The meeting was called to order by Dr» Charles W, Armstrong, president» Drs ~ Thomas Leslie Lee, Roy MoKnight, M. Bonner, Paul Parker, A ~ Pittman, and Paul G, Parker and Ivan Procter vrere present' The secretary discussed many items that vrere to come before the board during its three day meeting» The seoretary brought up the matter of employing an attorney on an annual basis for the State Medioal Society and the State Board of Medioal Examiners as requested at a reoent meeting of the executive committee of the State Medical Society» The board appointed the seoretary as a committee of one Co meet with the execuCive committee of the State Society to decide upon the attorney and amount of salary. The medioal sooiety oommittee reoently appointed by President Paul Whitaker oonsists of Drs ~ Hubert Hayvrood, Rosooe McMillan and Ivan Procter» A resolution was adopted directing the seoretary to write Dr. Roscoe MoMillan~ Secretary of the State Society~ asking him to forward a letter to eaoh county medioal society, informing the membership of the relationship of the State Board of Medical Examiners to organized medicine in North Caroli. na and its function in the case of irregular practioe or aotion on the part of Pysioians; and further requesting that these letters be read at a meeting of each county medical society» The following is a letter from Dr. McMil lan: "TO SECRETARIES OF THE COUNTY MEDICAL SOCIETIES: Dear Doctors: July 5, leeS. After hearing the oase in question~ if the State Board ofMedioal Examiners feels that the facts justify a continuaticn,it will in tuxn make oharges, as an authorized state agent~ againstthe individual ~ These oharges will then be turned over to theAttorney General After reviewing them, if he feels that thecharges are justifiable, he will turn the matter over to thesolicitor of that district for prosecuti one

Dr. Rov McKnight moved that the North Carolina State Boardof Medical Examiners decline to give any more examinations outsideof the state The motion was duly seoonded and. passed

The seoretary and treasurer of the board presented a financialstatement which was accepted by the president

There was a discussion as to whether or not the seoretary would

require an additional letter of verification from the secretary ofthe original licensing board and the membership agreed that this bedonee

The matter of Lt. Moffitt Ko Holler having passed Part I~ butno evidence found in the records, was disoussed. The board was

unable to take action on this matter without further evidenoe. Lt.Holler inquired if his commission in the I'&avy would give him satis-factory oredentials for lioense ~ The answer from the board was "no" ~

The meeting was adjourned.I

Dr ~ Laws on P, Barnes was granted a license,There was much disoussion in regard to Dri Emil Boehm, The

applicant was quizzed as to his failure to have oounty medical societyaffiliation at his previous home License was refused,

Dri C ~ R. Deeds had exoellent reoommendations and high honorsin the profession, but graduated from a grade B schools The boardwas strongly inclined to grant him a license on his attainmentsbut postponed aotion until the July meeting+

Dr. Lo H. Dunham was interviewedo He was questioned as to hislack of county medical society affiliation at his previous location+His application was declined The follov~ing morning Dro 74 Go Cheves,State~s Prison physician, and Dr. Alexander webb~ State Hospitalsurgeon, both appeared in Dr. Dunham's behalf. That on or about 1944 the said Dr» Richard C ~ Baker did treat BealDavis, Hoberdel, N» C ~ for hemorrhoids by injeotion treatment ~

That on or about May 31, 1945, the said Dr. Richard C ~ Baker didprescribe for Mrs ~ Nettie Paul~ Pee Dee Mill No» 3 some medicationin the form of tablets ~

That on or about May 24, 1945, the said Dr» Richard C ~ Baker did givea prescription to the L» G ~ Fax Drug Company for Miss Quick prescrip-tion 7',."-.520-015-B, the same conta"ning sulfathiazole, 5 grain tablets ~

