Foreword

In Kumam communities over 90% of the land is under customary land tenure system, managed in accordance with Kumam Principle, Practices, Rights and Responsibilities (PPRR), as provided for by the 1995 Constitution of The Republic of Uganda. While Kumam PPRR in land tenure management is well known amongst the kumam communities, its understanding and clarity within the new Kumam generation is not as clear as it is with the earlier generations due to the effect of time and change. For some parts of Kumam, the situation has been made worse by the 20 years of insecurity and the effects of displacement. In addition, the courts of law and other non Kumam within Uganda and beyond do not understand with adequate clarity the Kumam PPRR in land tenure management. Furthermore, there is lack of written Kumam PPRR in land tenure management, leaving it to be passed from one generation to another through actual practices, oral tradition/verbal and folklore.

In the face of the challenges of population increase, people returning home from displacement and the need for harmonization of all stakeholders understanding of the Kumam PPRR in customary land tenure system, Kumam Elders’ Forum (KEF) with its Clan Heads, has documented the Principles, Practices, Rights and Responsibilities of customary tenure for Kumam communities, with support from our development partners, particularly Iteso Cultural Union (ICU) and Land and Equity Movement in Uganda – LEMU and those who support them. We believe that it will provide a lot of useful guidance to our people, those involved in land management, courts of law, and other stakeholders. We also believe this PPRR will help to reduce the many land problems currently faced by the Kumam society with regards to land rights under customary tenure such as:

i) Boundary disputesii) Land grabbing from unmarried daughters, sons born out of

marriage, divorce women who return to parents and people who are away from home. The land grabbing is sometimes unfortunately done by the very clan members who have the responsibility to protect the land rights.

iii) Irresponsible sale of land without knowledge and consent of family members and clan leaders; without considering future generations, for money for alcohol, luxuries and gambling.

iv) Sale of the same land more than once due to greed for money with resultant consequences that sometimes cause death.

v) Secret sale of land belonging to others, the community or public land such as community grazing lands and wetlands.

vi) Conflict caused by people who migrated and resettled in some other place a long time ago but return to home of origin for land to sell.

vii) Conflict caused by the retraction of land gifts by relatives from other people and institutions, these include lands given in the past for; health centres, markets, forest, settlements, play grounds and worship places.

viii) The chasing widows, orphans and children from their land by some clan leaders, family members and neigbhours.

ix) Some leaders taking land by force in the name of development but without giving the legally required compensation – purchase price, disturbance allowance and improvements on the land.

x) Conflict brought about by court rulings made without clearly understanding rights under customary land tenure.

The challenge lying a head is adequate dissemination of this PPRR book to all key stakeholders, adherence to it and receiving necessary feedback for continuous improvement.

The process of documenting and ensuring the accuracy and authenticity of the PPRR of customary tenure in Kumam was through a Working Group consisting representatives of male and female members of the Kumam Elders’ Forum, ICU council members and LEMU staff as facilitators of the process. The Elders’ Forum drafted the PPRR based on information from members of the Elders’ Forum on customary laws, the PPRR of Lango, Teso and Acholi. The final draft of the PPRR was laid before more than 147 clan heads, youths and women representatives for discussion and approval.

Part 1:Preliminary 1. This Principles, Practices, Rights and Responsibilities of customary

tenure for Kumam Communities may be cited as the PPRR number 1 of 2011.

2. This PPRR is subject to the Laws of Uganda but specifically to:

a) Article 37 of the 1995 Constitution which states that every person has a right as applicable to belong to, enjoy, practice, profess, maintain and promote any culture, cultural institution, languang, tradition, creed or religion in the community with others.

b) Article 237 (3) of the 1995 Constitution of Uganda which points out that customary tenure is one of the four land tenure systems in Uganda. The others being (i) Mailo (ii) Freehold and (iii) leasehold.

c) Article 246 (3) of the 1995 Constitution of Uganda provides for the extistance of cultural institutions, their powers and roles.Section 3 (1) of the 1998 Land Act which describes customary land with reference to section 27 of the same act.

Section 27 of the 1998 Land Act says “Any decision taken in respect of land held under customary tenure, whether in respect of land held individually or communally, shall be in accordance with the customs, tradtion and practice of the community concerned, except that a decision that deny women or children or persons with disability access to ownership, occupation or use of land or impose conditions which violate Section 33, 34 and 35 of the 1995 Constitution of Uganda of any ownership, occupation or use of land shall be null and void.

d) Section 88 of the Land Act 1998 which says “Nothing in this part shall be taken to prevent or hinder or limit the exercise by traditional authorities of the functions of determining dispute over customary tenure or acting as mediator between persons who are in dispute

over any matters arising out of customary land tenure”.e) Section 39 of the 1998 Land Act which states that no person shall

sell, exchange, transfer, pledge, mortgage, or lease any land except with prior written consent of the spouse.

