FACILITY LEVEL LEADERSHIP AND GOVERNANCE POLICY GUIDELINES
Hon. Sanga: Thank you Mr. Speaker. I wish to table the facility level leadership and governance
policy guidelines. Hon. Members, currently, dispensaries and referral hospitals are electing the
management boards. I have the guideline with me, copies will be given to all of you. Nurses in
charge have been informed to liaise with you Hon. Members so that you can be involved in
selection of the committee members of dispensaries and referral hospital. Thank you. I beg to table.

ADOPTION OF NANDI COUNTY ASSEMBLY SERVICE BOARD REPORT ON
APPOINTMENT OF TWO MEMBERS OF PUBLIC TO SERVE IN THE NANDI COUNTY
ASSEMBLY SERVICE BOARD
Hon. Komen: Thank you Mr. Speaker, I stand to move a Motion that this County Assembly adopts
the report of County Assembly Service Board on successful applicants to serve in Nandi County
Assembly Service Board tabled on the floor of the House on 6th December 2017. I will read the
report;

On behalf of Members of Nandi County Assembly Service Board and pursuant to section 12 of
County Government Act, 2012, it is my pleasure and duty to present to this House, the Board’s
report on the interview for the appointment of two members (man and woman) of Nandi County
Assembly Service the Board.
Membership of Nandi County Assembly service board upon commencement of Second County
Assembly is currently constituted of the following members:-
1. Hon. Joshua Kiptoo – Speaker of the Assembly (Chairperson)
2. Hon. Osborn Komen – Representative from Majority Party (Vice Chairperson)
3. Hon. Eliud Kirongo – Representative from Minority Party
4. Mrs. Isabella Maiyo – Secretary
Mandate; the County Assembly Service Board is established under section 12(1) of the County
Government Act, 2012, and the County Assembly Service’s Act, 2017, which provides that, there
shall be a County Assembly Service Board for each County Assembly.
The County Assembly Service Board duties is as indicated in the report.
In the nomination of the Members of the Board to County Assembly Service Board, the Nandi
County Assembly Service Board pursuant to Article 10 of the Constitution advertised the positions
on 15th September 2017 in both the Standard and Daily Nation Newspapers. A total of 46
candidates applied for the position as indicated below:-

Those are the 46 candidates all their ID numbers are indicated in the report except for one.
The Board held meetings during which the said applicants were shortlisted, appeared before the
Board and they were interviewed in accordance with the Public Appointments (Parliamentary
Approval) Act No.33 of 2011 and taking into account the constitutional provisions of good
governance.
May I take this opportunity to thank all Members of the Board for their input and valuable
contributions made during the deliberations and interviewing of the applicants. I also wish to thank
all the applicants who appeared before the board for interview.

Joshua Kiptoo, Speaker of the Assembly on 4th of December 2017.
On background establishment of Service Board, Section 12(2) of County Government Act, 2012
and the County Assembly Service’s Act, 2017, provides that the County Assembly Service Board
shall be a body corporate with perpetual succession and a common seal and shall consist of-
(a) The Speaker of the County Assembly as the chairperson;
(b) A Representative from the majority party as the vice chairperson;
(c) A Representative from the minority party; and
(d) Two members of the public (one man and one woman), appointed by the County Assembly
from among persons who have knowledge and experience in public affairs, but who are not
Members of the County Assembly.
(e) The County Assembly Clerk shall be the secretary to the County Assembly Service Board
The mandate of County Assembly Service Board is to consider for approval by the House
appointments of members of the Board. Section 7(10) of the Public Appointments (Parliamentary
Approval) Act No.33 of 2011, provides that, where the nomination of a candidate is rejected by
Assembly, the appointing authority may submit to the relevant House the name of another
candidate and the procedure for approval specified in this Act shall apply accordingly.
Appointment process of the members to County Assembly Service Board, the advert to the post
of Nandi County Assembly Service Board member was made advertised in the standard newspaper
dated 15th September 2017.
The Board considered the qualifications and public sector experience of the applicants and
competitively shortlisted a total of seventeen applicants (nine men and eight women). The
shortlisted candidates were invited for interview via the Daily Nation and Standard Newspapers.
The shortlisted candidates appeared before the County Assembly Service Board as indicated in the
report. It should be noted that since Tuesday 28th November 2017 was declared a public holiday
for the President’s swearing-in ceremony, the interviews scheduled for that day were rescheduled
to Friday 1st December 2017.
The Board set the following as the basic requirements for appointment;
That the candidate must be a Kenyan citizen and must be a resident of Nandi County, have
knowledge and over 10 years’ experience in public affairs, hold at least a Bachelor’s degree from
a University recognized in Kenya and meet the requirements of leadership and integrity as set out
in Chapter 6 of the Constitution of Kenya 2010.

