Duncanville City Councilman Mark Cooks Was Arrested for Assaulting His Wife The Dallas Observer, Amy Silverstein Wed., Dec. 11 2013 at 11:59 AM Categories: Crime

A Duncanville City Councilman was arrested by the city's police department after his wife accused him of stealing her cell phone and assaulting her, court records show.

Mark Cooks was elected to the Duncanville City Council in 2012. More recently, in June, the Duncanville City Council in June selected him to serve as the city's 2014 Mayor Pro Tem.

His wife Cynthia Cooks suspected a few months ago that he was having an affair with a woman at their church, according to an arrest warrant. So, on September 8, 2013, Mrs. Cooks followed the other woman in her car after that week's service. The two pulled over in a parking lot.

The warrant doesn't have many details about what transpired between the two women, or where Mark Cooks was at the time, but soon enough he arrived on the scene.

Mrs. Cooks then got out of her car, cell phone in hand, and raised her phone "so that she could video Mark Donnell Cooks and the other woman together," the warrant says.

And this is where the criminal charges come in: The warrant says that Mr. Cooks then grabbed her cell phone out of her hand, while at the same time clutching her biceps "so hard it caused her physical pain." After he got the phone, he pushed her away, the warrant says.

Ms. Cooks got back in her car and drove to the Duncanville PD, asking for help to get her cell phone back. The officer tried to call the councilman on his own cell phone "to hear his side of the events," but police say the councilman didn't return the call.

The next day, the police department arrested and accused him of assault/family violence, a Class A Misdemeanor.

Cooks got out of jail shortly after on a $1,500 bond.

His wife has since asked for the charges to be dropped, though she doesn't explain why. "I want the prosecution of this case to be withdrawn, dismissed and terminated, and it is my desire that the District Attorney dismiss all charges against Mark Cooks," says the affidavit of non-prosecution that she signed on September 17.

Cooks' next hearing is scheduled for December 30. He didn't return calls, but his attorney, Lorenzo Brown, said he expects all of the charges against him to be dismissed and disputes the account of the alleged assault in the warrant. "I know that's not what happened," Brown said.

Mark Cooks currently is still serving on the council, his attorney said, adding, "Why do you think he wouldn't be?"

It's not the first time that a Duncanville City Councilman has been arrested. Last year, Duncanville City Councilman Scott Gannon made news after police accused him of "engaging in an act that constitutes indecent exposure." Gannon resigned not long after his arrest.

Interesting to find out the city council is upset with you & you with them.

It's also rumored that you are unwilling to testify as an expert witness.

Without you, they have nothing, and my guess is that they still owe you money. They are unwilling to pay because your report contains nothing worth paying for. Between the City staff and the Andersons, you did almost zero paperwork, read what they gave you and based your "findings" on that.

You want your money and I would like nothing more than to see this council get publicly called to the carpet for wasting our money, time and resources and conspiring to crucify the Andersons over a personal vendetta.

I'm after the truth, not you. Honestly, if you were able to dupe this council out of the cash you did, they deserve what they got.

Any email, voice mail or document dated and signed by the current regime would be greatly appreciated. There will be no sinking of ships.

You've spent time on the voice. You know I keep my word.

Exposing the truth is worth far more to me than what you have been paid.

Let's hope all this ends before it goes to trial and all of the ugly truth is exposed into public record... but I digress…

Duncanville $0 – Anderson $1,659,785 March 6, 2014 - News - no comments

DUNCANVILLE, TX – On February 4, 2014, the Duncanville City Council voted 4-3 to give developer Monte Anderson a total of $1,659,785 of new money, forgiveness of old debt, and tax benefits — an amount equivalent to 9 cents of the city property tax rate (currently 73 cents). Voting in favor were Councilmen Cliff Boyd, Mark Cooks, Patrick Harvey, and Stan Smith. Voting against were Mayor Deborah Hodge, Councilman Stephen Jones, and Councilwoman Johnette Jameson. Technically, the vote was to approve a proposal made by the Duncanville Economic Development Board. The only members of the Duncanville Economic Development Board are Councilmen Cliff Boyd, Mark Cooks, Patrick Harvey, and Stan Smith.