3. Interpretation. In this PPRR, unless the context otherwise requires:-“Agreed boundrary trees” are Ejumula and Eligoi or any other trees agreed by the Kumam Elders’ Forum.“A clan is - Ateker” recognized in Kumam communities as people or group who are following the same norms or beliefs and cannot marry among themselves.“An heir means a person appointed by the clan members after the death and burial of his/her head of family to take over management of the estate of the deceased.“Customary land rights” means land rights acquired on unregistered land through birth, marriage, purchase, gift by being a member or accepted as a member of the community on land managed and protected by clan leaders.“Customary tenure” has the same meaning as in the Land act 1998 and also means land that has no freehold or Mailo paper titles.“Divorce” means return of dowry or letter from any of spouse and their clans stating that they have divorced. “Freehold” has the same meaning as is in the Land Act (CAP 227)“Good reason” for selling land is for serious medical treatment and a request after the clan fails to assist one to raise school fees for a person at the stage of sitting a national examination and to get dowry for marriage. “Head of family” is - a married man, on his father’s clan land if born during a marriage, a widow, with or without children on husband’s clan land if in marital home and if she returns home then on her father’s clan land, a divorced woman on parents clan land, an orphan if appointed as head of household by the clan on father’s clan land, or unmarried woman on fathers clan land and an uncle as a temporal head of household for orphans, if appointed to manage the land of an orphan or child until he or she becomes head of family to take over.

“Important information” to determine consent to sell land includes how much a family is left with, how many children and wives, how many times the head of family has sold the land and reasons for selling, reason for sale, if all family members support the sale, etc.“KEF” means Kumam Elders’ Forum, which is composed of representatives of clan heads, youth representatives and women representatives elected from all the clans in each of the sub counties in and one from outside Kaberamaido and the Council of Elders. “Leasehold” has the same meaning as is in the Land Act (CAP 227)“Marriage” means engagement and any marriage celebration where full or part dowry is paid thereafter. Marriage amongst Kumam community is an agreement between the boy intending to marry and his parents and the girl he is intending to marry and her parents. “Mailo” land tenure has the same meaning as is in the Land Act (CAP 227).

Part 2:Land rights and land holding.

4. Rights to Land of all family members.

a) All persons born in, married into a family, given land as a gift or has genuinely and legally purchased land under customary tenure, have rights to customary land.

b) Land rights under customary tenure amongst the Kumam communities are not dependant on good behavior or having children.

5. Land rights of head of family.All Married men, Unmarried adults girls, with or without children, the children born by un married girls, Widows, Widows who voluntarily choose to return to their parents’ homes, Orphans and all daughters who were once married but divorced and returned to their parents’ homes have rights to land as individuals and the responsibility to manage land in trust as head of family on behalf of all family members.

6. Rights of an heir.All heirs to family land have rights and responsibilities of a head of family over their own allocated land, and to manage land left unallocated in a pool in trust for the use and future allocation to the whole family under the supervision of the clan.

7. Rights of unmarried girls and boys.a) All children, boys and girls born to a family have the right to allocation

of land by their fathers and right to use land allocated to them as well as pass it to their children.

b) Children born out of marriage shall have rights to the land of their mother’s family unless the biological father claims their heritage by paying compensation to the mothers’ clan. Once compensation is paid and accepted by the girls’ family, the children born out of marriage shall have rights to the land of their biological father.

c) It is the responsibility of the clans of the unmarried girl and the clan of the biological father of the children to ensure that children know where their heritage land and entitlement is before the children become adults.

d) It is the responsibilities of the clans of the divorced women or widows who return to their maiden homes to ensure that children born in marriage but living with their mothers are shown their land in their fathers’ homes and their rights are protected until they are old enough to live on their land. The clan members of divorced women and widows must ensure the land is shown to the children by their fathers and their clans.

e) Where the parents and the clans fail to show the children where their land is or to agree, the clan of the child born out of marriage, they must accept this failure and must not chase the affected children but shall give them land to hold in perpetuity.

f) If the families of the divorced women or widows who return to their maiden homes want to give gift of land to the children of their divorced and widowed daughters, no one shall remove these rights.

g) Children born to a wife who is separated from her husband but not divorced have rights to the clan land of the husband whether or not the biological father of the child is or is not a clan member of the husband.

