That the Council of the Corporation of the District of Surrey hereby declares that the abandoned foundation, located on Lot Two Hundred Ninety-Two (292) of Section Twenty-Five (251, Block Five (5) North, Range Two (2) West, Plan Sixty-Three Thousand Seven Hundred Fifty-Nine (637591, New Westminster District, being 14234 - lOlA Avenue, Surrey, B.C., is a nuisance and is hazardous to the community, It is hereby ordered that the said abandoned foundation be removed and the excavation filled in with clean granular material and that the property be regraded to its original state by the owners or agent of the owners within sixty (60) days of service of this order upon them. It is further ordered that, should the owners or agent of the owners fail to comply with the aforesaid order within the said period of sixty (60) days, the Permits & Licenses Department, by their own workmen or contractorsB may be instructed to enter on the land, fill in the abandoned foundation and regrade the site at the expense of the owner, and the charges for so doing, if unpaid by the owner on the 31st day of December of any year, shall be added part of the taxes payable in respect of that land as arrears e

the District of Surrey hereby declares that the dilapidated building located on Lot Five (51, Block Seven (7) of District Lot Six (D.L.61, Group Two (21 , Plan One Thousand Mine Hundred Fifty-Two (19521, New Westminster District, being 10798 Timberland Road, Surrey, B.C., is in so dilapidated and uncleanly a condition as to be offensive to the community, is hereby ordered that the said dilapidated building be demolished, foundation removed or filled in with clean granular material if necessary, and all debris removed from the site by the owners or agent of the owners within sixty (60) days of service of this order upon them. It is further ordered that, should the owners or agent of the owners fail to comply with the aforesaid order within the said period of sixty (60) days, the Permits & Licenses Department, by our own workmen or contractors, may be instructed to enter on the land and demolish the dilapidated building and remove the debris from the site at the expense of the owner, and the charges for so doing, if unpaid by the owner on the 31st day of December of any year, shall be added to and form part of the taxes payable in respect of that land as taxes in arrears.

E. MAYOR'S REPORT:

1. A memo had been received from the Acting Mayor regarding an invitation from Langley Council to attend a dinner meeting in Langley on June 12th or 13th.

After briefly discussing this matter, it was determined that June 12th or 13th was not an acceptable date.

The Municipal Clerk was requested to contact Langley and arrange an alternate meeting date.

The Municipal Manager submitted a report from the Deputy Planner - Current dealing with a Development Permit that had been prepared to allow the construction of a retail building at 102A Avenue and 152A Street.

The report indicated that the Development Permit supplemented the Zoning By-law by attaching building design, siting and landscape plans.

The Municipal Manager was recommending that Development Permit No. 6784-066 be approved.

It was then Moved by Alderman Easton Seconded by Alderman Campbell That Council approve Development

Permit No. 6784-066, that the Mayor and Clerk be authorized to sign the Development Permit, and that Council authorize the transfer of the permit to the heirs, adminigtrators, executors, successors and assigns of the title of the land within the terms

Royal Canadian Air Cadets - Use of Municipal

The Municipal Manager submitted a letter from Major B.J. Whitehead - Commanding Officer of the 746 Cloverdale Squadron requesting the use of the Municipal Hall parking lot on Mondays, May 7, 14, 21, and 28, and June 4 from approximately 1900 hours

, , to 2030 hours. The letter indicated that the parking lot would be used for the Squadron's annual inspection and preparation.

The Municipal Manager was recommending that approval be given for the Royal Canadian Air Cadets to use the Municipal Hall parking lot on the dates outlined in Mr, B. Whitehead's letter.

The Municipal Manager noted that Council had previously approved the June 4th date.

Item No. 4369: Application for Strata Title - Guildford Garden Apartments - 14918/96 - 108 Avenue (14918/96-10800)

The Municipal Manager submitted a report from the Chief Inspector dealing with an application for a strata title of the Guildford Garden Apartments at 14918/96 - 108 Avenue. The report indicated that Council recently rejected an application to strata title these apartments as they were substantially run down and do not meet the current Building Code requirements in many respects. The report added that the amount of money required to repair these apartments and bring them up to current Code requirements will be substantial, and the owners wish to know whether or not Council would consider their application for strata title if they went ahead with this work.

Item No. 4370: Development of a Tot Lot in the Panorama Park Subdivision (8379-001)

The Municipal Manager submitted a report from the Parks and Recreation Administrator dealing with a petition for the development of a tot lot in the Panorama Park Subdivision,

The report indicated that a school and adjoining park are planned immediately west of the development in question. Some of the property is already in Municipal ownership, and some of it is presently under negotiation. The report added that most elementary school sites are designed and developed to serve as a neighbourhood play space complete with playing fields and play apparatus, and it therefore is not appropriate to create another play structure on Lot 380,

The Parks and Recreation Administrator was recommending that Lot 380 not be developed as a play space, but rather a walkway with appropriate landscaping, and that the neighbourhood play space for this subdivision be developed on the school-park site immediately west of the area,

The Municipal Manager was recommending that the development of the open space as a walkway be referred to the 1985 Parks and Recreation Budget for consideration, and that a copy of this report be forwarded to the petitioners,

Item No. 4372: Opening of 124 Street Adjacent to Strawberry Hill Elementary School (2152-12400)

The Municipal Manager submitted a report from the Assistant Municipal Engineer -.Design dealing with the completion of 124 Street at 76 Avenue.