The settlement agreement terminates a lawsuit filed by the Economic Development Board in 2012 against Monte Anderson and his wife Rosa. In the 2012 lawsuit – filed before Cliff Boyd, Patrick Harvey, and Stan Smith were on the Economic Development Board – the City alleged numerous contract violations by Monte and Rosa Anderson involving developments at 111 East Davis Street and 212 North Main Street, and contract violations and fraud involving Anderson’s Main Station development.

Here is a breakdown of the payments to Anderson approved by the City Council on February 4, 2014:

1. For the 111 East Davis Street development: Cash payment of $100,000; $2,850 reimbursement for a building permit Anderson allowed to expire; and “forgiveness” of $100,000 owed to the City for non-performance of contract.

2. For the 212 North Main Street development: Cash payment of $100,000; $29,085.90 reimbursement for Anderson’s expenses; “forgiveness” of $100,000 owed to the City for non-performance of contract; and the replacement of the original contract – in which Anderson agreed to build a three-story building – with a new contract that obligates Anderson to build only a one- or two-story building.

3. For Anderson’s Main Station development, which is co-owned by the City: Anderson agrees to recover the shares in the Main Station development that he previously sold illegally; the City assigns current and future losses for the City’s portion of Main Station to Anderson so Anderson can get a tax write-off; payment of $245,588.28 of the City’s ownership interest in Main Station to Anderson’s company Options Real-Estate, payable over an unspecified number of years at an interest rate of 8.5% per year; and payment of a separate $125,617.10 of the City’s ownership interest in Main Station directly to Monte and Rosa Anderson, payable over an unspecified number of years at an interest rate of 8.5% per year.

4. Strangely, the City Council voted to give Monte Anderson money for the “Rail Road (sic) Flats” project (formerly known as the Center Street Condo Project) even though that development was not included in the 2012 lawsuit filed against Anderson. “Rail Road Flats” was supposed to be a 31-condo development but Anderson only built two townhomes, neither one of which was ever sold.

Here is a breakdown of the payments to Anderson for “Rail Road Flats”:

1. Cash payment of $219,644.19 to buy back the undeveloped land where the other 29 condos were supposed to have been built (land that the City had previously given to Anderson);

2. “forgiveness” of $287,000 debt that Anderson owes the City; 3. “forgiveness” of another $350,000 debt that Anderson owes the City; and 4. the City will give Anderson the two townhomes that he did build, free of any debt

obligation to the City.

Anderson has received many grants of taxpayer money from the Duncanville City Council in the past.

1. These include nearly $1,000,000 for his Main Station Development; 2. a $500,000 bond provided by the City to guarantee Main Station’s “Interim

Construction Loan” (a bond that was never paid back to the City); 3. $780,000 in land and cash for the “Rail Road Flats” development; the interest on

Anderson’s “Rail Road Flats” construction loan; 4. a $125,000 reimbursement for asbestos abatement at 102 North Main Street that only

cost $95,000; 5. $135,000 for improvements at Main Station (landscaping and awnings), and 6. at least $200,000 for the developments at 111 East Davis Street and 212 North Main

Street.

This settlement agreement settles all pending litigation against the Andersons. The city is still a partner in the Main Station project.

Legislature voted to require that certain projects create or retain primary jobs. A primary job is one at a company that exports a majority of its products or services to markets outside the local region, infusing new dollars into the local economy. Primary jobs are further limited to specific industry sectors such as agriculture, mining, manufacturing and scientific research and development. Those industry limitations can be found in Local Government Code, Chapter 501.

EDCs cannot simply gift sales tax proceeds to businesses. An EDC must enter into a written performance agreement with any business enterprise that it funds directly or makes expenditures that benefit an eligible project. At a minimum, the performance agreement must contain:

a schedule of additional payroll or jobs to be created or retained; the capital investment to be made by the business enterprise; and the terms for repayment of the EDC’s investment if the business fails to meet the performance requirements specified in the agreement.

Development corporations created by cities located within 25 miles of the Texas-Mexico border may fund airport facilities if the city h as a population of less than 50,000 or an average unemployment rate that is greater than the state average rate during the 12 months prior to the project’s approval. In addition to airports, Type A and Type B corporations located in Hidalgo County may fund ports and sewer or solid waste disposal facilities required or suitable for infrastructure necessary to promote or develop new or expanded business enterprises.