The husband and the clan of the husband must give clan land to the children.

h) Children of a widow who has not remarried whether or not the biological father of the child is or is not a clan member of the husband, have rights to land of the widow’s husband. The family of the husband must give land to the children.

i) Even though it is assumed that all girls will marry and not divorce, girls who do not marry have rights to land allocation by their fathers and the fathers must allocate them land if they do not marry.

8. Rights of an Orphaned minor. An orphan has the right to be the head of the family. The village clan committee must ensure that the land of orphans is not grabbed by anyone.

9. Rights and responsibility of people cohabiting.Any man who lives with a woman as wife but without marring her must pay dowry to the parents of the girl if the woman dies while still living with him. If the man dies before marring the girl he is living with as his wife the man’s family must pay the agreed dowry to the family of the girl.

10. Land rights of the first wife in a polygamous marriage.The first wife of a polygamous man and her children have exclusive rights to land allocated to her and her husband by her father in law or a family member. If the husband marries other wives or land is bought during their marriage before other wives, he must not divide or allocate part of the land already given to the first wife or bought during marriage to the first wife to any of the other subsequent wives. He must find alternative land by himself alone to allocate to any of the subsequent wives he marries

Part 3:Land rights of widows and divorced women.

11. Land rights of widows and their protection.

a) A widow has the right to make any of these choices: choose to live in her marital home or return to parents home. If she returns to parents home, and does not remarry, she may return to her marital home and get her land back at any time; she may choose to live alone without a man to inherit her; she may choose to pick an inheritor from within or from outside the clan.

b) After the death of her husband, a widow becomes the head of family over the land which was allocated to her at marriage and when her husband still lived. Even if she picks a new man in her life, she is the one who is head of the family and not the man in her life.

c) A day after the burial of the husband, a widow must make her choice known to the clan in writing or in the presence of trusted clan members and members of the LC1 executive. A widow may choose if she wants to return to fathers land or remain in her martial land with or without a man in her life.

d) Widows who voluntarily leave their marital homes to get married in another clan must appoint one of the children as the head of family and leave the land to her/him or leave the land to the clan of her husband if she has no children or if the children are young.

e) Women who are separated with their husbands and return to their fathers land must leave the land to her husband or the clan of the husband. Nonetheless, the husband and the children cannot sell the land without the consent of the separated wife and the clan.

f) Women who are separated from their husbands but who are not divorced have the right to return to her land in her marital home. The husband and the clan must return the land to them

g) A divorced woman who returns to her parents or a widow who re-marries to a man of another clan shall leave the first marital land of the former husband to her children and their clans and return to her maiden home where she must be allocated land by either parents, if they are

still alive and there is land in the pool or if the parents are dead and there is no land left in the pool for allocation, then by the brother who used her dowry to marry. Should the divorced woman marry again, the land given to her should remain in the pool for her possible return. Upon her death, this land reverts to the one who allocated it or passed on to any child of the divorced woman born before marriage or after the divorce.

h) A widow who is a head of family on land from the husbands family who has no child may decide which child to allocate and pass the land to as long as the child is a relative of the husbands family and not her parents family. The widow must make a choice of the child in writing or verbally in front of the clan.

Part 4:Land rights after long absence and rights of IDPs.

12. Land rights after a long absence from family land.

a) Any persons, family or community that lived away from their original home without visiting the original home, informing neighbors or local leaders of their intention to retain land rights over the original home, shall have no rights to re-claim the land if on return, they find their original home had already been occupied by other persons who genuinely believed that this land was virgin and vacant land, without original owner (s). The exceptions to the above are only if:

i) The people who have occupied the land are other relatives who knew or should have known that the land belonged to the person, family or community that lived away from the land.

ii) If the people on the land are neighbors or friends of the neighbors to the land of the people who lived away from the family land.

iii) If people who occupied the land are children or grand children of the person who had given this land to the family who lived away from the land.

iv) On return, they find the land is still vacant or the land is occupied after 1998 when the Land Act was passed.

v) The people who left their home to stay away were minors; persons in prison, students at School, refugees outside Uganda; had left the family land due to war/political instability or are minors who did not know of the existence of this land.

b) If the person, family or community that lived away from the original land in question is claiming rights to this land to sell it they will not have the right to do so. It will be construed that the intention of their staying away from their original family land was to permanently migrate and settle elsewhere. The land must remain with the people who are occupying it and not with family or community reclaiming it.