While conducting the interviews, the Board observed the following among others in awarding
marks, in accordance with the Public Appointments (Parliamentary Approval) Act.No.33 of 2011;
academic qualifications, employment record, professional affiliations, potential conflict of
interest, knowledge on the relevant subject, overall suitability for the position that is general
presentation, appearance, courtesy, etiquette, composure, communication skills and knowledge
and experience in public affairs.
Mr. Speaker, I wish to inform the House that neither memoranda nor sworn affidavit was submitted
to the board in respect to the shortlisted candidates, this gave the Board the positive image on the
perception of the public against the candidates in respect to integrity issues.
The Board in its process was guided by the following constitutional principles; high standard of
professional ethics, transparency and provision to the public of timely, accurate information and
affording adequate and equal opportunities for appointment, and advancement to; both men and
women, members of all ethnic groups and persons with disabilities.
The committee was further guided by principles of good governance as set out under Article 10 of
the Constitution of Kenya, 2010.
During its sittings held on Wednesday 29th November 2017, Thursday 30th November 2017 and
Friday 1st December 2017, at the Committee room at County Assembly precincts, the candidates
were first categorized into male and female candidates. The observations and recommendations in
respect to each shortlisted candidate are as provided herein under:-
Female candidates were eight and the first is Felicity Irene Magut the identification number is as
indicated. Mrs. Felicity Irene Magut appeared before the Board for interview on Friday 1st
December 2017 at 11:25 am and was taken through oral interview. Academic qualification is as
indicated. She has a Degree in psychological counselling (Mt. Kenya University) the work
experience is as indicated.
The Board observed that the candidate was not the most suitable for appointment to the post of
Member of County Assembly Service Board on merit for having emerged position three out of
eight candidates. Pursuant to section 12(3) (d) of County Government Act, 2012 and County
Assembly Service Act, 2017, the Board recommends that this House does not approve Mrs.
Felicity Irene Magut for appointment.
The second lady was Mrs. Rose J. Kogo Chemogos who appeared before the Board for interview
on Thursday 30th November 2017 at 3:00 pm and was taken through oral interview. Personal
details, academic qualification, work experience is as indicated in the report.
The Board observed that the candidate was not the most suitable for appointment to the post of
Member of County Assembly Service Board on merit for having emerged position seven out of
eight candidates. Pursuant to section 12(3) (d) of County Government Act,2012 and County
Assembly Service Act, 2017, the Board recommends that this House does not approve Mrs. Rose
J. Kogo Chemogos for appointment by the County Assembly Service Board to the vacant post of
Nandi County Assembly Service Board member.

Wednesday 29th November 2017 at 12:00 noon and was taken through oral interview. Personal

interview on Wednesday 29th November 2017 at 10:20 am and was taken through oral interview.

The Board observed that the candidate was not the most suitable for the appointment so the post
of Member of County Assembly Service Board on merit for having emerged position five out of
eight candidates. Pursuant to section 12(3) (d) of County Government Act, 2012 and County
Assembly Service Act, 2017, the Board recommends that this House does not approve Mrs.
Pacifica Chepkosgei Mining for appointment by the County Assembly Service Board to the vacant
post of Nandi County Assembly Service Board member.

