Disaster Purchasing Unrestricted access to all Schedules Based on Presidential disaster declarationExpanded now to include disaster preparedness13Federal Acquisition ServiceCongress has issued a number of authorizations that enable state and local governments to use the GSA Schedules. In 2002, Congress authorized state and local use of Schedule 70, the IT Schedule, through the e-Government Act. In 2008, Congress also authorized state and local use of Schedule 84, the law enforcement, public safety and security Schedule. These two Schedules constitute GSAs Cooperative Purchasing Program and can be used by state and local governments at any time and with any source of funds.

Congress created a new Schedules program, the Disaster Recovery Purchasing Program, through Section 833 of the John Warner National Defense Authorization Act for Fiscal Year 2007. The legislation provides state and local governments with access to all GSA Schedules for the purposes of responding to a Presidentially-declared disaster or act of terrorism. Advance purchasing is permitted in anticipation of anticipated disasters.

Federal Acquisition ServiceA broad section of state and local governments are authorized to use the GSA State and Local Programs under Cooperative Purchasing and Disaster Recovery Purchasing as shown on this slide.

Eligible Users include all 50 states, all counties, municipalities, cities, towns and townships, Tribal Governments, Public Authorities (Public or Indian Housing agencies under the U.S. Housing Act of 1937), school districts, and colleges or any instrumentality there of.

The term does not include contractors or grantees of state or local governments. Receiving grant monies does not make otherwise ineligible users eligible. An entity either falls under the above definition or they do not.

Other programs that I will mention have different eligibility lists.

If there is any confusion over whether or not your jurisdiction meets the criteria for an eligible user, you may submit a request for an eligibility determination letter to GSA.
