I. EXECUTIVE SUMMARY

EXECUTIVE SUMMARY
The Banks project emerged out of the ground during the month of December 2008! Contractors installed the first Freedom Way East columns which will support the intermediate garage slab, and the roadway above. The Freedom Way roadway construction is an important Phase 1 project milestone due to associated Ohio Department of Transportation (ODOT), Federal Highway Administration (FHWA), Economic Development Administration, and Ohio Department of Economic Development funding. Additional Phase 1 site work still continues on underground construction including:
• Installation of over 1,100 auger cast piles to date (out of almost 1,600 total) in Lot 26, Freedom Way East, and Freedom Way West. This collective progress has been realized over the past two months and is included in Bid Packages 2, 3 and 4. Lots 16 and 20 will add approximately 1,000 additional auger cast piles to the count for a Phase 1 total of over 2,500 providing the foundation for the parking garage, street grid and the private development above.
• Installation of 35 pile caps to date in Freedom Way East. This activity commenced during December and is included in Bid Package 4.
• Continued installation of underground storm and sanitary utilities associated with Bid Package 4.
• Coordination with the installation of Duke Energy’s chilled water line.
The December 2008 above-ground work also included the delivery and installation of The Bank’s 156’ tall tower crane. This highly visible tool will provide welcome logistical efficiency for the Block 26 horizontal and vertical construction activities including garage and street grid steel and concrete placement. The tower crane’s usage will continue into The Bank’s Phase 1A and Phase 1B overbuild. Phase 1A is to include apartments and retail, and Phase 1B is expected to include Class “A” office and additional mixed-use space.
A tower crane Media Alert was distributed in advance by Northlich, and three local television news crews arrived on December 16th to hear the good news about The Banks safety record, inclusion performance to date, and the upcoming January 6th bid date for Bid Package 5.
Through the end of December, the following summary of progress is reported:
• Safety: Over 240 workers have completed the Construction Manager’s jobsite safety orientation program, and have worked over 11,850 hours on site without a lost time accident.
• Inclusion: Through the first four bid packages, the public project work (streets, garages and utilities) is tracking at 34.8% Small Business Enterprise (SBE) participation to date (4.8% over the 30% SBE goal).
• Schedule: Phase 1 of the parking garage project schedule is on target for a spring 2010 completion. Private development (above the garage) is expected to begin by May of 2009. The underbuild and overbuild management teams conducted schedule integration efforts to identify ways to streamline the integration of the overall Banks schedule in a cost-effective manner.
• Budget: While the final project budget for streets and garages is in the final stages of development, the first four bid packages have come in $1.6 million under the Construction Manager’s Published Estimates. Elements of the public infrastructure cost estimates are tracking between 2% to 4% over the initial schematic design estimates from August 2007. Building on the successful November Value Analysis efforts, the design, construction management and program management consultants worked closely with Hamilton County and City of Cincinnati personnel in December to work through open issues associated with the draft project budget, which is on track to present to the Joint Banks Steering Committee, Hamilton County, and City of Cincinnati officials in January.

PROJECT SUMMARY
The Central Riverfront Parking Garage, and the Freedom Way structural bridge deck, utility infrastructure and traffic control (i.e., the “Project”) is the design and construction of multiple structured public parking garage facilities and related public infrastructure improvements including, but not limited to, site development, streets and sidewalks, public utility distribution, structural elements, mechanical, electrical and plumbing systems, interior and exterior building and parking systems and fixtures, fire and security systems, interior and exterior pedestrian and vehicular traffic control and access systems, landscaping and related improvements. It is anticipated that the Project will be planned, designed and constructed in multiple phases or parts over a period of several years. This Project is planned, designed and constructed through the efforts of Hamilton County, the City of Cincinnati, and the Development Manager, Carter Dawson. Hamilton County has retained THP Limited, Inc. for Central Riverfront Parking Garage design services. The City of Cincinnati has retained Burgess & Niple for Freedom Way structural bridge deck, utility infrastructure and traffic control design services. In addition, Hamilton County has retained Messer Construction for construction management services.
Phase 1 of the Project includes the Central Riverfront Parking Garage between Second Street (to the North), Mehring Way (to the South), Walnut Street (to the West) and Main Street (to the East).