The report noted that this matter was discussed with the Planning Department and it was agreed that 124 Street was the most suitable route for a through road. The report added that the proposed completion of 124 Street as an 11 metre through road will be constructed by and at the expense of the developer of Project 7881-133.

The report concluded that there was no continuous north-south route connecting 72 Avenue to 80 Avenuep between Scott Road and 128 Street.

The Nunicipal Manager was recommending that the information be received, that 124 Street be completed adjacent to the new Strawberry Hill Elementary School, and that a copy of the report be forwarded to the petitioners.

Item No. 4373: Restrictive Covenant for Detention for a Mobile Home Development - 14 Avenue and 164 Street (7882-342) The Municipal Manager submitted a report from the Municipal Engineer dealing with a restrictive covenant that would ensure the maintenance, unrestricted and continued use of detention facilities for benefiting lands. The restrictive covenant documents also provide for the maintenance of the facilities by the benefiting property owners. In the event of failure to maintain, the document also provides for the Municipality to carry out the work at the expense of the owner.

The report concluded that the detention facilities will be constructed on site, and will be incorporated into the building permit design.

The Municipal Manager was recommending that the restrictive covenant be approved, and that the Mayor and Clerk be authorized to sign the document.

The report indicated that the applicant was now requesting the cancellation of the Development Permit, and the return of the $7,500 Letter of Credit deposited to guarantee the landscape works. The report added that the applicant indicated that they were not aware of the $52,000 in Development Cost Charges required for this development, and they could not afford this additional expense.

The Municipal Manager submitted a report from the Deputy Planner - Current dealing with a Development Permit that had been prepared to allow the conversion of an existing shed to a barn at 18451 - 76 Avenue The report indicated that on March 5, 1984, Council approved in principle a location farther to the rear of-the existing shed, howevera this report and recommendation to Council was based on erroneous information about the shed’s actual location,

The report noted that the verified location of the shed was within 5 metres of the recommended and approved location.

The Municipal Manager then submitted two maps dealing with the location of the shed. The Municipal Manager indicated that the first map indicated the existing and proposed location as well as the recommended location, Map No. 2 dealt with a revised

- - * sketch showing the actual location of the existing shed in relationship to the originally recommended location of the proposed barn.

The Municipal Manager pointed out that there was a great deal of confusion concerning the location of this barn.

The Municipal Manager was recommending that the Development Permit not be approved.

Alderman Watkins indicated that the Province is not spending enough money on science related education, and consideration should be given to developing our human resourcese

Alderman Schrenk indicated that she would be providing additional information at a later date.

2. Alderman Easton questioned whether or not the Provincial Government has awarded the 86 Games.

Alderman Easton noted that the Munieipality had not received official communication on this, but the rumour is that the Games have been awarded to Cranbrook.

Alderman Easton requested that the Administration check into this matter.

3. Alderman Campbell made brief reference to the resolution passed at the last Regular Council meeting whereby the Municipality would be making submission to the new Electoral Commission that had been established by the Provincial Government.

The Municipal Clerk was requested to get a copy of the appropriate legislation, the guidelines to be followed by the Commission, and the previous brief that was submitted to the Warren Commission.

4 , Alderman Bose made reference to Engineering works that were being carried out on 156 street, north of Highway 10,

Alderman Bose indicated that the residents had not been advised of this work, and some serious problems arose. Alderman Bose stated that he thought that the Project Management was required to contact the residents so that they were aware of the intended works.

5. In connection with the GVRD minutes, Alderman Higginbotham made reference to the proposed Tynehead Regional Park Recreational Vehicle camp site.

Alderman Higginbotham indicated that the Expo 86 Committee is trying to have some temporary and permanent recreational vehicle sites developed prior to 1986.

the village of Port Mann is known to have been one of the earliest settlement areas in the Municipality of Surrey, and

the present community of Port Mann possesses distinct cultural and historic value to all the peoples of Surrey, and

the historical record is sufficient to enable certain lands, buildings and structures within the village known as Port Mann to be identified as historically significant, and

the Municipality (Surrey) has the authority to designate by by-law all or part of certain landsp buildings or structures pursuant to the provisions of the Heritage Conservation Act of the Province of British Columbia and the provision of the Municipal Act, and

under Section 12 of the Heritage Conservation Act, "No person shall

(a) demolish a building or structure (b) alter the facade or exterior of a building

(c) build on land designated under this part or structure, or

without the prior approval, by resolution of the Council", and

certain other provisions of the Heritage Conservation Act of the Province of British Columbia make for provision of the security of sites of historic significance from the time notice is given of the intent of the Municipality to so designate certain lands, buildings and st ruc tur es

THEREFORE be it resolved that certain lands, buildings and structures within the village of Port Mann, to be identified from an examination of the historical record, be designated by by-law as an historic site.

In speaking to the Motion, Alderman Bose indicated that the Municipality has unfettered authority to make Heritage designations, and a legal opinion would have to be obtained as to whether or not this legislation would take precedence over the Federal legislation the CN was using.

Alderman Schrenk noted that the CM has made offers to the residents and the Heritage Committee previously reviewed this area, and there were no significant heritage sites or buildings within this section of Port Mann.

Alderrrian Schrenk added that the application for a truck stop at 8 Avenue and 176 Street had been turned down by the Agricultural Land Commission. Alderman Schrenk indicated that the applicants would now have to appeal to Cabinet if they wished their application to proceed.

What are the projected ridership figures?

What proportion of the operating costs will be paid by the fares from riders?
