MORTON COUNTY COMMISSION REGULAR MEETING September 10, 2020 The Morton County Commission Regular Meeting was called to order on September 10, 2020 at 5:30 PM by Chairman Schulz at the Morton County Courthouse, 210 Second Avenue NW, Mandan, North Dakota. Others present were Commissioners Zachmeier, Leingang and Buckley, Auditor Rhone and States Attorney Koppy. Commissioner Strinden was present virtually. Leingang moved and Buckley seconded to approve the agenda. All voting aye, motion carried. Buckley moved and Leingang seconded to approve the minutes of the August 13, 2020 regular meeting. All voting aye, motion carried. Zachmeier moved and Leingang seconded to approve August bills and payroll. All voting aye, motion carried. Buckley moved and Leingang seconded to approve September bills and payroll. All voting aye, motion carried. Buckley moved and Leingang seconded to approve the allocation of Morton County Development Funds in the amount of $25,000 to assist in connecting the Morton County Fairgrounds to the City of New Salem sewer system. All voting aye, motion carried. Zachmeier moved and Buckley seconded to deny the application for classification of
inundated land due to the request not in full compliance with NDCC 57-02-27.2(6). All
voting aye, motion carried.
Leingang moved and Buckley seconded to approve abatements #5354-5355. All voting
aye, motion carried.
Buckley moved and Leingang seconded to approve abatement #5356. All voting aye,
motion carried.
Leingang moved and Buckley seconded to approve abatements #5357-5358. All voting
aye, motion carried.
Leingang moved and Strinden seconded to approve abatements #5359-5380. All voting
aye, motion carried.
Leingang moved and Buckley seconded to approve abatements #5381-5383. All voting
aye, motion carried.
Leingang moved and Strinden seconded to approve abatements #5384-5581. All voting

