countycandidates emerge to replace Woolsey if she retires in 2012 Rumor is, Rep. lynn Woolsey will not seek re-election in 2012. the list of those ready to fill the position is getting longer with each passing day.

Prospective candidates lining up, so far, are Assemblyman Jared huffman, D-san Rafael; state sen. noreen evans, D-santa Rosa; Marin county supervisor susan Adams; sonoma county supervisor shirlee Zane.

one of the first in line was huffman, who will be termed out in 2014. Both Marin supervisor charles McGlashan and san Rafael councilman Damon connolly have indicated they are interested in stepping into huffman’s seat when he leaves. McGlashan has also said he is interested in an appointment to the california Public utilities commission. supervisor susan Adams expressed interest in Woolsey’s congressional seat as well. Marin supervisors approve reduced pension benefits for new hirestuesday the board of supervisors approved an agreement that cuts pension benefits for new hires. in additionthe deal delays the retiring age to 61.

According to officials the agreement with the Marin Association of Public employees covering 1,400 workers will eventually save taxpayers more than $1.1 million a year.

in the plan a new reduced pension “tier” will apply to new employees. new hires will be eligible for a pension amounting to 2 percent of their three-year average salary, for every year of service — when they are 61 years3 months old. Many employees now get 2 percent at age 55.

county supervisors have been criticized for approving pension and retiree health packages over the years that have left taxpayers with an unfunded liability of anywhere from $700 million to more than $2 billion.

ARE THERE

VOTES?

Governor Jerry Brown unveiled his budget plan this week which proposes large cuts to nearly all state programs while hopeful Californians will agree to extend previous temporary tax hikes for an additional five years that are set to expire mid-2011.

Brown’s proposed spending plan eliminates an 18-month budget gap estimated at $25.4 billion comprised of a current year shortfall of $8.2 billion and a budget year shortfall of $17.2 billion. overall, the budget proposal includes $12.5 billion in spending reductions, $12 billion in tax extensions and modifications, $1.9 billion in other budgetary methods to close the gap and provide for a $1 billion reserve. A combination of $26.4 billion package is needed in order to also provide a $1 billion reserve. In addition, the deficit will grow to $26.6 billion if the proposed sale of state office buildings, blocked by court order, does not proceed, requiring the budget to deficit to grow to $27.6 billion in order to have a reserve.

The budget also proposes to change the role that state and local governments play in local development activities by eliminating state tax benefits for enterprise zones and phasing out the current funding mechanism for redevelopment agencies. This will return billions in property tax revenues to schools, cities and counties and help pay for public safety, education and other services.requires a two-thirds vote threshold for any tax measures occurring after october of 2009.

Given GoP opposition to tax hikes, there are contingency plans to use an obscure state law to bypass the necessary two-thirds threshold and thus the need for Republican support to place the tax question on the ballot.

Brown is quoted as saying it would be "much better if this is a bipartisan effort" but left the door to such a maneuver open. The Senate Republic leader said that "zero" members of his caucus would cast votes under the current proposal and Assembly Republicans stand united " against the plan to "place the same tax increases that voters overwhelmingly rejected less than two years ago back on the ballot."

The game is on and a high-stakes game it is. Much could happen and changes will made before an actual vote on a budget plan. Brown is doing his best by staying in constant contact with all four legislative caucus. it is still early to predict if he can unite the legislature to complete the budget process quickly in his first months as Governor and then convince voters to give the state more of their money. Failure of the voters to approve an extension of taxes will require even more reductions and a vote on a new budget plan.

Chriss Daniels is our new Marketing Publicist. Chriss handles the Weekly Bulletin and all social media, web development for MBA. Chriss has twelve years in marketing and advertising. She also is a mother of a 10 year old daughter named Mia. Chriss owns and operates a Day Spa one block from the town square in Sonoma called O’Mai Day Spa.

Kellie Buono joined the staff as our receptionist and administrative assistant. She was born and raised in San Francisco, and has been in the administration field for a number of years working and interact-ing with clients. She has three older sisters, is married and has a lovely daughter. In her spare time she enjoys playing volleyball, Irish dancing, and doing fun activities with family and friends. She is here to help guide and assist our membership as much as possible.

Paula Krause has been dedicated to the organization and staff for 23 years. She has a wealth of historical information and is always willing to share. Paula began her career as the bulletin editor, moving into insurance administration then Office Manager.

