Armed Service Members Have Another Year for Home Buyer Tax Credit For most Americans, the home buyer tax credit expired on April 30. But Congress, recogniz-ing that many members of the military, foreign service and in-telligence communities may have missed out on the opportunity to take advantage of the credit due to being posted over-seas, has given service members more time to take advantage of it. The law provides qualified service members who served on official extended duty outside of the United States for 90 days or more at any time between Jan. 1, 2009, to April 30, 2010, another year to buy a home and claim the credit. “Qualified service mem-bers” are defined as a member of the uniformed services of the United States military, a member of the Foreign Service of the United States, or an employee of the intelligence community. Qualified service members who are eligible for the home buyer tax credit now have until April 30, 2011, to sign a sales contract, and until June 30, 2011, to settle and close on the home. Both the $8,000 first-time and $6,500 repeat home buyer tax credits are included in this rule. For married couples, only one
spouse, not both, needs to be a qualified service member who served the required amount of extended duty outside the United States. In many cases, the rule that requires buyers to repay the credit if they move out of their home within three years has also been waived for service members. If the home owner or their spouse receives government or-ders for qualified official extended duty service and have to sell their home, they do not have
to pay back the credit. This applies even if they have to sell in the same year they purchased the home. The new place of duty must be at least 50 miles from the principal residence being sold. The IRS also made sure that soldiers and other service members who are wounded overseas, or have to return to the United States for other medical reasons, are not denied the credit if their time
spent overseas ends up less than 90 days. This credit could make an impact when the Army’s 7th Special Forces Group is moving to Eglin Air Force Base and Duke Field. The 7th Special Forces Group is an oper-ational unit of the United States Army Special Forces that was activated May 20, 1960, and initially based at Fort Bragg in North Carolina, its current headquarters. may not know, in 2008, Air Force officials signed a record of decision to relocate the 7th Special Forces Group to Eglin Air Force Base. In order to accommodate the move, Eglin Air Force Base began in 2009 construction on more than 5 million square feet of buildings and hard surfaces. Construction, which has a price tag of about $382 million, is scheduled to run through 2011. New construction features a new headquarters and training compound in the Eglin Reservation. The main complex for the 7th SFG is located about four miles west of Duke Field, and 12 miles north of Eglin’s main base. There are about 2,200 soldiers in the 7th Army unit, which includes a headquar-ters staff and five battalions that are each about the equivalent of an Air Force squad. This 7th Army move to Eglin AFB means about 4,000 family members will relocate to the Emerald Coast and Northwest Florida region surround-ing Eglin Air Force Base. The Florida Home Build-ers Association (FHBA) is pleased to report that FIVE of your SIX 2010 Top Legislative Priorities passed during the just-completed Legislative Session. Specifically, lawmakers passed legislation that:• Prohibits mandatory residential fire sprinklers from being added to the Florida Building Code,• Removes unnecessary barriers to condo bulk-buyers that will help spark sales,• Prevents job killing regulations associated with agency rulemaking efforts,• Validates permit extensions and DRI exemp-tions, and• Funds Phase II of the Department of Health study of performance-based septic treatment systems. “With the passage of these great bills, lawmakers have put the brakes on Florida’s decline,” said David Hart, Vice President of Legislative and Governmental Affairs for FHBA. “They recognize that Florida’s building industry is vital to our state’s economy, and took positive actions to create a more hospita-ble environment for private sector job growth.” Despite this strong successes achieved in the 2010 Legislative Session, FHBA is disappointed that lawmakers could not move legislation lifting the cap on the Sa-dowski Affordable Housing Trust Fund across the finish line. The affordable housing measure had majority support in both the House and Senate; however an unfriendly amendment was added to the bill which ultimately caused the bill to die. Below is a brief synopsis of your FHBA legislative victories:Fire Sprinklers With the passage of SB 846 by Sen. Mike Bennett (R-Bradenton), the installation of mandatory residential fire sprinklers in one- and two-family dwellings will not be added to the Florida Building Code. Without the passage of this good bill, the Florida Build-ing Commission would have been forced to include mandatory residential fire sprinklers in the 2010 Florida Building Code because of a directive from the International Code Con-gress. Florida is one of more than 20 states that filed legislation to block this mandate. Special thanks to Rep. Robert Schenck (R-Spring Hill) for sponsoring the House companion legisla-tion.
Condo Bulk-Buyers With the passage of SB 1196 by Sen.