Chairman Schulz recused himself for the next agenda item and turned the chair over to
Vice-Chair Zachmeier.
Leingang moved and Strinden seconded to approve the MOA between the State of North
Dakota, acting by and through the Department of Emergency Services’ Division of State
Radio, and the County of Morton, for 911 dispatching services provided by State Radio.
Voting aye: Leingang, Strinden, Buckley and Zachmeier, motion carried.
Vice-Chair Zachmeier turned the chair back over to Chairman Schulz.
Buckley moved and Strinden seconded to approve the resolution to promulgate Morton
County’s Local Emergency Operations Plan dated August 26, 2020. All voting aye, motion
carried.
Leingang moved and Strinden seconded to approve the purchase of the used Izuzu truck by
the Weed Department for $21,000. All voting aye, motion carried.
Buckley moved and Leingang seconded to approve the final plat of the short-form
subdivision known Dallas Subdivision and a zoning map amendment from Agricultural (A)
District to Residential (R) District, as the subdivision conforms to the regulations
established in Article 7 of the Morton County Land Use Code and as the subdivision is not in
violation of policy 1.1.2 of the 2045 Comprehensive Plan. All voting aye, motion carried.
Leingang moved and Zachmeier seconded to approve the final plat of the short-form
subdivision known as Simonson Subdivision, and a zoning map amendment from
Agricultural (A) District to Residential (R) District, as the subdivision conforms to the
regulations established in Article 7 of the Morton County Land Use Code and as the
subdivision is not in violation of policy 1.1.2 of the 2045 Comprehensive Plan. All voting
aye, motion carried.
Buckley moved and Leingang seconded to approve the revisions to the Planning & Zoning
Bylaws. Voting aye: Buckley, Leingang, Strinden, Schulz; voting nay: Zachmeier. Motion
carried.
Zachmeier moved and Leingang seconded to deny the request of the Burleigh-Morton
COVID Task Force for a mandatory mask mandate at this time as a State of Emergency to
require a mandatory mask mandate for Morton County has not been proven, there is no
apparent public support for a mask mandate, no plan for enforcement was presented, and a
mandatory mask mandate should be proposed or ordered by the North Dakota
Governor. All voting aye, motion carried.
Buckley moved and Strinden seconded to appoint Melanie Gaebe to the Morton-Mandan
Library board with the term expiring on 6/30/2022. All voting aye, motion carried.
The total of all county funds expended from August 14, 2020 through September 10, 2020
equals $1,882,268.36.
A detailed list of funds expended by check is available for public inspection anytime during regular business hours at the Morton County Auditor’s Office. September 3, 2020 Morton County Attn: Dawn Rhone 210 Second Avenue NW Mandan, ND 58554 Greetings Dawn, The Mandan Progress Organization (MPO) was recently awarded a Partners in Planning Vibrancy Grant from the North Dakota Department of Commerce. The grant is a $1500 match that the MPO intends to use for the buildout of a visitors’ area within our office. We are accustomed to passersby stopping here to ascertain area information that includes recreation, shopping, dining and residential opportunities while they’re in town. The MPO would like to create a space that reflects the history of our community, offers comfortable seating and showcases information about the area. I am asking for Morton County to contribute $375 toward our $1500 match. We are simultaneously seeking the same amount from other institutions that benefit from local tourism including the City of Mandan and the Bismarck‐Mandan CVB. MORTON COUNTY, NORTH DAKOTA
RESOLUTION AUTHORIZING
SALES TAX REVENUE REFUNDING BONDS
(Joint Detention Center Project)
WHEREAS, Morton County, North Dakota (the “County”) and Burleigh County, North
Dakota (“Burleigh County”), entered into a Joint Powers Agreement on April 1, 2015 for the
purpose of setting forth the financing plan for a joint detention center; and
WHEREAS, Burleigh County previously issued $60,000,000 Multi-County Sales Tax
Revenue Bonds, Series 2015A (the "Series 2015A Bonds") and $30,000,000 Multi-County Sales
Tax Revenue Bonds, Series 2015B to finance the joint detention center, of which $48,515,000
Series 2015A Bonds will be outstanding on November 1, 2020 (the Series 2015B Bonds have
been paid); and
WHEREAS, it is in the best interest of the County to approve Burleigh County’s issuance
of Multi-County Sales Tax Revenue Refunding Bonds, Taxable Series 2020 (the “Bonds”) for
the purpose of advance refunding the Series 2015A Bonds in order to reduce the total interest
expense and shorten the final maturity date.
NOW, THEREFORE, be it resolved by the governing body of the County as follows:
Section 1. Authorization Bonds. Pursuant to the Joint Powers Agreement, the County
approves the issuance by Burleigh County of the Bonds. The Chairman and County Auditor are
authorized and directed to execute such documents as may be necessary in connection with the
issuance of the Bonds.
Section 2. Pledge of Sales Tax. The pledge of ninety percent (90%) of the County’s one
half of one percent (0.50%) sales and use tax to the Bonds is authorized, confirmed and ratified.

STATEMENT/PURPOSE:
On January 18, 2018, Governor Doug Burgum, the North Dakota Department of Transportation, North
Dakota Highway Patrol and the North Dakota Department of Health proudly unveiled a new traffic safety
strategy: Vision Zero. Zero fatalities. Zero excuses.
The Vision Zero strategy aims to establish a culture of personal and community responsibility where motor
vehicle fatalities and serious injuries are recognized as preventable and not tolerated. The mission is to
eliminate fatalities and serious injuries caused by motor vehicle crashes.
Personal Responsibility: Every driver and vehicle occupant in North Dakota can help meet the Vision Zero
goal by taking personal responsibility when traveling on the road. This means wearing a seat belt at all times,
transporting children in child passenger safety seats appropriate for the child’s age, weight and height, driving
distraction-free, driving sober (i.e. not under the influence of alcohol and/or drugs), and obeying all posted
speed limits.
Community Responsibility: Allowing communities to partner, alongside the state, to educate our own
communities through preventive outreach initiatives.
In an effort to meet our community responsibilities, we are requesting to partner with the North Dakota
Association of Counties and the North Dakota, Department of Transportation to house a grant-funded
employee who will serve the southwest portion of North Dakota.

This is a grant funded position through NDDOT. The position will be formerly managed by NDACO, Ryan
Gellner. However, we will provide local onsite supervisory support and will house the employee as a Morton
County Employee.
STAFF IMPACT:
Our Public Information Officer has agreed to be the onsite supervisory support for this position. This position
has a heavy outreach requirement which will pair well with our PIO strengths.
LEGAL REVIEW:
This has been forwarded to the SAO as information only.
RECOMMENDATION:
It is my recommendation to allow Morton County the opportunity to help lead this effort within the SW
Region of ND.