Armstrong.Mri Moore&a testimony was as follows:,"-He (Dr+ B ker) was called to my wife Thursday night~ July 26, 1942.I was at work& My father came to me at work and said my wife hadpneumonia ~ Medicine had been secured~ V1hen I arrived home, I didnot know what the medicine was ~ It was large white tablets ~ The

following morning, Dre Baker came out to the house and I was there&

He made the statement that it was sulfathiazole, 7&ether he 'brought

it or my father, I don't know but I do knm Dr Baker brought:tabletslater ~ He again said it was sulfathiazole ~ Antiphlogistin on theohest was the only other medioine used. I paid him $4i00 for eaohtrip. I paid him cash snd have no receipt Dr Baker broughttabletw and I asked him what they were and how much they were and he

said sixty cents ~ This was added on my bill+ He never sent me a bi3.1,My wife died August 10th~ 1942. Dr. Long was ca3.led in for consulta-tion on Sunday before she died on Monday morning He examined my

wife "Dr, Long interrupted here to say that his diagnosis was pneumonia

and that he thought it was too late to take her to the hospital,Dr Long saw the tahlets r, Baker was giving Mr, Moore's wife and

said he thought they were sulfathiazole ~

Mr. Moore oontinued: "On August 6th her pneumonia was broken andclearinga!!!!ay. Dro Baker said he wouldn't be back on the 7th unlesscalled but would come back on the 8th' My wife had her first con-vulsion on August 9th and Dr. Baker suggested using a drug to begiven only by a nurse. Vfe went to the hospital and couldn't get anurse but got a praotical nurse, A few minutes after we arrived withthe nurse Dr. Baker came backs IVhen he le ft the house~ he had beengone only a few minutes, we oalled him back because my wife was

having another cnnvulsion Dri Baker oame back and said only chancewas to take her to the hospital He left and said he would be backin a few m.'nutesi In about five minutes he came back with an ambulanoe

and carried her to the hospital s!;round 6:30 in the p, M ~ She liveduntil 20 minutes of 7 o' clock Monday morning's After my wife was

admitted to the hospital, Dr, B ker told Dr. James what he had done and

Ehringhaus having called the secretary of the Board of MedicalExaminers on the telephone stating that he advised his clientnot to appear. His advice to his client was based upon hisbelief that the aecretazy of the Board of Medioal Examinerswas without jurisdiction and had no right' to summons his clientfor such a hearing»

After hearing the evidence the State Bm. rd of Medicalashram-'nera adopted the following resolution: "Resolved that theState Board of Medioal Exam-. ners having heard the evidence againstRicha rd C ~ Bake r, os te opath, believes that Dr. Bake r i s practisingmedicine without a license ~ The State Board of Medical Examinershereby request the Attorney General of the State of North Carolinato prefer ohargea against Baker and to prosecute the sam@, "

Dr. Hooker vraa asked if he cared to make any statement ~ Hisreply vraa, "I have never been a pansy»" Dr ~ Hooker stated thathe was addicted to the use of alcohol and vras arrested while drunkin Chapel Hill» Furthermore that he did not Chink he had doneanythi. ng Co justify revocation of his license unless drinkingvhiskey justified it» Dr. Hooker stated that he signed a con-fession of Che crime vrith which he was charged; Chat his sign-ing was not under duress but'on the promise of oertain ChapelHill citizens and Mr» 7/illiam Murdock~ the solicitor of thatdistrict~ who stated that if he would sign the confession~ se3.1all of his real estate, and olose his office, there would be noprosecution. Following this Mr» Murdook went into the unitedStates Navy and Judge R» H» Sykea followed him as prosecutor»At the time of the signing of the confession the defendant statedChat his brother» brother-in-law, and his attorney were present,who all advised him to sign. The defendant stated that it wassuggested at the time of his trial i.n Orange County that he re-pudiate the confession, but he refused to do so because it waanot signed under duress ~

Dr» Thomas Leslie Lee moved that the license of Dr. Hookerbe revoked baaed upon his conviction in the Orange County Courtof a crime a~inst nature, the conviction being based upon thesigned confession of Che defendant. The motion was seconded byDr, Paul G» Parker and passed.
