Shows Takes the Reins of the HBA to Become Its

57th PresidentEditor’s Note: The below speech was giving by 2012 HBA President Luke Shows at the HBA Installation Banquet on December 15, 2011.

When David Peaden called me three years ago to ask me if I would be willing to serve on the Senior Board, which was a decision that would result in me eventually becoming the presi-dent of the HBA of West Florida, I told him I would agree to do it but he needed to understand that I was not certain I would still be in business when the time comes for me to become president. Well, I am proud to say that as of today I am still in business! The past few years have been tough on most of us but I hope and believe better times are just ahead. I want you to know that I consider it an honor to have the op-portunity to serve as your president and I look forward to working with you all over the next year. I would like to take a minute to acknowl-edge some individuals who have been critical to me being ready to serve in this role. First, I would like to show my wife Joelle a small token of my ap-preciation. (Flowers) Joelle and I have been married almost 21 years and she truly is my best friend. I didn’t realize when we got mar-ried that marriage is really the process of a wife training a husband. I am not sure when the training will be complete but don’t judge her with what you see as she didn’t have much to work with in the beginning! Joelle and I have three children; Emma, Caden and Isabel. They would have liked to be here today, just not enough to miss their school Christmas parties! I also want to acknowledge the for-mer presidents I have served under as a Senior Board Member over the past three years. They are Todd Stafford, Billy Moore and Russ Parris. Each of these men provided me an example of true professionalism and sound leadership that any organization should cherish. It has been a pleasure following their leadership. However, there have been many other members of the association and staff that have impacted me and the HBA in a very positive

manner and the list would be too long for the time allotted. These are folks like Rod Hur-ston, Chris & Steve Moorehead, Ron Tuttle, Gary Sluder, Steve Geci, Judy Gund and of course David Peaden to name a few. I have a feeling I am about to gain an even greater level of appreciation for David, Alecia and Amy and I look forward to working closely with them. I would also like to acknowledge those past presidents that are in attendance today. Thanks to each of you for your prior service and continued support. Today I want to speak to you about

certain things that are important to me. Maybe it is just because I am a simple man but when I am presented with a decision, opportunity or problem I try to look at it with the big picture in mind. I believe in a hierarchy of loyalty when it comes to making decisions and leading my life. My first loyalty is to God, second comes others (which includes my family) and lastly comes me. I am far from perfect but this is what I strive to achieve. When I make deci-sions I look to see if that decision will violate my loyalty to anyone in the hierarchy above me. If it does then it doesn’t deserve further consideration. Also, as your new president I want to share with you a little of what I have learned about leadership over the years. Leadership is so very important but yet so misunderstood in our society. Quality of leadership isn’t about the number of people you lead or a certain style of leadership. What it is defined by is our willingness to make decisions in the best interest of those we are serving. Sometimes

those decisions are popular but a true leader is willing to stand up and lead regardless. I have seen this true leadership over and over during my time serving with the HBA and it is my goal to continue that tradition. When I joined the HBA I had very little idea what all this association does for its members and our industry and community. The HBA, along with FHBA and NAHB fights the good fight every day to head off threats of unnecessary regulation at the local, state and national levels. Left unchecked some of our policy makers, and the special interests they

represent, would strangle our industry and then turnaround and blame us for our failing businesses. Regulations to some degree are needed but in my opinion we passed “needed” a long time ago. I want to encourage each of you to help us recruit members who can provide us with additional support to fight today, and help lead us tomor-row. In addition, our HBA has a long history of taking the lead on com-munity service projects ranging from renovating homes of families in need with our Remodelors Council to mak-ing sure the children of the Lakeview Center are not forgotten with the ef-forts of our Auxiliary Council. I know that we can once again step up to the plate and make a difference in our

community. In closing, I challenge you to put membership first and be a part of our member-ship effort next year. Who do you know right now who is benefiting from the all-important work that we’re doing and isn’t supporting our Association? Ask that person to join. Tell them that their future and our future depend on it. Everything we do at the Home Builders Association of West Florida depends on volunteers. We can’t our accomplish our tasks with a few people, but when we all come together with an ambitious and achievable set of goals, we can produce one of the best years this Association has ever enjoyed. When I look out in this audience today, I see many past presidents, second vice presidents and countless volunteers who have made this Association great. I know that we have a proven past -- and with each of us working together -- I know that we’ll have a promising future. Thank you.