Phase 1 of the Project also includes Freedom Way West (between Elm Street and Vine Street) and Freedom Way East (between Walnut Street and Main Street).

PHASE DESIGN SCHEDULE UPDATE
The architectural and engineering services are reflected in the phase design schedule. The following garage design activities were performed in December 2008, as identified by THP Limited, Inc:
1. Ongoing participation in Value Analysis, including evaluation of alternate light fixtures. 2. Underground Sewers:
a. Issued Bulletin No. 3: Revised/updated underground sewer information to match changes requested by Metropolitan Sewer District (MSD). Drawings submitted to City of Cincinnati Building Department as an engineering change.
b. Submitted final drawings to MSD for private and public sanitary and storm mains. c. Received approval from MSD for construction of sanitary and storm mains.
3. Bid Package No. 5 – Lot 26 Structure: a. Received approval to advertise from ODOT/FHWA. b. Provided support during the bid period by attending the pre-bid meeting and responding to bidder’s
questions. c. Submitted Bid Package No. 5 documents for permit.
4. Continued development of Construction Documents for Bid Package No. 6 and No. 8. 5. Continued to provide Construction Administration for Bid Package No. 2 through No. 4; submittal
review, responses to Request For Information (RFI), and attendance at construction meetings and site visits.
6. Issued Bulletin No. 4: Infill of door opening in transit center wall, modified elevator no. 1 and no. 5 configurations and updated inverts at manhole no. 2 to match MSD approval drawings, dated December 16, 2008.
7. Received 50% Design Documents of Lot 20 Park Development., dated December 11, 2008.
Anticipated action for January 2009:
1. Assist the Construction Manager and County with the evaluation of Bid Package No. 5 bids. 2. Continue detailed coordination with the Parks Lot 20 design team. 3. Continue development of Bid Package No. 6 and No. 8 bid documents. 4. Work with Hamilton County and Messer Construction Company (Construction Manager/CM) on
revising Bid Package No. 6 scope. 5. Continue Construction Administration for Bid Package No. 2 through No. 4. 6. Issue Bid Package No. 6 Pricing and Review Set.

The following reflects garage design activities in December 2008 as identified by Burgess & Niple:
1. Addressed questions regarding the Final Plans, Specifications & Estimate (PS&E) for Bid Package No. 7.
2. Landscape concept drawings were submitted to the City of Cincinnati for approval. 3. Telephone/cable and gas coordination drawings were distributed for review and confirmation. Anticipated action for January 2009:
1. Receive comments and finalize telephone/cable drawing development. 2. Receive comments and finalize gas coordination. 3. Coordinated headhouse design with Freedom Way Design. 4. Review Scope of Services with the City of Cincinnati 5. Mehring Way utility coordination the City of Cincinnati. 6. Expansion joint coordination with all utilities. 7. Approval for landscaping concept drawings. 8. PS&E approval for Bid Package No. 7.
PHASE CONSTRUCTION SCHEDULE UPDATE The following reflects garage design activities in December 2008 as identified by Messer Construction Company:
• Bid Package No. 1 – Site Demolition: TC-01 is completed on schedule. TC-02 is 95% complete
with their scope.
• Bid Package No. 2 – Auger Cast Piles under Freedom Way, Main St. to Walnut St.: Trade Contractor has completed all of the pile production work associated with BP No. 2.
• Bid Package No. 3 – TC-07, Block 26 auger cast piles are 65% complete.
• Bid Package No. 4 – TC-10, Freedom Way East auger cast pile work was completed on 12/31/08. Currently, work is focused around the Freedom Way West Roadways and is progressing on schedule with 75% of the work in this area complete. TC-09, pile caps and columns installation in the same areas is in progress.
• Bid Package No. 5 – Freedom Way East & West Streetgrid (ODOT): ODOT approved BP No. 05, with advertising for the bid package scheduled to commence on December 11, 2008. The bid opening is scheduled for January 6, 2009. A Building Permit application was submitted to the Building Department. This is the first of three ODOT packages.
• Bid Package No. 6 – Block 16 & 20 Concrete Structure, Slab-on-Grade: Currently not awarded.
• Bid Package No. 7 – Freedom Way East & West Streetgrid (ODOT): Submitted to ODOT for approval.