13. Land Rights of Internally Displaced Person(s) (IDPs)

a) The provisions of section 12(a) of this PPRR shall not apply to the land of Internally Displaced People (IDP) who ran away from their homes since 1986.

b) The people living on the land of IDPs must vacate the land for the owners either voluntarily or on request of the IDPs.

c) Any person, family or community who wants to continue staying on the land of an IDP host must agree in writing with the owner.

d) Those who occupied the land of the internally displaced persons by error must leave the land and unconditionally surrender the land to the IDPs on their return to the original family land. In this case, the returning IDPs shall give the occupants reasonable time for them to move and re-settle else where.

e) A person, family or community that was host to IDPs shall not chase them as long as the homes of the IDP from where they ran are still considered insecure. The hosts must inform the government of their intention to have the IDPs leave their land.

Part 5:Procedure for land transactions in Kumam communities. Land transactions

14. No right to sell land under customary tenure.

a) No person shall sell land under customary tenure without following the provisions of this PPRR.

b) No head of family shall sell land under customary tenure without following the provisions of this PPRR.

c) The committee charged with management of land shall not allow the selling of land under customary tenure without following the procedure in this PPRR.

d) Land under customary tenure will not be sold except for good reason.

Part 6:Control of land use.

15. The committee must not agree to the sale of land if:-

a) There is no written consent of widow(s), husbands, wives, children and all of adult family members.

b) Person/persons intending to sell the land once sold for one purpose but used the money for another purpose for which it had been agreed.

c) The committee of the clan sub-county considers that not much land is available for the family and what is left should be preserved for the livelihoods of the family members and for the future generation.

d) The clan committee considers the reason for selling land is not good enough i.e. for drinking and fees for a child in lower classes.

e) The clan considers reasons for sale of the land in question will make further sales of land most probable or unavoidable and will lead to landlessness of the family members.

f) The people seeking to sell land should follow the procedure in this PPRR.

16. The procedure for sale of customary land shall be as follows:-

a) The head of the family who wants to sell the land must first discuss and agree with members of the family household, whether they live with the head of the family or not, the intention to sell.

b) The head of family should then give “important information” to the chairperson of the village clan committee concerning the sale of the land. The information should be in writing, signed by all members of the family.

c) The chairperson of the village clan committee will convene a meeting of all members of the family household wanting to sell land to find out if the members consent to the sale. The consent, if agreed should be in writing and signed by all the members of the family household, indicating whether they agree or disagree with the sales, witnessed by the chairperson of the village clan committee and another member of the committee.

d) If a wife husband and a family member disagrees to the sale, it will be assumed that there is no agreement to the sale. Any sale shall therefore be null and void.

e) The family agreement to land sale shall be duly signed by all adult family members and a copy shall be forwarded to chairperson of the village clan committee together with attached letter requesting for permission to sell the land.

f) At the time of sale, the LC1 chairperson and the clan village committee must ensure that all members of the family selling the land are present:- all neighbors – men, women and children, whose land borders the one on sale, elders who know the boundary of the land being sold, people with interests and knowledge of the land being sold, and that there is no dispute over the land being sold.

g) The chairman L.C1 or a member of the village clan committee shall measure the size of the land and draw a map showing boundaries and size of the land on sale, list names of the neighbors whose land borders the land on sale on the map and attach copies of the request

letter for selling the land duly signed by all adult family members and village Clan committee’s chairpersons approval of the sale duly signed by members.

17. Land Gifts and donations.

a) The procedure for land sales in this PPRR shall apply to any land exchange, transfers, pledges, mortgages, rentals or lease and land gifts or donation under customary land tenure in Kumam communities.

b) A person, family or a community , with written permission from the family members and community, may donate land to a relative, a friend, the poor, the community or institutions for school, health units, for use as forests, Road reserves, and places of worship

c) Those who are donating land must do so in writing and all family members must approve and sign the agreement.

d) After this PPRR, any donation of land without a written agreement and with both parties to the agreement dead, will be assumed to be given for good and no one will have the right to retract the donation and reclaim the land.

e) Land that was donated, sold or given before the documentation of this PPRR must not be reclaimed by any relatives from the person/ people/ institution to whom it was donated, sold or given if the person, family members who donated, sold or gave the land are already dead and cannot give evidence as to the nature of the land gift.

