May the Municipal Vice-Mayor, acting as OIC,continue to preside over the session of the Sangguniang

The situation is different between the OIC and Acting. As earliernoted, in theactingcapacity, there is temporary vacancyintheOfceof theMunicipalMayor, while inOICcapacity, thereisnotemporaryvacancyintheOfceoftheMunicipalMayor. Moreover,OICsexerciseonlylimitedpowersasmaybecontained in the letter-authorizationdesignatinghimassuch.Hence, if incidentally, theMunicipalVice-Mayoras theone
designated as OIC, he can still continue to preside over thesession of the Sanggunian since the ruling in the Gamboa casewillnotapply.
As a mere OIC, he has no power to perform all the functionsandpowersoftheMunicipalMayorandmoreimportantly, heorshe is now empowered to approve ordinances. Such being thecase, the violation of separation of powers and functions, theevil sought to be avoided in the Gamboa ruling, is not present.Since,anyway,asOIChehasnopowertoapproveordinancesenactedbytheSanggunian.