Overall Construction and Bid Packaging Schedule August 13, 2008 Project Schedule remains basis of construction. The Construction and Bid Packaging schedule indicates that the private overbuild can begin in May, 2009. On December 9, 2008, Messer submitted the “Bid Package 5 Bid Schedule” update to the August 13, 2008 Baseline schedule. Initial review of the “Bid Package 5 Bid Schedule” update indicates that the garage finish date will shift 15 working days from the baseline schedule. The original finish date is currently tracking for March 9, 2010. The “Bid Package 5 Bid Schedule” update schedule indicates the finish date is now March 31, 2010. This 15 working day shift is due to design review durations, and is not tied to the IDMA critical path. IDMA critical path activities will continue to be monitored closely to deliver the facility in an efficient and expeditious manner.

BUDGET
The IDMA Project Team is closing in on a draft project budget, which is expected to be presented to the Joint Banks Steering Committee, County Commissioners, and City Council in January. This draft project budget builds upon the Construction Manager’s Design Development pricing information, issued in late October, 2008 for garage and street grid hard costs. Bid Packages issued to date, and resulting contracts, have greatly assisted the IDMA Team in understanding how the state of the economy has adjusted prior costs carried for the Design Development. The trends associated with this competitively-bid pricing, as shown in the figure below, have netted the IDMA with a $1,679,890 savings over the CM Published Estimate through Bid Packages 1 through 4. This bid award savings, coupled with over $2,000,000 savings attributed to the extensive Value Analysis effort performed by the IDMA Team in October and November 2008, have been effective counter actions to increases to the overall Phase 1 project since the original August 2007 Conceptual Estimate was presented as part of the Banks Sources and Uses baseline document. The IDMA Team is diligently coordinating all elements of the Phase 1 work scope, and their corresponding hard cost estimates including the following: • Lot 26 Garage, including Freedom Way East substructure (Main Street to Walnut Street) • Lot 16 Garage • Lot 20 Garage • Garage headhouse • Freedom Way West substructure (Race Street to Elm Street) • Freedom Way West substructure (Rosa Parks to Race Street) • Freedom Way (Main Street to Walnut Street) • Freedom Way (Race Street to Elm Street, including Phase 2 sidewalks) • Freedom Way (Rosa Parks to Race Street, including Phase 2 sidewalks) • Freedom Way (Walnut Street to Vine Street realignment) • Phase 1 utilities, including the riverfront utilities which will be located in the new Mehring Way
alignment (in preparation of the removal of Theodore M. Berry Way between Rosa Parks and Race Street)

In parallel to the IDMA Team’s efforts to identify and cost estimate all Phase 1 elements of hard cost scope, the IDMA Team is also finalizing the soft costs associated with project permits required, the County and City staffing projections, the Construction Manager’s agreement, and the Architect’s agreement.

V. INCLUSION

INCLUSION
The efforts of the Inclusion Team are netting positive results for The Banks Project. Ellington Management Services (EMS) continues to share information with the public about the project both through outreach and one-on-one communications.
Overall participation for SBEs currently remains at 34.8%. ODOT has set DBE participation goals for Bid Package No.5 and 7 at 8%. The goals for Bid Package No. 6 and Bid Package No. 8 will be established at a later date.
SBE/DBE IDENTIFICATION AND RECRUITMENT
The EMS Project Team continues to make phone calls and schedule one-on-one meetings with companies that may or may not be certified by the City of Cincinnati and/or the Ohio Department of Transportation. Meetings are held to encourage participation and to create opportunities for joint venture partnerships. EMS is also searching various databases to identify additional companies, both locally and outside of Hamilton County.

