Executive Director Mr. John Ware reported on the following:

1. Federal HEA Update: On October 29 , the U.S. Department of Education (USDE)th

published final regulations addressing program integrity and student aid programs. Theregulations - that become effective on July 1, 2011 - provide rules and definitions coveringa wide range of issues affecting colleges and universities as well as accrediting organizations.I have given the Board a copy of the CHEA summary of the final regulations. The finalregulation addressing gainful employment issues was delayed for further review, however,it is anticipated that it will be released in the next few months.

2. Annual Report: On September 16 , we issued usernames and passwords to all schoolsth

to allow them to enter their date for the Fiscal Year 2010 Annual Report into the Board’snew online database. We currently have less than 20 schools that have yet to enter their dataand we hope to have all data entered within the next few weeks so we can have this year’sAnnual Report finalized by the end of the calendar year.

3. State Budget Update: On November 1 , we submitted the Board’s operating budgetst

request for the biennium that begins July 1, 2011. As a result of the significant legislativechanges that will be forthcoming after January 1 and the projected $8 billion shortfall in thest

next budget, this will certainly be another very difficult budget process. The new Governoris required to submit his proposed budget by March 15 and the legislature will work toth

finalize the budget by June 30 . th

3. Strayer University, Mayfield, OH Update. This new school was presented to the Board atthe May 26, 2010 Board Meeting (motion #10-253) pending receipt of approved consultantreport/site visit and completion of facilities compliance statement and receipt of inspectionreports. On November 3, 2010, Mr. Tracy Locklin, Associate General Counsel for StrayerUniversity, e-mailed stating they are not going forward with the Mayfield, OH campus. Thismotion (only the Mayfield location) needs to be rescinded by the Board.
