This has reference to your 2nd indorsement dated March 9, 2015, addressed to the Honorable Secretary B. Armin A. Luistro FSC requesting for legal advice in the request of Atty. Ryan Paul N. Olfindo seeking authority to engage in the private practice of his profession.

Favorable approval of his request is hereby recommended provided that his undertaking of his limited authority to practice

a. Shall not conflict or interfere or tend to conflict or tend to interfere with his office functions;b. Cam be performed outside of normal working hoursc. Shall not require or induce him to discuss confidential information acquired while performing his official duties;d. Is not with a person or entity that transacts business before the Department of Education;e. Shall not use government resources in the furtherance of said private practice of profession;f. Shall not detract from the dignity of his Legal Office in the Department.

The Schools Division Superintendent being the approving authority for Atty. III position in the Division Office is the authorized signatory for said Limited Authority to Practice

MADAM:

This is in relation to your letter dated April 16, 2015 regarding the cancellation of ARP No. 2002-02-046-00001 of Lot 1090, located in San Jose, Busdac, Bacacay, Albay in the name of the Ministry of Education.

Our initial investigation of the matter reveals that the predecessor in interest of Belinda Madrid allegedly executed a deed of donation in favor of the Principal of Busdac Elementary School representing the Minister of Education sometime the 1960s. In said deed of donation, the predecessor in interest of Belinda Madrid allegedly conveyed around 4,000 square meters of Lot 1090 to the Principal of Busdac Elementary School to be used exclusively for education purposes. However, as of present time, we have not been furnished yet of a copy of said Deed of Donation by the school officials of Busdac Elementary School.

In view thereof, we are asking your good office to give us an extension of 60 days to procure a copy of said deed as proof of ownership of the Minister of Education, now Department of Education, over Lot 1090 in San Jose, Busdac, Bacacay, Albay.
