Purpose of this notice The parties have concluded a settlement for the benefit of the aforementioned class. The purpose of this notice is to inform you of your rights to participate in the hearing to approve the settlement. This will be the only hearing regarding the approval of the settlement. Should the Court approve the settlement, no other legal notice will be published. You will be able to consult the judgement approving the settlement on the website of the applicant’s attorneys. If you are a member of the class or a concerned doctor, you have the right to participate in the hearing for the approval of the settlement in the manner hereinafter described. Years covered by the settlement The parties have agreed that the settlement will cover fees paid between May 18, 2008 and May 23, 2011. OVERVIEW OF THE COMPENSATION PROVIDED IN THE SETTLEMENT Payment The Régie de l’Assurance Maladie du Québec (“RAMQ”) will obtain from the doctors, at no cost, information regarding injections administered and amounts billed. The Superior Court has waived the doctors’ confidentiality obligations for this purpose. The ministère de la Santé et des Services sociaux (“MSSS”), through the RAMQ, will pay out a maximum of $115 including all fees, interest and compensation for each injection received during the time period covered by the class action. The funds will be distributed to all the members of the class action who com- plete a claim form confirming that they have not been compensated for the same amounts by a public or private insurance fund or in the context of a compensatory program established by a manufacturer or distributor and which claim will be approved by the RAMQ. A member of the class action who has not been contacted by the RAMQ to complete a claim, may contact the RAMQ to file one. The validity of each member’s claim will be analysed by the RAMQ. If the claim is accepted, a cheque will be issued to the member. In case of a claim that is refused, a notice indicating the review process will be sent to them. Information regarding the procedure to file a claim will be made available on the RAMQ’s website following the Court’s decision approving the settlement. The cost of the present notice have been paid by the MSSS. Withdrawal (exclusion) A class action member may exclude him or herself from the present settlement by sending a written notice to that effect (you can find a form to do so on the website of the applicant’s attorneys). Such notice must be sent to the attention of the registrar of the Superior Court and to the attorneys in the present file, within 30 days of publication of this legal notice. Purpose of this noticeThe parties have concluded a settlement for the benefit of the aforementioned class.

The purpose of this notice is to inform you of your rights to participate in the hearing to approve the settlement. This will be the only hearing regarding the approval of the settlement. Should the Court approve the settlement, no other legal notice will be published.

You will be able to consult the judgement approving the settlement on the website of the applicant’s attorneys.

OVERVIEW OF THE COMPENSATION PROVIDED IN THE SETTLEMENT

PaymentThe Régie de l’Assurance Maladie du Québec (“RAMQ”) will obtain from the doctors, at no cost, information regarding injections administered and amounts billed. The Superior Court has waived the doctors’ confidentiality obligations for this purpose.

The ministère de la Santé et des Services sociaux (“MSSS”), through the RAMQ, will pay out a maximum of $115 including all fees, interest and compensation for each injection received during the time period covered by the class action.

The funds will be distributed to all the members of the class action who com-plete a claim form confirming that they have not been compensated for the same amounts by a public or private insurance fund or in the context of a compensatory program established by a manufacturer or distributor and which claim will be approved by the RAMQ. A member of the class action who has not been contacted by the RAMQ to complete a claim, may contact the RAMQ to file one.

The validity of each member’s claim will be analysed by the RAMQ. If the claim is accepted, a cheque will be issued to the member. In case of a claim that is refused, a notice indicating the review process will be sent to them.

Information regarding the procedure to file a claim will be made available on the RAMQ’s website following the Court’s decision approving the settlement.

The cost of the present notice have been paid by the MSSS.

Withdrawal (exclusion)A class action member may exclude him or herself from the present settlement by sending a written notice to that effect (you can find a form to do so on the website of the applicant’s attorneys).

Such notice must be sent to the attention of the registrar of the Superior Court and to the attorneys in the present file, within 30 days of publication of this legal notice.
