' ASK YOUR OWN LAWYER ' Notice; This column is not to be considered as any legal advice, always ask your own lawyer when you need legal advice.
The stories depicted in this column are commonsensical in approach and are intended for purely entertainment purposes.
Question: I recently got a speeding ticket for doing 100 in a 70 on an Interstate road in
Edgewood Indiana (Madison County). It was around 4:00 in the morning and there were
no other cars on this section of the road. I was not under the influence of any substances.
As I passed an officer parked along the highway, I pulled over before he could pull me
over, I knew I had made a mistake. He gave me a speeding ticket and sent me on my
way. My court date is coming up and I need some advice. I have a prior ticket (failure to
stop or yield) on my record and I would like to know if this would affect me? Also, I
called the Edgewood Courthouse to inquire about the ticket and was told that I would
have to appear in court. The reason they gave was that I was 30 mph over the speed limit
and I could be charged with a misdemeanor. I was wondering the likelihood that I would
be charged and if I will face jail time? I have no criminal record, just the two tickets.
Answer: First of all you need a local attorney’s advice. The charges related to this
ticket are up to the discretion of the prosecutor. He or she will decide whether or not to
charge you with a misdemeanor. The judge will have the discretion as to whether the
prosecutor has provided enough evidence to charge you with a misdemeanor offense. The
judge has broad discretion as to any sentencing that may stem from a guilty decision. The
prosecutor and the court will consider mitigating and aggravating factors to help them
make their decisions. From what you say, you have two aggravating factors: the fact that
you were substantially speeding, and the fact that you do have a prior offense. On the
other hand, you appear to have several mitigating factors: you cooperated with the police,
you only have one prior offense of unrelated driving conduct, it involves no drugs or al-
cohol and you have no criminal history. It is not possible to predict how the prosecutor
will charge you. However, there is a good chance that if you are charged, you could face
a very light or suspended sentence. You may even consider a plea bargain if it is offered.
Be sure, however, that you understand any unintended consequences of a plea bargain,
such as increased insurance rates. Slow down and Good Luck

The Race For the White House
I don't get involved with political viewpoints and I don't intend to do so now.
Mr. & Mrs. Voter, it is time to start considering who you might want to serve as our next
President of the United States.
Democrats and Republicans alike will compete in the Iowa Caucas, but only within
their respective political party since each one is responsible for setting their own rules
for the nomination process. It is a tedious task for politicians from both sides, but it
has remained the first stop in the road to the White House since 1972. Iowa can make
or break a candidate's campaign. In Kentucky, the new 2016 Republican Caucus will take
place on March 5 and the primary election will be held on May 17.
The prelude is set to begin next week, Monday, February 1 in Iowa. The next stop is
New Hampshire for the first primary election to be held on February 9. The following
primaries and caucus events are then strategically orchestrated throughout the spring
and summer months concluding with the primary in Washington D.C. on June 14. The
season of political ads and telephone solicitations will begin. Think of the issues that
concern you as a voter so wise choices can be made.
As Americans, we should be concerned with our health care system, the state of
the economy, and our role as a world leader. We need a reasonably priced and cost
effective health care system, one that is affordable for everyone. Citizens deserve a
low cost, quality health insurance in this country. The American people can no
longer afford the back room deals between Congress and the drug manufacturers that
give pharmacy behemoths the right to price prescription drugs higher in the U.S. than
they sell for in Canada, Mexico, and Europe.
We need good paying jobs to further the American dream of getting ahead, buying
our own home, and educating our children. The large banking monopolies should be
reduced into smaller, more responsive regional banks with no Wall Street associations.
The industrial giants and big businesses should be taxed so they are forced to trim
the exorbitant salaries that are paid to their CEO's and provide a wage increase for
their working class.
The United States needs to continue as the leaders of democracy in the Free World.
Americans have a duty to help other countries achieve independence from tyrannical
forces. We are a Christian nation, one that fosters religious freedom for all people, but
when others seek to destroy us, we must thwart their efforts.
As with the issues that I have expressed, there are many more multiples to consider
as we go to the polls to exercise our inalienable right to do so. It all comes down to this;
who do you believe will do the best job and what is their agenda?

