Một số điểm cơ bản trên vận đơn đường biển Vận đơn đường biển (Ocean Bill of Lading) là chứng từ chuyên chở hàng hóa bằng đường biển, do người vận chuyển (carrier) hoặc đại lý của người vận chuyển (Agent of carrier) phát hành cho người gửi hàng (Shipper) sau khi hàng hóa đã được xếp lên tàu (shipped on board) hoặc sau khi nhận hàng để xếp (received for shipment). Trên vận đơn đường biển thường có các nội dung cơ bản sau: 1. Tiêu đề vận đơn đường biển: Tiêu đề của vận đơn đường biển thường được in sẵn và không quyết định tính chất, nội dung và loại vận đơn, do đó về mặt lí thuyết vận đơn có thể không cần có tiêu đề hoặc có tiêu đề là bất cứ thế nào. Để biết vận đơn thuộc loại nào phải căn cứ vào nội dung cụ thể trên mặt trước tờ vận đơn. 2. Tên người chuyên chở: Bất kì vận đơn nòa cũng phải thể hiện tên của công ty vận tải biển hay người chuyên chở (Shipping company or Carrier). Người chuyên chở mới đích thực là biên đại diện cho hợp đồng chuyên chở nên người chuyên chở phải có trách nhiệm pháp lí về vận đơn phát hành trên danh nghĩa của mình và khi có tranh chấp xảy ra về vận tải hàng hóa thì người chuyên chở phải là người đại diện để giải quyết. 3. Người nhận hàng: Tùy theo việc giao hang là đích danh, theo lệnh hay vô danh mà điền vào ô nhận hàng (Consignee) cho thích hợp. Thông thường, ô này in sẵn các phương án để tiện dung trong các trường hợp khác nhau: - Nếu giao hàng đích danh thì phải ghi đầy đủ tên và địa chỉ kinh doanh của người nhận hàng; ngoài ra có thể ghi thêm các thong tin như điện thoại, fax, telex. Đồng thời, phải gạch bỏ tất cả các từ in sẵnđứng trước tên người nhận hàng có nội dung như “Theo lệnh – to Order”, “Theo lệnh của– to Order of” - Nếu giao hàng theo lệnh của 1 người đích danh, thì phải ghi đầy đủ tên và địa chỉ kinh doanh của người này, ngoài ra nếu trên vận đơn không in sẵn các từ như “To Order”, “To Order of” hay “or Order” thì phải ghi thêm

Nu ngi gi hng k hu theo lnh ca 1 ngi ch danh th vn n tr thnh vn n theo lnh hng ha s giao thoe lnh ca ngi ny. Vn n v danh t c s dng trong thc t v n d b lm dng chim ot hng ha nn c ngi gi hng, ngn hng pht hnh L/C v ngi m L/C u khng chp nhn loi vn n ny.- Nu trong ngi nhn hng trng th theo tp qun quc t c hiu l giao hng theo lnh ca ng gi hng.- Nu mun giao hng cho 1 ngi bt k (vn n v danh) th trong ny phi ghi to the Holder hoc to the Bearer.4. Nu ny trng th phi hiu l thong bo cho ngi nhn hng.5. S bn vn n gc pht hnh:Vn n ng bin pht hnh theo yu cu ca ngi gi hng, thng c pht hnh thnh b gm 3 bn gc v 1 s bn sao. V vn n l chng t s hu hng ha c lu thong v ngi chuyn ch s giao hng cho ai xut trnh vn n gc hp php u tin ti cng ch, do ngi ta cn phi bit c s bn gc vn n c pht hnh l bao nhiu theo di v kim sot trong qu trnh lu thong. 8.2 Payment Period:Thi hn thanh ton: Within 20 days (calendar) after completed receiving valid payment documents, Party Awill pay all charges for transportation. The valid payment documents include: Payment Request. Freight comparison minutes Diminished comparison minutes VAT invoices issued by Party B. The minutes of petroleum receipt, petroleum delivery that relate to eachvoyage. If having additional papers, other freight payment documents according toinstructions above, Party A will have specific instructions to Party B eachdocument, the number ... etc.. Payment date: To be counted as the date on a debit note of the Party Asbank.- Trong vng 20 ngy (tnh theo lch) k t ngy nhn chng t thanh ton hp l, Bn A s thanh ton khon cc ph vn chuyn.- Cc chng t thanh ton hp l bao gm: Giy ngh thanh ton. Bin bn i chiu cc vn chuyn. Bin bn i chiu hao ht. Ha n GTGT do Bn B pht hnh. Bin bn nhn xng du, giao xng du lin quan n tng chuyn vn chuyn. Nu c b sung thm cc loi giy t, h s thanh ton cc khc theo hng dn nh trn th Bn A s c hng dn c th cho Bn B tng loi chng t, s lng Ngy thanh ton: c tnh l ngy ghi trn giy bo n ca ngn hng Bn A.

8.3 Form of Payment: Party A shall transfer to the account appointed by Party B withVietnam dongHnh thc thanh ton: Bn A s thanh ton chuyn khon cho Bn B vo ti khon ch nh ca Bn B bng tin ng Vit Nam.9. Demurrage:Cc pht lu tu:VND 60,000,000 per day or pro-rataParty A has to pay a demurrage for the time over the specified laytime with the demurrage above.60,000,000 VND/ngy theo t l tng ng.Bn A phi tr tin pht cho thi gian vt qu thi gian lm hng qui nh .10.
