    National dug testing and oensic laboatoies ae engaged in theimpotant wok o the identication and analysis o seized mateialssuspected o being nacotic dugs, psychotopic substances o pecusos.In ode to ull the ole expected o them, laboatoy scientists mustnot only possess basic skills o identiying and analysing suchsubstances, but also have access to the acilities and tools equied todischage thei duties.

    The Intenational Nacotics Contol Boad ecognizes that analyticalsevices in some counties may be inadequate because o a lack o ullytained pesonnel o laboatoy equipment and mateials. Howeve,

    unctioning laboatoies eveywhee should have eady access to thehigh-quality eeence standads equied to ensue that the esultspoduced ae coect. That pocess o ensuing coect esults is citicalo the successul posecution o the guilty and the potection othe innocent. In addition, it povides a cost-eective way to peventtime-consuming challenges to ndings in cout.

    In most cases, national dug testing laboatoies can obtain withoutdiculty small quantities o the eeence standads equied o theeliable identication and analysis o dugs and pecusos. Howeve,poblems ae sometimes encounteed.

    These guidelines have been published to assist national laboatoies andothe elevant scientic institutions in obtaining, in a timely ashion, theeeence standads that they equie. They addess some o the mostequently encounteed diculties and povide guidance on how to ove-come obstacles. They ae intended o use by laboatoies that ae in needo eeence standads and by competent national authoities that aeesponsible o the contol o dugs and pecusos and that issue the impotand expot authoizations equied to execise that contol.

    1. At its eighty-outh session, in Novembe 2005, the IntenationalNacotics Contol Boad eviewed a special study concening the vaiousdiculties aced by dug testing laboatoies in obtaining eeencestandads o dugs unde intenational contol. Following that eview,the Boad, in its epot o 2005, noted the impotance o eady accessto eeence standads o maintaining eliable dug testing and oensicsevices at the national level, as well as the natue o ongoing poblems

    that lead to delays in obtaining those eeence standads.1 The Boaddecided that guidelines on obtaining eeence standads/samples odugs unde intenational contol should be poduced based on thespecial study pepaed by the Laboatoy and Scientic Section o theUnited Nations Oce on Dugs and Cime (UNODC). The Boad alsodecided that the guidelines should be distibuted to competent nationalauthoities, dug testing laboatoies and eseach institutions, in odeto highlight potential poblems and povide pactical guidance o thetimely issuance o the impot and expot authoizations2 equied undethe intenational dug contol teaties.

    2. The Laboatoy and Scientic Section povides technical assistance,on equest, to counties in the egions most aected by illicit dugpoduction, manuactue, tacking and abuse in ode to help establishand stengthen thei national dug testing laboatoies. Ongoing globalsuppot sevices include the povision o expet advice and guidance, aswell as basic laboatoy equipment and mateials, ecommended analyti-cal methods, technical guidelines, scientic liteatue and the eeencestandads necessay o analysis and eseach.

    3. In most cases, small quantities o eeence standads o nacoticdugs, psychotopic substances and pecusos can be obtained withoutdiculty, but poblems ae sometimes encounteed. The Single Conven-tion on Nacotic Dugs o 1961,3 that Convention as amended by the1972 Potocol,4 the Convention on Psychotopic Substances o 1971,5the United Nations Convention against Illicit Tac in Nacotic Dugsand Psychotopic Substances o 19886 and the elated esolutions o theEconomic and Social Council clealy povide o the intenational tadeo contolled substances. The Boad has peviously eviewed the issue

    teaty povisions should be ully applied to such eeence samples, sincethose poducts usually contain elatively pue active substances (awmateials) and may be tansmitted in quantities liable to abuse.7 Howeve,the pactical application o the contols in place at the national level tomeet the equiements o the intenational dug contol conventions canlead to signicant delays.

    A. Purpose of the guidelines

    4. These guidelines have been developed pimaily to assist nationallaboatoies and eseach institutes in obtaining in a timely manneeeence standads o nacotic dugs, psychotopic substances and pe-cusos unde intenational contol. The guidance povided is intendedto emove o minimize the obstacles oten encounteed when eeencestandads ae equied. Obstacles may aise because o: (a) inadequateawaeness o pocedual equiements o issuing impot authoization;(b) the length o time sometimes equied o issuing authoization;

    (c) legislation o othe egulations that impede the impot o contolledsubstances; o (d) a lack o appopiate inastuctue o the shipmento contolled substances into o out o a county.

    5. The guidelines ae intended to povide pactical guidance to ove-come obstacles in ode to acilitate implementation o national contols.They ae aimed at those laboatoies which ae in need o eeencestandads o the pope and eliable identication and analysis o dugsand pecusos and which theeoe need to ollow domestic equie-ments to equest impot and expot authoizations. They ae also aimedat the competent national authoities esponsible o issuing thoseauthoizations.