No outreach sessions were held in December. However, EMS is continuing to provide periodic updates to community stakeholder organizations. EMS currently provides updates to the NAACP, African American Chamber of Commerce, and the Urban League.
SBE MEETINGS
In order to encourage greater participation in the Banks Project by potential SBEs, EMS created a list of companies to make personal contact with that are not currently certified by the City of Cincinnati. EMS discussed with them their interest and capability to participate on the Banks Project. For those firms that are not certified, EMS asked them to apply for certification. EMS has met with the following firms:
1. ABEL Building Systems and Ohio Valley Electrical Services – ABEL Building Systems is
a minority-owned firm that is currently certified as a SBE with the City of Cincinnati. Ohio Valley Electrical Services is a majority-owned firm. These two companies are interested in creating a partnership, but wanted the advice of EMS as to what type of partnership structure would be acceptable for SBE certification. EMS provided them with several options to consider. They will present those options to their attorneys and schedule a follow-up meeting with EMS.
2. B. Parks Electric and IPS – B. Parks Electric is a minority-owned firm that is in the process of completing their application for SBE certification. IPS is a majority-owned firm that is interested in partnering with B. Parks Electric. EMS provided these firms with partnering options for their consideration. EMS will follow-up to ascertain their progress.
GOAL SETTING
ODOT has set the DBE participation goals for Bid Package No. 5 and 7 at 8%. The participation goals for Bid Package No. 6 and Bid Package No. 8 remain to be determined.

MONTHLY UTILIZATION REPORT
1. There has been no change in participation during this month. The project SBE participation for construction remains at 34.8% (Attachment A).
2. In relation to SBE participation for professional services, to date EMS has only received
monthly utilization reports from Messer Construction for their own activities. Messer’s participation commitment is 10%. Their commitment is consistent with the goal for professional services as stated in the Joint Policy. EMS has requested participation reports from other consultants on the project. EMS anticipates reporting those outcomes in the January 2009 report.
3. EMS has resolved the technical issues that prevented it from accessing the Construction Manager’s data system. EMS will now have full access to the information that will allow it to track all targeted businesses and workforce participation. That information will be included in January’s report.
CAPACITY BUILDING
To date EMS has not received any response to the letters that were sent out to SBEs currently under contract on the project. The letters offered SBEs capacity building assistance. EMS will make follow-up phone calls to determine if there is any interest in EMS providing them with capacity building services.
REPORTING AS REQUIRED BY THE JOINT POLICY
SBE utilization has remained steady due to the efforts and emphasis on outreach by the inclusion team since the inception of the Banks Project. Currently the utilization rate for SBEs on construction contracts is 34.8% (See attachment A). The project is currently exceeding the goal established by the joint policy.
For professional services, to date we have only received monthly utilization reports forms from construction manager Messer Construction for their own activities. Their participation commitment is 10%.

CITY OF CINCINNATI RIVERFRONT PARK PROJECT
• Cincinnati Riverfront Park (CRP) Phase IA – Walnut Street Fountains and Stairway (Lot 21) Auger Cast Piles contract executed and building permit issued. City has issued the Notice-to-Proceed and foundation piles will begin installation in January.
• US Army Corps. of Engineers authorized Sasaki to perform design and bid documents for CRP Phase IB – Walnut Event Lawn (Lot 20B Landscape Improvements). Design Development drawings were distributed and reviewed at a December 11, 2008, project meeting attended by Hamilton County, City of Cincinnati, THP, B&N, and C-D.
• As a result of the December 11, 2008, Design Development review meeting, a list of Sasaki/THP/B&N coordination issues has been compiled to be coordinated with the IDMA Team, including the design parameters of the Mehring Way wall, expansion joint coordination, and the garage entrance/exit layout.
• The City determined that C-D may apply for an access easement from City Parks to facilitate public access to the south side of the Block 16 Private Development on Lot 16B. A 14-ft-wide paved promenade is planned for this location, as approved by the Fire Department.
• The Park Board is represented at the bi-weekly OACM and Project Design meetings.
MEHRING WAY RELOCATION
• The project team previously secured Categorical Exclusion and letter of No Effect from the Kentucky Heritage Council for Mehring Way work. Mehring Way will be a separate Local Participating Agreement (LPA).
• The IDMA Team focused on riverfront utilities during the month of December. Communications, Electric, Gas and Water utilities are being coordinated with the Mehring Way design. These utilities will feed the riverfront following the future removal of Theodore M. Berry Way (prior to Phase 2).
• Mehring Way design drawing work continues.
• Mehring Way design coordination continues with the parking garage south wall and with the CRP interface.
UTILITY COORDINATION
Cincinnati Water Works • The City of Cincinnati has facilitated a number of meetings to resolve the provision for domestic
water for the project. Water Works has proposed, and the Developer has accepted, the concept of an “in the ground” option running in the southern sidewalk of the Transit Center. The public waterline will run vertically in the transit center north of the “property line” and penetrate the north wall of the parking facility into the ceiling plenum of the P1 level. The Developer of Block 26 will take the waterline from this valved location to the meter rooms. Block 16 will be serviced from existing in-ground water mains at Walnut and Main Streets. The development must be served by public fire hydrants, locations designated by the Cincinnati Fire Department. A meeting was held at the jobsite on December 2, 2008, to review the entire Banks Utility Masterplan with HNTB and Burgess & Niple. Carter Dawson, MCC and Hamilton County developed sketches to identify existing water lines, as well as, proposed waterlines.

