialoftheprovinceasOIC.Butsuchdesignationcannotexceed(3)days.Hence,onthe4thday,iftheMunicipalMayorfailedtoreturntohisstation,Section46(d)ofthesameCodewillnowapply,inwhichcase,theMunicipalVice-MayorshallassumeasActingMunicipalMayoronthe4thdayofabsence

    oftheMunicipalMayor.

    Who may be authorized to act as an OIC MunicipalMayor?

    Persection46(c)oftheLocalGovernmentCode,theMunicipalMayormaydesignateinwritinganyMunicipalOfcialtoactasOICduringhisabsenceforthee(3)days.Theauthorizationshallspecifythepowersandfunctionsthatthelocalofcialconcernedshall exercise.

    outside his territorial jurisdiction for a period of not exceedingthree(3)consecutivedays,hemaydesignateinfullwritingtheOIC.Suchauthorizationshallspecifythepowersandfunctionsthatthelocalofcialconcernedshallexerciseintheabsenceof lcaol chief executive, except the power to appoint, suspendordismissemployees.

    InthecaseofGamboavs.Aguirre(G.R.No.134213,July20,1991),theSupremeCourtruledthattheMunicipalVice-Mayor,whoisnowactingasActingMunicipalMayor,cannotanymorecontinueto preside over the session as this would violate the principle ofseparationofpowersandfunctions.TheMunicipalVice-Mayor,inhiscapacityasActingMunicipalMayor,isexpectedtoperformfull-timeexecutivefunctionswhichwouldincludeapprovalofordinances.ThispronouncementoftheSupremeCourtequallyapplies to provinces and municipalities.

    May the Municipal Vice-Mayor, acting as OIC,continue to preside over the session of the Sangguniang

    Bayan?

    The situation is different between the OIC and Acting. As earliernoted, in theactingcapacity, there is temporary vacancyintheOfceof theMunicipalMayor,while inOICcapacity,thereisnotemporaryvacancyintheOfceoftheMunicipalMayor.Moreover,OICsexerciseonlylimitedpowersasmaybecontained in the letter-authorizationdesignatinghimassuch.Hence, if incidentally, theMunicipalVice-Mayoras theone

    designated as OIC, he can still continue to preside over thesession of the Sanggunian since the ruling in the Gamboa casewillnotapply.

    As a mere OIC, he has no power to perform all the functionsandpowersoftheMunicipalMayorandmoreimportantly,heorshe is now empowered to approve ordinances. Such being thecase, the violation of separation of powers and functions, theevil sought to be avoided in the Gamboa ruling, is not present.Since,anyway,asOIChehasnopowertoapproveordinancesenactedbytheSanggunian.

    May theMunicipal Vice-Mayor, acting as OIC, appointofcials?

    No. Under CSC rules on appointment, an OIC cannot issue anappointment.

    What are the tasks and responsibilities of an OIC MunicipalMayor?

    ActorperforminaccordancewiththeauthorizationgivenbytheMunicipalMayor,suchas,butnotlimitedtothefollowing:

    Signandapprovevouchersforthepaymentofsalariesofthemunicipalemployees;