FHBA Legislative Successes Bode Well For HBA MembersMike Fasano (R-New Port Richey), investors wishing to make bulk condominium purchases of more than seven units will no longer have to accept the legal and financial liabilities of the original developer. For too long, investors have sat on the sideline – choosing not to buy condo’s in bulk – during a time when Florida desperately needed their help to reduce inven-tory and return stability to the market. The pas-sage of SB 1196 by Sen. Fasano removes the condo bulk-buyer barriers and will help ensure a stronger economic recovery. Special thanks to Rep. Ellyn Bogdanoff (R-Ft. Lauderdale) for sponsoring the House companion legislation.
Regulatory Streamlining Despite Florida’s 12.3 percent unemployment rate, some state agencies have moved forward with rulemaking efforts that would thwart job growth and eliminate even more jobs. But under a bill passed by the Florida Legislature, those job killing regula-tions will be prevented. With the successful passage of HB 1565 by Rep. Chris Dorworth (R-Heathrow), state agencies will be required to complete a Statement of Estimated Regula-tory Costs when these rules have a negative economic impact on Florida’s private sector job growth and small businesses. If the regula-tory impact is more than $1 million statewide, the rule must then be reviewed and ratified by the legislature to become effective. Special thanks to Sen. Bennett for sponsoring the Sen-ate companion legislation, and to Rep. Matt Gaetz (R-Fort Walton Beach) for serving as the prime House co-sponsor.
Permit Extension & DRI Exemptions Because the growth management reform law that resulted from the 2009 Leg-islative Session is tied up in a lawsuit, there has been great uncertainty in the develop-ment industry. Under SB 1752, better known as the Jobs Bill, that uncertainty has been removed. This good bill contained the Florida Home Builders Association’s (FHBA) growth management “patch” language which provides certainty to building professionals that took a permit extension or DRI exemption in reliance on the 2009 growth management bill – SB 360. SB 1752 by Sen. Don Gaetz (R-Milton) provides additional benefits to the building industry and Florida’s economy. Specifically, it opens the window for additional permits to be extended, encourages Florida-based manufac-turers to invest in machinery and equipment, accelerates tax credits for capital-intensive in-dustries in return for adding new, high-paying jobs, and addresses needs of Florida’s space in-dustry. It should be noted that FHBA’s growth management “patch” language was originally in HB 7099 by Rep. Dorothy Hukill (R-Port
Orange). However, HB 7099 died because of an unfriendly amendment. FHBA appreciates Rep. Hukill’s hard work and support.
Performance-Based Septic Treatment Systems When lawmakers passed Florida’s $69 billion budget (HB 5001), it included $2 million for Phase II of the Department of Health (DOH) Septic Tank Nitrogen Reduc-tion Study – a strong step toward reducing cost burdens on current and future homeowners. The funding will allow DOH to field-test dif-ferent technologies and strategies in a variety of soils and locations throughout Florida in both wet and dry seasons. Funding this study was vital. That’s because various state agencies and local governments in Florida have looked at establishing strict nitrogen limitations for ex-isting and new onsite septic systems. Recently, the federal EPA has proposed even more strict numeric nitrogen limitations on Florida water bodies. If not the federal government, DEP will be proposing nitrogen limits early next year. Eventually, these rules are expected to have the effect of mandating high-performance treatment technology for onsite systems – cost-ing upwards of $15,000 per home (new and existing). In addition to the burdensome cost of this system, it has not been proven to achieve nitrogen reduction levels in Florida’s climate. Without completion of this study, builders and homeowners will have no alternatives available to handle new government mandates com-ing down the pike. Estimates for upgrading homeowners to high performance, engineer-designed septic systems in the Wekiva region alone are well into the billions of dollars. New nitrogen restrictions with no other solutions than high-performance systems will amount to an overbearing regulatory burden and fee increase to citizens and businesses.
Next Stop: Governor Crist The Florida Legislature will forward the above bills to Governor Crist. The Gover-nor will have 15 days from receipt of each bill to either sign, veto, or allow it to become law without his signature. “We thank Florida lawmakers for the strong support they showed the building indus-try during the 2010 Legislative Session, and now shift our focus to ensuring each measure is signed into law by Governor Charlie Crist,” said Hart. FHBA appreciates the strong grass-roots support of each and every member that played a role in achieving these victories. On May 14, the HBA hosted the 2010 Parade of Homes Kick-Off Party at the 2010 American Dream Home located in the beautiful
gated community of Stonechase subdivision in Pace. The 2010 American Dream Home was built by HBA member Paragon Custom Home Group. Approximately 200 people attended the kick-off party and enjoyed music, margaritas and delicious crawfish and shrimp prepared by Gary Sluder