Wednesday 29th November 2017 at 10:20 am and was taken through oral interview. Personal
details, academic qualification, work experience is as indicated in the report.
The Board observed that the candidate was not the most suitable for appointment to the post of

candidates. Pursuant to section 12(3) (d) of County Government Act, 2012 and County Assembly
Service Act, 2017, the Board recommends that this House does not approve Mrs. Rose Jepleting
Boit for appointment by the County Assembly Service Board to the vacant post of Nandi County
Assembly Service Board member.
The next was Mrs. Viola Chepkemboi Chumba. She appeared before the Board for interview on
Thursday 30th November 2017 at 2:10 pm and was taken through oral interview.
The Board observed that the candidate was not the most suitable for appointment to the post of
Member of County Assembly Service Board on merit for having emerged position three out of
eight candidates. Pursuant to section 12(3) (d) of County Government Act, 2012 and County
Assembly Service Act, 2017, the Board recommends that this House does not approve Mrs. Viola
Chepkemboi Chumba for appointment by the County Assembly Service Board to the vacant post
of Nandi County Assembly Service Board member.
The next candidate is Mrs. Stella C. Rutto who appeared before the Board for interview on
Wednesday 29th November 2017 at 3:00 pm and was taken through oral interview. The Board

appeared before the Board for interview on Friday 1st December 2017 at 3:00 pm and was taken

Kosirai. Academic Qualification. Ongoing Doctorate degree in Philosophy English Language
(Moi Uni.), Master’s Degree of Philosophy in Education (Community Tech.) Bachelors Education
English Lit (Moi Uni.) KCSE B-. Work Experience: 2013 to date Senior Graduate Teacher (Kaiboi
Technical Institute), 2011-2013 Senior Graduate Teacher (Holy Rosary Girls) and 2002-2011
Graduate Teacher (Chemuswa Secondary School)
The Board observed that the candidate is suitable for appointment to the post of Member of County
Assembly Service Board on merit for having emerged position one out of eight candidates. She
demonstrated vast knowledge and experience in public affairs with excellent knowledge of the
public affairs of the County Assembly touching on both the staff and MCA’s matters. She was
precise in her responses and remained well composed. She came out as an explorative person ready
to try new ventures and portrays a character of a person with high level of commitment. Pursuant
to section 12(3) (d) of County Government Act, 2012 the Board recommends that this House do
approve Ms. Irene Jepkorir Choge for appointment by the County Assembly Service Board to the
vacant post of Nandi County Assembly Service Board as female representative.
On the male candidates for member of County Assembly Service Board, we had Wilson K.
Ng’etich of ID. No. 8591928. He appeared before the Board for interview on Friday 1st December
2017 at 11:25am and was taken through oral interview. The board made the following
observations; Personal details Name: Wilson K. Ng’etich. Date of Birth: 1967. ID No: 8591928.
Ward: Koiyo /Ndurio. Academic Qualification; Bachelor of Commerce (Kenyatta Uni.), Diploma
in Management (Kenyatta Uni.), ANC Stage I&II (Thika Technical College) and KCSE Division
IV. Work Experience; 2013-2016 MCA (Nandi County Assembly), 1991-1996 Accountant
(Kenya National Assurance) and 1997-2012 Accountant (AIC Chebisaas).
The Board observed that the candidate was not the most suitable for appointment to the post of
Member of County Assembly Service Board on merit for having emerged position nine out of nine
candidates. Pursuant to section 12(3) (d) of County Government Act, 2012 and County Assembly
Service Act, 2017, the Board recommends that this House does not approve Mr. Wilson K.
Ng’etich for appointment by the County Assembly Service Board to the vacant post of Nandi
County Assembly Service Board member.