Men Are Just Happier People
What do you expect from such simple creatures? Your last name stays put. The
garage is all yours. Wedding plans take care of themselves. Chocolate is just another snack.
You can wear a white T-shirt to a water park. You can wear NO shirt to a water park. Car
mechanics tell you the truth. You don't have to stop and think of which way to turn a nut on
a bolt. Same work, more pay. Wrinkles add character. Phone conversations are over in 30
seconds flat. You know stuff about tanks.
A five-day vacation requires only one suitcase. You can open all your own jars. You get
extra credit for the slightest act of thoughtfulness. If someone forgets to invite you, he or
she can still be your friend. Two pairs of shoes are more than enough.. You almost never
have strap problems in public You are unable to see wrinkles in your clothes. The same
hairstyle lasts for years, maybe decades. You only have to shave your face & neck. You
can play with toys all your life. One wallet and one pair of shoes -- one color for all
seasons. You can wear shorts no matter how your legs look.No wonder men are happier.
EATING OUT When the bill arrives, Mike, Dave and John will each throw in $20,
even though it's only for $32.50. None of them will have anything smaller and none will
actually admit they want change back. When the girls get their bill, out come the pocket
calculators.
MONEY A man will pay $2 for a $1 item he needs. A woman will pay $1 for a $2
item that she doesn't need but it's on sale.
ARGUMENTS A woman has the last word in any argument. Anything a man says
after that is the beginning of a new argument.
FUTURE A woman worries about the future until she gets a husband. A man never
worries about the future until he gets a wife.
MARRIAGE A woman marries a man expecting he will change, but he doesn't.
A man marries a woman expecting that she won't change, but she does.
OFFSPRING Ah, children. A woman knows all about her children. She knows about
dentist appointments and romances, best friends, favorite foods, secret fears and hopes and
dreams. A man is vaguely aware of some short people living in the house.
THOUGHT FOR THE DAY: A married man should forget about his past mistakes.
There's no use in two people remembering the same thing! Get the picture.

Super Bowl 50 Sunday, Feb. 7 @ 6:30pm on CBS Carolina Panthers vs. Denver Broncos
And the winner is: It all comes down to your preference as to who has the
best QB. Who will play well enough to win the game? Carolina has a very
young Cam Newton, who has proven that he has all the right stuff, can throw
the ball and run extremely well. He has earned the right to be considered as an
elite quarterback. On the other hand, Denver has a 39 year old Peyton Manning,
who has already been to the Super Bowl three times, sports 1 ring, but has re-
cently had injury problems. He is also an elite quarterback who knows how to
win with style. He is clever, smart, talented, plus he has been there before. Both
teams are capable of winning this game, however Carolina opened as a 4 pt.
favorite.
The Panthers play aggressive and deliberate with Newton at the helm. Their
defense is pretty darn good, as they showed when they demolished Arizona this
past Sunday. As it stands now, Manning is the one with all the records, and
Newton is the one chasing his dream. Food for thought. If Carolina wins,
Newton could become one of the few elite players to win a college national
championship, a Heisman, a Super Bowl and an MVP. If the Panthers play the
way they did last Sunday night, the question won't be if the young gun has a
chance, it will be how many MVPs and championships they will likely win
before he's Peyton Manning's age.
I„m a Peyton Manning fan for sure, I also like Newton as well, so if
Manning can play his game of finesse, and Newton plays his game of brawn,
this could be the Super Bowl that everyone remembers, # 50, one for the ages.
Kentucky Basketball Seems To Be Righting The Ship I am sure that Cat fans have heard Neil Young‟s song from the 1970‟s,
Alabama. In the song he sings, “Your Cadillac has a wheel in the ditch and one
on the track.” That described Kentucky basketball last week after the loss at
Auburn. Fast forward one week and the Cats have morphed into what they
should be, a team that plays with energy, talent and most of all HEART. What a
difference one week can make in the life of the SEC race.
Some fans are questioning Coach Cal‟s decision about not playing Skal in
the Vandy game after he looked and played so well against the Razorbacks. I
say this, he is the coach and knows when Skal can be a factor in a particular
game, so leave it alone folks. He will have his chance, that‟s for sure.
Next up: Kentucky vs. Kansas in Allen Fieldhouse, Jan. 30 at 6:00 pm - TV-
ESPN. Remember, Kansas has slipped and lost some games lately. Go Cats
Don't Mess With Texas
Bubba was from Texas ... And he needed a loan, So he walked into a
bank in New York City and asked for a short term personal loan.
“Officer,” as he said, I am going to Paris France for an International Red-
neck Festival for two weeks and need to borrow $5,000. I am not a deposi-
tor of your bank.
The bank officer told him that the bank would need some form of security
for the loan, so the Redneck handed over the keys to his new Ferrari. The
car was parked on the street in front of the bank. Bubba produced the title and everything
checked out. The loan officer agreed to hold the car as collateral for the loan and apolo-
gized for having to charge 12% interest. He signed the papers and left the establishment
for the airport.
Later, the bank's president and its officers all enjoyed a good laugh at the Redneck from
the Texas for using a $250,000 Ferrari as collateral for a $5,000 loan. An employee of the
bank then drove the Ferrari into the bank's private underground garage and parked it.
Two weeks later Bubba returned and repaid the $5,000 and the interest of $23.07. The
loan officer said, "Sir, we are very happy to have had your business, and this transaction
has worked out very nicely, but we are a little puzzled.
While you were away, we checked you out on Dunn & Bradstreet and found that you are
a distinguished alumni from Texas A & M, a highly sophisticated investor and
multi-millionaire oil man with real estate and financial interests all over the world. Your
investments include a large number of wind turbines around Sweetwater, Texas. What
puzzles us is, why would you bother to borrow $5,000?"
The good 'ole boy replied, "Where else in New York City can I park
my car for two weeks for only $23.07 and expect it to be there when I
return?"
His name was BUBBA.... Keep an eye on those Texas boys! Just
because they look & talk funny doesn‟t mean they are stupid !!!

