TERMS AND CONDITIONS OF SALE

1. Catalog descriptions are guaranteed correct with respect to bold and capitalized portion of description only. Material composition is guaranteed in the case the catalog describes an item of silver, gold, ivory or bronze. This warranty will hold only where an error in such description results in a material difference in monetary value. The terms “attributed to”, “style of”, “manner of”, “possibly by” and the like are terms of opinion but carry no guarantee as to authorship or maker. The intention of the catalog description warranty is to protect bidders from conterfiet and reproduction items erroneously identified as authentic. No other written or verbal representation including advertisements carries this warranty, although statements by the auctioneer at the podium before the sale may be used to modi-fy the catalog description. Claims against the catalog description warrany must be made within 10 days of auction in writing and if disputed must include a written description by an expert acknowledged by auctioneer, supplied within the following 7 days. There is no warranty as to condition. Warranty is limited to the selling price. Otherwise, all sales final.

Though all description and commentary are believed to be correct, neither Auctioneer or Consignor makes any additional warranties or representations of any kind with respect to merchandise. Buyer shall not rely on the Auctioneer, employees, or advertisements in any part, and must rely only on his own inspec-tion and opinions of all items. No employee is authorized to make any warranties, expressed or implied, on behalf of Fairfield Auction, LLC. Any and all claims made to Fairfield Auction, LLC or consignor must be made within 5 days of the auction date.

2. The Auctioneer is acting as agent only and is not responsible for acts of its principals. If any dispute arises, the Auctioneer's word is final.

3. Where the Consignor is indebted to or has a monetary guarantee from Fairfield Auction, LLC, and in certain other instances, Auctioneer may have an interest in the offered lots and the proceeds therefrom other than its commissions, and may bid therefore to protect its own interests. Auctioneer reserves the right to with-draw any lots from the sale or cancel a sale at the Auctioneer's discretion. The Auctioneer reserves the right to reject any bid or eject any person from the premis-es.

4. Fairfield Auction, LLC and it's employees shall not be held liable for any damages or accidents that may result from handling, lifting, moving, loading and pack-ing of purchases. Loading may be offered as a courtesy, but all responsibility for goods shifts to the buyer once the invoice is paid and buyer should take appro-priate measures of care when handling. Some items may not be removed until end of auction due to size, weight or disruption to the auction. Professional mov-ers may be required as a condition of sale for very heavy items such as pianos.

PAYMENT

6. Payment terms are cash, approved check, Visa/MasterCard or wire transfer. Visa/MasterCard payments are accepted in person only with proper identi-fication, and limited to $20,000 per auction. In any case, payment must be made, in full, day of sale for those present and within 5 days for absentee/phone bid-ders, otherwise Auctioneer may resell merchandise at public or private sale and retain 20% deposit as liquidated damages. Auctioneer may, at his discretion, hold purchases until check clears or money order/cashiers checks are verified.

7. A buyer's premium of 15% applies to all sales, except for purchased made through LiveAuctioneers internet broadcast, where the buyer's premium is 18%. The buyer's premium is added to the price knocked down by the Auctioneer. State and local sales taxes are applied to all purchases unless a valid resale number is on file.

8. Absentee bids are accepted. Phone bids are accepted at the Auctioneer's discretion. Fairfield Auction, LLC shall not be held responsible or liable for bids that are missed or otherwise not executed.

9. Bidders not present are required to register for phone/absentee bidding no later than 3pm the day prior to the auction. Phone bidders will be called from the gallery. No incoming calls are taken auction day. As each item is sold the phone bidder’s agent will announce the bid price. Failure to immediately object con-stitutes acknowledgement of the purchase at the announced hammer price plus buyers premium and applicable taxes. Phone bidders should confirm the hammer price after any successful bid.

10. Removal shall be at the expense, liability and risk of the purchaser. All arrangements for removal must be at convenience of Fairfield Auction, LLC. We can suggest names and phone numbers of appropriate firms to assist with delivery. If arrangements can't be made within 20 days of sale, items may be removed and stored at the expense and risk of the buyer. After 20 days a storage fee of $25 per lot plus $10 per day per lot thereafter shall be charged. Auctioneer shall apply any payments to loss, damages, and expense incurred in the resale of goods not payed for in full or removed in the time specified and shall retain any balance as liquidated damages. After 90 days items shall be become property of Fairfield Auction. All items sold AS IS, WHERE IS. ALL SALES FINAL.