Diane Van Renselaar has been assisting members with their Plan Room needs since 1987. She is a graduate of Dominican College, a former U.S. Air Force “brat” and the widow of a na-val aviator. Her commitment to an accounting for America’s abandoned prisoners of war in Southeast Asia has defined her life and consumes much of her spare time. She is also a writer and an award-winning artist who enjoys skiingmargaritas gardening, breeding koi and herding cats.

Klif Knoles has been with the Marin Builders Association since October 2005. Klif was a member of the Association for over thirty (30) years, and also served on the Board of Directors. He is a past President of the MBA Board, 2003 – 2004.Klif is a third generation Marin resident and fourth genera-tion in the construction industry, making his home in the City of Novato. He has been actively involved in Rotary and is a director on the Marin Space board. He previously served as a Director for Whistlestop and on the Marin Economic Com-mission. Klif has been appointed by the Marin County Board of Supervisors to the Marin County Building Board of Appeals and the Access Board of Appeals. He and his wife, Heidy, have two adult sons, Terrence and Nick.

Conditions on the Job for Construction Workers Are More Dangerous now Than at Any Time of the year as Winter Brings Wet, Freezing Weather, and the Serious need for Cold Weather Safety

Precautions

Cold weather work can be hazardous to anyone, but it’s especially dangerous to construction workers and others who work outdoors. Employers must take extra precautions to protect workers from cold weather-related injuries, according to the occupational Safety and health Administration (oShA). To help, oShA reissues warnings each year about the dangers of working in cold temperatures.

Specific conditions that can result from prolonged exposure to the cold include frostbite and hypothermia.

With the arrival of cold weather to new york, oShA is reminding both employers and workers to take necessary precautions. Tips include the importance of:

•RECOGNIZING THE ENVIRONMENTAL AND WORKPLACE CONDITIONS THAT MAY BE DANGEROUS AND THEN IMPROVING THEM.

•LEARNING THE SIGNS AND SYMPTOMS OF ILLNESSES AND INJURIES CAUSED BY THE COLD AND HOW TO PERFORM EMERGENCY CARE

•TRAINING EMPLOYEES ABOUT THE ILLNESSES AND INJURIES THAT CAN RESULT FROM THE COLD WEATHER AND FREEZING CONDITIONS

•USING THE BUDDY SYSTEM, WHICH MEANS CONSTRUCTION WORKERS SHOULD WORK IN PAIRS. INDIVIDUALS WORKING ALONE CAN OFTEN BE UNAWARE OF THEIR WORSENING HYPOTHERMIA OR OTHER CONDITION, RESULTING IN AN INABILITY TO GET HELP.

•MONITORING YOURSELF. FOR EXAMPLE, AVOIDING EXHAUSTION BECAUSE MORE ENERGY IS NEEDED TO KEEP MUSCLES WARM.

•ENCOURAGING EMPLOYEES/CO-WORKERS TO WEAR THE CORRECT CLOTHING WHILE WORKING IN COLD, WET AND WINDY CONDITIONS. LEARNING TO LAYER IS CRITICAL. CLOTHES CAN BE ADJUSTED TO CHANGING WEATHER AND JOB-RELATED

•ENSURING THAT WORK SITES ARE CHECKED TO MAKE SURE UNSAFE CONDITIONS LIKE SNOW AND ICE ARE CLEARED FROM THE AREAS OF THE SITES WHERE CONSTRUCTION CREWS ARE WORKING.

By a majority vote following a public hearing, the following revisions to a Title 8 safety order have been adopted by Cal/OSH Standards Board. They have been approved by the office of Administrative Law and now are in the California Code of Regulations.

MAXiMUM ALLoWABLE LoAD: Revisions to Construction Safety orders §1709 were heard at the Aug. 19, 2010, public hearing; adopted nov. 18, 2010; and are effective Jan. 28, 2011.

The revisions were promulgated in response to a Cal/oSh Appeals Board decision in DPS Plastering, inc. An administrative law judge in April 2008 dismissed a serious violation and $14,400 penalty after a worker was seriously injured when a suspended ceiling collapsed on him.

The safety order prohibits building structures, temporary supports or scaffolding to be loaded in excess of their capacity. The worker was injured while applying the second of three coats of plaster to the suspend-ed ceiling.

The ALJ ruled that to demonstrate a violation, DoSh was required to establish the actual designed capacity of the ceiling support system and the actual load the system was subjected to at the time of the incident. The division did neither, the judge said.

Moreover, “designed capacity” is not defined in Title 8, and the ALJ used the dictionary definition – the capacity of the ceiling as originally designed by the architect.

As Standards Board staff put it, the lack of a definition of “designed capacity” led the ALJ to use “extrinsic” definitions that caused evidentiary problems for the division.