    6. Boad implementation o the guidelines will help to optimize egu-latoy pocedues and acilitate the wok o national laboatoies andeseach institutes. That will educe ustation and ictionbetween agencies and institutions at the national level. It will alsoenable UNODC to immediately povide the technical assistance andsuppot equied i those laboatoies ae to meet intenationallyecognized standads o peomance, and to povide the equiedsuppot to national ciminal justice systems and law enocement,health and egulatoy authoities.

    Requirement of reference standards

They ae also essential o

    the validation and evaluation o both qualitative and quantitativeanalytical methods and o the implementation o good laboatoypactices.

    8. reliable dug testing and oensic expet sevices ae a key elemento dug and cime contol activities at the national, egional and inte-national levels. Thus, it is citical that oensic laboatoies ae able topovide those sevices at all times. Given that the quality o analyticalsevices in some counties may be compomised because o a lack oequipment, mateials o ully tained pesonnel, it should be stessedthat unctioning laboatoies eveywhee must have eady access to the

    eeence standads and contols equied to ensue eliable esults.

    Availability of reference standards

    9. Authentic eeence standads ae commecially available om anumbe o souces. Laboatoies that have no independent access tosuch standads o dug and pecuso substances may obtain smallquantities o them om the Laboatoy and Scientic Section as pato the ongoing global suppot sevices that UNODC povides toMembe States.

    10. Unotunately, laboatoies sometimes encounte diculties whenthey ty to obtain the eeence standads that they equie, especiallywhen those standads ae not available om domestic souces and mustbe impoted. Since those diculties ae mostly elated to nationallegislation and administative pocedues o issuing impot and expotauthoizations, the poblems multiply when eeence standads must beimpoted om a numbe o dieent souces outside the county owhen a seies o sepaate impot authoizations must be obtained.

    11. The guidelines ae based on the elevant expeiences o vaious labo-

    atoies woldwide and in some cases thei espective national authoities,as well as on the expeiences o the Laboatoy and Scientic Sectionin handling equests o eeence standads om those laboatoies.

    A. Legislative and regulatory context for theissue of import and export authorizationsfor reference standards containinginternationally controlled substances

    12. The 1961 Convention, the 1971 Convention and the 1988 Conven-tion and related resolutions of the Economic and Social Council providethe framework for international cooperation in preventing the diversionof narcotic drugs, psychotropic substances and precursors. The threeconventions contain special provisions relating to the international tradeof controlled substances and impose a general obligation on States par-ties to cooperate with each other to prevent diversion. For example,States parties must participate in the control of international trade bycontrolling exports and imports.

    13. The most important provisions in that regard relate to the require-

    ment of import and export authorizations covering international tradein controlled substances8 and the requirement of a licensing regime forthe issue of such authorizations. To that end, and for such a regime tofunction, each State must have a competent authority empowered toissue export and import authorizations for narcotic drugs and psycho-tropic substances and some form of pre-export notification for precur-sors. Note that the name and address of the designated national com-petent authority must be communicated to the Secretary-General of theUnited Nations (through the Executive Director of UNODC) in orderfor the authority to be recognized.

    14. The practical procedures for issuing import and export authoriza-

    tions introduced by Governments must be consistent with national legaland administrative frameworks. Simplified flow charts outlining the mostimportant steps for the granting of import and export authorizationsfor drugs under a typical national licensing regime are contained inannex II. A model import authorization form, adapted from the importauthorization model established by the Commission on Narcotic Drugsfor the import of narcotic drugs or psychotropic substances, is containedin annex III. Because requirements for the international shipment ofprecursors are slightly different, a model application form for the importof controlled chemicals is contained in annex IV.

    B. Difficulties encountered

    15. When a equest to impot a eeence sample is accompanied by apopely completed oiginal impot authoization issued by the designatednational competent authoity, with an appopiate peiod o validity(expiy date), thee is usually no poblem in poviding laboatoieswith eeence standads o nacotic dugs, psychotopic substances andpecusos. Fo eeence standads povided by UNODC, o example,the Austian authoities esponsible o issuing authoizations aehelpul and ecient and povide the necessay expot authoizationwithout delay.

