MINUTE 19/2017 Moved: Cr Kneale Second: Cr McMahon That Council make a submission on the Department of Planning and Environment - exposure draft of the Environmental Planning & Assessment Amendment Bill 2017 to request that it be amended to achieve the following outcomes:
1. Councils are still given authority to determine the content of its Development Control Plan. 2. The Department should apply regular housekeeping type amendments to the standard instrument
LEP to reduce the amount of duplicated planning proposals between Councils. 3. The Department identifies a clear pathway to regularise unauthorised work which involves an
equivalent level of assessment as the correct approval pathway. A Building Certificate is not considered an appropriate vehicle for this assessment.
4. The proposal to extend private certification is not supported on the basis that higher impact developments require independent assessment by the local planning authority as well as increased public participation at DA stage.
5. No amendments that reduce the role of the Commission are supported. CARRIED

Moved: Cr Staines Second: Cr Booby That Council make a submission on the Department of Planning and Environment - Draft New England North West Regional Plan to request that it be amended to achieve the following outcomes:
1. Provide specific commentary on developing telecommunications specifically how the NBN will interact and enhance local economic opportunities.
2. Council to be kept informed of ten-year plans that will be developed for individual agricultural industries.
3. Council to be involved in the preparation of the strategy/guidelines for intensive agricultural and food processing developments.
4. Council to be involved in the preparation of the guidelines on the identification and management of Biophysical Strategic Agricultural Land.
5. The Department of Planning and Environment: a. complete a review of the current minimum lot sizes for rural zones in conjunction with
Council; b. develop model planning provisions adopting the principles of the Department of Primary
Industries Land Use Conflict Risk Assessment Guidelines (2011); c. develop in conjunction with the Department of Primary Industries Guidelines for Land Use
Conflict Management (including in use). 6. Provide more information on the threats and opportunities provided by the Melbourne-Brisbane
Inland Rail and investigate the use of inactive railway lines for freight transport including how the efficiency of freight transport through Narrabri, Moree Plains and Gwydir can be balanced with the needs of the local community to cross roads.
7. Address land access agreements which are required for exploration activity on land not owned by the exploration company.
8. Council to be involved in the preparation of the state wide criteria for land release for rural and regional areas.
9. Narrabri Shires smaller towns and village be included in transport connectivity initiatives. 10. To advocate greater ‘prime-time’ access to Kingsford Smith Airport for Regional NSW Centres.

14.6 AMENDMENTS TO SECTION 94 PLAN FOR NARRABRI SHIRE
RECOMMENDATION That Council request GLN planning to make the following amendments to the Narrabri Shire Section 94 Contributions Plan 2016 based on the submission received during public exhibition of the plan, and that Council pay any additional cost to the consultant of making this amendment: 1. Amend Figure 1 ‘Land subject to public car parking contributions’ on page 4 of the adopted Section 94 Plan dated November 2016 to include all of the land currently zoned B2 Local Centre by the Narrabri Local Environmental Plan 2012; and 2. Insert an exemption to the Public Car Parking contribution in Narrabri Town Centre in the following circumstances:
a) Premises have most recently been utilised for an authorised commercial or retail development. b) Parking provision is deficient in terms of the standards in the Code. c) Proposal is for another commercial or retail use that would not comply with the parking standards in the Code other than with a dispensation that does not exceed the number of parking spaces in subsection b).

14.7 SUBMISSION ON SOCIAL IMPACT ASSESSMENT DRAFT GUIDELINES
14.8 DOMESTIC ANIMAL POLICY
MINUTE 24/2017 Moved: Cr Booby Second: Cr Campbell That Council make a submission on the Department of Planning and Environment - draft guidelines for Social Impact Assessment for State significant mining, petroleum production and extractive industry development to request the document to be amended to achieve the following outcomes:
1. All new applications for, and applications to modify, State significant mining, petroleum production and extractive industry development require the submission of a Social Impact Assessment concurrently with the required Environmental Impact Statement.
2. All applications for State significant mining, petroleum production and extractive industry development require the review of their Social Impact Assessment annually as a condition of consent to be imposed by the consent authority.
3. That State significant mining, petroleum production and extractive industry developments be required to prepare management plans that address issues identified in their Social Impact Assessment and that the management plans form part of the approved plans referenced in the development consent.
4. That a stronger emphasis on the social impacts on landholders/residents in close proximity to the development site be included in the guidelines.