Dr. Abraham Kiprop Mulwo of ID. No. –21031214. Dr. Abraham Kiprop Mulwo appeared before
the Board for interview on Tuesday 28th November 2017 at 09:00 am and was taken through oral
interview. Date of Birth: 1977, ID No: 21031214 and Ward: Kaptel. Academic Qualification: PhD.
Cultural & Media Studies (University of Kwazulu-Natal South Africa), M.Phil. Communication
studies (Moi University), Bachelor of Arts Language & Literary Studies (Moi University) and
KCSE B. Work Experience: 2014 to date Senior Lecturer, 2010-2014 Lecturer (Moi University)
2005-2010 Tutorial Fellow (Moi University), Assistant Lecturer (Moi University) and in 2008
Researcher (CADRE, UNESCO).
The Board observed that the candidate is suitable for appointment to the post of Member of County
Assembly Service Board on merit for having emerged position one out of nine candidates. He was
very knowledgeable on the County Assembly procedures cutting across both public and state
officers. He demonstrated precise application of strategies to implement in the Assembly from
media, communications to public participation. He also has a wealth of experience at management
level having chaired and transformed similar management boards. Pursuant to section 12(3) (d) of
County Government Act, 2012, the Board recommends that this House do approve Dr. Abraham
Kiprop Mulwo for appointment by the County Assembly Service Board to the vacant post of Nandi
County Assembly Service Board as the male representative.
The Board members have affixed their signatures in support of the report.

Hon. Rono Emmanuel: Before I do that, I wish to confirm how many candidates were
interviewed. Is it eight or nine? I wish to confirm that from Hon. Komen. How many? Eight or
nine?
Hon. Komen: Through the Speaker we had eight female candidates and nine male candidates.
Hon. Rono Emmanuel: So on that note Hon. Speaker, as Hon. Fred has said, I have tried going
through this report and I am a little dismayed by the report itself. Hon. Komen, I am wondering
why this statement is a lazy observation. From candidate one to the last for those who did not
qualify, this copy pasted statement is the laziest that I have ever seen. As Hon. Fred has said, it is
a blanket condemnation of those who did not qualify and carries no value to this House. I would
have wished to see the grading, the parameters that you used to judge the candidates. As the
observation say, the board observed that the candidate was not the most suitable for appointment
to the post of Member of County Assembly Service Board. On merit for having emerged position
eight out of eight candidates. What does it say? We want to see that candidate A did not qualify
because of this reason and that reason. In fact I am not going to continue further.
Hon. Murrey: Thank you very much Mr. Speaker. I also want to echo what my fellow colleagues
have already said. It is like the interview was actually more of subjective rather than being
objective because like Hon. Rono Emmanuel has told us is that we have not been given parameters.
The values which were actually used to arrive at those conclusions. So Mr. Speaker, the other time
I was reading the score card of the results of an interview of VC’s of Moi University and we were

given percentages awarded by each panelist but when it comes to this there is nothing like that.
So, I also want to say that if you look at all these candidates, all of them according to me are
qualified. Not unless we are given those percentages which were, I mean the parameters used to
award marks from number one to number nine or one to eight. So Mr. Speaker, at this juncture I
must say that I do not support this report. Thank you.
Hon. Speaker: Hon. Members before you proceed, let me say something. I happen to be the chair
of the committee so I can be able to speak up about the same. Number one, as noted by the Hon.
Members the missing piece of the work is the entire work that we did. I can confirm number one
that you will get the figures of each and every of the persons.
Number two, maybe the person that moved did not give the idea that we had 56 and dropped it
down to 19 and again we will have to give the basis for getting to that. Number three, we will also
give the raw transcript of each and every of the member. So I want to assume the Members are
asking for the raw data. When we undertook the Selection Committee for the CEC’s I remember
the same concern of the House that were whatever they would want was the final thing. So I would
acknowledge the absence of the entire scripts which I think the Committee can confidently and
comfortably be able to produce before the House. Remember, when it comes to vetting or when it
comes to interviewing, do not think that we sat in a corner and it was a case of someone comes
talks goes marks are given. Not at all. We did three days of interviews running and after three days
of interviews we proceeded for another three days of writing the report but we did it within two
days. So what is absent from the report is the raw fact sheet of the same.
Hon. Kipkurui Chepkwony: Thank you. Hon. Speaker, in view of the sentiments that you have
put forward pertaining this list I also share in the sentiments by the Hon. Member for Ol’Lessos
that the Committee that you chaired, Committee on Appointments, the report was well done
because that report gave us the standards that were set by the Committee on Appointments before
the CEC’s appeared before that Committee and thereafter the awarding of marks and grading was
availed which you have said that it is---
Hon. Speaker: Hon. Chepkwony, I think we never availed marks for the Committee on
Appointments. What we availed was the score cut that each of the CEC’s was to get out of 70.
Hon. Kipkurui Chepkwony: Yes.
Hon. Speaker: The Majority Leader can confirm that. The difference between our report and the
CEC report, the missing tip is the content in terms of explaining to the Members. The Majority
Leader can comment.
Hon. Koech David: The other one was about vetting. This one was an interview. We were just
vetting a candidate but this is a different case. I understand why Members are asking for the same,
it is because we are comparing several candidates. I think that might be the difference. Thank you.