The text of the revision states:“no building, structure, or part thereof, or any temporary support of scaffolding in connection therewith

shall be loaded in excess of its designed capacity subjected to any load beyond its design load strength, unless the employer determines, based on information received from a qualified person who is qualified in structural design, that the structure or portion of the structure is capable of safely supporting the load. For the purpose of subsection (a), the design load strength refers to the load bearing capacity of a structural

member(s) computed on the basis of the allowable stresses which are assumed in the design.” 8

Republicans are Standing Firm

i had breakfast earlier this week with the Assembly and Senate Republicans. The main point of discussion was the governor's budget proposal. The bottom line, they're not going to provide Any support to help the governor nor the Democrats in either house to obtain the two thirds vote to put the five year sales tax extension on the ballot; nor are they going to provide any help on marshalling the proposed budget through the process.

They are, however, interested in looking at some pos-sible "horse trades." in the forefront of these could be the rollback of AB 32 for five years (which was Prop 23 on the november ballot which lost, big time), along with rollbacks of other onerous rules and regulations that are killing business' recovery in California.

Between the Republicans "digging in" and the Democrats in his own party preparing to fight the proposed cutbacks in welfare and other social programs, Brown is in for a huge battle. And, he has said he wants everything resolved within 6 weeks so the tax extension can make the June ballot! i don't want to be a naysayer, but Brown certainly has his work cut out!

By the way, the governor was having lunch that day with both Republican Caucuses to talk about the budget and possible avenues of working together. you’ve absolutely got to give him credit for realizing that he has to reach out to both sides of the aisle.

This is a tremendous contrast to Arnold Schwarzenegger who never even learned the names of the Republicans in either house! How bad was it? The Republicans had a reception last year that Schwarzenegger attended and ALL of the members had to wear name tags!!!

For members of the Legislature, there’s many things to hate in the proposed budget which may ultimately lead to all finding common ground to get through the mess together - but then, maybe not!

if he is exempt from Worker’s compensation insurance, but still “employs a non-family member” you could be liable if they get hurt -- even if you are unaware. Ask to see a copy of the contractor’s Worker’s comp certificate and check carefully with the cslB that it is still valid. in reality, chances are to do a complete tear-off and re-roofing, there will be at least one employee who should be covered.

Whether a “B” hires a “c-39”, or you hire a roofer directly, please note that all “c-39” contractors must carry adequate Worker’s compensation insurance coverage for their employees (or a certificate of self-insurance). they cannot file an “exemption”.

Q: i have a “c-17” (Glazing) license that i just activated. the thing is that i’m setting up a commercial glass shop for a good friend of mine that started a company out-of-state but wants to do work in california.

What is the best way to get my license in his name, or make me a Responsible Managing employee (RMe) or a Respon-sible Managing officer (RMo)? i’ve been trying to under-stand the contractors state license Board forms, but it only confuses the hell out of me.

A: if you want to help your friend to get a contractor’s li-cense in cA, have him first decide how he wants to conduct business (corporation, partnership or sole owner). once this decision is made, you’ll be able to better determine your options on becoming his Qualifier. For instance, as a sole owner, you can only be a RMe. if a corporation, you have the option of being a RMe or RMo. if you form a partnership, you can be the “Qualifying partner” or RMe.

the cslB paperwork and overall licensing process can often be confusing. For instance, depending on your title and percentage of ownership, you may need to inActiVAte the “c-17” license you just re-activated. call me and i’ll be happy to discuss your options and help you navigate through the cslB forms.

Q: I found this answer on Capitol Services web site and I had a similar question about contractors doing roofs. Your response in part was as follows: “…However, based on the stated facts, the contractor does not appear to have the correct license. To perform roofing ONLY on a given project, a General Building contractor should either hold a “C-39” classification or hire a licensed “C-39” subcontractor”

So, are you saying that if I hire a contractor who only has a “B” license and he doesn’t use a sub with a “C-39” license, will my roof be illegal? We are having a roof put on our house in Los Angeles County soon and I’m in the process of get-ting bids. If the contractor’s license states he is exempt from Worker’s Comp because he states all his employees are fam-ily, then if he does have someone (who is not family) work on my house and I don’t know it, could I be liable if they get hurt?

A: By definition, a General building contractor should be handling two or more unrelated trades on a given project or subcontract the work to a licensed specialty contractor (in your case a “c-39” roofing contractor). if you were to use a “B” who is performing the work, it would not mean your roof would be ‘illegal’, only that the contractor may be working improperly.