A Man of Family and Faith, Luke Shows Life Experiences Prepare Him for the Future

You may know Luke Shows through his business as a custom home builder with Shows Construction, or from the Home Builders Association Board of Directors, where he has been an active member since 2005. But there’s a lot you may not know about Shows. Shows grew up living in a number of places as his father worked construction build-ing power plants which would require his fam-

ily to move after about three years in a town. When people ask Shows where he grew up he generally just tells them, “The South!” Shows graduated from high school in Augusta, Geor-gia and then attended Harding University in Searcy, Arkansas. After graduating in 1989 with a degree in Business Man-agement, Shows joined the Navy and completed officer and flight train-ing at NAS Pensacola, graduating from Aviation Officer Candidate School and Naval Flight Officer training. Shows and his wife, Joelle, a Gulf Breeze native, were stationed in Virginia Beach, Virginia where he served as a Bombardier/Navigator in an A-6 In-truder squadron. Shows completed his service in the Navy in 1999 teach-ing at the NROTC unit at Auburn University where he earned an MBA with a concentration in Con-struction Management.

It was when Shows and Joelle bought their first house while living in Auburn, a fixer-upper, that he realized his passion for construc-tion. “Through the remodeling process Joelle kept pointing out how much I was enjoying

myself,” Shows explains. “She’s the one who suggested I should look into becoming a build-er.” Shows had always dreamed of starting his own business, and he had finally discovered the right direction. When asked what he likes about being a builder Shows is quick to explain that he gets satisfaction from many aspects of the business. “I enjoy being an expert in my field and working closely with my clients and team of contractors to create well-built and energy efficient homes that my clients will take pride in and benefit from for years to come,” Shows explains. Joining the HBA early on, he didn’t really know what to expect out of membership. “To be honest, I didn’t even know how much the HBA does; I just joined on the principle of supporting the industry,” Shows says. “The more I got involved, and the more I learned about what the HBA does for our industry and community the more committed I became to support the service that the HBA provides each of us. During his tenure as President, Shows plans to increase membership by at least ten percent. “I want there to be a strong push for the membership drive,” he explains. “I want to get back some of the members we’ve lost due to the economy.” He also plans on having a great year with the Parade of Homes. Shows believes that the Parade of Homes is one of the best ways for HBA to get our name out and get noticed. “The last two years with the Parade of Homes have been home runs for us, and I want another great year,” he says. But Shows isn’t just a builder and HBA president. He is also the Treasurer for his church, enjoys hunting and fishing (when time allows) and is a devoted husband and father. Of his children Shows says, “There is nothing better than being a dad. I get so much pleasure from seeing our children growing, learning and experiencing life.” He and Joelle have been married for 21 years and have three children: Emma (14), Caden (10) and Isabel (7). Shows and Joelle are active members in their church and are involved with their children’s activities including school, sports and music. “I’m looking forward to a great year and I sincerely hope that the HBA will continue to prosper and be a source of information, training and networking for our industry,” said Shows.

Past, Present and Future leaders ushered in a new year of leadership at the Home Builders Association Installation Banquet that was held on December 15th at HBA member New World Landing. HBA members ushered in a new year of leadership with Luke Shows of Shows Construction taking the reins of the Home Builders Association of West Florida. It was certainly a memorable event with many past leaders attending to celebrate the Florida Hous-ing Hall of Fame induction Jack McCombs of McCombs Electric.

Reynolds worked extremely hard and spent countless hours working on the behalf of the Green Building Council. Her perseverance has made the Green Building Council one of the best councils in the state. Congratulations Natasha!

Newman Rodgers has truly given of his time and talents for the betterment of the home building industry and the HBA. Rodg-ers contributed to the overall success of the HBA by volunteering for events, meetings, and spearheading the new addition to the Council on Aging’s Adult Day Care Center. He has worn the white hat for the home build-ing industry. Great job, Newman!

In a 48-year career, Home Builders Association of West Florida member Jack McCombs of McCombs Electric is one of the Florida Home Builders Association’s most widely honored mem-bers. A past HBA and FHBA Associate of the Year and a member of the National Hall of Honored Associates, he helped develop Florida’s first energy code and made history in 1985 as the first associ-ate member from Florida to serve on the Board of Directors of the National Association of Home Builders (NAHB). HBA CouncilNews

It was a very productive year for the HBA’s Auxiliary Council under the leadership of Angie Cooper of Gulf Power Company. Even under a strained economy, the council was able to provide assistance to many local organizations in need. Reflecting on the year, Cooper said, “As usual, I am so proud to be associated with such a wonderful group of women. Together we accomplish so much for so many. This year we raised funds to cook dinner for over 100 homeless people, gave a $1,000 donation to the Gulf Coast Kids House, gave almost 50 children of the Lakeview Cen-ter a Spring party, a Christmas bowling party and bought Christmas presents for them. We