Hon. Speaker: Fair enough Majority Leader. Well captured.
Hon. Kipkurui Chepkwony: Thank you. The issue that was brought forth by the Hon. Member
for Ol’Lessos was the issue of the absence of the raw data that you have indicated that it is
available. So from where I sit I would feel the importance of having that raw data to inform the
Hon. Members so that any judgment on the results of this interview will not be seen and viewed
by Members like the Hon. Member for Ol’Lessos has said that it is a copy and paste.
Clearly, I would have felt the importance of having it. It is even shocking what the Hon. Member
for Kapsabet has indicated. The document that is attached by one Irene Choge on the EACC which
is going back to 2013. So Hon. Speaker, probably there exists in the files another document, an
updated version or an updated report from EACC about her. So we would not want to judge that
based on what we have here because if we were to base on what we have here, Hon. Speaker then
the issue of adopting this list might be a challenge.

Hon. Rono Emmanuel: Now that Hon. Speaker you have hinted that other information can be
availed, is it in order for us to continue discussing this report without that information?
Hon. Speaker: Hon. Member before you stood I wanted to rule on the same but I would give Hon.
Robert Kirwa to state a word.
Hon. Kirwa: Asante sana Mhe. Spika. Maoni yangu ni kwamba tuhairishe hoja hadi kikao
kifwatacho kwa sababu hatukuzingatia nidhamu.
Hon. Maiyo Teresa: Thank you Hon. Speaker. Initially when I looked at the scores and the
experiences depicted by the successful candidate, I saw that there was some work that was actually
done and that it was not all that bad work. But looking at the requirements, I have tried to look at
the advert on what was necessary to attach on the list. It really beats logic how someone I know,
at times the police clearance may take time but this one of EACC honestly beats logic. The other
time we said that any report before it is tabled here in the House, let the one tabling own it first so
that at least we do not keep on moving forth and back in any report. Thank you.
Hon. Speaker: Hon. Members due to fore going I would rather before we pre-empt on the same,
I would wish to rule that, the mover of the Motion together with the clerks at the table can liaise
with the Human Resource office to provide necessary information so that the same can be tabled
again. So the debate will continue.

Hon. Speaker: I have stated that the Motion will have differed the putting into question of the
same simply because I would wish the House to vigorously debate but the House seems
constrained due to the fact that there is need for report. What the House has asked for is factual
information. In this sense, they have asked for the markings, how the same was made and all that.
So because of that I have differed the putting of question and allowing the same discussion so that
the same can be done and be brought before the House.