18. Process for marking boundaries for land to be sold.

a) The members of the family wanting to sell land and members of the village clan committees will inform other clan members of the land being sold and if none of them is able or interested to purchase it, or is offering a price below the market price, the head of the family selling land may then advertise to sell land outside the clan.

b) The buyer, seller, all neighbors to the land to be sold, chairperson of the village clan committee and LC1 of the area where the land is situated, must then visit the land to be sold and verify and agree on boundaries and plant Ejumula/Eligoi tree or any other trees approved

by the KEF boundary marks. c) The LC1 and or the chairperson of the village clan committee must

cause to be drawn a sketch map of the land to be sold with details and measurements, campus direction, names of neighbors, description of any visible land marks.

d) The sketch map must be signed by the buyer, seller, L.C1, neighbors, agreed witnesses and chairperson of the village clan committee.

19. Drawing of sales Agreement and Sketch maps.

a) LC1 must then draft a sales agreement using, as a guideline the format in Schedule 1 of this PPRR and must include the family consent letter and the wives consent agreements as integral parts of the sales agreement

b) After payment of all the agreed purchase price of the land by the buyer to the seller, the sales agreement must be signed by the buyer, seller, wife or wives of the seller (if any) and witnessed by the LC1 and the chairperson or vice chairperson of the village clan committee. The LC1 or village clan committee chairperson must ensure that 6 copies of the signed sales agreement and signed sketch map of the land sold are made and a copy each given to the seller, chairperson of the village clan committee, the Government Sub County Chief, the KEF and a copy kept in the LC1 chairperson’s file and the original copy given to the buyer.

Part 7:Land management responsibilities.

Responsibility of Head of Family20. Responsibility of head of family must:-

a) Protect the rights of family members who are women, children, the sick, the old and weak people and protect them from irresponsible land transactions.

b) Manage family land and determine and mediate on family land disputes, without discrimination.

c) Allocate land fairly to individual members of the family for use before the members become heads of families and when the members become heads of families.

d) Ensure land is used for livelihoods of family members.e) Demarcate land boundaries and plant agreed boundary trees

in consultation with the family members, village clan committee members, neigbours and LC1 chairperson.

f) Make objective decisions regarding land but subject to the interests of the family members.

g) Render assistance to the family and clan members where necessary.h) Seek consent from family members as regards their land rights i) Seek consent of family members and clan leaders for any land

transactions. j) Ensure that orphans are shown the land boundary of all their late

father’s land. k) Ensure that some land remains in the family pool, unallocated to give

to divorced unmarried and widowed daughters who may return to parents’ clan land and who do not remarry.

l) All heads of families must therefore keep some land in the pool to allocate to unmarried girls, divorced girls and widows who return home.

21. Responsibility of the clan to protect rights of widows and orphans.

a) The father in law of the widow, the eldest brother in law to the widow or the closest clan relatives must appoint a man of integrity and good behavior to protect the rights of a widow, whether the widow has children or not.

b) A man appointed by the clan to be the widow’s protector must protect the land rights of the widows and her children. For the avoidance of doubt, a man appointed as the widow’s protector is not a widow’s inheritor.

c) The clan must appoint in writing the nearest and oldest clan relative with integrity and good behavior as the temporal head of family of

the orphan, to manage the land of the orphan until the orphan is old enough to become head of family.

d) The father in law, brother in law and closest relatives of a deceased husband and parents must implement this PPRR book to plant boundary trees as marks, draw maps of the land of a widow and orphan and keep copies with the widow, orphan and the village clan committee.

e) The land rights of the widow, children and orphans do not pass on to the widow’s protector or the appointed orphans’ protector.

f) The clan need not appoint a protector if the widow has grown up and responsible sons who can protect their mother.

g) The clan member who appoints a protector of the widow and orphan must dismiss them and appoint another if the protector abuses his office as a protector.

22. Clan rights and responsibilities over customary land. Each clan shall have, among others, the following rights and

responsibilities over customary land:-

a) Protecting customary land from irresponsible salesb) Knowing the overall size of clan land.c) Ensuring that land is not sold without knowledge and consent of the

wives, family members and clan. d) Getting alternative means to selling of land to solve the problems or

needs of school fees, dowry, blood compensation, repaying loans so that land is not sold.

e) Protecting and respecting the rights of widows, orphans, women, the aged, the sick and the disabled so that their land and other properties are not grabbed from them.

f) Ensuring that customary land is preserved for the future generation. g) Informing people of laws and issues regarding customary land.h) Protecting community land such as grazing and hunting land, forests

and water points. i) Protecting land vested in the government to hold on behalf of the

public such as forest, roads, and road reserves, wetlands and games reserves.

j) Ensuring that customary land is managed in strict adherence to this PPRR.

k) Proposing and encouraging the Kumam to protect land boundaries by planting agreed trees.

l) Mediating and arbitrating on land conflicts but referring them to higher clan committees for appeals or where they fail.