Spotlight on Black History Month ~ Vivien T. Thomas
Vivien T. Thomas was born in New Iberia,
Louisiana in 1910, the son of a carpenter. His
family moved to Nashville, where Vivien graduated
with honors from Pearl High School. Later in 1929
he was preparing for college & medical school
when his savings for tuition disappeared following
the October stock market crash. With no means for
education, he took a job as a laboratory technician
at Vanderbilt University's medical school, working
for Dr. Alfred Blalock.
Thomas still hoped to save tuition money to earn
his own medical degree, but the Great Depression
worsened & the research with Blalock grew. Soon
Thomas was working sixteen hours a day in the
laboratory, performing operations on animals that
would advance Blalock's studies of high blood
pressure & traumatic shock. For his work, Thomas
invented a heavy spring device that could apply
varying levels of pressure. Blalock & Thomas' work
at Vanderbilt created a new understanding of shock,
showing that shock was linked to a loss of fluid &
blood volume.
When Blalock became chief surgeon at Johns Hopkins University's medical school in
1941, he insisted that Vivien Thomas be hired to join his team there. At Johns Hopkins,
Thomas & Blalock pioneered the field of heart surgery with a procedure to alleviate a
congenital heart defect, the Tetralogy of Fallot ("blue baby syndrome"). Sufferers faced
brutally short life expectancies. Working with cardiologist Helen Taussig, Blalock &
Thomas developed an operation that would deliver more oxygen to the blood & relieve
the constriction caused by the heart defect. Thomas tested the procedure -- a refinement of
one that they had created in laboratory dogs -- on animals to make sure it would work. In
1944, with Thomas advising Blalock, the first "blue baby" operation was successfully
performed on 15-month-old Eileen Saxon.
Thomas was a key partner in hundreds of "blue baby" operations, performing pre-&
post-operation procedures on patients as well as advising in the operating room. At the
same time, he continued to manage Blalock's ongoing laboratory research. As head of
the Hopkins surgical research laboratory, Thomas also taught a generation of surgeons
& lab technicians. The residents & research fellows who worked with Thomas testified
to his unique abilities & his dedication.

This Week: Kykuit ~ The John D. Rockefeller Estate
The industrial billionaires of turn-of-the-century America
were referred to as “Robber Barons” comparing them to the
highway men & bands of robbers that plundered passing
merchant wagons. The name suggests that these men made
their money by exploiting workers in America & that their
massive wealth was an accumulation of the money that
they looted from the American people. The term was
applied to men like Andrew Carnegie, John D. Rockefeller &
Cornelius Vanderbilt who monopolized a modern industry.
Over the next few weeks, we will be visiting some of the
notorious homes of the "Robber Barons."
John Davison Rockefeller (1839-1937) was the
founder & former chairman of the Standard Oil
Company, founder of the University of Chicago &
Rockefeller University, founder of the General Education
Board, & the founder of the Rockefeller Foundation. He
was a generous philanthropist & business magnate that
revolutionized the petroleum industry. From his humble
beginnings, the Standard Oil Company refined 90
percent of the oil produced in America by 1880. His
foundations pioneered the development of medical
research & were instrumental in the eradication of
hookworm & yellow fever.
JDF spent the last decades of his life at his Kykuit Estate in Sleepy Hollow, NY. The
Classical Revival-style villa located on 249 acres was completed in 1913 for the richest
man in America. The six story Indiana limestone house consists of 40 rooms designed
by Chester Holmes Aldrich & William Adams Delano. Kykuit, Dutch for "lookout", is
situated on the highest point in the hamlet of Pocantico Hills, overlooking the Hudson
River at Tappan Zee. It has a view of the New York City skyline 25 miles to the south.
The opulent landscape designed by William Welles Bosworth is complete with a 30
foot high Oceanus fountain just inside the gates, a copy of the famous original in the
Boboli Gardens of France. The dramatic grounds feature formal gardens in a variety of
styles, large scale sculptures, & pavilions.
In later years, Kykuit was the home of his son, JDR
Jr. & grandson, Nelson Rockefeller, four time
governor of New York & vice president under Gerald
Ford. Pieces of Nelson's art collection on display
include works by Louise Nevelson, David Smith,
Pablo Picasso, & Henry Moore.
Kykuit was designated a National Historic
Landmark in 1976. In 1979, Nelson Rockefeller
bequethed upon his death his 1/3 interest in the estate
to the National Trust for Historic Preservation. As a result, the estate is now open to the
public for tours conducted by Historic Hudson Valley. The extraordinary landmark has
been continuously & meticulously maintained for more than 100 years.