ADOPTION OF THE LIST OF MEMBERS TO SERVE IN THE SPEAKER’S PANEL

is this, ‘for you to sit in that panel, you must be a good reader’. Hon. Nancy, Hon. Clara is not here
and Hon. Kipkurui, you must be a good reader. A good reader of the Standing Orders, a good
reader of the Constitution of Kenya, a good reader of the Koran, a good reader of newspapers, a
good reader of journals, be a good reader. This is because if you are going to sit down and you are
not well read, you are going to embarrass yourself. So this afternoon, the only message I am going
to pass to you is that for you to be a good Speaker you must be a good reader. Thank you and
congratulation.
Hon. Koech Gideon: Thank you Mr. Speaker for giving me this opportunity to contribute to this
debate. I wish to also join my colleagues who have spoken before me in congratulating Hon.
Kipkurui Chepkwony, Hon. Clara and Hon. Nancy for clinching the coveted prize since several
other Hon. Members would have also wished to be there. I am not saying that they are jealous but
this is a very good position. So, I wish to congratulate them and urge them to move as per or to
take the steps you have taken as a Speaker. I wish to only inform Hon. Fred that I actually think
the numbers in the Speaker’s panel is still constitutional in the sense that we also have the Hon.
Deputy Speaker. So I think your interest has been catered for in talking of the ladies having been
there but mine is to just congratulate them. I wish them the very best, let them lead and guide this
House during debates in the best way. Thank you Mr. Speaker.

actually just really wish to congratulate them and wish them the best as they deliver their service.

that seat. I wish to tell them that they should work very closely with Members because that seat
they will be sitting on sometimes can be very hot. I know Hon. Chepkwony has been vocal most
of the time and he knows. Hon. Clara Chepkwony also here---

Sorry, Hon. Clara Chepkemei. You know she has left another name which is very important. She
uses Chepkemei but I wish there was another name here. One time she presided over a session and
she did very well. One commendable thing Mr. Speaker sir, is that you use public relations system
while in that Chair. Hon. Nancy Chemutai also one time did very well. Now that she is one of the
members chosen, I hope the same system will be used. I hope they will all work with us, assist us
and we will appreciate. Thank you.
Hon. Sang: Thank you Mr. Speaker. I rise to support and thank you for nominating the three Hon
Members. I think it was wise to have these Members so that they can have an opportunity. For
instance Hon. Kipkurui Chepkwony seem to have been rewarded because he talks much in the
House. Mr. Speaker, I hope now when he sits in that Chair of the Speaker Members will have
ample time. Members have not been having ample time from this man and that problem has now
been tamed. So Hon. Kipkurui Chepkwony we want to appreciate that you have been given that
chance. I know this position, the way Hon Fred has put it, is not easy. I know you have appointed
Members who are capable. I wish to tell them that they should work together with the Speaker as
a team.
Hon. Clara has a lot of words and I know when she is on that seat those words will reduce Mr.
Speaker.

Inafaa Mheshimiwa aelewe kwa sababu kuna mambo unaweza kuongea hapa---

Hon. Nyauntu: I was wondering because I have been standing and being left out. The nominees
are very much fit and that is why they are supported by the Hon. Members. This also means that
everybody else is also fit to be in the Speaker’s Panel so long as you are in the House. That is
inclusive of Ho. Kipkemboi. Hon. Kipkemboi you are fit. Do not exclude yourself. I concur with
everybody that this list is very much okay. These Members will serve us diligently and I conclude
by using a quote that says, if you cannot beat them, join them.
Hon. Maiyo Teresa: Thank you Mr. Speaker. Let me take this opportunity to congratulate the
team for being in that panel and thank you very much for considering the two ladies, at least for
the first time the ladies are more than men. Putting together it will be made up of three each which
is really balanced and may this continue in future. When we say a third gender rule it does not
mean it has to be minimum of a third, it can be a third of the other gender. So the gender rule does
not necessarily mean ladies. Let it be men at times. I thank you Mr. Speaker for what you did. I
am sure they are going to perform and we shall be here to see and support. Thank you.

Hon. Koech Gideon: Mr. Speaker, I wish to inform Hon. Member that the Motion by the Leader
of Majority is not to push the sitting to next week but rather to bring to tomorrow in the morning.
So I think he should be made aware that it is tomorrow morning and not next week.

Hon. Kipkemboi: Mheshimiwa Spika watu wengine hawaelewi Kiswahili. Nimesema tuna
mikutano ya Kamati mbalibali asubuhi. Kama tutakuwa na kikao asubuhi na mikutano ya kamati
tutafanya saa ngapi Mheshimiwa Spika? Unajua Kiswahili wakati mwingine inakuwa kigumu
lakini usiwe na wasiwasi Mheshimiwa Spika. Ni kama mimi, Kiingereza sielewi sana lakini
itakuwa sawa tu.

