Please find attached the revised plan for the above Consent application. Please note the following minor

revisions to the original plan:

1 A. The Lot frontages have been revised slightly. Lot 2 has been widened by 1.39m and Lot 1 has

been narrowed by the same amount. This change was required to satisfy the proposed location of

the driveway access to Lot 2, requiring a 1m clearance to the existing street pole n the boulevard.

B. The Lot Areas have been recalculated as a result of Revision 1: Lot 2 is 960.24sm. and Lot 1 is now

1,114.47 sm.

2. The proposed driveway locations are shown to satisfy Engineering comments. The proposed driveway

access widths meet zoning and engineering standards and can accommodate future siting of dwellings

at Site Control application, as required by the Planning department for building permit review.

I have submitted a copy of this letter to Mr. Santini in Engineering for his review. Also, please note

that I have spoken with Ms. Liz Fraser in Forestry who confirmed that a Tree Inventory and Tree

preservation Plan will be required at the time of Site Plan Control, prior to getting any building permits

for this site.

This item is scheduled for Aprill9, 2012 Committee of Adjustment meeting. We would appreciate no further delays in processing this application. Thank You.

On March 7, 2012 an e-mail was received from Frank Greco, the agent requesting that item 6, File No. 8014/12 FRANK GRECO, PASQUALINO MARCARIO, JASON MONACO AND NIKOLAOS TSIMIDIS, be ADJOURNED to the April 19, 2012 meeting to allow time to address the Engineering Department comments.

I had a chance to speak with Otello Santini from Eng Dept. We agreed that he can review our plan once we get him the info that adresses his comments in his comments to Committee re our severance. Our surveyor and civil engineer will get the plans to address his comments in the next 2-3 weeks for Eng dept's further review.

In light of the above:

I respectfully request that our Consent application #8014/12 be adjourned to the April 19 Committee of Adjustment date so that we may address the comments by Engineering staff and any other comments that we receive from other departments. Please confirm receipt of this request and if there is any concerns with granting this request. Please advise if I need to repost any sign or notice on the property.

The Owner is requesting permission to create a 1182.8m2

residential lot and retain a 962.05m2 residential lot. The severed and retained lands comply with the minimum lot frontage and lot area requirements stipulated by By-law 1-88.

The subject lands are designated "Mainstreet Commercial" by OPA #601 (Kieinburg - Nashville Community Plan), as amended by OPA #633. The subject lands are also designated "Low Rise Mixed Use" by the City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board (OMB). The proposal conforms to the policies of the Official Plans.

There is an existing dwelling located on the subject lands. The dwelling is Designated Part V under the Ontario Heritage Act and is part of the Kleinburg - Nashville Heritage Conservation District. The existing dwelling shall be demolished prior to a certificate of consent being granted. The Owner has already obtained a Heritage Permit (HP.2008.005.00) from Vaughan Cultural Services for the demolition of the existing dwelling.

The Development Planning Department is of the opinion that the proposal meets the intent of the Official Plan and the consent criteria stipulated in Section 51 (24) of the Planning Act.

The Owner is advised that new individual single detached dwellings located within the Kleinburg - Nashville Heritage Conservation District shall be subject to Site Plan Control. Through the Site Plan process, building elevations, access and driveway locations, site servicing, etc., will be reviewed.

A site visit was conducted on March 5, 2012. Please note, a minimum of a 1.0 metre clearance is required at from the edge of any driveway access. In addition, the Owner should be aware the subject lands, which are located adjacent to an 081 zone, may be subject to the further zoning requirements under the 081 zone (i.e. minimum setback requirements). Furthermore, the Committee of Adjustment should circulate the above noted Consent Application to the Parks Forestry Operations Department for further review/comments with respect to the impact of the removal of the existing trees located on the subject lands.

As such new construction, additions, demolitions and changes to the exterior of buildings and properties within Heritage Districts require approval of a Heritage Permit application in addition to other City permits such as Building Permits or Planning Application approvals. Proposed changes to properties designated within heritage conservation districts must be in keeping with the heritage character of the building, the historical streetscape and must be in conformance with the heritage district plan and design guidelines.

Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation), a. permit is required from the TACA prior to any of the following works taking place:

a) str~ightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland;

b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

Development is defined as:

i) the construction, reconstruction, erection or placing of a building or structure of any kind, ii) any change to a building or structure that would have the effect of altering the use or potential use

of the building or structure, increasing the size of the building or structure or increasing the number of dwelling units in the building or structure,

iii) site grading, iv) the temporary or permanent placing, dumping or removal of any material, originating on the site

or elsewhere.

In addition, the TRCA's Valley and Stream Corridor Management Program (VSCMP) sets out development guidelines for properties influenced by valley and stream corridors. The overall objective of the VSCMP policies is to prevent-new development from occurring within areaS that may introduce risk to life and

property associated with flooding, erosion, and slope stability, or that is not compatible with the protection of these areas in their natural state. VSCMP policies define the valley and stream corridor boundary by the greater of the long-term-stable top-of-bank (where there is a well-defined feat\,lre} plus 1 0 metres inland, or the flood plain {where there is no valley feature) plus 10 metres inland. The corridor boundary is also extended to include any significant adjacent vegetation. To this end, please be advised that no new development is permitted within the boundaries or ~alley and stream corridors.

Application-Specific Comments · Sased upon a site visit conducted by TRCA staff on February 28, 201 2, the subject property is directly adjacent to the valley and stream corridor of a tributary of the Main Humber River.

We note that the majority of the slope along the northwestern property boundary is relatively gentle with only a few localized steeper areas. We further note that the slope Is relatively shallow with a maximum depth of approximately 3 metres.

TRCA staff are generally satisfied that the proposed retained lot is located in an area where there are no significant natural features or hazards and is sufficiently away from the valley wall and can be considered to be o~ide of the valley feature. On this basis, TRCA staff are satisfied that the portion of the subject lands within the valley corridor will not be fragmented.

However, the newly created lot would rernain within a TRCA Regulated Area and partially within, the valley system. As such, the proposed redevelopment of the riew lot will require a· permit under Ontario Regulation 166/06. Please note that the redevelopment of the new lot should not l'esult in an increased encroachment towards the slope over the existing conditions and the structural setback from the top of the minor slope of the existing dwelling should be maintained. ·

Recommendations _ In light of the above, TRCA staff have no objections to the above noted consent application, as submitted subject to the following conditions: .

1. · The applicant submit the consent application fee of $1,200 payable to the Toronto and Region Conservation Authority.

However, please be advised that all future development proposals for the severed lands should be circulated to the TRCA for our review and approval prior to any works taking place. ·

Fees By copy of this letter; the applicant ·is advised that the TRCA has implemented a fee schedule for our planning application review services. This application is subject to a $1 ,200 consent application review (minor) fee which has been included as a condition for our clearance of this application. The applicant is responsible for fee payment and should forward the application fee to this office as soon as possible.
