Most notably, Earl was appointed as tribunal secretary in a US$1.6 billion oil and gas dispute seated in Nigeria, and a US$1.4 billion dispute involving fraudulent misrepresentations seated in Singapore. Earl is a Fellow of the Singapore Institute of Arbitrators, and a Member of the Chartered Institute of Arbitrators (candidate for fellowship) as well as the Philippine Institute of Arbitrators. She is also a visiting lecturer at the Ateneo de Manila School of Government and Ateneo de Manila Law School, a convenor for student moots for the International Commercial Arbitration course at the National University of Singapore, a regular lecturer for the Philippines’ Mandatory Continuing Legal Education for lawyers, and an ad hoc legal consultant of the Philippine Embassy in Singapore. Qualified as an Attorney-at-Law in the Philippines in 2005, Earl was a Justice’s Law Clerk, a government litigator, and a professor of law therein. Earl has appeared before a coram of three judges of the Singapore Court of Appeal to assist the amicus curiae, Professor Lawrence Boo, in the preparation of brief on subject-matter arbitrability of minority oppression claims in Singapore. The Court of Appeal’s judgment was published in the case of Tomolugen Holdings Ltd and another v Silica Investors Ltd and other appeals [2015] SGCA 57. RECENT APPOINTMENTS AS ARBITRATOR

Appointed as sole arbitrator in a SIAC arbitration involving disputes arising from a distributorship agreement between an Indian company and a Spanish company where the Respondent failed to appear at the hearing on the merits. Seat is India and the governing law is Indian law. Award issued.

Appointed as sole arbitrator in a SIAC arbitration involving disputes arising from guarantees between a Singaporean company and an Indian company. Seat of arbitration is Singapore and the governing law is Singapore law. Decision on jurisdiction was issued. Award published in June 2017.

Appointed as sole arbitrator in a SIAC arbitration involving disputes arising from hotel management agreements between an Australian company and an Indonesian company. Seat is Indonesia and the governing law is Singapore law.

RECENT APPOINTMENTS AS TRIBUNAL SECRETARY

Appointed as Secretary to the Tribunal in approximately 30-50 cases a year since 2012 for a total claim of approximately US$ 6.2 billion under the auspices of the ICC, SIAC, LCIA, KLRCA, SCMA, AMTAC, HKIAC, VIAC, ICDR/AAA, BANI and assisted the Chairman in an ICSID arbitration including annulment committee procedure. Most notable appointments include:

a US$ 1.6 billion dollar oil and gas dispute in an ad hoc arbitration involving Africa-based oil companies. Governing law and seat of arbitration is Nigeria, with the UNCITRAL Rules of Arbitration as the rules of arbitration. Hearing venue was Nigeria and London;

a US$ 1.4 billion dollar complex dispute in an ICC arbitration involving a share purchase agreement in the pharmaceutical industry with allegations of fraud against 20 respondents. Governing law is Indian law and seat of arbitration is Singapore;

a multi-million dollar dispute in an ad hoc arbitration involving agreements in the oil and gas industry and alleged unauthorized use of patents. Governing law and seat of arbitration is Indonesia. Tribunal was appointed in January 2016 and award was issued in November 2016 (i.e. within 10 months) to comply with timelines under the Arbitration Act of Indonesia;

a multi-million dollar dispute arising from a joint venture agreement in the technology sector in a LCIA arbitration between an Indian company and residents from the British Virgin Islands and Bahrain with seat of arbitration in Delaware, USA. Decision on jurisdiction, place of hearing issued in this matter;

a multi-million dispute arising from joint venture agreements in the retail industry in a SIAC arbitration between a Korean company and a Chinese company with seat of arbitration in Singapore with order on interim relief issued in this matter. Law of China governs;

a multi-million dispute arising from shareholders’ agreement, call option agreement, and convertible bond agreement in an ICC arbitration in the medical device industry between a Korean company and a Swiss company with seat of arbitration in Seoul, Republic of Korea, and governing law is Korean law;

a multi-million dispute arising from a supply agreement in the automobile industry between a Thailand / Australian company and a Korean company with seat of arbitration in Singapore and governing law is the law of Australia;

a multi-million dispute arising from a contract of sale of goods between an Australian company and an Indian company under the AMTAC Rules with seat of arbitration in Sydney, Australia;

a multi-million dispute arising from a contract of sale of goods between two domestic companies in China under the auspices of the ICC. Seat of arbitration is Hong Kong and governing law is China.

a multi-million dispute arising from a contract for the refurbishment of electric generators of power plants seated in Singapore, and the governing law is Swiss law.

a multi-million dispute arising from engineering and procurement contracts seated in Singapore and the governing law is the law of England and Wales.

a multi-million dollar dispute in an ad hoc arbitration involving agreements in the oil and gas industry and alleged unauthorized use of patents. Governing law and seat of arbitration is Indonesia. Tribunal was appointed in January 2016 and award was issued in November 2016 (i.e. within 10 months) to comply with timelines under the Arbitration Act of Indonesia;