23. Marking land boundaries to reduce land conflicts.

a) All clan village committee members must proactively promote the planting of agreed boundary trees along land boundaries so as to reduce boundary disputes and land grabbing.

b) Tree planting shall proceed as below:-.i. Either the Chairperson LC1 or the village clan committee of each

clan, of the area where the land is shall convene a meeting of a team composed of: people with rights to the land, clan members, neighbors to land being demarcated, elders who know the boundaries of the land and the persons with interest in the land.

ii. The team attending the meeting shall inspect and ensure correct boundary marking.

iii. The people with rights to the land shall proceed to plant Ejumla or Eligoi on their boundaries.

iv. The chairperson LC1 or the village clan committee chairperson of the clan shall draw a map of this land, noting on it the size and land marks.

v. All people who participate shall sign their names and signatures on the maps drawn to confirm that boundary tree planting went on well without any complaints from people with land rights and their neighbors

vi. Each copy of the map duly signed shall be distributed to; People with land rights, LC1 chairperson; Village Clan Committee chairperson, Parish Clan chairperson and Government sub county chief.

24. Protecting boundary of customary land.

a) It shall be the responsibility of the owner(s) of the land and their neighbors, the LC1 chairperson or the Police to ensure boundary

markers are protected. b) Nobody shall in secret uproot the boundary trees planted. c) Any person, who intentionally removes or destroys boundary markers

without the consent of the owners, commits an offence under the Penal Code of Uganda.

d) Before reporting the person responsible for uprooting or destroying the boundary trees, the person will be requested and expected to:

i. Replace the tree uprooted and maintain it to grow to maturity. ii. Provide good food to the people who participated in the original

boundary tree planting and dispute resolution meetingsiii. Carry out any other punishment deemed necessary by the clan elders

during the meeting. e) On refusal to comply with these corrective measures, the person who

uprooted the boundary trees will be reported to the Police for the offence committed.

f) The LC 1 chairperson and village clan committee of the area where the land is situated shall keep records of the wrongs committed.

g) The following individuals have the responsibility to protect land rights:i. Brothers in laws, office of an inheritor, adult sons, fathers in law must

protect the land rights of widowsii. Brothers must protect the land rights of their sistersiii. Uncles must protect the land rights of their nephews and niecesiv. Husbands must protect the land rights of their wivesv. Heirs must protect the land rights of all the mothers, brothers, sisters

in the households.

Part 8:Management of clan committees.

25. Land committees and institutions for managing land under customary tenure.

a) Each of the clans of the Kumam communities shall have the following bodies for managing the customary land; a) Head of family; b) Father/Father in law, husbands, brothers, brothers in laws, uncles c) Village

c) All clan committees’ chairpersons and members at all levels are responsible for the affairs of their clans and not only for the land matters.

d) The council of clan heads of the different Kumam clans.e) Members of the Kumam Elders’ Forum (KEF) will be the following: a) the

current members of the Council of Elders; b) a woman representative, youth representative and a clan head each elected by all the clans in the sub counties in Kaberamaido (excluding the municipal) and one other sub county to cater for clans living outside Kaberamaido e) the Chairperson to Kumam Elders’ Forum shall be elected by all the clan heads of Kumam communities.

f) The committee to the Kumam Elders’ Forum.g) Clan committees shall be body corporate and may sue and be sued.

26. Membership of the village, parish, sub county, county and Kumam Clan Forum clan committees.

a) All of the clan committees shall consist of (11) members comprising of a Chairperson, Vice chairperson, Secretary, Treasurer, Officer responsible for mobilization, Women representative, Youth representative, Chief for land affairs, Officer for security, Disability representative and secretary for Education.

b) The office for vice chairperson, treasurer and women representative must be reserved and filled by women so that at all times, all the committees have a minimum of 3 women in the clan committee.

27. Election of village clan committees.

a) The village clan committee is the lowest committee in the structure. b) The “Won Ateker” shall be the chairperson of this committee and

responsible for the election of the members of their clans.