    16. Howeve, poblems have been encounteed in poviding eeence

    standads in a timely manne to dug testing laboatoies in some coun-ties, pimaily because those laboatoies ace diculties in obtainingthe elevant impot authoizations. Those diculties ae ongoing, causedelays and ceate ustation and iction at the national level. Mostimpotant, as a esult o those diculties, UNODC is unable to imme-diately povide the technical assistance and suppot that ae clealyequied, and dug testing laboatoies cannot meet intenationally ecog-nized standads o peomance o povide citical suppot to nationalciminal justice systems and law enocement, health and egulatoyauthoities. The poblems encounteed include:

    (a) Poblem 1. Legislation o egulations that impede o pohibit

    the impot o expot o contolled substances, including eeencestandads and test samples;

    (b) Poblem 2. Inadequate awaeness on the pat o competentnational authoities o the equiements o dug testing laboatoies inode to ull thei ole and unctions (o example, why laboatoiesneed eeence standads) and inadequate awaeness on the pat o labo-atoies o the equiements o accuate and compehensive completiono application oms equesting impot and expot authoizations omcompetent authoities. Note that the Laboatoy and Scientic Sectionpovides geneal guidance o issuing authoizations and details on theinomation equied in pepaing equests o eeence standads andothe test and eseach samples containing intenationally contolledsubstances (see annex I and the model impot authoization omcontained in annex III);

    (c) Poblem 3. Undue delays and othe complications caused bynational authoities in issuing authoizations with an appopiate peiodo validity (expiy date), including delays caused by the peeence oissuing a seies o single authoizations (one o each o the contolledsubstances equied) athe than an individual authoization that listsall the substances equied;

    (d) Poblem 4. Chages levied by national authoities o issuanceo authoizations, a poblem compounded when multiple authoizations

    ae equied o when expied authoizations need to be eissued, andcustoms cleaance chages levied by the elevant authoities at the timeo impotation. Delays may also be intoduced because o the additional

    need, o customs puposes, to povide a note o po oma invoiceindicating the value o the eeence standads povided;

    (e) Poblem 5. Lack o appopiate inastuctue o shipment ocontolled substances (eeence standads and test samples) into o outo a county.

    C. Recommendations for overcoming obstacles

    17. The competent authoity, as a key playe in national dug contoleots, has a pime esponsibility in ensuing that its laboatoycountepats ae aoded the ullest suppot in poviding eliable dug

    testing and oensic expetise. At the same time, some geneal awaeness-aising is equied on both sides to minimize the impact o potentialpoblems. A numbe o specic ecommendations aimed at ovecomingthe diculties encounteed ae listed below.

    Awareness-raising

    18. Competent authoities should be made awae o, and ecognize, thecitical impotance o the eeence standads and othe mateials e-quied by dug testing laboatoies in ode to povide a eliable sevicein suppot o national dug contol eots. At the same time, laboa-toies equesting eeence standads should amiliaize themselves withthe elevant steps and inomation equiements o issuing o impotand expot authoizations (see annexes). relevant taining pogammesand awaeness-aising execises o both competent authoities and labo-atoies should theeoe be extended, whee necessay toaddess: (a) the impotance and value o dug testing laboatoies aspat o the national dug contol inastuctue, and the equiementso laboatoies in ullling thei ole and unctions (that is, the specicneed o eeence mateials and test samples o outine opeationalwok); (b) the pocedual and compehensive equiements o applica-tion o impot and expot authoizations by laboatoies, and o com-

    pletion o elevant oms; and (c) the need o a close and constuctivewoking elationship between competent authoities and nationallaboatoies.

    Minimizing legislative and regulatory impediments

    19. Govenments should eview the adequacy o existing domestic legis-lation and egulations to ensue that no unnecessay obstacles pevento othewise complicate the acquisition by bona de dug testing laboa-toies o eeence standads o test samples containing intenationally

    contolled substances. Whee necessay, Govenments should consideamending legislation and egulations, using some om o apid amend-ment scheme o exemption pocedue i equied, to ovecome the oten

    Minimizing delays and other related complications

    20. Competent authoities should seek at all times to impove thei e-sponse to equests o impot and expot authoizations o contolledsubstances to be used as eeence standads o test samples by dugtesting laboatoies and should povide the necessay technical suppotand guidance to ensue a apid esponse to equests. They should teatsuch equests as a pioity and take all steps to ensue the timely issu-ance o impot and expot authoizations in ode to help national

    oensic laboatoies quickly obtain the standads equied. To that end,authoities should conside establishing ast-tack pocedues o thetimely issuance o authoizations o contolled substances to be usedas eeence standads o test samples.

    21. Fo thei pat, laboatoies should ensue that application omsand othe documentation elated to equests o standads ae ullycompleted and that all inomation povided is accuate.

    Eliminating charges levied by competent national authorities

    and customs clearance charges

    22. Competent authoities, especially in counties whee laboatoy e-souces ae limited, ae equested to conside waiving any chages no-mally applied o the issuance o impot and expot authoizations inthose cases involving contolled substances to be used as standads/testsamples by dug testing laboatoies o outine opeational wok.