Hon. Koech Gideon: Is the Hon Member in order to impute that now that I have informed him
that the Motion is about bringing the sitting to 9.30 am, I do not understand Kiswahili? Can he
withdraw and apologize?
Hon Speaker: Mhe. Kipkemboi, je unasema ya kwamba Mheshimiwa Koech Gideon haelewi
Kiswahili?
Hon. Kipkemboi: Haelewi Kiswahili.

Ya kwanza Mheshimiwa Spika nimesema kuna vikao vya Kamati na kuna kikao cha Bunge. Hio
ndio maana nimesema hakuelewa Mheshimiwa Spika.

Mheshimiwa Spika na pia aelewe kwamba ukifaulu kwa lugha ya Kiingereza huwezi ukafaulu
kwa Kiswahili.

Mheshimiwa Spika naona---
Hon. Speaker: An Hon Member can speak in English or Kiswahili. That at times may create an
impression but I want to urge the Hon Members that language should not be used to that basis. If
another Member did not hear well, we should not therefore impute and say that they seem not to
understand. So Hon Kipkemboi proceed and I hope the concern has been noted.
Hon. Kipkemboi: Mheshimiwa Spika, pia tuelewe ya kwamba Bungeni tuna shughuli nyingi.
Tungefanya shughuli za Bunge inavyofaa kisha twende kwenye shughuli ya Mheshimiwa baadaye.
Lazima vikao vya kamati vifanyike asubuhi kisha saa nane unusu tufanye kikao cha Bunge. Hii ni
kwa sababu hata tukienda kule saa tano sherehe hiyo haitakuwa imeanza. Ni vyema kujadiliana na
kupanga mambo haya kwanza. Siungi mkono hoja hii, Mheshimiwa Spika.
Hon. Maiyo Teresa: Thank you so much Mr. Speaker. I would like to support this Motion on
moving the afternoon session to morning because this has been a trend and whatever we do at a
Member’s place markets the activities of this Assembly---

connotation that we are moving the business of the House to morning session because of an Hon.

Member. I think the Hon. Members should read in between the Motion as indicated clearly that it
is due to an official engagement think the issue of bringing on Board whether there is a Member
who is going for a dance, party or an engagement party, is none of our business. Our business is
as indicated that we are going to have an official engagement. So, is it in order for the Members to
bring into the Motion issues that are not addressed by the Motion?
Hon. Speaker: Hon. Members I think we should stick to the Motion. If my copy serves me right
it talks about official engagements on 7th December 2017 in the afternoon. So Hon Terry proceed.
Hon. Maiyo Teresa: Mr. Speaker, whichever the engagement my point was referring to why Hon.
Kipkemboi declined the Motion and I said those outings that we go attending Members’ functions
are very important to our unity here. At the same time it gives a communication to the public. So
whether that is one of the official engagements or there are others, it will be in order for us to move
the afternoon session to morning since Committee meetings can easily be rescheduled Hon.
Speaker. Thank you.
Hon. Rono Emmanuel: Thank you Hon Speaker. I rise to support this Motion first because
Standing Order number 21 (2) allows the variation of such. So I have no problem about this
variation so that Members can participate in the official engagement as mentioned here. Hon.
Kipkemboi as much as you have business tomorrow we have adequate time to attend to Committee
meetings. You have adequate time, we have Friday, and we have a whole two months to attend to
Committee meetings. So I request you through the Speaker to accept and support---

to why we sit in Committees is to get money?

inaitwa kwa kimombo sitting allowances. Kwani hawa hawajasoma ama namna gani? Wanajua
hiyo pesa tunalipwa baada ya kuhudhuria vikao, Mheshimiwa Spika. Na hio ndio maana
nawaambia saa nne kamili tutakuwa na mikutano ya kamati na hio kamati inawakilisha Kaunti
mzima. Kwani kufanya harusi ndio kitu cha maana kwa Kaunti yetu ya Nandi?

