MEETING OF THE BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA The Pinehurst Hotel, Pinehurst, North Carolina May 19-22, 1974 The Board of Medical Examiners of the State of North Carolina met at The Pinehurst Hotel, Pinehurst, North Carolina, May 19-22, 1974 for the purpose of interviewing applications for license by endorsement of credentials and other business. Sunday, May 19 The Board convened for business. Drs. Joseph W. Hooper, Jr. , President, Charles B. Wilkerson, Jr. , Secretary-Treasurer, Frank Edmondson, Bryant L. Galusha, Cornelius T. Partrick, E. Wilson Staub and Vernon W. Taylor, Jr. were present. Also present were Mr. Bryant D. Paris, Jr. , Executive Secretary, Mrs. B. Joe Cooke and Mrs. Diane Freeman. RE: Dr Nabil S Malek consideration for licensure Dr. Trevor Hughes and Dr. Joseph Patterson appeared to request the Board to consider letting Dr. Malek apply for license by endorsement of credentials in North Carolina although he has not taken the FLEX examination, but is licensed in Pennsylvania by state board written. examination and is a Fellow of the Faculty of Anesthetists of the Royal College of Surgeons of England, which has been determined to be comparable to the American Board of Anesthesiology certification. ACTION: Dr. Partrick moved that the Board forward an application for license by endorsement of credentials to Dr. Malek and that the Board will consider same on an individual basis. Seconded by' Dr. Galusha and duly passed. HE: Mobile Intensive Care Technicians Mr. James Page with the North Carolina Department of Human Resources and three assistants met with the Board to discuss the Board's opinions and thoughts in regard to the new legislation passed by the 1974 General Assembly regarding various medical acts performed by certain emergency personnel, such as Mobile Intensive Care Technicians. Mr. Page is seeking the Board's approval for the proposed rules and regulations covering the Mobile Intensive Care Technician, and possible authorization by the Board for his department, Office of Emergency Medical Services, to enforce these rules and regulations and a positive statement from the Board of Medical Examiners regarding the authority of this agency. Following the discussion, the Board advised Mr. Page that they would like to review the criteria and program for the Mobile Intensive Care Technicians and asked him to supply this for them as soon as possible so it could be discussed again at the June Board meeting, which Mr. Page advised that he would do. RE: Biennial Re istration Reinstatement The following physicians' licenses were suspended for failure to register as required by North Carolina General Statute 90-15' They have now registered: David Geoffrey Allen William Beall Lorentz, Jr. John Zebulon Little Dr. Edmondson moved that if all fees and penalties have been paid, the above physicians be duly registered. Seconded by Dr. Wilkerson and duly passed. RE: Conversion Limited to full license Dr. Taylor moved that all applicants for conversion of limited to full license be approved for same if all credentials are in order. Seconded by Dr. Wilkerson and duly passed. They are: James Page Aplington and James Richard Boatright. REs Dr. Albert E. Barnhardt Kannapolis, N. C. Board reviewed file. The Board of Medical Examiners of the State of North Carolina met atThe Pinehurst Hotel, Pinehurst, North Carolina, May 19-22, 1974 for thepurpose of interviewing applications for license by endorsement of credentialsand other business.

Sunday, May 19

The Board convened for business. Drs. Joseph W. Hooper, Jr. , President,Charles B. Wilkerson, Jr. , Secretary-Treasurer, Frank Edmondson, Bryant L.Galusha, Cornelius T. Partrick, E. Wilson Staub and Vernon W. Taylor, Jr.were present. Also present were Mr. Bryant D. Paris, Jr. , Executive Secretary,Mrs. B. Joe Cooke and Mrs. Diane Freeman.

RE: Dr Nabil S Malek —consideration for licensure

Dr. Trevor Hughes and Dr. Joseph Patterson appeared to request the Board toconsider letting Dr. Malek apply for license by endorsement of credentials inNorth Carolina although he has not taken the FLEX examination, but is licensedin Pennsylvania by state board written. examination and is a Fellow of the Facultyof Anesthetists of the Royal College of Surgeons of England, which has beendetermined to be comparable to the American Board of Anesthesiology certification.

ACTION: Dr. Partrick moved that the Board forward an application forlicense by endorsement of credentials to Dr. Malek and that the Board will considersame on an individual basis. Seconded by' Dr. Galusha and duly passed.

HE: Mobile Intensive Care Technicians —Mr. James Page with the NorthCarolina Department of Human Resources and three assistants met with the Boardto discuss the Board's opinions and thoughts in regard to the new legislationpassed by the 1974 General Assembly regarding various medical acts performed bycertain emergency personnel, such as Mobile Intensive Care Technicians. Mr. Pageis seeking the Board's approval for the proposed rules and regulations coveringthe Mobile Intensive Care Technician, and possible authorization by the Boardfor his department, Office of Emergency Medical Services, to enforce theserules and regulations and a positive statement from the Board of Medical Examinersregarding the authority of this agency.

