Licensing systems (Article 4B, paragraph 4, of the Montreal Protocol) 1. Status of licensing systems and focal points

Note by the Secretariat

I. Licensing systems (Article 4B, paragraph 4, of the Montreal Protocol)1. Article 4B of the Montreal Protocol requires each party to the Protocol to establish a system for licensing the import and export of new, used, recycled and reclaimed controlled substances listed in Annexes A, B, C and E to the Protocol by 1 January 2000 or three months after the date of entry into force of Article 4B for the party. Pursuant to paragraph 4 of Article 4B, the Secretariat is required to prepare and circulate periodically to all parties a list of parties that have reported to the Secretariat on their licensing systems. The Secretariat is also required to forward that list to the Implementation Committee for its consideration and appropriate recommendations to the parties.

2. Annex I to the present note lists all parties to the Montreal Amendment to the Montreal Protocol that had established licensing systems and notified the Secretariat by 5 October 2010. Of 181 parties to the Amendment, 175 have established licensing systems, while 5 have not reported on the status of establishment of such a system. Section A of Annex II to the present note lists the 12 States that are parties to the Protocol and, although not yet parties to the Montreal Amendment, have already established and implemented licensing systems. The three parties to the Protocol listed in section B of Annex II have neither ratified the Montreal Amendment nor established licensing systems.

3. This status is updated regularly on the basis of information reported to the Secretariat. Parties are encouraged to report to the Secretariat information on the establishment of licensing systems to be reflected in future updates to the present note.

II. Focal points4. To facilitate the efficient notification, reporting and cross-checking of information on licensing systems, by decision IX/8 each party was invited to inform the Secretariat of the name and contact details of the officer to whom information and requests should be directed. Annex III to the present note contains a list of names and contact details of focal points updated as at 5 October 2010. Parties