On December 3, 2008, another meeting was held at City Hall with CWW. The water main serving Lot 26 will terminate at the location mentioned above. Lot 1 and Lot 2 of Banks future development have water provided by a similar CWW installation of a water main in the transit center coming from the west. Water mains will be installed along the realigned Mehring Way with lines connecting Mehring Way to Walnut and Vine Streets.
Electric Power • Coordination meetings continue between Duke Energy and representatives of the project team.
Conceptually, the overbuild development will locate its transformers and switch boxes internal to the project along the private service drive. The garage transformer will be located in a sidewalk vault at east side of Lot 17. Primary feeds through the public duct bank will be concrete encased, continuing up to the individual transformers. The proposal is proceeding to install a structure in the middle of the E-W direction of Freedom Way on the south side with conduit running west to existing manhole at Freedom Way and Walnut Street. Six 6-inch conduits will run north and south to serve Blocks 26 and 16. A room will be created in the P1 level of the parking facility to serve as “manhole” for structure identified in Freedom Way above.
Storm & Sanitary • The responsibility matrix indicates the Private Development would be responsible for the cost of
the sanitary and storm lines down to connect above the P2 Level slab on grade. Sanitary and storm from this clean-out connection just above 489 to the new and/or existing mains would be by the public parties. Maintenance of these distribution lines, under the slab, will be maintained by the Private Developer.
Data/Telecom • Burgess & Niple has shown a conduit duct bank in the right-of-way for these lines. The over-
build design teams have stated they do not need rooms in the parking facility. The overbuild design team has developed and distributed a drawing which shows the proposed tele/com rooms as identified on the schematic drawings for the Phase 1A and Phase 1B-Office development.
Gas • Natural gas shall be suspended under Freedom Way, per the agreement. A meeting was held at the
jobsite on Dec 2, 2008, to review the entire Banks Utility Masterplan with HNTB and Burgess & Niple. Carter Dawson, MCC and Hamilton County developed sketches to identify existing and proposed gas lines. On December 3, 2008, another meeting was held at City Hall with Duke Energy. The gas main serving Lot 26 will terminate at the meter room on the north side of the parking deck ramp at the P1 Level. The gas main for Block 16 will terminate in the designated meter rooms. Gas mains will be installed along the realigned Mehring Way with line connecting Mehring Way to Walnut and Vine Streets.

PERMITTING COORDINATION
Permitting Coordination meetings are scheduled for every other week on an as needed basis. Key Issues include:
• The City of Cincinnati facilitates bi-weekly Code Task Force meetings to continue to address various aspects of Building Code coordination related to the mixed-use occupancy nature of the Banks project, particularly in regards to how the public garage permitting and code issues need to be coordinated with the overbuild, and the overall permitting and code issues affect the below podium work.
• The code coordination meetings are also used as an opportunity to address the public utility
companies code issues related to providing utilities to the project.
• Building Permit Status:
- Bid Package No. 4 - Foundations, Underground Utilities, and Freedom Way: Building Permit has been issued, and the MSD qualification was removed.
- Bid Package No. 5 - Concrete Structure for Block 26 including the Podium: The documents were submitted on December 12, 2008, for building review.
• A meeting was held on December 3, 2008, to address the status of outstanding building permits,