Escambia and Santa Rosa county schools received hon-ors for their outstand-ing efforts in career academies at a luncheon sponsored by the Pensacola Bay Area Chamber of Commerce and the Northwest Florida Next Generation Learning Commu-nity. Jobs are getting more high-tech, with science, technology, engineering and math (STEM) skills becoming more important than ever. In the past two years, the local school systems along with the business community has made establish-ing career academies a priority, creating 43 career academies in Escambia County and 16 career academies in Santa Rosa County. Students enrolled in ca-reer academies are not only more prepared for the workforce, they have a 90 percent gradua-tion rate. HBA Immediate Past President Todd Stafford, who was instrumental in creating the academy, accepted the award on behalf of the Home Builders Association. HBA President Billy Moore and Executive Director David Peaden attended the special event. Awards of excellence were given to the following: “Career Academies Receiving Industry Certification” were West Florida High School

The April Green Building Council meeting was hosted on Wednesday, April 23 at the HBA of West Florida. Guest speakers were Keith Swilley and Jeff Hatch from Gulf Power. Keith and Jeff discussed the EarthCents Home Program and the benefits of building and Earth-Cents home. Council members learned about the interactions of all the systems within the home including:
• cooling, heating & ventilation system• water heating system• insulation & air-barrier system• appliances & lighting• windows

The May Auxiliary Council meeting was hosted on Tuesday, May 4 at the HBA of West Florida. Guest Speaker was Susan Way, the Senior Health Educator for West Florida Hospital. Susan spoke to the group about weight management and discussed several other health related issues that face women today. In addition to a wonderful and educating program, the ladies of the Auxiliary council stuffed Easter eggs with candy and spare change. The Easter eggs will be used at the Lakeview Kid’s Spring Party scheduled for May 22.

The Remodelor’s Council hosted an After Hours Event on Thursday, May 13 at Energy Services of Pensacola. The event was sponsored by Air Design Systems, ESP and Ferguson Enter-prises. Guest Speaker was Butch Aikens, a representative from Rheem Water Heater. Since the 1920’s, Rheem has been a leading provider for water heaters. Whitmire Cemetery Project On Saturday, May 1, members of the HBA Remodelor’s Council, along with members of Seville Rotary and Worship on Tuesday’s church youth group spent the day cleaning up the Whitmire Cemetery. The Whitmire Cemetery is family owned and
dates back to the 1800’s. Current owners are Mr. & Mrs. Creighton who are both so very appreciative of the cleanup efforts made. The council worked hard and filled 200 large garbage bags with leaves, limbs and other yard debris. Thank you to everyone who participated in the clean up.

In construction, a spike is a steel object that is essen-tial to making a building strong. As in construction, the HBA of West Florida sees a Spike as someone that works to keep our association strong. Spikes work on the recruitment and retention of members in addition to keeping members active with the association. Anyone is eligible for Spike status. On Spike credit is awarded for each new member recruited and an additional credit is awarded for that new member’s renewal on or before their anniversary date. If you help to retain a member, you are eligible to receive a half point for each member.