Monday, May 20

The Board convened to review credentials of applicants for license byendorsement of credentials and other business.

RE: Dr William B. Cota, Elizabethtown, N. C. —assistant to Dr. Rex C.LaGrange, Elizabethtown, N. G. Board reviewed file.

ACTION: Dr. Wilkerson moved that the Executive Secretary and the attorneyfor the Board check on Dr. Cota's working in North Carolina and follow throughwith the appropriate procedures. Seconded by Dr, Edmondson and duly passed.

RE: Office rocedures — com terization —The Executive Secretary presentedto the Board the study completed regarding computerization of records for theBoard's office. At the Board~s request, the Executive Secretary recommendedthat the Board purchase the Burroughs computer equipment on the installmentpurchase agreement plan; and that following this purchase and a period of use, ifthe equipment is not satisfactory or not meeting the requirements of the Board,the plan be converted to the lease agreement plan, and drop the lease, if necessary.

ACTION: Dr. Edmondson moved that the Executive Secretary's recommendationbe approved. Seconded by Dr. Wilkersonand duly passed, unanimously.

Monday, May 20

The Board considered and interviewed applicants for license by endorsement.

RE: Dr James Wellin ton Asa h appeared applying for license by endorsementof credentials with incomplete file. He is a graduate of the University of Oregonin 1962 and is licensed in New York by endorsement with National Boards.

Dr. Galusha: Dr. Asaph holds a resident's training license to the Universityin Chapel Hill and his application lacks the Oregon Board inquiry and NewYork narcotic inquiry.

A: Well, I only hold a Basic Science Certificate in Oregon —don't have a fulllicense there yet.

Dr. Galusha: Dr. Baker is now in the military at Fayetteville, and his credentialshave now been completed with the missing letter of recommendation he has brought.

Yes, sir. I have discussed this whole thing with Dr. Galusha and possiblyhe has talked with you about it. The trouble was regarding a loan I hadand the Kentucky Board got into it.

Dr. Hooper: What is the status of that now2

At this time, that licensure board considered a request from the scholarshiploan fund for discontinuance of the license, and elected to do nothingabout their request —the way it stands now, I don't know. There is no

appeal before them at this time, as far as I know.

RE: Re istered nurses erformin medical acts —Nurse Practitioners —Dr.Partrick presented report on the recent information received from the North CarolinaBoard of Nursing regarding the registered nurses performing medical acts andregulation of same. Dr. Partrick, as Chairman of the Board' s sub-committee onthis matter, moved that the Board implement the rules and regulations regardingthe registered nurse performing medical acts as adopted at the March, 1974 Boardmeeting for accepting applications for registration of these nurses, in theout-of-hospital situation only. Seconded by Dr. Milkerson and duly passed.

Also, Dr. Edmondson moved that Dr. Taylor be instructed to document theinformation received regarding the wife of a physician who is acting as hisassistant in a mobile unit, without the physician present. Seconded by Dr.Wilkerson and duly passed.

The Executive Secretary was instructed to ascertain who is in charge ofworking with the nurse practitioner program and clinics in the State Departmentof Human Resources and plan to invite one or more persons to the June Boardmeeting to discuss the implementation of the rules and regulations with theBoard.

RE: N. G. Medical Societ Executive Council —Following meeting withthe Executive Council of the North Carolina Medical Society, Dr. Staub advisedthe Board that the House of Delegates of the Society had been requested by theExecutive Council to endorse an amendment to the Medical Practice Act recommendedby the Ad Hoc Liaison Committee of the Board of Medical Examiners and the MedicalSociety. The amendment would allow the Board of Medical Examiners, in itsdiscretion, to revoke or restrict a license to practice medicine for lack ofprofessional competence and would be incorporated in Section 90-14 of the Act.It was also the Council's recommendation that the Ad Hoc Committee of the Boardand the Society be continued for the purposes of making further recommendationsto implement the recommendation above.

RE: Meetin with deans from North Carolina medical schools—

As decided at the March, 1974 Board meeting, the deans from the three North Carolinamedical schools were invited to meet with the Board and discuss any problems theyfelt were pertinent to the Board and the schools. Attending the meeting were Dr.William Cromartie from the University of North Carolina School of Medicine; Dr.Richard Janeway from Bowman Gray School of Medicine of Make Forest University; andDr. John Gallemore from Duke University School of Medicine. Those topics coveredin the discussion were the problems faced by the Board in examining and licensingrecent medical school graduates with early graduation dates and also the problemof visiting professor who have received a Certificate of Registration for a one-yearsabbatical and then requesting the Board to allow them to take the North Carolinaexamination for full licensure. The deans expressed their concern over thesesituations and indicated they would be working on these problems from their officeand would work with the Board any way they could. Dr. Hooper expressed the Board'sappreciation for their meeting and discussion with the Board.