of calendar sittings for Thursday 7th December. I think Hon Speaker, tomorrow’s session being the

last before we proceed for recess, I duly support because I cannot wait to have time to engage the
people of Tinderet over this holiday, to be able to get their views and their interests progressively
as we go into the next financial year budget cycle. However, Hon Speaker, that said and done, the
Standing Orders give us lee way to do this over and over that is why, the Hon. Members cannot
find some of us who are very technical. We cannot find any technical hitch to be able to capitalize
on the varying of calendar. The only thing is probably the gender activist, Hon. Teresa trying to
imply that we are going to have parties. I think Hon Speaker, if that would have come out clearly
whether we are going for parties, I would be the first person to oppose---
Hon. Maiyo Teresa: Honestly speaking Mr. Speaker, let Hon. Chepkwony withdraw what he is
alleging. I did not say that.
Hon. Speaker: Hon. Chepkwony, you are well informed I did not hear the Hon. Member talk
about partying so you have to withdraw the same.
Hon. Kipkurui Chepkwony: Hon. Speaker, I did mention Hon. Kipkemboi and Hon. Teresa.
Not necessarily attaching Hon. Teresa to the issue of partying. I have only mentioned the two
names because the Hon. Member for Kapsabet actually the last statement he mentioned was
wedding which is a party. So it does not necessarily touch Hon. Teresa, however if she feels that
it is directed to her----

Hon. Kipkemboi: Mheshimiwa Spika, ni halali Mheshimiwa ambaye ameongea kuamka na
kusema bila kupewa kibali?
Hon. Speaker: Hon Chepkwony, kindly conclude.
Hon. Kipkurui Chepkwony: Thank you Hon. Speaker, so as I was saying, the issue that has been
indicated here by the sponsor of the Motion, the Leader of Majority is that we are going to have
official engagement.

Hon. Sang: The language that Hon. Chepkwony is using in the House is not right. When he said
gender activist, I do not know if we have activists in this House. Hon. Chepkwony you should
withdraw the statement. We have Honorable Member representing gender but not activist, Hon.
Chepkwony. That is the language you used and it is not a parliamentary language. He has been
given the opportunity to serve in the Speaker’s Panel and he has started messing.

Hon. Kipkemboi: Mheshimiwa Spika ningependa kujulisha Mheshimiwa aliyechangia kwamba
neno gender ina maana ya mwanamme ama mwanamke.
Hon. Kipkurui Chepkwony: Hon Speaker, I think as much as earlier on, the Hon Member for
Nandi Hills had implied probably Hon. Member for Kapsabet does not understand English, he has
proven now in the sentiment that he has just made right away. This is because I clearly said gender
activist. Hon. Speaker allow me to say this, Hon.Teresa in an earlier Motion indicated that in future
we should have more women and men now should be considered for a third and all of us remember
Hon. Teresa earlier on about a month ago was forging for women to be included in the Committees.
So by playing both parts speaking on behalf of the boy child and girl child, she qualifies to be a
gender activist.
(Laughter)
So it is in no way Hon. Speaker, unless we are saying which word is negative. Neither of the words
is negative neither gender nor activist.
Hon. Speaker: Hon. Chepkwony I think the substance of the Motion was on varying of the
calendar. I would not wish we disgrace anyone. I hope you have finished your submission.
Hon. Kipkurui Chepkwony: Thank you Hon Speaker, I will lay to rest at that and say Hon.
Speaker that I fully support the Motion before the House. Thank you.
Hon. Sanga: Thank you Mr. Speaker. I too support the Motion. The Committee on Health and
Sanitation will be much affected because we had planned to attend a ground breaking ceremony
at Chepkunyuk Ward where a health center is to be constructed. All the Committee Members were
ready to attend. Thank you.
Hon. Sang: Thank you Hon. Speaker for giving me this chance. I also support the varying of the
calendar and I have also found another the reason to attend that official engagement. Hon. Speaker,
I think it is wise for us to change so that we can go and have the official launching and maybe if
there is another engagement, we can go after we have launched the dispensary or the Health Centre
in Chepkunyuk. Otherwise I do support that we pass this Motion. Otherwise thank you Mr.
Speaker.