In December, a 156-foot tower crane was erected on the project. This is major addition to the site as it will be utilized for construction activities in both Phase 1A and 1B. Auger cast pile work for Block 26 continues to progress, as well as auger cast pile work for Freedom Way West. The auger cast pile work for Freedom Way East has completed on schedule, and currently the installation of pile caps and columns is underway. The demolition of underground utilities continues at Theodore Berry Way, Walnut and Main Street intersections.
Bid Package No. 5 received approval from ODOT in December, and the bid process will commence, with bid opening anticipated to start early January. Additionally, documents for this bid package were submitted for the Building Department for permit; the permit is expected January. Approval to begin the bid process for Bid Package No. 07 is expected soon.

Temporary fencing is now installed in appropriate places where construction work is going on. Since the awarding of 9 Trade Contracts truck traffic to and from the site has increased. Keeping roadways and walks clean and safe is a high priority for the Construction Manger staff and Trade Contractors. Personnel (spotters) are still being used when Auger Cast Pile drilling rigs are close to any public walkway As construction progresses it will be necessary to place more temporary fencing and concrete barricades where construction work is taking place. This may for short periods of time require closing some walkways and parts of streets. The Site Safety Orientation Program continues to provide value to the workers as they come on boarded to work. To date 240 people have gone through the orientation sessions and a total of 11,854 hours have been worked without a lost time accident. Quality Management and Assurance Plan The QM/QA Plan activities have now expanded to incorporate the work associated with the installation of pile caps and columns. The QM/QA Plan includes material testing for concrete associated with pile caps and columns as well as the inspection of reinforcing steel associated with these items. Thelen Associates, Inc continues to provide the service for this work as well as the on going Geotechnical work associated with the work for Auger Cast Piles.

Safety and Site Logistics For Bid Packages #1 through #4 over 11,854 hours have been worked without a lost time accident and 240 people have gone through the jobsite safety orientation program. Special attention is being paid to public walkways at Freedom Way West, Main and Walnuts streets. When the demolition of underground utilities and drilling rigs get close to the guardrails in those areas personnel from the contractor are sent to the sidewalk areas to make sure public safety is maintained and walkways are kept clean. Temporary fencing has also been installed. Weekly site safety inspections evaluation scores continue to be around 90%. There is a very good attitude among the workers about safety. As part of the Construction Manager staff there is a full time onsite Safety Coordinator who performs the site inspections. The Safety Coordinator inspects all aspects of the construction operations and reports it findings back to the Construction Management staff and Trade Contractor. This information is also reviewed at the Contractor Field Coordination weekly meeting. With the implementation of the “Safety 4 Site” program all contractor personnel are required to wear safety glasses 100% of the time as well as 100% tie off if the worker is going to be off the ground greater than 6’. To help workers understand the importance of safety on The Banks Project each worker must attend a Safety Orientation meeting before they are allowed to work on site. The orientation covers OSHA 4 primary accident areas (Falls, Struck-By, Caught-In – Between and Electrical). Along with the OSHA 4 review accountability for non- compliance covered. Site emergency information as well as medical facilities are identified for the worker. At the completion of the session each worker receives a project sticker for their hard hat and a pocket size orientation manual containing all the data that was covered in the orientation session. Daily Huddle Meetings: To raise safety awareness each Trade Contractor would have a daily Huddle Meeting before starting work. QUALITY MANAGEMENT AND ASSURANCE PLAN The Quality Management and Assurance Plan activities have now expanded to incorporate the work associated with the installation of pile caps and columns. The QM/QA Plan includes material testing for concrete associated with pile caps and columns as well as the inspection of reinforcing steel associated with these items. Auger cast pile work continues to have a full time inspector on site. Inspections Reports are generated on a daily basis and distributed to the appropriate people via email Inspections Reports. The Quality Management And Assurance Plan continues to be used for the Bid Packages #1, #2, #3 and #4. Thelen continues to provide the service for this work as well as on going geotechnical work for Auger Cast Piles. All Non-Conforming Work gets addressed with the Trade Contractor in a timely manner. .