Flawed Appraisals Killing Home

Sales, Hampering Housing Recovery

One out of three builders are reporting losing signed sales contracts during the preceding six months because appraisals on their homes are less than the contract sales price, according to a recent nationwide survey conducted by the National As-sociation of Home Build-ers (NAHB). “The inappropriate use of distressed and foreclosed sales as comparables in determining new home values is needlessly driving down home prices, killing home sales, causing more workers to lose their jobs and delaying a housing and economic recovery,” said NAHB Chairman Bob Nielsen, a home builder from Reno, Nev. Too often, due to faulty appraisal practices, brand new homes with sparkling appliances and interior upgrades get compared to a distressed property that has been sitting va-cant and in disrepair. The result, in many cases has been that the new house winds up getting appraised at less than the cost of construction. That is precisely what is occurring in today’s marketplace, according to the NAHB survey, where a full 60 percent of respondents reported they were experiencing appraisals coming in below their contract sales price. Of those reporting that they had encountered this problem, 53 percent said the appraisal amount was actually less than the cost of building the home. “This is not only unfair and unrea-sonable, but it perpetuates the cycle of declin-ing home values, drives more home owners underwater, harms local economic activity and acts as an obstacle to the recovery of the hous-ing market,” said Nielsen. These appraisal practices are a major contributing factor to the current acquisition, development and construction (AD&C) lending crisis that has choked off credit for home build-ers and threatens to prolong the current housing downturn. Falling appraised values for land

and subdivisions under development have led some financial institutions to stop lending to developers and builders, to demand additional equity and even to call performing loans. Since Sept. 2009, NAHB has held four apprais-al summits in Washington with representatives of federal banking regulators, the appraisal industry, the housing finance industry, the real estate and housing sectors and others to find solutions that will allow appraisers to develop

realistic valuations based on sales that are truly comparable. The need to give top prior-ity to addressing the complexity of property valuations in distressed markets and impediments to the flow of appro-priate information

on homes between appraisers and interested parties was discussed during the most recent summit, which occurred on Oct. 19. “Major reforms in appraisal practices and oversight are needed to ensure that apprais-als accurately reflect true market values and don’t contribute to price volatility or harm as-piring home owners and move-up buyers,” said Nielsen. “We will continue to work with all stakeholders in this debate to find solutions.” With the decline in home prices appearing to have ended or be coming to an end in most parts of the country, resolving the appraisal and credit crunch issues remain a top priority for the association. NAHB’s latest Improving Markets Index has shown modest signs of improvement in scattered housing markets where employ-ment is gaining and distressed properties are not as numerous. New-home construction stands ready to serve as an engine for economic recovery. Building 100 single-family homes creates more than 300 full-time jobs and provides $8.9 mil-lion in federal, state and local tax revenues. “Resolving inappropriate appraisal practices and restoring the flow of credit to home builders will not only help to put America back to work, it will provide badly needed tax revenues that is essential for local governments to support schools, police and firefighters in communities across the land,” said Nielsen.

No Link to Drywall, Health ProblemsFederal officials testified last week that there is not enough evidence to prove defective drywall is a significant health hazard. Affected homeowners have claimed that the drywall was responsible for numerous ailments but health and safety officials told a U.S. Senate panel that an analysis shows the levels of toxic chemicals emitted by the drywall aren’t high enough to indicate a link to health problems. About 4,000 families – 56 percent from Florida – have complained about the potential health effects of the drywall to the Consumer Product Safety Commission, indicating that it was the source of nosebleeds, respiratory problems, and pet deaths. Most of the impacted homes were built after the 2005 hurricanes in Florida, which led to product shortages and most reli-ance on drywall from China. Both Florida’s U.S. Senators have a role in the issue with Bill Nelson sponsoring last week’s Senate hearing and Marco Rubio suggesting legislation that will protect the credit ratings of individuals whose homes lost value because of Chinese drywall.

State Approves New NNC CriteriaThe Environmental Regulations Commission (ERC) unanimously approved proposed rules by the Florida Department of Environmental Protection (DEP) to set numeric nutrient crite-ria (NNC) for Florida water bodies in Decem-ber. Nutrients are considered to be nitrogen and phosphorous. The ERC approved revisions to Chapter 62-302 (Surface Water Quality Standards) and Chapter 62-303 (Identification of Impaired Surface Waters). These rules (not yet effective) now contain NNC standards for lakes, flowing waters (streams), springs, and es-tuary specific criteria for several estuaries. The new rules were drafted as an alternative to the US Environmental Protection Agency’s (EPA) NNC that were promulgated for Florida’s lakes and flowing waters in November of 2010. If approved by the EPA, the state NNC will replace the federal NNC. Florida Home Build-ers Association General Counsel Keith Hetrick of the Broad and Cassel law firm applauded the ERC approval of the rules but cautioned that there are still hurdles to overcome. “Now that the ERC has approved the rules, they still need to be ratified by the Florida Legislature and approved by the EPA,” said Hetrick. “And we wonder whether the EPA will really leave the State of Florida, as it should if it approves Florida’s rules.”