28. Rights and responsibilities of village clan committees are to:-

a) Protect community – owned land in the area of their jurisdiction. Where the land falls beyond the jurisdiction, the chairperson must ensure that all the relevant clan committees come together to elect people to manage the community land on behalf of the community.

b) Determine and mediate on land disputes without bias, hearing both parties, hearing witnesses, recording and writing judgments, and informing of and allowing appeals.

c) Inform land owners about the provisions in the PPRR especially the procedures of selling land, and proactively planting boundary trees.

d) Inform clan members on the role of the central government in the management of public land such as wetland, forest reserves, road reserves, game reserves and Game Park, among others.

e) Proactively promote planting agreed boundary trees along the boundaries to reduce boundary disputes.

f) Facilitate the writing of community rules for managing and protecting communally owned land where clans have land rights.

g) Ensure that all members of the family, especially wife/wives and children have agreed to sell land and it is not only the decision of the head of family.

h) Give consent for orphans, the disabled to sell their land if they have good reasons and the clan is not in a position to assist them with their problem.

i) Refer appeal cases and cases they have failed to resolve to the parish clan committee.

j) Assist those who appeal to the parish clan committees with how to process their appeal.

k) Inform the parties to a land case before them of their right to appeal to a higher clan parish committee and assist them to access the clan

e) Keep records of all lands, land sales and land conflicts in the parish f) Protect and inspect wetlands, road reserves, forests and other fragile

ecosystem for public good.

33. County clan committees.

a) There shall be a committee to be known as county clan committee. b) The county clan committee shall be a body corporate with perpetual

succession and a common seal and may sue or be sued in its corporate name. Members of the county clan committees will be elected from the elected sub county clan committees.

34. Functions of the county clan committees.The functions of the county clan committees shall be to: a) Identify, protect, hold and manage community land such as grazing

lands, picnic sites, recreation sites, hunting lands and woodlands on behalf of the clan if the land is in more than one sub county.

b) Hear appeals on decisions on land sales and land conflicts referred from the sub county clan committees

c) Refer land sales and land conflict related cases which they are not able to solve to Kumam Elders’ Forum.

d) Ensure that communities and sub county clan committees are informed of policies and laws on all lands vested in government of Uganda in trust for the people, such as wetlands, forests, etc

e) Keep records of all lands, land sales and land conflict in the countyf) Protect and inspect wetlands, road reserves, forests, environment and

other fragile ecosystem for public good.

35. MeetingsKumam Elders’ Forum.There shall be a committee for all the Kumam communities under theKumam Elders’ Forum known as the Kumam Elders’ Forum Committee with:

a) The rights and responsibilities of all the committee to:-i. Hear appeals of land cases from committees of the sub clan heads.ii. Ensure that grazing land, wetlands, forest reserves, game reserves,

and game parks, road reserves, sport and playing ground, schools, health units, markets, and places of worship are protected.

iii. If the land to be protected falls beyond the jurisdiction of more than one sub clan, the different sub clan committees will elect office bearers to protect the land.

iv. Ensure land rights of people such as widows, orphans, children and other vulnerable people are protected and their land is not grabbed.

v. Inform government of customary land matters.vi. Forge and build relationships and mutual understanding between

Iteso Cultural Union (ICU), local and central government in respect to customary land.

vii. Play a leading role in linking local and central government developers or investors to land owners so they negotiate land agreements.

viii. Forward land cases they fail to resolve to the courts of Laws.ix. Be witnesses in court procedures.x. Ensure the Kumam communities know of this PPRR and government

laws and policies on land.xi. Monitor the implementation of the PPRR in Kumam communities to

draw lessons on what part of the PPRR should be amended and which judgments should be used as precedents.

xii. Act on any requests concerning land management from the Government.

36. Committee meetings.

a) Committee meetings at various levels shall be convened according to the need to meet by the chairperson or the vice chairperson.

b) The quorum shall be 1/3 of men of the members and two women committee members.

c) The committee shall record proceeding of respective meetings and keep the minutes in their files.

d) The tenure of office, disciplining of committee members, replacements, dismissal of committee members and any other provisions that are not provided for in this PPRR will be in accordance with each clan constitution and the Constitution of the Kumam Elders’ Forum.

37. Referral.Any person aggrieved by the decision of the clan committee at a lower level may refer the matter for consideration to a clan committee at a higher level. Referrals will lie from village clan committee to parish clan committee, from parish clan committee to sub county clan committee, from sub county clan committee to county clan committee and finally from county clan committee to KEF.

Part 9: Miscellaneous.