    23. Similaly, national authoities should also conside waiving chagesnomally applied o customs cleaance at the time o impotation. Whenequesting standads, laboatoies should indicate i a note is equied

    stating the value o the eeence mateials to be povided. In the caseo the eeence standads distibuted by UNODC, a note o invoice ispovided stating the total nominal value o the samples and the actthat the samples have been povided ee o chage and ae o scienticpuposes only.

    Shipment of standards to and from countrieswith inadequate infrastructure

    24. Whee thee is no easy physical means o shipping contolled sub-

    stances into o out o a county, all those involved should be fexiblein nding solutions, in accodance with the povisions o the inte-national dug contol teaties and national and intenational legislation,

    to acilitate delivey o eeence standads and test samples o use bydug testing laboatoies.

    D. Summary

    25. These guidelines emphasize the value and impotance o laboatoydug testing. They highlight some o the diculties that laboatoiesexpeience in obtaining eeence standads and the act that, withoutsuch standads, laboatoies cannot povide essential suppot sevicesto national ciminal justice systems and law enocement, health andegulatoy authoities.

    26. To avoid diculties and to pevent simila poblems om aisingin the utue, laboatoies should be made awae o the elevant stepsand inomation equied o the issuing o impot and expot authoi-zations. They should also ensue that application oms and othe docu-mentation elated to equests o standads ae ully completed and thatthe inomation povided is accuate.

    27. Competent national authoities should also: (a) give pioity to e-quests o impot and expot authoizations o eeence standads otest samples containing intenationally contolled substances o use bydug testing laboatoies; and (b) take all necessay steps to ensue the

    timely issuance o the authoizations equied unde the intenationaldug contol teaties.

    Simplified flow charts outlining the most important steps forthe granting of import and export authorizations for drugsunder a typical national licensing regime

    1. Beoe authoizing an impot, the competent authoity o the impotingcounty must be satised that the ollowing citeia have been met:

    (a) The Intenational Nacotics Contol Boad has conmed an estimateo the dug to be impoted (in the case o nacotic dugs);

    (b) The quantity to be impoted does not exceed the total o the estimateso that dug (in the case o nacotic dugs), taking into account the quantities

    aleady odeed and excluding the quantities to be e-expoted in the couseo the yea;

    (c) I the county has no estimate o the dug in question o i the esti-mate is too low, the competent national authoity should unish the Boadwith a supplementay estimate and an explanation o why the supplement isneeded.     2. Once an impot authoization is issued, a copy o the authoization shouldbe sent to the competent authoities o the expoting county. Two copiesshould go to the impote (which will send one copy to the expote and keepthe second copy o the customs declaation). One copy should go to thecustoms authoities o the impoting county, and the nal copy should be keptin the ecods o the competent authoity o the impoting county.

    4. Beoe authoizing an expot, the competent authoity o the expoting

    county must be satised that the ollowing citeia have been met: (a) The competent authoity o the county o destination has issued animpot authoization in good and due om. In case o doubt with espect tothe authenticity o that document, the expoting county should contact theBoad and/o the competent national authoity o the impoting county oclaication;

    (b) The county o destination has an estimate o the dug it is seekingto impot (in the case o nacotic dugs). In case o doubt, the expoting countyshould contact the Boad and/o the competent national authoity o theimpoting county o claication;

    (c) The quantity equested in the impot authoization does not exceed

    the total o the estimates o the county o destination (in the case o nacoticdugs), taking into account expots aleady known to have been made to thatcounty and deducting any e-expots that may have taken place. In case o

    doubt, the expoting county should contact the Boad and/o the competentnational authoity o the impoting county o claication;

    5. Once an expot authoization is issued, a copy should be sent to the com-petent authoities o the impoting county. Two copies should go to theexpote, one o which must accompany the consignment. One copy should goto the customs authoities o the expoting county, and anothe copy shouldbe kept in the ecods o the competent authoity o the expoting county.

    6. Expot and impot authoizations should be in a standad omat that ispotected against alsication. Models o the expot and impot authoizationsshould be unished to the Boad and should contain the ollowing inomation:the name o the substance (the intenational non-popietay name (INN) i

    available), the quantity to be expoted o impoted, the name and addess othe expote and the impote and the peiod within which the expot o impotmust be eected (expiy date). The expot authoization must state the numbeand date o the coesponding impot authoization and the name o theissuing authoity.

    7. Ate eceiving the shipment, the impoting authoity shall etun theaccompanying expot authoization with an endosement cetiying the amountactually impoted.

    The impot authoization should consist o ve copies: one copy o theecods o the issuing competent national authoity, one copy to be sent tothe competent authoities o the expoting county, one copy to be sent to thecustoms authoities o the impoting county and two copies o the impote(o which one copy is to be sent to the expote and the othe copy is to beused o the customs declaation).