Unemployment Comp Under ReviewFlorida lawmakers are considering changes to the state’s unemployment compensation rules. A proposed committee bill filed last week by the House Business and Consumer Af-fairs Subcommittee seeks mandatory training for unemployment compensation beneficiaries who score below “minimum proficiency” on a skills test portion of the benefits application process. It also extends the statute of limita-tions for the state to seek compensation and prosecute unemployment compensation fraud, and makes it easier to garnish wages of those found guilty of fraud. Also, employers would not have to pay into the system for layoffs related to man-made disasters such as oil spills and terrorist attacks. The bill would also rename the “Unemployment Compensation Law” the “Re-employment Assistance Program Law,” changing all references to “unemploy-ment compensation” to “re-employment assis-tance.” Florida Governor Rick Scott is pushing the renaming and the proposed changes to help alter the mindset of Florida’s unemployment compensation program. The proposal also is designed to help slow and reverse Florida’s rising unemployment compensation tax, the minimum rate of which will rise to $171.70 per employee next year, up from $8.40 in 2009. The maximum rate will increase from $378 to $459 per employee.

Builders Report Tight Lending Conditions Persist

in the Third Quarter The commercial banks on which home builders and devel-opers largely rely to finance their projects continued in this year’s third quarter to hold tight reins on acquisition, development and construction loans (AD&C), ac-cording to the most recent quarterly survey by NAHB’s Economics and Housing Policy Group on the availability of credit to the housing industry. More than half of the single-family builders and developers surveyed by NAHB indicated they had decided to put any new construction or land activity on hold until the financing climate improves. Freeing up credit for housing remains a top priority for NAHB, which has been work-ing to obtain a legislative solution on Capitol Hill. On May 5, Reps. Gary Miller (R-Calif.) and Brad Miller (D-N.C.) introduced H.R. 1755, the Home Construction Lending Regulatory Improvement Act of 2011, to ad-dress specific regulatory impediments to the flow of credit needed by home builders. That measure currently has 80 cosponsors, and NAHB is seeking a companion bill in the Senate. Of the minority of builders who sought AD&C loans in the third quarter, few saw improvement in the lending climate over the previous quarter and a significant share saw conditions continue to deteriorate. Forty-eight percent of those polled said they had looked for financing for single-family construc-tion in the third quarter. Of those, only 8% said the availability of financing for single-family projects was getting better (compared to the previous quarter), 61% said it was unchanged and 31% reported it had worsened. An index by the Federal Reserve based on quarterly surveys of senior loan officers around the country has been paint-ing a somewhat rosier picture than NAHB’s ongoing series on AD&C lending. On balance, the Fed survey showed that credit conditions for real estate had eased slightly in the third quarter of 2011 and throughout the year. The latest research from NAHB shows that more home building activity has moved to alternative sources of financing in response to the tighten-ing, even as commercial banks have remained the most important source of credit.

This has particularly been the case for land acquisition loans, where banks were the primary source for 60% of third-quarter loans, down from the 80% range when that share first started declining at the start of 2009. The NAHB study found that private equity funds were cited as the primary source of credit by 23% of the developers seeking loans for land acquisition in the third quarter. Survey respondents who indicated that lenders were clamping down further on credit avail-ability in the third quarter noted several ways in which the tightening was occurring:• 77% said lenders were reducing the

amount they were willing to lend. • 75% reported seeing the allowable loan-

to-value ratio being lowered. • 66% found lenders who were not making

any new real estate loans. • 63% said they encountered lenders who

were requiring personal guarantees or col-lateral not related to the project.

• Third-quarter survey results showed that tight lending was least discouraging for multifamily rental develop-ers.

• Thirty-eight percent of them said they were putting their multifam-ily projects on hold because of the scarcity of finance, com-pared to a 54% freeze on new single-family construction, 59% for land acquisition and 60% for land development.

• Between 20% and 33% of the respondents to the AD&C survey said that lenders were tightening terms and conditions on outstand-ing production loans.

Tightening was most common for outstanding single-family construction loans (33%) and least common for multifamily rental and condominium construction loans (20% each). In 84% or more of the cases, the out-standing AD&C loans were performing before the lender took action to tighten them. By far the most common way lenders were tightening up on outstanding production loans in the third quarter was requiring a partial downpayment based on a re-appraisal (reported by 66% of respondents) and demanding ad-ditional assets as collateral (64%). Lenders most often told builders they were tightening on loans because the regula-tors were forcing them to do so. Sixty-eight percent of those surveyed said they were given this reason for restrictions on new loans and 52% heard it was the reason for tightening an outstanding loan.