38. Wrongs for not following the PPRR for any land transaction.

a) After the 24th day of October 2011 when this PPRR comes into effect, any land transaction that does not follow the procedures herein shall be null and void.

b) Any person, family or community responsible for taking land away from the clan for any land transaction without following the procedure laid down in this PPRR shall refund to the village clan committee chairperson and his committee the money received from the transaction which money is to be given back to the other party to the land transaction and the land to be given back to the family from which the land was taken.

c) The village clan committee chairperson and his committee of the person who sold/ gave out land without their consent shall discipline him according to their clan rules.

d) The person, family or community who takes land to transact must return the money to the party from whom s/he received the money if the land transaction is null and void under the PPRR and The Land Act.

e) If a party to the land transaction who received the money cannot be found to return the money to the buyer, the party who paid the money for the land will lose his/her money.

f) The burden of proving that consent for the land transaction was given will be on the party claiming that consent was given and s/he must produce all the documents of consent required by the PPRR.

39. Abuse of land rights of others.

a) Any person who cuts down trees, grass, harvests red and white ants, picks ant hill mushrooms, collects fruits such as shear nuts, mangoes or other wild edible fruits without the consent of the land owners commits a wrong under this PPRR.

b) Consent for section 39(a) is to be given either in writing or verbally when in the presence of witnesses before accessing their property.

c) Any person who commits a wrong under section 39 (a) shall be asked by the village clan committee chairperson and his committee to pay for the property taken at the cost of the prevailing market value and also pay for other damages caused.

d) The payment of damages will be in accordance with each clan rules.

40. Commencement of the PPRR.

a) For purposes of referring to the PPRR for any work or land disputes, the date of commencement of the PPRR is the 24th day of October 2011.

b) Since most of the provisions of the Principles. Practices, Rights and Responsibilities (PPRR) are in use in Kumam communities, it may be used to solve land disputes already registered with them but not to change the decisions made in past cases.

c) After the coming into force of the PPRR, all the Kumam people must abide by the provisions of this PPRR.

41. Amendment of the PPRR.

a) This PPRR shall be reviewed for amendment and change from time to time as and when deemed necessary.

b) The amendment shall be proposed by the Kumam Elders’ Forum committee members to all the active members of the Kumam Elders’ Forum and council of clan heads.

c) Notice of the proposed amendment shall be circulated by the Kumam Elders’ Forum committee to all the active members of the council of clan heads and Kumam Elders’ Forum three months before the meeting scheduled to discuss the amendment, stating clearly the parts to be amended, reasons for amending and the proposed amendment.

d) Three quarters of all the active clan heads and active members of the Kumam Elders’ Forum shall effect the amendment.

e) The committee of the Kumam Elders’ Forum may with the approval of the active clan heads and members of the Kumam Elders’ Forum amend the Schedule to the PPRR.

e. To behave at all times as a good neighbor, and not to allow anyone to do something which would be a nuisance to those living around the land.

f. To return the land with no squatters when this agreement ends g.Not to do anything to the land that will permanently degrade or reduce

the value of the land. E.g. use the land for burial, or cut down big trees.

2. The landlord agrees: a. That the Tenant shall enjoy the Land until the end of the agreement

without any interruption from the Landlord or people he sends. b. If at any time during the agreement the Landlord wishes to sell the land,

he shall give priority to the tenant. c. To provide the Tenant with reasonable notice before any inspection of

the Land.

3. Termination of agreement:

a. The agreement shall end at the expiry of the tenancy. b. Any breach (doing anything that is not allowed) of part or the whole

of this agreement shall entitle the aggrieved party to terminate the agreement.

c. At the end of the tenancy, if the landlord wants to rent the land again and the tenant had obeyed the terms of the agreement, the tenancy agreement will be extended on the same terms or new terms.

4. Dispute resoultion.

If the parties have any dispute pertaining to the Land, the matter should be directed to the customary authorities of both parties as agreed. If there is no agreement the matter should be taken to the clan committees or state court for land, currently the LCs executive committee of the area where the rented land is situated.

Task:

Draw map of the land being rented and include the following: north, south, east and west arrow signs; the length and width in meters of the “stick” used in measurement; any features on land of a permanent nature such as tress, rivers. Map should then be signed at the back by the landlord, tenants, LC, wives, clan leaders. Five (5) copies of the map should be made and one each given to landlord, tenant, L.C1, village clan committee, and 1 registered with the Government sub county chief (recorder) for records.

clans by the Kumam

Elders’ Forum.

The registered Irark clans were

26 and after vetting the total

number of Irarak was 21 clans.

and Inomu clans by the

Kumam Elders’ Forum.

The registered Basere clans

were 4 in number and after

vetting the total number was 6

was 75 clans.Therefore there

were 47 clans that were added

after veting as 100 clans were

registered before veting, and

so a total of 147 clans were

registered.
